Hello 2013! We begin with AP's Ryan Nakashima who explains Why Al Jazeera bought Al Gore's Current TV via Christian Science Monitor csmonitor.com With its purchase of left-leaning Current TV, the Pan-Arab news channel Al-Jazeera has fulfilled a long-held quest to reach 60 million US homes. But Current's audience immediately got a little smaller. The nation's second-largest TV operator, Time Warner Cable Inc., dropped Current after the deal was confirmed Wednesday, a sign that the channel will have an uphill climb to expand its reach. Now, Current TV reaches about 40 million US homes. "Our agreement with Current has been terminated and we will no longer be carrying the service. We are removing the service as quickly as possible," the company said in a statement. .... Gore confirmed the sale Wednesday, saying in a statement that Al-Jazeera shares Current TV's mission "to give voice to those who are not typically heard; to speak truth to power; to provide independent and diverse points of view; and to tell the stories that no one else is telling." ..... Previous to Al-Jazeera's purchase, Current TV was in 60 million homes. It is carried by Comcast Corp., which owned less than a 10 percent stake in Current TV, as well as DirecTV. Some media observers interpreted the move as motivated by politics. "Time-Warner cable shows abject political and journalistic cowardice by dropping Current because of Al Jazeera deal," tweeted Dan Gilmor, a technology writer and founding director of the Knight Center for Digital Media Entrepreneurship at Arizona State University. The Time Warner Cable spokesman would not comment on politics when reached by The Huffington Post, but said via email that "we do have an agreement with [Al Jazeera English], though we have no plans to launch it at this time." Al Jazeera America will be separate from Al Jazeera English, although roughly 40 percent of the new network's programming is expected to come from the English-language channel, which is based in Doha, Qatar. New York Times reporter Brian Stelter reported that Time Warner Cable had warned it might drop Current due to low ratings. On Twitter, Stelter noted that Al Jazeera will acquire Current's carriage deals with other cable providers, including DirecTV, Comcast, Dish, Verizon and AT&T. .....

Now Krugman has Perspective on the Deal .... There are two ways progressives can lose this fight. One is direct defeat on the question of social insurance, with Congress actually voting to privatize and eventually phase out key programs — or with Democratic politicians themselves giving away their political birthright in the name of a mess of pottage Grand Bargain. The other is for conservatives to successfully starve the beast — to drive revenue so low through tax cuts that the social insurance programs can’t be sustained. The good news for progressives is that danger #1 has been averted, at least so far — and not without a lot of anxiety first. Romney lost, so nothing like the Ryan plan is on the table until President Santorum takes office, or something. Meanwhile, in 2011 Obama was willing to raise the Medicare age, in 2012 to cut Social Security benefits; but luckily the extremists of the right scuttled both deals. There are no cuts in benefits in this deal. The bad news is that the deal falls short on making up for the revenue lost due to the Bush tax cuts. Here, though, it’s important to put the numbers in perspective. Obama wasn’t going to let all the Bush tax cuts go away in any case; only the high-end cuts were on the table. Getting all of those ended would have yielded something like $800 billion; he actually got around $600 billion. ..... So why the bad taste in progressives’ mouths? It has less to do with where Obama ended up than with how he got there. He kept drawing lines in the sand, then erasing them and retreating to a new position..... Thanks Dr. Krugman for that! Over at NakedCapitalsim.com Matt Stoller has another take Eight Corporate Subsidies in the Fiscal Cliff Bill, From Goldman Sachs to Disney to NASCAR Throughout the months of November and December, a steady stream of corporate CEOs flowed in and out of the White House to discuss the impending fiscal cliff. Many of them, such as Lloyd Blankfein of Goldman Sachs, would then publicly come out and talk about how modest increases of tax rates on the wealthy were reasonable in order to deal with the deficit problem. What wasn’t mentioned is what these leaders wanted, which is what’s known as “tax extenders”, or roughly $205B of tax breaks for corporations. With such a banal name, and boring and difficult to read line items in the bill, few political operatives have bothered to pay attention to this part of the bill. But it is critical to understanding what is going on. ...... Most tax credits drop straight to the bottom line – it’s why companies like Enron considered its tax compliance section a “profit center”. A few hundred billion dollars of tax expenditures is a major carrot to offer. Surely, a modest hike in income taxes for people who make more than $400k in income and stupid enough not to take that money in capital gain would be worth trading off for the few hundred billion dollars in corporate pork. This is what the fiscal cliff is about – who gets the money. And by leaving out the corporate sector, nearly anyone who talks about this debate is leaving out a key negotiating partner. So without further ado, here are eight corporate subsidies in the fiscal cliff bill that you haven’t heard of...... Have a look! Good item! Tyler Durden chimes in with Today's Examination Of Yesterday Yesterday we had a nice rally in the equity markets. No surprise; the sigh of relief was palpable that Congress did something, anything to address our fall over the cliff. I would not get too excited however. We raised taxes, we penalized those succeeding and we did it in a meaningful manner. We did not cut the national debt as sung by the chorus across the airwaves. In fact, according to the Congressional Budget Office we decreased revenues by $3.6 trillion over ten years. We did not protect the middle class, but because of the expiration of the payroll tax decrease, Federal taxes will rise for 77% of all working Americans. Thus we rewarded non-working Americans at the expense of those with jobs. For those that are truly succeeding, making over one million dollars, we increased their taxes by $171,300.00 on average which becomes a disincentive to progress or a very good reason to explore tax avoidance and gimmickry. We still face “sequestration” in March and the “debt ceiling” in February and nothing was done to curtail our social and entitlement programs that cannot be afforded without even more debt and mountains of it regardless of all of the new taxes. The game was the continuation of postponement and avoidance and reckless governance of the nation. The spin is that the increase in taxes on capital gains and dividends will rise from 15% to 20% (a 25% increase) but this is not accurate. Under the Affordable Care Act, which is in effect today, there is another 3.8% tax which raises taxes on capital gains and dividends to 23.8% which is a 37% total raise. So much for the value of appreciation and the value of dividends if you start out yards behind the eightball. Then you can feel very proud of our President and our Congress because they feathered the nests of so many peacocks in the process. GE’s tax bill was lowered along with several other companies with the $111.2 billion extension for off-shore financing. How about $78 million for Nascar, $248 million for films and TV programs in additional depreciation and $222 million in a special exemption for imported rum. ...... Michelle Richardson, Legislative Counsel, ACLU Washington Legislative Office offers this FISA UPDATE: Warrantless Wiretapping Wins Again It’s official. The Senate voted 72-23 last week to extend the FISA Amendments Act another five years, which President Obama signed Sunday. Unfortunately, the public discussion of George W. Bush’s warrantless wiretapping program may soon fade back into the shadows. The heartbreak of another Senate vote in favor of dragnet collection of Americans’ communications, however, pales in comparison to the rejection of modest amendments in favor of more FISA transparency and accountability. These amendments would not have limited the government’s spying program in any way; they would have only compelled the government to tell the public what the law says and whether it protects us from government prying. Sen. Ron Wyden (D-OR), a long-time member of the Intelligence Committee, valiantly fought for a year-and-a-half for basic information about how this surveillance program affects Americans and put a hold on the bill until a debate and amendment process was scheduled. He finally got a vote to force disclosure of whether the National Security Agency is vacuuming up wholly domestic communications or searching through FISA taps for Americans, yet it failed by a vote of 42-52. Sen. Jeff Merkley (D-OR) also went to the mattress over the secret FISA court opinions that determine whether we have constitutional rights to privacy in foreign intelligence investigations. He put the Senate to a vote on whether the administration should be forced to release the court opinions, supply unclassified summaries of them, or explain why they should be kept secret. That one went down 37-54. Simply put, if the public were to find out what the government is doing with our information, or how many of us are affected, the program would be “destroyed,” according to Senate Intelligence Committee Chair Dianne Feinstein (D-CA). If this news has you ready to throw yourself off of the FISA cliff, take in a few rays of hope from the Senate floor..... Of course Glenn Greenwald explains how GOP and Feinstein join to fulfill Obama's demand for renewed warrantless eavesdropping and you can tell he is genuinely pissed off. To this day, many people identify mid-2008 as the time they realized what type of politician Barack Obama actually is. Six months before, when seeking the Democratic nomination, then-Sen. Obama unambiguously vowed that he would filibuster "any bill" that retroactively immunized the telecom industry for having participated in the illegal Bush NSA warrantless eavesdropping program. But in July 2008, once he had secured the nomination, a bill came before the Senate that did exactly that - the FISA Amendments Act of 2008 - and Obama not only failed to filibuster as promised, but far worse, he voted against the filibuster brought by other Senators, and then voted in favor of enacting the bill itself. That blatant, unblinking violation of his own clear promise - actively supporting a bill he had sworn months earlier he would block from a vote - caused a serious rift even in the middle of an election year between Obama and his own supporters. .......... The Democratic Chair of the Senate Intelligence Committee, Dianne Feinstein, took the lead in attacking Wyden, Merkley, Udall and Paul with the most foul Cheneyite accusations, and demanded renewal of the FISA law without any reforms. And then predictably, in virtually identical 37-54 votes, Feinstein and her conservative-Democratic comrades joined with virtually the entire GOP caucus (except for three Senators: Paul, Mike Lee and Dean Heller) to reject each one of the proposed amendments and thus give Obama exactly what he demanded: reform-free renewal of the law (while a few Democratic Senators have displayed genuine, sustained commitment to these issues, most Democrats who voted against FISA renewal yesterday did so symbolically and half-heartedly, knowing and not caring that they would lose as evidenced by the lack of an attempted filibuster).
In other words, Obama successfully relied on Senate Republicans (the ones his supporters depict as the Root of All Evil) along with a dozen of the most militaristic Democrats to ensure that he can continue to eavesdrop on Americans without any warrants, transparency or real oversight. That's the standard coalition that has spent the last four years extending Bush/Cheney theories, eroding core liberties and entrenching endless militarism: Obama + the GOP caucus + Feinstein-type Democrats. As Michelle Richardson, the ACLU's legislative counsel, put it to the Huffington Post: "I bet [Bush] is laughing his ass off." But what's most remarkable here is not so much what happened but how it happened. ......... Just four or five years ago, objections to warrantless eavesdropping were a prime grievance of Democrats against Bush. The controversies that arose from it were protracted, intense, and often ugly. Progressives loved to depict themselves as stalwartly opposing right-wing radicalism in defense of Our Values and the Constitution. Fast forward to 2012 and all of that, literally, has changed. Now it's a Democratic President demanding reform-free renewal of his warrantless eavesdropping powers. He joins with the Republican Party to codify them. A beloved Democratic Senator from a solidly blue state leads the fear-mongering campaign and Terrorist-enabling slurs against anyone who opposes it. And it now all happens with virtually no media attention or controversy because the two parties collaborate so harmoniously to make it happen. And thus does a core guarantee of the founding - the search warrant requirement of the Fourth Amendment - blissfully disappear into nothingness. Here we find yet again a defining attribute of the Obama legacy: the transformation of what was until recently a symbol of right-wing radicalism - warrantless eavesdropping - into meekly accepted bipartisan consensus. But it's not just the policies that are so transformed but the mentality and rhetoric that accompanies them: anyone who stands in the way of the US Government's demands for unaccountable, secret power is helping the Terrorists. "The administration has decided the program should be classified", decreed Feinstein, and that is that. ..... We skipped huge chucks of this so please go read all of it at The Guardian. And be as equally pissed off as Greenwald. More Greenwald: The 'war on terror' - by design - can never end. Also while at the Guardian check out Neil Clark Europe's support for the US has made the world a more dangerous place. And Congress also found some time to fund the ubiquitous 'war on terror' as well. Erik Kain at Forbes asks President Obama Signed the National Defense Authorization Act - Now What? .....The National Defense Authorization Act greatly expands the power and scope of the federal government to fight the War on Terror, including codifying into law the indefinite detention of terrorism suspects without trial. Under the new law the US military has the power to carry out domestic anti-terrorism operations on US soil. “The fact that I support this bill as a whole does not mean I agree with everything in it,” the president said in a statement. “I have signed this bill despite having serious reservations with certain provisions that regulate the detention, interrogation and prosecution of suspected terrorists.” Worse, the NDAA authorizes the military to detain even US citizens under the broad new anti-terrorism provisions provided in the bill, once again without trial. There is some controversy on this point, in part because the law as written is entirely too vague. But whether or not the law will be used to indefinitely detain US citizens domestically, it is written to allow the detention of US citizens abroad as well as foreigners without trial.
“Obama’s signing statement seems to suggest he already believe he has the authority to indefinitely detain Americans—he just never intends to use it,” Adam Serwer writes at Mother Jones. “Left unsaid, perhaps deliberately, is the distinction that has dominated the debate over the defense bill: the difference between detaining an American captured domestically or abroad. This is why ACLU Director Anthony Romero released a statement shortly after Obama’s arguing the authority in the defense bill could “be used by this and future presidents to militarily detain people captured far from any battlefield.” Glenn Greenwald makes a compelling case that the law gives the government truly frightening powers. He notes that section 1022 exempts US citizens from the requirement of military detention but still leaves the option open to the state. “The only provision from which U.S. citizens are exempted here is the “requirement” of military detention,” Greenwald writes. “For foreign nationals accused of being members of Al Qaeda, military detention is mandatory; for U.S. citizens, it is optional. This section does not exempt U.S citizens from the presidential power of military detention: only from the requirement of military detention.” ........ In part the National Defense Authorization Act helps to preserve the status quo established a decade ago with the original provisions in the PATRIOT Act giving the government broad new powers in the so-called War on Terror. In part the bill expands those powers, codifying the use of indefinite detention of foreign nationals and possibly US citizens arrested abroad and at home. In part the bill expands the use of the US military on domestic soil, at once complicating anti-terrorism strategies at home and raising serious questions about the role of the military in law enforcement. All these things should make Americans – and not just Americans – very nervous about the preservation of their civil liberties. That precarious balance between security and liberty is looking ever more tilted toward the former and away from the latter. ........ I’ve written in the past that people concerned with civil liberties should begin to walk away from the old left-right dichotomy entirely and focus on electing civil libertarians to congress whether these are members of the left like Russ Feingold or of the right like Rand Paul. Of course, both Paul and Feingold will fall short of the ideal civil libertarian when it comes down to it, but both are a far cry better than 90% of their colleagues. We have few options available to us at this point. The NDAA may be challenged in the courts, and this will almost certainly happen if the president (or a future president) actually makes use of the powers related to US citizens. Even then, however, the courts could come down on either side. The Supreme Court is not exactly filled to the brim with civil libertarians. Until that time, however, we can try to abandon politics-as-usual and focus on electing politicians who care more about curtailing government excess than expanding government power endlessly in our never-ending War on Terror..... For more Michael McAuliff adds in at HuffPoAOL Obama Signs Defense Bill Despite 'Serious Reservations' and this interesting item from a few weeks ago NDAA Indefinite Detention Provision Mysteriously Stripped From Bill Congress stripped a provision Tuesday from a defense bill that aimed to shield Americans from the possibility of being imprisoned indefinitely without trial by the military. The provision was replaced with a passage that appears to give citizens little protection from indefinite detention. The amendment to the National Defense Authorization Act of 2013 was added by Sen. Dianne Feinstein (D-Calif.), but there was no similar language in the version of the bill that passed the House, and it was dumped from the final bill released Tuesday after a conference committee from both chambers worked out a unified measure. ....... The new provision appears to do little, because the Supreme Court has already declared that the writ of habeas corpus -- requiring that someone be presented to a judge -- applies to all people. The more difficult part of whether people deserve a trial remains unsettled, and the new provision does not appear to resolve it...... Nevertheless, many activists who oppose indefinite detention were not all that enamored with her amendment because some felt it asserted that Congress had the right to make laws requiring detention of citizens. Others believed it failed the test of constitutionality because the Constitution specifies its protections extend to all people, not just citizens. It also did not address terror suspects captured overseas....... Over at Salon Natasha Lennard offers her take in Obama signs NDAA again, disappoints on Gitmo and civil liberties again This time last year, President Obama said that he had “serious reservations” about certain provisions of the 2012 National Defense Authorization Act. But he signed it anyway. This year, the same provisions over which he was so reserved remain in the 2013 version of the bill, along with a number of brand-new problematic amendments. The president threatened a veto on the new bill’s prohibitions on closing Guantánamo Bay detention center. But he didn’t veto; he signed the bill again on Thursday..... Way more (again!) so go read! At this point we're pretty disgusted with Obomber supporters and the go-along-to-get-along spineless Dems who so vociferously opposed these ideas when it was the bu$h crime family (except Diane Feinstein who has been all good with all of it from the get-go). NO matter how awful these bills are the Obomber hand-maidens in the blogosphere (and in real life) find SOME justification for them. We go to Trinity College professor Thomas Harrington at Common Dreams for an explanation of How Liberals Shirk Responsibility for Atrocious Policies ..... Obama has, among many other things, greatly expanded the horrific terror that is drone warfare, increased state secrecy and citizen surveillance, dramatically increased deportations of illegal immigrants, expanded defense budgets, undermined all serious efforts to curb climate change, largely preserved the ill-gotten gains of financial elites, put entitlement programs on the table for chopping and has turned rendition, unlimited detention and extra-judicial killing of US citizens into permanent and legally unassailable elements of American life. However, when I confront people whom I know voted for Obama and his party with this desultory and undeniably accurate bill of particulars, they act as if it had little or nothing to do with them and their vote. Indeed, in my experience, they not only do not take responsibility for enabling these behaviors, but will often go to the next step of portraying those of us that point out these obvious realities as liars and fabulists. What is going on here? The key to understanding this lies, it seems, in the role high self-regard plays in the life of many liberals. There are, of course many, many humble and sincere advocates for justice and human dignity among those that regularly vote for the Democratic Party. But along side of them, there are many, many others for whom voting for the dark-skinned and silken-tongued Obama is primarily a way of achieving or cementing what the great French sociologist Pierre Bourdieu called “social distinction”. In other words, in identifying with Obama and a Democratic party elite that is generally much more cosmopolitan and socially refined than their Republican counterparts, these voters seek to acquire--and here again I recur to Bourdieu—“cultural capital” that they are sure will identify them as sophisticated “players” within our rapidly crumbling, winner-take-all social structure. For such people, the actually policies implemented by Obama and the Democrats are a decidedly secondary concern. And that is if they are a concern at all. ...... Viewed from a slightly different angle, this phenomenon goes a long way to explaining the Republican’s extraordinary success in turning middle and lower class voters against the Democrats. All they need to do is hold up a mirror to the rank insincerity and moral indifference of this large and growing sector of the party--think Susan Rice, Samantha Powers, Cass Sunstein and Julius Genachowski-- and show just how much of what they do is driven not by a desire to bring peace and dignity to the lives of ordinary people, but rather to burnish their own images as intellectually and morally superior beings. Yes, for a lot of liberals, the ethos of junior high still looms large. Confident of their exalted status with the in-crowd, they feel little or no need to explain, or even rationalize, the actions they support with their votes. No, explaining is strictly reserved for nerds and their grown-up counterparts who, from their vantage point, are stupid enough to inhabit the right side of the political spectrum. That's certainly ONE explanation. Of course our Brick TeeVee readers see through this whole charade and know the left-right paradigm is designed to pit one group against another ad nauseum as part of the "Two sides - Same coin" self-serving ruling class's GRIP on our society. This is why the whole surveillance state FBI vs Occupy is so alarming: Occupy is trying to pull back the curtain on the Ruling Class but our so-called "lawmakers" are determined to keep the status-quo intact for their nefarious purposes. Bill C-45 includes significant changes to land management on reserves under the Indian Act. "Idle No More" organizers say the changes would make it easier for the federal government to control reserve land. .... "Bill C 45 is not just about a budget, it is a direct attack on First Nations lands and on the bodies of water we all share from across this country," added Sylvia McAdam, another organizer. C-45 is a corporate give-away to the extraction industries (including the XL pipeline 350.org and other in the U.S. have been opposing). See David Suzuki Foundation Environmental groups, First Nations join in opposition to omnibus Bill C-45 "Simply put, lakes, rivers and streams often stand in the path of large industrial development, particularly pipelines. This bill, combined with last spring's changes, hands oil, gas and other natural-resource extraction industries a free pass to degrade Canada's rich natural legacy," said Devon Page, executive director of Ecojustice. The latest omnibus legislation would further undermine the protection of Canada's environment by making changes to the Fisheries Act and the Hazardous Materials Information Review Act—critical laws that are used to steward a sustainable environment, clean water and healthy oceans for all Canadians. - Lawmakers concerned about the health effects on humans from mountaintop removal coal mining set forth legislation in the U.S. House of Representatives today. Representatives Dennis Kucinich (OH), Louise Slaughter (NY), Maurice Hinchey (NY), Earl Blumenauer (OR), Lucille Roybal-Allard (CA), John Yarmuth (KY), Lynn Woolsey (CA), Judy Chu (CA), Raúl Grijalva (AZ), James Moran (VA), Michael Honda (CA), John Conyers (MI), and Keith Ellison (MN) introduced the Appalachian Communities Health Emergency (ACHE) Act H.R. 5959 which would place a moratorium on permitting for mountaintop removal coal mining until health studies are conducted by the Department of Health and Human Services.
