So yes, the Wall Street Journal, when pondering which “expert” might have something interesting to add to the debate over the Affordable Care Act (aka Obamacare), they reached out to the creator of the Thighmaster, who’s apparently a bit of a right-wing nut. And boy, did they pay for it. Somers wrote a lovely seven paragraph screed about the evils of communism, or Canada, or something. And then, to make things even more fun, she got a lot of it wrong. So wrong, in fact, that the Journal had to issue a long “correction” beneath her story. Let’s just quote that correction in full, shall we? Thing is, you probably know someone who thinks just like Chrissy from Three's Company (misinformed, uninformed and basically clueless). And they may even own a Thigh-Master haha!

In societies shaped by advertising, sane people come to regard statements by the rich, with their carefully constructed images, with extreme skepticism. Promotions for products and political personalities turn out too often to be lies designed to steal money from unwitting consumer citizens, falsehoods that additionally rob their victims of precious time and a measure of their inborn ability to trust. What to think then of the most recent performances by British comedian Russell Brand? Earlier this month it was announced that Brand, who has been increasingly vocal in his dislike of all manner of elites, would guest-edit an issue of the London-based left-liberal magazine New Statesman. The theme? Revolution. An early-October interview with conspiracy theorist Alex Jones offered an unofficial preview of what was in store to viewers unacquainted with Brand’s political thinking. A newcomer myself, I concluded at the time that the basics of Brand’s sense of what’s wrong were spot on, but that his insistence on mystical sources of salvation exposed him as another celebrity detached from reality. Now, after watching him deflect the provocations of BBC stuffed shirt Jeremy Paxman, and reading his essay in the latest issue of New Statesman—which deserves to be read for its dead-on insight and playful, engaging voice (“The price of privilege is poverty. David Cameron said in his conference speech that profit is ‘not a dirty word.’ Profit is the most profane word we have.”)—I’m less sure....... Read on! GREENWASHING UPDATE: At Mother Jones Andy Kroll and Jeremy Schulman discover Leaked Documents Reveal the Secret Finances of a Pro-Industry Science Group The American Council on Science and Health bills itself as an independent research and advocacy organization devoted to debunking "junk science." It's a controversial outfit—a "group of scientists…concerned that many important public policies related to health and the environment did not have a sound scientific basis," it says—that often does battle with environmentalists and consumer safety advocates, wading into public health debates to defend fracking, to fight New York City's attempt to ban big sugary sodas, and to dismiss concerns about the potential harms of the chemical bisphenol-A (better known at BPA) and the pesticide atrazine. The group insists that its conclusions are driven purely by science. It acknowledges that it receives some financial support from corporations and industry groups, but ACSH, which reportedly stopped disclosing its corporate donors two decades ago, maintains that these contributions don't influence its work and agenda. Yet internal financial documents (read them here) provided to Mother Jones show that ACSH depends heavily on funding from corporations that have a financial stake in the scientific debates it aims to shape. The group also directly solicits donations from these industry sources around specific issues. ACSH's financial links to corporations involved in hot-button health and safety controversies have been highlighted in the past, but these documents offer a more extensive accounting of ACSH's reliance on industry money—giving a rare window into the operations of a prominent and frequent defender of industry in the science wars. ........... Dr. Gilbert Ross, the group's executive director, declined to answer specific questions about ACSH's fundraising. He did not dispute the authenticity of the documents provided to Mother Jones. (Multiple corporations listed as donors on these documents confirmed they had supported ACSH.) Ross says the group doesn't disclose its backers because "the sources of our support are irrelevant to our scientific investigations." According to Ross, "Only science-based facts hold sway in our publications, even if the outcome is not pleasing to our contributors." As Mother Jones reported in 2005, Ross was previously convicted for defrauding New York State's Medicaid program of roughly $8 million. His medical license was temporarily revoked and a jury sentenced him to 46 months in prison, of which he served 23 months. Ross currently has his license and is allowed to practice. ......... ACSH maintains that it doesn't accept donations from corporations or trade associations earmarked for specific research projects—that is, that there's no quid pro quo. But in a March 1992 internal memo obtained by Consumer Reports, Whelan wrote that ACSH staffers would ask the Calorie Control Council, a trade group backed by diet food and drink companies, and McNeil Specialty Products, a Johnson & Johnson subsidiary that owned the US marketing rights to Splenda (an artificial sweetener), for contributions to underwrite the dissemination of a research paper touting artificial sweeteners. (Splenda was then seeking approval for sale in the United States.) The newly revealed documents say that ACSH staffers should approach potential corporate financial backers with pitches geared toward specific issues. ........ WOW! Much more at the link! WaPo's William Wan now explains the Outrage at alleged U.S. spying efforts gathers steam in Asian capitals BEIJING — Allegations in an Australian newspaper that the United States and its allies use embassies in Asian capitals as hubs for electronic data collection triggered a new wave of outrage at Washington on Thursday. China’s government is “severely concerned about the reports and demands a clarification and explanation,” Foreign Ministry spokeswoman Hua Chunying said. Government officials in Indonesia, Malaysia and Thailand — all U.S. allies — made similarly angry statements. “Indonesia strongly protests the existence of a tapping facility in the U.S. Embassy in Jakarta,” Indonesian Foreign Minister Marty Natalegawa said. “If it’s confirmed, such action is not only a breach of security, but also a serious violation of diplomatic norms and ethics, and certainly not in tune with the spirit of friendly relations between nations.” The Asian leaders were reacting to a report this week in the German magazine Der Spiegel and a Sydney Morning Herald article Thursday that named cities in which embassies are used for electronic surveillance by the United States, Britain, Australia, Canada and New Zealand — a group of intelligence partners known as the “5-eyes.” The reports were based on a secret National Security Agency document that was leaked by former contractor Edward Snowden and first published by Der Spiegel. The Sydney newspaper, part of the Fairfax Media group, also included information provided by an unidentified former Australian intelligence officer. Code-named STATEROOM, the program used disguised surveillance equipment in about 80 embassies and consulates worldwide, the Herald reported, adding that the equipment is concealed in roof maintenance sheds or as features of the building itself. Nineteen of the diplomatic facilities are in Europe. The Asian embassies involved include those in Jakarta; Bangkok; Hanoi; Beijing; Dili, East Timor; Kuala Lumpur, Malaysia; and Port Moresby, Papua New Guinea. Australian Prime Minister Tony Abbott declined to discuss the Herald report in detail, but he told reporters, “Every Australian governmental agency, every Australian official at home and abroad operates in accordance with the law, and that’s the assurance that I can give people at home and abroad.” ....... "The military reveals it was conducting an explosives training exercise on the day a massive bushfire started in New South Wales." Eh Tony?
AT WIRED.COM's Threat Level David Kravets tells us there is Legislation Unveiled to Bar NSA’s Bulk Phone Metadata Collection Lawmakers proposed legislation today [Tuesday] that would effectively end the NSA’s bulk phone metadata collection program. The legislation has support from Republicans and Democrats in both the House and Senate, and from groups like the American Civil Liberties Union and National Rifle Association. But the USA FREEDOM Act’s passage into law remains uncertain. “It is time for serious and meaningful reforms so we can restore confidence in our intelligence community,” said Sen. Patrick Leahy, a Democrat from Vermont and one of the bill’s chief sponsors. Today’s proposal is a radical revamp of the Patriot Act, legislation passed in the immediate aftermath of the September 11, 2001 terror attacks. In 2006, lawmakers amended the act to allow the bulk collection program under the disguise of Section 215 of the Patriot Act — which allows the secret Foreign Intelligence Surveillance Court to authorize broad warrants for most any type of “tangible” records, including those held by banks, doctors and phone companies. Under the Patriot Act, the government only needs to show that the information is “relevant” to an authorized investigation. No connection to a terrorist or spy is required. That provision has been interpreted to allow for the bulk collection of all call records in and out of the United States. Rep. Jim Sensenbrenner (R-Wisconsin) the main sponsor of the Patriot Act, said that such an interpretation was an abuse of the law. Today’s proposal, he said, seeks to alter that interpretation. Sensenbrenner said he never thought every telephone call would become “relevant” to an investigation. “Somewhere along the way, the balance between security and privacy was lost,” said Sensenbrenner, another co-sponsor of the sweeping package. ....... The ACLU, which is suing the President Barack Obama administration amid claims the collection program is unconstitutional, said the proposal is “real spying reform.” Today’s measure, officially called the “Uniting and Strengthening America by Fulfilling Rights and Ending Eavesdropping, Dragnet-collection, and Online Monitoring Act” has 16 Democratic co-sponsors in the Senate and 70 bipartisan co-sponsors in the House. It has been met with stiff opposition from the White House, which has said the collection program has helped solve dozens of terror plots at home and abroad. A similar bill was proposed in July in the House, and was narrowly defeated 205-217. Two days later David Kravets reports Senate Committee Votes in Favor of NSA Phone-Records Snooping A key Senate committee approved today [Thursday - Halloween] a measure that would give congressional blessing to the NSA’s bulk collection of domestic telephone metadata, and bolster the legal underpinnings of the controversial snooping program. Sponsored by Sen. Dianne Feinstein (D-California), the head of the Senate Intelligence Committee, the proposal (.pdf) sets the stage for a major legislative battle with a competing measure unveiled Tuesday prohibiting the data collection that began in 2006 and was first disclosed by whistleblower Edward Snowden in June. “The NSA call-records program is legal and subject to extensive congressional and judicial oversight, and I believe it contributes to our national security,” Feinstein said in a statement, after the committee approved the measure in private. “But more can and should be done to increase transparency and build public support for privacy protections…” Among other things, the package specifically adds bulk phone-metadata collection to the business records provision of the Patriot Act. In 2006, lawmakers amended the act to authorize broad, secret warrants for most any type of “tangible” records, including those held by banks, doctors and phone companies.
Rep. Jim Sensenbrenner (R-Wisconsin), the main sponsor of the Patriot Act, said both the Bush and Obama administrations wrongly interpreted the Patriot Act to allow the bulk collection of all phone call records, slamming the NSA program as an abuse of the law. Feinstein’s bill certifies once and for all that the metadata program is authorized. .....

But the tech giants just threw their support behind a real reform bill. Specifically, Google, Apple, Microsoft, Yahoo, Facebook and AOL put their support behind the USA Freedom Act … the bill introduced by Senator Leahy and Congressman Sensenbrenner to start reining in the NSA for real. The tech giants aren’t supporting the bill out of the goodness of their hearts, but because cooperating with the NSA has cost them tens of billions of dollars. And see this. Kim Zetter at THREAT LEVEL discovers THIS REPORT: NSA Is Intercepting Traffic From Yahoo, Google Data Centers Not satisfied with the bulk data it collects through court orders from internet giants Google and Yahoo, the National Security Agency reportedly vacuumed up traffic from communication links between the companies’ data centers, according to documents leaked by Edward Snowden. Google expressed outrage over the government’s actions and called for reform. The taps of the data links allow the spy agency to collect data on millions of users, including Americans, without cooperation from the two companies and without oversight from the Foreign Intelligence Surveillance Court, according to the Washington Post, which broke the story. An NSA slide obtained by the Post even shows where the NSA has presumably exploited a weakness in Google’s encryption to siphon the data. The NSA project, codenamed MUSCULAR, is operated jointly with the UK spy agency GCHQ. Both agencies copy entire data flows that pass through fiber-optic cables linking one Google data center to another. It does the same with Yahoo, at times sucking down so much information that analysts complained about the quantity. The data, which amounts to millions of records daily, gets passed to NSA data collection centers at Ft. Meade. In just 30 days NSA field collectors had processed and sent back 181,280,466 records, according to one document. The information siphoned included not only metadata but also content. ....... Google told WIRED it was angered by the NSA’s conduct. “We have long been concerned about the possibility of this kind of snooping,” Google Chief Legal Officer David Drummond said in a statement, “which is why we have continued to extend encryption across more and more Google services and links, especially the links in the slide…. “We are outraged at the lengths to which the government seems to have gone to intercept data from our private fiber networks, and it underscores the need for urgent reform.” ............. “Our system of judicial and congressional oversight of the NSA is fundamentally broken, and dragnet programs like this one are the result,” ACLU Deputy Legal Director Jameel Jaffer said in a statement. “If we want the right to privacy to survive the NSA’s assault on it, we need both Congress and the courts once again to play the role the constitution envisioned for them.”....... And lets remember Candidate Senator Obomber flying in off the campaign trail to sign the Telecom Immunity Act in 2008 Obama Backs Bill Giving Immunity To Telecoms and House passes new surveillance law which states The bill, which was passed on a 293-129 vote, does more than just protect the telecoms. The update to the 30-year-old Foreign Intelligence Surveillance Act is an attempt to balance privacy rights with the government's responsibility to protect the country against attack, taking into account changes in telecommunications technologies. "This bill, though imperfect, protects both," said Rep. Jane Harman, D-Calif., and a former member of the House intelligence committee. President Bush praised the bill Friday. "It will help our intelligence professionals learn enemies' plans for new attacks," he said in a statement before television cameras a few hours before the vote.   • GREENWALD: My objection is not to that process itself but to specific instances where it leads to the suppression of information that ought to be public. Without intended rancor, I believe that the 2004 decision of The Times to withhold the Risen/Lichtblau N.S.A. story at the request of the Bush White House was one of the most egregious of such instances, but there are plenty of others.
  • KELLER: Like any endeavor run by human beings, ours is imperfect, and sometimes we disappoint. Critics on the left, including you, were indignant to learn that we held the N.S.A. eavesdropping story for more than a year, until I was satisfied that the public interest outweighed any potential damage to national security. Critics on the right were even more furious when, in 2005, we published. Honorable people may disagree with such decisions, to publish or not to publish. But those judgments were the result of long, hard and independent calculation, a weighing of risks and responsibilities, not “fealty to the U.S. government.”
We at BTV strongly believe had the NYT published as soon as they knew about the Bu$h Crime Family's illegal spying in 2004 that we just might have had President Kerry. And then perhaps there wouldn't have been an Ed Snowden if President Kerry, elected on this very spying issue, had nipped it in the bud back then, eh? Hmmmm. We'll call bullshit on Keller right now. Britain's Cameron says may act against newspapers over spy leaks LONDON | Mon Oct 28, 2013 12:33pm EDT Oct 28 (Reuters) - British Prime Minister David Cameron said on Monday his government was likely to act to stop newspapers publishing what he called damaging leaks from former U.S. intelligence operative Edward Snowden unless they began to behave more responsibly. "If they (newspapers) don't demonstrate some social responsibility it will be very difficult for government to stand back and not to act," Cameron told parliament, saying Britain's Guardian newspaper had "gone on" to print damaging material after initially agreeing to destroy other sensitive data............." AND we'll leave you with Glenn Greenwald On leaving the Guardian Reporting the NSA story hasn't been easy, but it's always been fulfilling. It's what journalism at its crux is about, and we must protect that. ............. We do not yet have an exact launch date for the new outlet, but rest assured: I'm not going to disappear for months or anything like that. The new site will be up and running reasonably soon. In the meantime, I'll continue reporting in partnership with foreign media outlets (stories on mass NSA surveillance in France began last week in Le Monde, and stories on bulk surveillance of Spanish citizens and NSA's cooperation with Spanish intelligence have appeared this week in Spain's El Mundo), as well as in partnership with US outlets. As I did yesterday when responding to NSA claims about these stories, I'll also periodically post on my personal blog – here – with an active comment section, as well as on our pre-launch temporary blog. I'm gratified by my 14-month partnership with the Guardianand am particularly proud of what we achieved together over the last five months. Reporting the NSA story has never been easy, but it's always been invigorating and fulfilling. It's exactly why one goes into journalism and, in my view, is what journalism at its crux is about. That doesn't mean that the journalists and editors who have worked on this story have instantly agreed on every last choice we faced, but it does mean that, on the whole, I leave with high regard for the courage and integrity of the people with whom I've worked and pride in the way we've reported this story. As I leave, I really urge everyone to take note of, and stand against, what I and others have written about for years, but which is becoming increasingly more threatening: namely, a sustained and unprecedented attack on press freedoms and the news gathering process in the US. That same menacing climate is now manifest in the UK as well, as evidenced by the truly stunning warnings issued this week by British Prime Minister David Cameron: ......... There are extremist though influential factions in both countries which want to criminalize not only whistleblowing but the act of journalism itself (pdf). I'm not leaving because of those threats – if anything, they make me want to stay and continue to publish here – but I do believe it's urgent that everyone who believes in basic press freedoms unite against this. Allowing journalism to be criminalized is in nobody's interest other than the states which are trying to achieve that. As Thomas Jefferson wrote in an 1804 letter to John Tyler:
    Our first object should therefore be, to leave open to him all the avenues to truth. The most effectual hitherto found, is the freedom of the press. It is, therefore, the first shut up by those who fear the investigation of their actions.
I hope everyone who believes in basic press freedoms will defend those journalistic outlets when they are under attack – all of them – regardless of how much one likes or does not like them. Finally: thanks, most of all, to my readers and commenters who participate in so many ways in the journalism I do. I've always said that my favorite aspect of online political writing is how interactive and collaborative it is with one's readers: that has always been, and always will be, crucial in so many ways to what I do.
