CHEM SPILL SPECIAL FIRST UP Craig Aaron at FreePress.net does the math Comcast + Time Warner Cable = Disaster Comcast just announced that it’s buying Time Warner Cable. If approved, this outrageous deal would create a television and Internet colossus like no other. Comcast is the country’s #1 cable and Internet company and Time Warner Cable is #2. Put them together and you get a single giant controlling a massive share of our nation’s TV and Internet-access markets. No one woke up this morning wishing their cable company was bigger or had more control over what they watch and how they get online. But that is the reality we’ll face unless the Justice Department and the Federal Communications Commission do their jobs and block this merger. Stopping this kind of deal is exactly why we have antitrust laws. After a year of sustained organizing, we convinced the DoJ and the FCC to stop AT&T from gobbling up T-Mobile. This merger would put more than a third of all cable-TV subscribers in Comcast’s hands and give it control over more than half of the “triple-play” services that combine TV, phone and Internet service. Don’t forget, Comcast already owns NBC, MSNBC, Universal Studios and tons of cable channels. That means that for most of America, Comcast could control even more of what you see and how you see it. Putting this much power in the hands of one company is dangerous. This deal would lead to less consumer choice, less diversity and much higher cable bills. Tell the FCC and the DoJ to stop this merger today. This is a fight we can win.
David Sirota reports Old media outlets collude with politicians to protect monopoly, punish media startups Here’s some good recent news for free-speech advocates: A federal court recently ruled that bloggers, online journalists and the public at large enjoy the same protections as legacy news outlets do when facing defamation lawsuits. Now for some bad news: Some of those legacy news outlets are colluding with politicians to try to protect an artificial information monopoly, one that conveniently protects media industry dinosaurs and punishes new media upstarts. The latest example of this larger trend comes from Colorado, but it is merely one chapter in a larger story of government granting private companies monopoly control over public information. That story most famously includes government efforts to stop activist Aaron Swartz from ending the corporate hammerlock on court records, taxpayer-funded research and other public records. In the Colorado iteration of this story, the details are different, but it is the same basic tale. ....... READ ON! MORE SIROTA! PBS Becoming the Plutocrats Broadcasting Service In a world of screaming cable television hosts and partisan media outlets, PBS is supposed to be the last refuge for honest news. This is ostensibly why taxpayers still contribute money to the public broadcasting system. That money is appropriated to try to guarantee that there remains at least one forum for unvarnished facts, even if such facts offend those with money and power. The problem, though, is that because our government spends so little on public media as compared to many other industrialized countries, our most prominent public media outlets are becoming instruments for special interests to launder their ideological agenda through a seemingly objective brand. Starved for public resources, these outlets are increasingly trying to get their programming funded with money from corporations and wealthy political activists — and that kind of cash comes with ideological expectations. Case in point is the Public Broadcasting Service, as evidenced by the major report we published this week at PandoDaily. In that story, we meticulously documented how PBS's flagship affiliate, WNET of New York, solicited funding from former Enron trader John Arnold. The $3.5 million Arnold contributed was earmarked for a "Pension Peril" series now airing in PBS NewsHour broadcasts on stations throughout the country. If that was the entire story, it might not be much of a story. However, at the same time the billionaire Arnold is funding PBS's pension-related coverage, he is also sponsoring the nationwide legislative push to slash public employee pension benefits. Indeed, with his massive contributions to Super PACs, think tanks and local front groups, Arnold is financing a national movement to convince legislators to, in the words of his foundation, "stop promising a (retirement) benefit" to public workers. This is likely why the Arnold-backed PBS pension series has loyally echoed the billionaire's anti-pension themes. Case in point is the Public Broadcasting Service, as evidenced by the major report we published this week at PandoDaily. In the absence of the funding from the Laura and John Arnold Foundation, the project, called “Pension Peril,” will go on hiatus, although WNET will continue to report on the topic. The series, which began in September, was examining the economic sustainability of public pensions. .......... In a joint statement from PBS and WNET, PBS said it stood by WNET’s reporting in the series but “in order to eliminate any perception on the part of the public, our viewers and donors that the foundation’s interests influenced the editorial integrity of the reporting for this program,” WNET would return the gift. Leila Walsh, a spokeswoman for the foundation, said by email that it “never sought, nor did we receive, any editorial control or access to the programming.” She added that the foundation remained “committed to educating the public about our nation’s severe pension problems and solutions that protect workers and their retirement security.” ........ PBS’s “perception test” guidelines prohibit accepting funding for public affairs programs if “there exists a clear and direct connection” between the interests of a proposed funder and the program’s subject matter, even if the funder has no editorial control. Stephen Segaller, WNET’s vice president for programming, said in the statement, “We made a mistake, pure and simple.” ........ He added that the grant had been solicited with “absolute conviction” that the foundation was an acceptable funder. Late Friday, the PBS ombudsman, Michael Getler, weighed in, saying Mr. Sirota’s article shined a light on “what seems to me to be ethical compromises in funding arrangements and lack of real transparency for viewers.”

The index, together with regional and thematic analyses, continues to be available in English, French and other languages on the Reporters Without Borders website (rsf.org). This year’s index covers 180 countries, one more than the 179 countries covered in last year’s index. The newcomer is Belize, which has been ranked in the enviable position of 29th. ....... In an unstable environment, the media become strategic goals or targets for groups or individuals trying to control news and information in violation of the guarantees enshrined in international conventions. ......... Invoked too readily, the protection of national security is encroaching on hard-won democratic rights. In the United States (46th, -13), the hunt for leaks and whistleblowers serves as a warning to those thinking of satisfying a public interest need for information about the imperial prerogatives assumed by the world’s leading power. The United Kingdom (33rd, -3) has followed in the US wake, distinguishing itself by its harassment of The Guardian. ....... On a regional level, the Texas Right to Life Committee received $160,000 and 40 Days for Life received $20,000. The foundation gives generously to pregnancy crisis centers, too. But that's the tip of the iceberg. Farris Wilks is the engine underneath two other activist organizations that seek to stop women from exercising their lawful right to choose. ........ Much more! GOPher WAR ON GAYS UPDATE: And in Kansas it gets worse as Slate's Mark Joseph Stern explains why Kansas’ Anti-Gay Segregation Bill Is an Abomination On Tuesday, the Kansas House of Representatives overwhelmingly approved a measure designed to bring anti-gay segregation—under the guise of “religious liberty”—to the already deep-red state. The bill, written out of fear that the state may soon face an Oklahoma-style gay marriage ruling, will now easily pass the Republican Senate and be signed into law by the Republican governor. The result will mark Kansas as the first state, though certainly not the last, to legalize segregation of gay and straight people in virtually every arena of life. If that sounds overblown, consider the bill itself. When passed, the new law will allow any individual, group, or private business to refuse to serve gay couples if “it would be contrary to their sincerely held religious beliefs.” Private employers can continue to fire gay employees on account of their sexuality. Stores may deny gay couples goods and services because they are gay. Hotels can eject gay couples or deny them entry in the first place. Businesses that provide public accommodations—movie theaters, restaurants—can turn away gay couples at the door. And if a gay couple sues for discrimination, they won’t just lose; they’ll be forced to pay their opponent’s attorney’s fees. As I’ve noted before, anti-gay businesses might as well put out signs alerting gay people that their business isn’t welcome. But that’s just the tip of the iceberg. In addition to barring all anti-discrimination lawsuits against private employers, the new law permits government employees to deny service to gays in the name of “religious liberty.” This is nothing new, but the sweep of Kansas’ statute is breathtaking. Any government employee is given explicit permission to discriminate against gay couples—not just county clerks and DMV employees, but literally anyone who works for the state of Kansas. ......... Supporting the bill on the House floor, Republican state Rep. Charles Macheers proclaimed that “discrimination is horrible. It’s hurtful. … It has no place in civilized society, and that’s precisely why we’re moving this bill.” The latter claim is absurd, of course—this bill is an explicit effort to make gay people’s lives miserable—but the former is absolutely true. Discrimination is hurtful and horrible, and it will also soon be codified into Kansas law, as other red states look on (and follow suit)........ According to a former drone operator for the military’s Joint Special Operations Command (JSOC) who also worked with the NSA, the agency often identifies targets based on controversial metadata analysis and cell-phone tracking technologies. Rather than confirming a target’s identity with operatives or informants on the ground, the CIA or the U.S. military then orders a strike based on the activity and location of the mobile phone a person is believed to be using. The drone operator, who agreed to discuss the top-secret programs on the condition of anonymity, was a member of JSOC’s High Value Targeting task force, which is charged with identifying, capturing or killing terrorist suspects in Yemen, Somalia, Afghanistan and elsewhere. His account is bolstered by top-secret NSA documents previously provided by whistleblower Edward Snowden. It is also supported by a former drone sensor operator with the U.S. Air Force, Brandon Bryant, who has become an outspoken critic of the lethal operations in which he was directly involved in Iraq, Afghanistan and Yemen. In one tactic, the NSA “geolocates” the SIM card or handset of a suspected terrorist’s mobile phone, enabling the CIA and U.S. military to conduct night raids and drone strikes to kill or capture the individual in possession of the device. The former JSOC drone operator is adamant that the technology has been responsible for taking out terrorists and networks of people facilitating improvised explosive device attacks against U.S. forces in Afghanistan. But he also states that innocent people have “absolutely” been killed as a result of the NSA’s increasing reliance on the surveillance tactic......... Much more! Ari Phillips at ClimateProgress has this VIDEO: Explosion And Fire At Chevron Natural Gas Well In Pennsylvania from Tuesday At around 6:45 this morning a fire was reported at a Chevron natural gas well in Greene County, Pennsylvania, just north of the West Virginia border. As of early afternoon, one person had been injured and another was still missing, according to statements from the company. Twenty workers were on the scene at the time of the fire. While Chevron did not initially know the cause of the blast, the fire chief on scene recently said it was caused by natural gas. According to Chevron spokeswoman Lee Ann Wainwright, the well was in the final stages of being put in production. ........... Pennsylvania governor Tom Corbett recently proposed allowing gas drilling in the state’s parks and forests after a four-year ban, listing energy independence and economic security as reasons to ramp up fracking the massive Marcellus Shale region. Drilling on public lands fragments the land via pad construction, roads, and pipelines and makes the habitat more vulnerable to chemical spills or explosive fires.
NEXT Ken Ward Jr. of the West Virginia Gazette reports Tuesday 'Significant' coal slurry spill blackens Kanawha County creek CHARLESTON, W.Va. -- More than 100,000 gallons of coal slurry poured into an eastern Kanawha County stream Tuesday in what officials were calling a "significant spill" from a Patriot Coal processing facility. Emergency officials and environmental inspectors said that roughly six miles of Fields Creek had been blackened and that a smaller amount of the slurry made it into the Kanawha River near Chesapeake. "There has been a significant environmental impact," said Harold Ward, acting director of the state Department of Environmental Protection's Division of Mining and Reclamation. The incident occurred at Patriot Coal's Kanawha Eagle operation, Ward said. Initially, Dale Petry, director of emergency services for Kanawha County, said that an eight-inch slurry line between the preparation plant and the company's refuse impoundment ruptured, sending an underdetermined amount of coal waste into the creek before the flow was stopped. Later, DEP officials said they had determined that the spill was caused by a malfunction of a valve inside the slurry line carrying material from the preparation plant to a separate disposal site, not to an impoundment. ...... Patriot officials did not immediately respond to a request for comment. .......... This is at least the third slurry incident since 2010 at the Kanawha Eagle cite. In late November, black water was discharged into South Hollow Stream, and ended up in Fields Creek. The company was fined $663. In October of 2010, there was a slurry line break that discharged into Spicelick and Joes Creek, impacting about 3 miles of stream. The company was fined $22,400. On Tuesday, Huffman said fines alone were not enough of a deterrent to prevent spills. "At some point companies will just pay. We have to do more than that, we can't just send them a bill and say you have to pay this to continue operating, there have to be fundamental changes made at a facility that's had multiple incidents," Huffman said. "Maybe there needs to be a top down review of all their processes. Maybe there's a cultural change within that company that needs to take place that has more of an emphasis on safety, environmental controls, things like that." .......

NEXT Emily Atkin at ClimateProgress tells us Company Responsible For West Virginia Chemical Spill Skips Congressional Hearing Exactly one month and a day after 10,000 gallons of chemicals spilled into West Virginia’s water, members of the U.S. House Transportation and Infrastructure committee on Monday traveled to the state’s capital city, ostensibly to ask state leaders the still-unanswered questions surrounding the leak. There are many. Perhaps the most important party that could provide answers would have been Freedom Industries, the company whose chemical storage tanks leaked a coal-cleaning chemical called crude MCHM into the water. Company president Gary Southern had been invited to testify, but in the end, did not show up. “I find that extremely telling,” said Rep. Shelley Moore Capito (R-WV). “Freedom Industries’ decision not to testify today compounds its gross misconduct, and is an absolute affront to every person impacted by its spill.” Freedom Industries’ decision not to show up to a hearing that otherwise housed every party that should be held accountable for the spill (Representatives from West Virginia American Water, West Virginia’s Department of Environmental Protection, and the U.S. Chemical Safety Board showed up, to name a few) is depressingly typical, and a painful reminder of the company’s non-presence throughout the month-long ordeal. “They’ve been basically out of the picture since day one of this crisis, even though they were the cause of the crisis,” Executive Director of West Virginia Citizen Action Gary Zuckett, told ClimateProgress, recalling the events of the week following the spill. “The first thing that [Freedom] did was file for bankruptcy. The second thing they did was open a new corporation to loan the first corporation money.” ......... When asked for comment by the Huffington Post, a representative for Freedom Industries referred to its lawyer, Paul Vey, who said Southern did not attend “simply because the company is relatively small and we are focused exclusively on remediation of the spill.” And considering all the bad press, Zuckett said maybe it was for the best that Southern didn’t show up to the hearing. “He was digging this thing deeper,” Zuckett said. “They wisely decided to get him out of the spotlight.” At Salon.com Lindsay Abrams also notes The company responsible for West Virginia’s chemical spill didn’t bother to show up to the congressional hearing ......... Here’s what we learned:

• The storage facility containing the leaked chemical never should have been built upstream from a water treatment plant in the first place, according to Rafael Moure-Eraso, chairman of the independent safety board. Citing regulation gaps, he told the committee: “The facility just did not need to be where it was.”
• Freedom Industries ordered its own review of the storage tanks last October, after which environmental consultants determined that the storage units were “not necessarily” in full compliance with EPA and industry standards: they were built on porous ground, and a “last resort” containment wall was improperly constructed.
• Yes, West Virginians’ water still smells like licorice — a telltale sign of the chemical’s presence — but levels of MCHM in the water are below the safety threshold set by the CDC. West Virginia American Water’s Jeff McIntyre explained: “Just because you smell something doesn’t mean it’s not safe.”
• But that also doesn’t mean it is safe. State Bureau of Public Health commissioner Dr. Letitia Tierney attempted to give a definite answer thusly: “That’s in a way a difficult thing to say because everybody has a different definition of safe.”
• Believe it or not, West Virginia American Water customers still don’t trust the water. As Rep. Shelley Moore Capito, R-W.Va., told Metro News: “It is such a simple, stark, understandable phrase, ‘The drinking water is safe.’ It’s frustrating that nobody could say that today!”
• Bankrupt Freedom Industries is “focused exclusively on remediation of the spill,” according to the company’s lawyer, attempting explain why it failed to send a representative to the hearing. An alternative explanation, provided by Capito: “Freedom Industries’ decision not to testify today compounds its gross misconduct, and is an absolute affront to every person impacted by its spill.”

At Philly.com senior writer at the Philadelphia Daily News Will Bunch asks Why are a Patriot and Freedom poisoning America? Kris Kristofferson, with a little help from his friend Janis Joplin, told us that "freedom" is just another word for nothing left to lose - but that was before American capitalism grasped hold of it. And then there's "patriot" -- a great word that a radical minority called the Tea Party has tried to hijack. But today West Virginians -- and all of America, really -- should be asking themselves: Why is this Patriot, and why is this Freedom, trying to poison our water and poison us: [Ken Ward's piece] It's getting to the point where it's hard to keep these coal ash, coal slurry, and toxic coal-cleaning chemicals straight -- on top of various fracking explosions, oil-by-rail explosions, pipeline spills and what not. Why is this happening now? The broad answer is that America is producing more fossil-fuel energy than ever, but after thirty years of deregulation that -- especially in a red state like West Virginia -- have been backed by leaders from both major parties, no one is checking to see what's safe. This is happening because industry and the politicians they've bought and paid for think they can get away with this, but it's backfired. Freedom for big business isn't really free if it enslaves the everyday citizens who depend on clean water to live. And anyone who treats America's waterways with such callous disregard is no patriot. Two groups, the Freedom Partners Chamber of Commerce and TC4 Trust, handed out almost $264 million from mid-2011 to October 2012 to 30 other nonprofits. Almost half of that went to the Center to Protect Patient Rights, which then funneled millions to a constellation of dark money groups, some of which also received money from Freedom Partners and TC4 Trust. Groups that got significant amounts of money from the Center, Freedom Partners and TC4 Trust reported political spending of more than $75 million in 2012. Much of the money flowed through what are known as “disregarded entities” — limited liability companies, or LLCs, that some of the groups have set up. TC4 Trust has folded and the Center to Protect Patient Rights no longer plays a central role in the Koch network, but many of these groups will be active in the 2014 election. Fundraising by the libertarian billionaire brothers Charles and David Koch supports a tangle of nonprofits, sometimes referred to as the Kochtopus, all aimed at advancing conservative causes. Two groups, the Freedom Partners Chamber of Commerce and TC4 Trust, handed out almost $264 million from mid-2011 to October 2012 to 30 other nonprofits. Almost half of that went to the Center to Protect Patient Rights, which then funneled millions to a constellation of dark money groups, some of which also received money from Freedom Partners and TC4 Trust. Groups that got significant amounts of money from the Center, Freedom Partners and TC4 Trust reported political spending of more than $75 million in 2012. Much of the money flowed through what are known as “disregarded entities” — limited liability companies, or LLCs, that some of the groups have set up. TC4 Trust has folded and the Center to Protect Patient Rights no longer plays a central role in the Koch network, but many of these groups will be active in the 2014 election. A series of recent developments highlight the way we are losing ground in the epic struggle to slow global warming. This has not been for lack of effort. Around the world, dedicated organizations, communities, and citizens have been working day by day to reduce greenhouse gas emissions and promote the use of renewable sources of energy. The struggle to prevent construction of the Keystone XL tar-sands pipeline is a case in point. As noted in a recent New York Times article, the campaign against that pipeline has galvanized the environmental movement around the country and attracted thousands of activists to Washington, D.C., for protests and civil disobedience at the White House. But efforts like these, heroic as they may be, are being overtaken by a more powerful force: the gravitational pull of cheap, accessible carbon-based fuels, notably oil, coal, and natural gas. ............ As oil and gas have proven unexpectedly abundant and affordable, major energy consumers are planning to rely on them more — and on renewable sources of energy less — to meet their future requirements. As a result, the promises we once heard of a substantial decline in fossil fuel use (along with a corresponding boom in renewables) are fading. According to the most recent projections from the U.S. Department of Energy, global fossil fuel consumption is expected to grow by an astonishing 40% by 2035, jumping from 440 to 615 quadrillion British thermal units. While the combined share of total world energy that comes from fossil fuels will decline slightly — from 84% to 79% — they will still dominate the global energy marketplace for decades to come. Renewables, according to these projections, will continue to represent only a small fraction of the total. If this proves to be accurate, there can be only one plausible outcome: vastly increased carbon emissions leading to rising temperatures and the sort of catastrophic climate change scenarios that now seem almost impossible to imagine. Think of it this way: in our world, the gravitational pull of carbon exerts itself every minute of every day, shaping the energy decisions of individuals, companies, institutions, and governments. This pull is leading to defeat in the global struggle to slow the advance of severe climate change and is reflected in three recent developments in the energy news: a declaration of surrender by BP, a major setback in the European Union, and a strategic end-run by Canadian tar sands companies. ....... Read this another way and a new and truly unsettling meaning emerges: the “shale gas revolution” being promoted with such fervor by President Obama as a “bridge” to a more climate-friendly energy system in the United States is having the opposite effect in Europe. It is weakening the EU’s commitment to renewable energy and threatens to increase Europe’s reliance on fossil fuels. .............. These three recent encounters in the historic struggle to avert the most destructive effects of climate change tell us a great deal about the nature and terrain of the battlefield. Climate change is not the product of unfortunate meteorological phenomena; it is the result of burning massive quantities of carbon-based fuels and spewing the resulting gaseous wastes into the atmosphere. As long as governments, corporations, and consumers prefer carbon as an energy source, the war on climate change will be lost and the outcome of that will, in turn, be calamitous. There is only one way to avert the worst effects of climate change: make the consumption of carbon unattractive. ...... We snipped quite a bit so click over to read all the details! Had we pursued "energy independence" when Jimmy Carter put solar panels up on the WH and reduced the speed limit to 55 mph to conserve fossil fuels we may have had a chance. Think about it. At that point we could have begun to slowly redirect subsidies away from coal & oil and toward developing solar, hydro, hydrogen and everything else. Imagine how much further we'd be had scientists spent their time developing these alternative renewable energy sources. Instead a bunch of "Raygun Dems" voted Jimmy OUT and we hurled down the path of Milton Friedman Chicago-School Reaganomics which resulted in the largest expansion of the U.S. military in history to support a bellicose "foreign policy" which in turn resulted in millions killed all in the name of protecting "U.S. strategic interests" as outlined in John Perkins' COEHM. Did you know The United States Military is the the world’s largest fuel-burning entity? All this is still in play today as the beltway "Washington Consensus" continues to dominate, even though study after study shows "trickle down" does the exact opposite. Our legislatures and media are even more bought-n-paid-for now to add to the momentum.
