Post-2012-election wrap With Congressional disapproval ratings hovering around 75% one might think there would be a big turnover in Congress. Reporting for Politico Seung Min Kim explains the 5 traits of the House freshman class It wasn’t a wave election, but the 2012 races will sweep in an outsize freshman class nonetheless. The 113th Congress will welcome at least 79 new House members — 44 Democrats, 35 Republicans. That total would grow to 85 new faces in the House if current results in still-uncalled races hold. It will be the largest freshman class of the past dozen years, aside from the 89-member class elected in November 2010. The newest members knocked out more than 20 incumbents. But a large number of retirements and redistricting in key states also helped bring fresh blood to the Capitol. California alone will be responsible for 11 new members in the House. Here are POLITICO’s five traits of the incoming class of House freshmen. Next year’s House Democratic Caucus will achieve a significant milestone: the first in which women and minorities make up the majority. Democratic gains will boost Latino ranks in the House with at least eight new members .... This cycle saw the highest number of Asian-American congressional candidates in history ..... The Congressional Black Caucus will welcome five new members .... And the incoming class of House freshmen will have three openly gay members, all Democrats. ..... Though Democrats fell short of the 25 net seats needed to regain House control, they did manage to narrow the GOP majority. Gains in suburban America were a big reason why. .... House Democrats bragged after Tuesday night that they rolled back the “tea party wave” that swept them out of power in 2010. But plenty of new freshmen are strong conservatives backed enthusiastically by the movement that made its mark in 2010. ..... Six of the comeback specialists are Democrats ousted in the 2010 Republican wave: Bill Foster of Illinois, Alan Grayson of Florida, Ann Kirkpatrick of Arizona, Dan Maffei of New York, Carol Shea-Porter of New Hampshire and Dina Titus of Nevada. .... So all these new members equate to about 18-20% turnover, way lower than the 75% disapproval rating the 112th Congress now enjoys. The Do Nothing Congress will return as the 113th Edition in January with Paulie Ryan leading the obstructionists no doubt from the so-called "Fiscal Cliff" to more climate-change denial. Meanwhile citizens in the NY/NJ area are still dealing with the latest data point of climate change, Hurricane Sandy's aftermath. Over at Slate Katherine Goldstein wonders Is Occupy Wall Street Outperforming the Red Cross in Hurricane Relief? In Sunset Park, a predominantly Mexican and Chinese neighborhood in South Brooklyn, St. Jacobi’s Church was one of the go-to hubs for people who wanted to donate food, clothing, and warm blankets or volunteer help other New Yorkers who were still suffering in the aftermath of Hurricane Sandy. On Saturday, Ethan Murphy, one of the people heading the kitchen operation, estimated they would prepare and send out 10,000 meals to people in need. Thousands and thousands of pounds of clothes were being sorted, labeled, and distributed, and valuable supplies like heaters and generators were being loaded up in cars to be taken out to the Rockaways, Staten Island and other places in need. However, this well-oiled operation wasn’t organized by the Red Cross, New York Cares, or some other well-established volunteer group. This massive effort was the handiwork of none other than Occupy Wall Street—the effort is known as Occupy Sandy. .... So how did an offshoot of Occupy Wall Street, best known as a leaderless movement that brought international attention to issues of economic injustice through the occupation of Zucotti Park in the financial district last year, become a leader in local hurricane relief efforts? Ethan Murphy, who was helping organize the food at St. Jacobis and had been cooking for the occupy movement over the past year, explained there wasn’t any kind of official decision or declaration that occupiers would now try to help with the hurricane aftermath. “This is what we do already, “ he explained: Build community, help neighbors, and create a world without the help of finance. Horst said, “We know capitalism is broken, so we have already been focused on organizing to take care of our own [community] needs.” He sees Occupy Sandy as political ideas executed on a practical level. DN! sent our their correspondent Mike Burke for this fascinating interview After Sandy, Occupy Movement Re-Emerges as Relief Hub for Residents in Need Interestingly, one of the more active relief efforts that we came across in the Rockaways was done by a group calling themselves Occupy Sandy Relief. And this is a group of—pretty much of alumni from Occupy Wall Street who started organizing really in the hours after the storm, about ways that just, you know, regular members of the community could help. And we talked to one organizer named Catherine Yeager. She lives in the Rockaways, and we talked to her outside of the—a restaurant called the Veggie Island, which had been transformed into a relief hub. And this is part of what she had to say.
    CATHERINE YEAGER: ....Right now, the biggest issue that we need is generators, and we need pumps, because we can’t get the electricity turned back on until all of the basements are pumped out. And there’s still—if you walk Rockaway and you knock on any door, someone—every single door, someone is going to need help. The water that came in is toxic, OK? We had water from the beach. I watched the waves that morning. They were already incredibly dirty. The bay and the ocean met every single part of Rockaway during the storm. There was at least two feet of flooding everywhere, sometimes up to six or seven feet of flooding, depending on where you lived. Everyone’s been affected, doesn’t matter who you are, doesn’t matter where you are. Every single person’s been affected. And so, a lot of right now is getting those basements pumped out, debris getting pulled out, you know, sweeping out huge chunks of just gunk and junk, and trying to figure out where it all goes. The boardwalk is destroyed. You know, I watched the boardwalk out my window come rushing down. The water level here got up to about five feet, and the winds were almost 20 miles per hour, so it looks like the ocean coming through this entire place. I watched cars rolling down the street. I mean, it was—it was scary. And out the window, you could see the fire. You could see this huge flame of fire coming from Breezy Point. And they really—I mean, there were, I think, 80 homes lost over there—and just devastated. So, the last couple days have been very inspiring, because we’ve had so many people coming. People are starting to realize that Rockaway was hit as bad as it was hit, and they’re coming to start helping and starting to think about us a little bit more. So, we’ll see what happens. I don’t know when we’re going to get electricity back. I don’t know. ....

BUSH CRIME FAMILY NEWS: Robyn Hagan Cain at FindLaw.com tells us Court Dismisses Torture Lawsuit Against Donald Rumsfeld The Seventh Circuit Court of Appeals rejected a lawsuit this week from two American civilians who claim that they were tortured by the U.S. military in Iraq, Reuters reports. In an 8-3 opinion, the Seventh Circuit concluded that the plaintiffs had no right to sue former Secretary of Defense Donald Rumsfeld and others in the military chain of command for damages. The en banc decision reverses last year's Seventh Circuit panel ruling that the men could pursue their Bivens claims against Rumsfeld. .... Writing for the Seventh Circuit majority, Chief Judge Frank Easterbrook said that a Bivens remedy is personal, and would not apply to the contractors' case even if the court created a common-law damages remedy against military personnel and their civilian superiors. Though the Supreme Court concluded in Iqbal that cabinet secretaries and other supervisory personnel are accountable for what they do, they are not vicariously liable for what their subordinates do. Knowledge of a subordinate's misconduct is not enough for liability. ...... The contractors' lawyer, Michael Kanovitz, expressed disappointment in the ruling, saying that the decision means "a civilian can never bring a claim to enforce their rights if they are violated by anyone in the U.S. military," Reuters reports. Kanovitz indicated to Bloomberg that Ertel and Vance might petition the Supreme Court for review. Good luck with THAT considering the R.A.T.S. on the SCOTUS. Maybe, just maybe, Obama will get to nominate a couple of decent (non-corporate aka for-the-peeps) judges to the SCOTUS in the next four years (as every Obamabot has beat us over the head with this election season). Paul Krugman explains the Delusions of Reason at his NYT blog What’s so strange about this is that everything — everything — that has happened for the past decade has demonstrated the opposite. Modern Republicans are devotees of faith-based analysis on every front. On economics, in particular, they are devoted to supply-side fantasies that keep being refuted by evidence — and their reaction is to try to suppress the evidence. They’ve spent pretty much the whole past four years issuing dire warnings about inflation and soaring interest rates that keep not coming true; they cling to the belief that if only a Republican were in office we’d have a 1982-style recovery even though economists who actually studied past financial crises predicted the slow recovery in advance. And don’t even get me started on climate change. The truth is that the modern GOP is deeply anti-intellectual, and has as its fundamental goal not just a rollback of the welfare state but a rollback of the Enlightenment. Yet there are some wannabe intellectuals who delude themselves into believing that they have aligned themselves with the party of objective (as opposed to Objectivist) analysis. You might think that the election debacle would force some reconsideration. But I doubt it; if the financial crisis didn’t do it, nothing will.
As we have tried to explain over and over again OBJECTIVE REALITY IS IMMATERIAL to the Right Wing and the Greater GOPher electorate. Over at NYMag.com Frank Rich calls it Fantasyland - Denial has poisoned the GOP and threatens the rest of the country too Mitt Romney is already slithering into the mists of history, or at least La Jolla, gone and soon to be forgotten. A weightless figure unloved and distrusted by even his own supporters, he was always destined, win or lose, to be a transitory front man for a radical-right GOP intent on barreling full-speed down the Randian path laid out by its true 2012 standard-bearer, Paul Ryan. But as was said of another unsuccessful salesman who worked the New England territory, attention must be paid to Mitt as the door slams behind him in the aftermath of Barack Obama’s brilliant victory. Though Romney has no political heirs in his own party or elsewhere, he does leave behind a cultural legacy of sorts. He raised Truthiness to a level of chutzpah beyond Stephen Colbert’s fertile imagination, and on the grandest scale. That a presidential hopeful so cavalierly mendacious could get so close to the White House, winning some 48 percent of the popular vote, is no small accomplishment. The American weakness that Romney both apotheosized and exploited in achieving this feat—our post-fact syndrome where anyone on the public stage can make up anything and usually get away with it—won’t disappear with him. A slicker liar could have won, and still might. ..... The blogger Steve Benen, who meticulously curated and documented Mitt’s false statements during 2012, clocked a total of 917 as Election Day arrived. Those lies, which reached a crescendo with the last-ditch ads accusing a bailed-out Chrysler of planning to ship American jobs to China, are not to be confused with the Romney flip-flops. The Etch-A-Sketches were a phenomenon of their own; if the left and right agreed about anything this year, it was that trying to pin down where Mitt “really” stood on any subject was a fool’s errand. ..... Given that Romney had about as much of a human touch with voters as an ATM, it sometimes seemed as if a hologram were running for president.(Do you mean Mitt Headroom? Haha! -Ed.) Yet some 57 million Americans took him seriously enough to drag themselves to the polls and vote for a duplicitous cipher. Not all of this can be attributed to the unhinged Obama hatred typified by Mary Matalin’s postelection characterization of the president as “a political narcissistic sociopath.” ....... This year’s instantly famous declaration by the Romney pollster Neil Newhouse that “we’re not going to let our campaign be dictated by fact-checkers” crystallized the mantra of the entire GOP. The Republican faithful at strata both low and high, from Rush’s dittoheads to the think-tank-affiliated intellectuals, have long since stopped acknowledging any empirical evidence that disputes their insular worldview, no matter how grounded that evidence might be in (God forbid) science or any other verifiable reality, like, say, Census reports or elementary mathematics. No wonder Romney shunned the word Harvard, which awarded him two degrees, even more assiduously than he did Mormon. At the policy level, this is the GOP that denies climate change, that rejects Keynesian economics, and that identifies voter fraud where there is none. At the loony-tunes level, this is the GOP that has given us the birthers, websites purporting that Obama was lying about Osama bin Laden’s death, and not one but two (failed) senatorial candidates who redefined rape in defiance of medical science and simple common sense. It’s the GOP that demands the rewriting of history (and history textbooks), still denying that Barry Goldwater’s opposition to the Civil Rights Act of 1964 and Richard Nixon’s “southern strategy” transformed the party of Lincoln into a haven for racists. Such is the conservative version of history that when the website Right Wing News surveyed 43 popular conservative bloggers to determine the “worst figures in American history” two years ago, Jimmy Carter, Obama, and FDR led the tally, all well ahead of Benedict Arnold, Timothy McVeigh, and John Wilkes Booth. The good news for Democrats this year was that the right’s brand of magical thinking (or non-thinking) bit the GOP in the ass, persuading it to disregard all the red flags and assume even a figure as hollow as Romney could triumph........ Nor, for all the panicked Republican talk about trying to make the party more inclusive and rational, is there any evidence that the GOP base wants to retreat a whit, whether on immigration or gay marriage or reproductive rights or the reinstatement of Jim Crow–era roadblocks to voting in states like Florida and Ohio. Or that any Republican leaders with actual power (as opposed to the out-of-office Jeb Bush) want to, either. The right is taking solace from exit-poll findings that more Americans still label themselves conservative than liberal and still think government does too much. A moderate putsch led by Olympia Snowe in exile, or David Frum, David Brooks, and Michael Gerson from op-ed pages, or Meghan ­McCain on Twitter, is not going to get very far. But that’s the Republicans’ plight...... The news business, which we once counted on to vet hoaxes and fictions, is now so insecure about its existential future that it was cowed to some extent by the Scarboroughs, Noonans, and Roves, with most of the networks, not just Fox, ignoring the statistical data of Silver and others and instead predicting a long, nail-biting Election Night. And almost on cue from CBS This Morning we find Condoleezza Rice: GOP sent "mixed messages" throughout election While Rice maintained that the electoral college often skews the reality of an election -- "It was still a close election in the popular vote," she said -- she admitted that there is a need for a "bigger tent for the Republican party." She explained that while the party stands for a lot of things that are "broadly popular with the American people" -- from "fiscal responsibility" to "the possibility of strong national defense," she admitted "clearly we are losing important segments of the electorate." Rice explained, "on the immigration issue ... and probably some issues about women too, some mixed messages were sent. And when you send mixed messages through the narrow funnel that is the media funnel, sometimes people only hear one side of that message. At AlterNet Roy Edroso proprietor of Alicublog asks Why Does the GOP Keep Generating Extremists? During the campaign, instead of tying Democrats to weirdos, the Republicans generated a flood of their own. Again! .... And because the conventional wisdom had always been that autonomous, sexually active women and the men who love them are just a fringe constituency, instead of questioning the wisdom of attacking them, the big brains questioned the wisdom of having Sandra Fluke speak at the Democratic Convention. I always knew this issue was a winner for the Democrats, but now I'm beginning to think that it affected everything else as well. That is, Romney's crackpot economic and environmental policies might have had more traction with voters if so many of them were not convinced that he represented and was listening to a bunch of lunatics who were totally out of touch with how human beings live. .... Haha! Confused? So was Kristen Neel headlines the Sydney Morning Herald! It must be quite a shock for Julia Gillard to find that President Barack Obama's re-election somehow transformed her into Australia's male, Christian president who "actually supports what he says". Confused? So was Kristen Neel, a teenager from Georgia, who gained Twitter infamy in Australia in a matter of hours on Wednesday evening. After news President Obama won four more years, the 18-year-old tweeted: "I'm moving to Australia, because their president is a Christian and actually supports what he says." She has since deleted her Twitter account, but search tool Topsy showed she was retweeted over 1500 times. Before she went offline, Ms Neel tried to explain. "I was referring to the prevous (sic) office that actually had a moral position," she wrote. Australian political and media observers didn't take long to pounce, sending out numerous tweets:

Over at that bastion of liberalism NPR's David Folkenflik explains on All Things Considered Friday show Some In GOP Criticize Fox For Failing Its Audience The noted conservative political analyst Michael Barone and conservative columnist George Will each predicted a landslide in the Electoral College for Romney. But they were far from alone. You would've heard a steady diet of such punditry on Fox News for weeks. .....This morning, conservative commentator and former George W. Bush speechwriter David Frum appeared on MSNBC's "Morning Joe" and leveled a charge against his fellow pundits.
    DAVID FRUM: The conservative followership has been fleeced, exploited and lied to by the conservative entertainment complex. UNIDENTIFIED MALE: Name names.
Frum demurred, though he has pointed to Fox News and Rush Limbaugh in the past. He argued that conservative media have failed their audiences by cheerleading rather than reflecting what was actually happening in the race. .... Romney loyalists had insisted his momentum wasn't being reflected in the most recent polls. But those polls were showing an edge for President Obama, especially in key battleground states. Byron York is the chief political correspondent for the conservative Washington Examiner. He reported from Romney's headquarters on election night.
    BYRON YORK: The thing that struck me talking to Romney supporters at the convention center right after he had conceded was that so many of them said they were incredibly shocked at this. They had come to the event expecting Romney to win. They were really stunned when it turned out that he hadn't.
A number of Romney supporters told York Tuesday night they had been influenced both by the campaign's internal polls and very much by what they read in print and heard on the air. The assumption among conservatives, as York found when he pressed Romney's strategists, was that Democrats would not vote at the same levels they did in 2008 in electing Mr. Obama the first time. And that meant many conservatives argued the polls themselves were skewed because they showed a Democratic advantage. But the trade of polling was vindicated. The Examiner's Byron York said there was a logic behind the Republicans' belief, but they were unable to question that thinking at a time they needed to most.
    YORK: You had this kind of mutually reinforcing phenomenon going on between the Romney campaign, some influential commentators and then a lot of that commentary then gets repeated in the media at large.
And that's how a defeat foreshadowed by the polls can still come as a surprise to those on the losing end.
We harp on constantly IT'S THE MEDIA STOOPID! Let's remember over 57 million people voted the Romney/Ryan ticket nationwide with a good portion of them no doubt FAKE SNOOZE followers, tea-baggers, Ditto-heads and climate-change deniers who we know are Less Informed Than Those Who Read No News! They buy into canards like The War On Women, The War on Science, The War on Big Bird and The War on "Librul Media" especially. We also know from a 2007 study (pdf) by The Center for American Progress and Free Press that "91 percent of the total weekday talk radio programming was conservative, and only 9 percent was progressive" and "Each weekday, 2,570 hours and 15 minutes of conservative talk are broadcast on these stations compared to 254 hours of progressive talk — 10 times as much conservative talk as progressive talk." And since 2007 how many over-the-air progressive stations have since gone dark? The latest casualty now is Portland's Clear Channel-owned KPOJ Progressive Talk Station Flipped to Fox Sports reported by Brad Friedman (see below). We also know about The 6 Monolithic Corporations That Control Almost Everything We Watch, Hear And Read The six corporations that collectively control U.S. media today are Time Warner, Walt Disney, Viacom, Rupert Murdoch's News Corp., CBS Corporation and NBC Universal. Together, the "big six" absolutely dominate news and entertainment in the United States. But even those areas of the media that the "big six" do not completely control are becoming increasingly concentrated. For example, Clear Channel now owns over 1000 radio stations across the United States. Companies like Google, Yahoo and Microsoft are increasingly dominating the Internet. But it is the "big six" that are the biggest concerns. When you control what Americans watch, hear and read you gain a great deal of control over what they think. They don't call it "programming" for nothing. The conventional wisdom has arrived: 2012 was a status quo election. President Barack Obama was reelected. Democrats continue to have a majority in the Senate. Republicans still control the House. Only two states changed their presidential votes from 2008 to 2012 (North Carolina and Indiana). Six billion dollars were spent and almost nothing changed! The conventional wisdom is wrong. Things have indeed changed. Voters came out to defend the revolution of 2008. They rejected a return to the old order. The status quo candidate in this election was Republican presidential nominee Mitt Romney. Romney represented the old order that’s been in power since 1980: the Reagan regime with its power base of older white men. Bill Clinton, the only Democrat to win the White House during that regime, tried to make accommodations with it. They impeached him. All that changed with the revolution of 2008. The New America, led by Obama, came to power. It was a movement of young people, working women, African-Americans, Latinos, Asian-Americans, union members, liberals, gays and other groups that had long been denied power. A revolution always faces a counterrevolution. When the Bolsheviks came to power in Russia, they immediately faced a counterrevolution led by the White Army, which was fighting to defend the Czarist regime. When the Obama movement came to power in 2009, a counterrevolution sprang up immediately: the Tea Party. The Tea Party enjoyed a big victory in 2010 when it gained power in Congress and nearly killed health care reform. Tuesday, the New America defeated the forces of reaction. There were some doubts about whether the 2008 majority would show up again. Many Democrats were disappointed in Obama and frustrated by his inability to deliver the hope and change he promised. But they did show up. What drove them to the polls this time was not hope but fear — fear that the Tea Party Republicans would take over the country. Obama continued to draw strong support from women, gays, African-Americans, Latinos, Asian-Americans, liberals and union members. In some cases (Latinos, Asian-Americans, gays), Obama did better than he did in 2008. His big loss was among white men (from 41 percent in 2008 to 35 percent this year). They’re the old regime. The White Army was routed. It retreated to Siberia — in this case, the House of Representatives, where Republicans retained their majority. Why did Republicans hold on to the House? Because the House is fortified against change. House incumbents are difficult to defeat. Their challengers are mostly unknown. Moreover, most state legislatures are controlled by Republicans, and they used their power over redistricting to protect Republican incumbents. It’s hard to call this a status quo election when so many Americans are dissatisfied with the status quo. Karl Rove was the Admiral Alexander Kolchak of the effort to hold back change, the supreme commander of the counterrevolutionary forces. His American Crossroads Super PAC spent more than $100 million on attack ads. According to the Sunlight Foundation, only 1 percent of the candidates supported by his committee won. That is one of the lowest returns on investment of any independent spending group. The Bolsheviks shot Kolchak. Rove was lucky. He just got humiliated on national TV. .... The president's winning coalition of 2008 remains intact — and demographic trends suggest that it will only get larger worth a look. But this is a mistake. Regardless of who wins the election on Tuesday, total capitalism is America's true ruler, and it has the power to destroy the country. Good item! Finally Nobel Laureate Paul Krugman tells The Dems and pResident Obama Let’s Not Make a Deal To say the obvious: Democrats won an amazing victory. Not only did they hold the White House despite a still-troubled economy, in a year when their Senate majority was supposed to be doomed, they actually added seats. Nor was that all: They scored major gains in the states. Most notably, California — long a poster child for the political dysfunction that comes when nothing can get done without a legislative supermajority — not only voted for much-needed tax increases, but elected, you guessed it, a Democratic supermajority. But one goal eluded the victors. Even though preliminary estimates suggest that Democrats received somewhat more votes than Republicans in Congressional elections, the G.O.P. retains solid control of the House thanks to extreme gerrymandering by courts and Republican-controlled state governments. And Representative John Boehner, the speaker of the House, wasted no time in declaring that his party remains as intransigent as ever, utterly opposed to any rise in tax rates even as it whines about the size of the deficit. So President Obama has to make a decision, almost immediately, about how to deal with continuing Republican obstruction. How far should he go in accommodating the G.O.P.’s demands? My answer is, not far at all. Mr. Obama should hang tough, declaring himself willing, if necessary, to hold his ground even at the cost of letting his opponents inflict damage on a still-shaky economy. And this is definitely no time to negotiate a “grand bargain” on the budget that snatches defeat from the jaws of victory. In saying this, I don’t mean to minimize the very real economic dangers posed by the so-called fiscal cliff that is looming at the end of this year if the two parties can’t reach a deal. .... Nobody wants to see that happen. Yet it may happen all the same, and Mr. Obama has to be willing to let it happen if necessary. Why? Because Republicans are trying, for the third time since he took office, to use economic blackmail to achieve a goal they lack the votes to achieve through the normal legislative process. ...... Mr. Obama essentially surrendered in the face of similar tactics at the end of 2010, extending low taxes on the rich for two more years. He made significant concessions again in 2011, when Republicans threatened to create financial chaos by refusing to raise the debt ceiling. And the current potential crisis is the legacy of those past concessions. Well, this has to stop — unless we want hostage-taking, the threat of making the nation ungovernable, to become a standard part of our political process. So what should he do? Just say no, and go over the cliff if necessary. .... Most of all, standing up to hostage-taking is the right thing to do for the health of America’s political system. So stand your ground, Mr. President, and don’t give in to threats. No deal is better than a bad deal. So this Sunday look for apologists of every stripe too many to list but the only Big Hitter seems to be 0's Senior Campaign Adviser David Axelrod with Face the Bob. Conspicuously absent is KKKARL "I don't need no stinkin subpoena" ROVE, MARCO RUBIO, CHRIS CHRISTIE, MITCH MCCONNELL, JOHN "Crybaby" BOEHNER and GEORGE "LANDSLIDE" WILL among others who hitched their wagon to Paulie and Rawmoney. So spend yer Sunday with all the BTV regulars who have a cornucopia of post election coverage!     Lawmakers concerned about the health effects on humans from mountaintop removal coal mining set forth legislation in the U.S. House of Representatives today. Representatives Dennis Kucinich (OH), Louise Slaughter (NY), Maurice Hinchey (NY), Earl Blumenauer (OR), Lucille Roybal-Allard (CA), John Yarmuth (KY), Lynn Woolsey (CA), Judy Chu (CA), Raúl Grijalva (AZ), James Moran (VA), Michael Honda (CA), John Conyers (MI), and Keith Ellison (MN) introduced the Appalachian Communities Health Emergency (ACHE) Act H.R. 5959 which would place a moratorium on permitting for mountaintop removal coal mining until health studies are conducted by the Department of Health and Human Services. The ACHE coalition presently consists of participants from Coal River Mountain Watch, Mountain Health and Heritage Association, and Christians for the Mountains. “We encourage you, if you’re concerned about mountaintop removal’s effect on your community’s health, to join us in making your voice heard,” said Allen Johnson, executive director of Christians for the Mountains. “Please contact us, learn about the issue, and take action to protect your community.”

Reaffirming the socialist objective of the Bolivarian Revolution as a strategic goal depends first of all making the Ministries and their sub-officials accountable to their constituents via empowered citizens councils and professionally trained oversight committees of ‘users of the services’. Current abuses, corruption, inefficiencies, non-delivery of services are chronic, politically costly and mock the socially progressive projects promised by President Chavez. Periodic ‘renovation’ and replacements of Ministers, civilians by military, provide at best a temporary respite: but under conditions of unchecked power, the rentier culture and mentality promptly reasserts itself in the same dysfunctional behavior. Citizen oversight with the power to sanction errant officials provides a more permanent corrective. The centrality of mal-administration has enormous political consequences; it probably accounted for over half of the minority popular vote which defected to the opposition. It is a mistake to attribute the 45% vote for the opposition as a call for a return to neo-liberalism: in fact it represents a protest vote of Chavez sympathizers against officials who mismanage funds and who appoint incompetent party cronies. It was a vote against Ministers who spend billions but can’t keep the oil flowing, lights on and the water running. Above all the anti-Chavista protest vote was a response to the Ministers of Interior and Defense, civilian or military, who have failed to reduce the crime rate – in the streets, in the private suites and in the public offices...... As much of New York, New Jersey and other states dig out from Hurricane Sandy (lots of communities even in Ohio are still without power) Scott DiSavina of Reuters explains how Sandy slows nuclear plants, oldest declares alert NEW YORK (Reuters) - Hurricane Sandy slowed or shut a half-dozen U.S. nuclear power plants, while the nation's oldest facility declared a rare "alert" after the record storm surge pushed flood waters high enough to endanger a key cooling system. Exelon Corp's 43-year-old New Jersey Oyster Creek plant remains on "alert" status, the U.S. Nuclear Regulatory Commission (NRC) said early Tuesday. It is only the third time this year that the second-lowest of four emergency action levels was triggered. The alert came after water levels at the plant rose by more than 6.5 feet above normal, potentially affecting the "water intake structure" that pumps cooling water through the plant, an NRC spokesman said. Those pumps are not essential since the reactor has been shut for planned refueling since October 22. However, a further rise to 7 feet could submerge the service water pump motor that is used to cool the water in the spent fuel pool, potentially forcing it to use emergency water supplies from the in-house fire suppression system to keep the rods from overheating. On Tuesday, an NRC spokesman said the levels reached a peak of 7.4 feet -- apparently above the threshold. As of 6:10 a.m. EDT waters were at 6.5 feet, with the next high tide at 11:45 a.m. He said the company had moved a portable pump to the water intake structure as a precaution, but has not needed to use it. Exelon said in a statement that there was no danger to equipment and no threat to public health or safety. ..... Despite the alert -- which is a serious but not catastrophic event that signals a "potential substantial degradation in the level of safety" -- the U.S. nuclear industry was broadly seen having passed the test. About a dozen alerts have been issued in the past four years, according to NRC press releases. On Tuesday morning, the NRC said that Entergy Corp's Indian Point 3 automatically tripped offline at about 10:41 p.m. last night due to fluctuations in the power grid caused by the storm, while Public Service Enterprise Group Inc's Salem Unit 1 was manually shut down at 1:10 a.m. due to a loss of "condenser circulators" due to the storm surge and debris. ..... Among other units, Constellation Energy Nuclear Group's 630-MW Nine Mile Point 1 nuclear power reactor in upstate New York did shut due to a problem putting power onto the grid, although it was not clear whether the trouble was related to the storm. In addition, Sandy caused power reductions at both units at Exelon's Limerick nuclear plant in Pennsylvania and one unit at Dominion's Millstone plant in Connecticut. At Alternet Nomi Prins explains How Wall Street Won the Election Long Before The First Vote Was Cast ...Obama hasn’t brought ‘sweeping reform’ upon the Establishment Banks, nor does Romney need to exude deregulatory babble, because nothing structurally substantive has been done to harness the biggest banks of the financial sector, enabled, as they are, by entities from the SEC to the Fed to the Treasury Department to the White House. For the record, both missed, or don’t get, that nearly 32% of that Treasury debt is reserved (in excess) at the Fed, floating the banking system that supposedly doesn’t need help. The ‘worst economic period since the Great Depression’ barely produced a short-fall of an approximate average of $200 billion in personal and corporate tax revenues per year, according to federal data.) ..... The most consistent political platform is that big finance trumps main street economics, and the needs of the banking sector trump those of the population. We have a national policy condoning zero-interest-rate policy (ZIRP) as somehow job-creative. (Fed Funds rates dropped to 0% by the end of 2008, where they have remained since.) We are left with a regulatory policy of pretend. Rather than re-instating Glass-Steagall to divide commercial from investment banking and insurance activity, thereby removing the platform of government (or public) supported speculation and expansion, props leaders that pretend linguistic tweaks are a match for financial might. We have no leader that will take on Jamie Dimon, Chairman of the country’s largest bank, JPM Chase, who can devote 15% of the capital of JPM Chase, which remains backstopped by customer deposit insurance, to bet on the direction of potential corporate defaults, and slide by two Congressional investigations like walks in the park. ....... Over at AmericaBlog John Aravosis explains how the Red Cross had to divert staff to deal with Romney’s phony “relief effort” As we warned earlier, because the Romney campaign preferred a political stunt to actually helping Hurricane Sandy victims, the Red Cross is now busy wasting valuable resources processing donations from the Romney campaign that its own Web site admits it does not want. As you’ll recall, Mitt Romney, after promising not to campaign today, campaigned anyway. And to add insult to injury, he used the pretense of Hurricane Sandy to hold campaign events wrapped in a cloak of “storm relief.” Not surprisingly, Romney then turned his “relief” events today into what the campaign called “victory rallies,” including a Romney campaign propaganda video and the distribution of t-shirts saying “Obama, You’re Fired!” ..... In fact, Mitt Romney used the suffering of millions of Americans as a shield to fend off criticism that this was a political event. But it was a political event, as countless reporters attested. (And it was more than a shield. He used people. He used their suffering to advance his own ambition. And he got caught.) The other way that Romney attempted to camouflage his campaign event as a “relief effort” was by, yet again, asking people to bring donations of supplies that the Red Cross has said repeatedly it does not want, and in fact, they’ve said it will impede hurricane relief efforts. And I quote from the Red Cross Web site:
    Unfortunately, due to logistical constraints the Red Cross does not accept or solicit individual donations or collections of items. Items such as collected food, used clothing and shoes must be sorted, cleaned, repackaged and transported which impedes the valuable resources of money, time, and personnel.
And that’s what happened as a result of Mitt Romney’s little hurricane stunt earlier today. We learn via a tweet from CNN’s Jim Acosta that the Red Cross is now having to spend staff time dealing with the collected food and other items the Romney campaign gathered today: [.....] .... The Red Cross outright told anyone else doing what Romney did today, to collect financial donations or blood – not supplies. It was a subtle rebuke to the Romney campaign, and an effort by the Red Cross to undo the damage Romney has already done in sending the message to the American people that the Red Cross needs us to donate food, when they don’t, and it will actually hurt their relief efforts by diverting necessary manpower. And that is exactly what happened today, now that the Red Cross is having to “work with the Romney campaign to process this donation of supplies,” instead of focusing on the actual victims of Hurricane Sandy who need their help in the eastern United States.
MORE MITT HEADROOM PREVARICATIONS: Christian Science Monitor runs Reuters' Bernie Woodall Jeep not moving to China, Mr. Romney Jeep is not moving to China and out of the United States, Chrysler executives reaffirmed Tuesday after it became an issue in the US presidential campaign. Mitt Romney said that Chrysler was thinking about moving all Jeep production from Ohio to China during a rally last week. Chrysler Group LLC Chief Executive Sergio Marchionne reaffirmed on Tuesday that the company is not moving Jeep vehicle production out of the United States to China after it became an issue in the U.S. presidential campaign. Chrysler in an Oct. 25 blog post had already rejected a statement made that day to a crowd in Ohio by Republican presidential candidate Mitt Romney, that Chrysler was thinking of moving all Jeep production from Ohio to China. Marchionne told employees by email on Tuesday, "I feel obliged to unambiguously restate our position: Jeep production will not be moved from the United States to China." Romney, speaking last week to a crowd in Defiance, Ohio, said that he had read a news article that said Chrysler's Jeep brand is considering moving "all production to China." Later, the Romney campaign aired an advertisement that did not repeat the move of production from Ohio but said that Chrysler is considering making Jeeps in China, which Chrysler has said. U.S. President Barack Obama's campaign, in its own ad, said Romney was making a "false claim" and noted that Chrysler had challenged Romney's statement. ..... Romney's ad and his comments in Defiance state that Chrysler has been taken over by an Italian company. Chrysler is based in Auburn Hills, Michigan, outside Detroit. Defiance is about an hour's drive to the a main Jeepplant in Toledo, Ohio. .... "We will invest more than $1.7 billion to develop and produce the next-generation Jeep SUV, the successor of theJeep Liberty -- including $500 million directly to tool and expand our Toledo Assembly Complex and will be adding about 1,100 jobs on a second shift by 2013," his email to employees said. Marchionne said that Chrysler, including Jeep, has added 11,200 jobs in the United States since 2009. "Jeep assembly lines will remain in operation in the United States and will constitute the backbone of the brand," said Marchionne in the email. "It is inaccurate to suggest anything different." As Greg Palast explains in The Nation Mitt Romney's Bailout Bonanza .... Romney has done a good job of concealing, until now, the fact that he and his wife, Ann, personally gained at least $15.3 million from the bailout—and a few of Romney’s most important Wall Street donors made more than $4 billion. Their gains, and the Romneys’, were astronomical—more than 3,000 percent on their investment. .... Delphi, once the Delco unit of General Motors, was spun off into a separate company in 1999. Alone, Delphi foundered, declaring bankruptcy in 2005, after which vulture hedge funds, led by Silver Point Capital, began to buy up the company’s old debt. Later, as the nation’s financial crisis accelerated, Singer’s Elliott bought Delphi debt, as did John Paulson & Co. John Paulson, like Singer, is a $1 million donor to Romney. Also investing was Third Point, run by Daniel Loeb, who was once an Obama supporter but who this summer hosted a $25,000-a-plate fundraiser for Romney and personally donated about $500,000 to the GOP. As Delphi was in bankruptcy, making few payments, the bonds were junk, considered toxic by the banks holding them. The hedge funds were able to pick up the securities for a song; most of Elliott’s purchases cost just 20 cents on the dollar of their face value. By the end of June 2009, with the bailout negotiations in full swing, the hedge funds, under Singer’s lead, used their bonds to buy up a controlling interest in Delphi’s stock. According to SEC filings, they paid, on average, an equivalent of only 67 cents per share. Just two years later, in November 2011, the Singer syndicate took Delphi public at $22 a share, turning an eye-popping profit of more than 3,000 percent. ..... Yet without taking billions in taxpayer bailout funds—and slashing worker pensions—the hedge funds’ investment in Delphi would not have been worth a single dollar, according to calculations by GM and the US Treasury. Altogether, in direct and indirect payouts, the government padded these investors’ profits handsomely. The Treasury allowed GM to give Delphi at least $2.8 billion of funds from the Troubled Asset Relief Program (TARP) to keep Delphi in business. GM also forgave $2.5 billion in debt owed to it by Delphi, and $2 billion due from Singer and company upon Delphi’s exit from Chapter 11 bankruptcy. The money GM forgave was effectively owed to the Treasury, which had by then become the majority owner of GM as a result of the bailout. Then there was the big one: the government’s Pension Benefit Guaranty Corporation took over paying all of Delphi’s retiree pensions. The cost to the taxpayer: $5.6 billion. The bottom line: the hedge funds’ paydays were made possible by a generous donation of $12.9 billion from US taxpayers. ..... Romney has slammed the bailout as a payoff to the auto workers union. But that certainly wasn’t true for the bailout of Delphi. Once the hedge funders, including Singer—a deep-pocketed right-wing donor and activist who serves as chair of the conservative, anti-union Manhattan Institute—took control of the firm, they rid Delphi of every single one of its 25,200 unionized workers. He might be right if we all simply choose to vote and go home, but voting is just the least we can do. Frankly, as you read the Hedges article on the air, I also kept thinking of your words: “unless you’re a member of a targeted group, Fascism isn’t so bad.” You see, I do live in this nation as a member of a targeted group. ...... Yes. Obama is a corporatist. Yes. Yes. Yes. Sorry Mr. Hedges is so disappointed. Me too. But the New Gilded Age didn’t happen overnight and it isn’t going away overnight either. But unless Mr. Hedges is advocating bloody revolution to overthrow this corporate oppression, his “protest vote” seems more like political equivalent of “the mouse that roared.” You know me, Mike.     The directive, issued Friday, lays out the requirements for submitting a provisional ballot. The directive includes a form which puts the burden on the voter to correctly record the form of ID provided to election officials. Husted also instructed election officials that if the form is not filled out correctly by a voter, the ballot should not be counted.
In other words, not only does the state get to put a pain in the voter's ass about the ID, the voter also now has to function as his own election official and as a de facto recording secretary, or his vote doesn't count. ...... Jon Husted hasn't been merely a clumsy partisan (see: Harris, Katherine), and he hasn't simply been a bureaucratic weasel, although he undeniably has been one of those. He has actively, publicly defied the courts, over and over again. Purely out of partisan spite, Husted is draining of public credibility whatever the official result of the election in Ohio turns out to be. This isn't partisan vandalism. It's partisan arson. Next Jim Hightower tells us about Romney's Halloween trick on Ohio voters If you really want to scare people this Halloween, go trick-or-treating dressed as an Ohio voting machine. The "black box" e-vote machines that Ohioans will use on November 6 are owned by Hart Intercivic – but that disguises the real owner. Last year, Hart was taken over by an investment fund with the cryptic name of HIG Capital. Peek into HIG, and you'll find that of its 22 American directors, 21 are donors to Mitt Romney's campaign, and a third of them had been money managers at Bain & Company, the hedge fund that gave Mitt his start in corporate plundering. But the enigma within Ohio's machines goes even deeper than these cozy partisan ties suggest, for HIG itself is largely owned by an inscrutable private equity creature called Solomere. Who dat? Solomere was formed by Romney's oldest son, Tagg, and financed by Mama Ann Romney and Uncle Scott Romney, with Papa Mitt himself chipping in $10 million and personally pitching Solomere to other rich investors. Like father, like son – Tagg cloaks the fund's operations through a dark maze of offshore tax shelters. And, now, the son has slipped out of Solomere to be a top campaign manager for his father. OUR LAST WORD goes to Charlie Pierce at Esquire Why I'm Voting to Re-Elect President Obama Because I am going to be in Florida on Election Day, I am voting this morning here in the Commonwealth (God save it!). There is only one vote that I am casting with any measurable amount of enthusiasm. That is the vote I am casting for Elizabeth Warren to be my next United States senator. ..... I am also going to vote for Barack Obama. Without enthusiasm. And without a sliver of a doubt in my mind. ...... However, I am casting my vote for him (again) because of something that Dr. Jill Stein said the other night on TV, when she was being interviewed in the wake of that third-party candidates debate that Larry King hosted. I've known Jill socially for some time, and I admire her, and I agree with her on a marginally greater percentage of the issues than I do with the president. I think a lot of the snark aimed her way is unjustified. She's not responsible for the wankerific fantasies of renegade "progressives." I do not, however, think she is any more likely to become president — or any more qualified to be president — than I am. ......... listening to Stein talk about the glories of the "Green New Deal" she's going to pass through a Congress that is unlikely to differ much one way or the other from the one we have now, well, that makes Barack Obama sound like Huey Long. Still, I thought long and hard about tossing her my vote, because I live in the bluest of blue states, and I felt that, in casting my vote that way, I would absolve myself of complicity in the drone strikes, and in the inexcusable pass given to the Wall Street pirates, and in what I am sure is going to be an altogether dreadful Grand Bargain while not materially damaging the most important cause of all: making sure that Willard Romney is not president. And I might have done it, had Jill not gone on TV and talked about how those people who are voting for the incumbent president simply to make sure that Willard Romney is not president are doing so out of "fear." Horse hockey. It is not fear. It is simple, compelling logic. We have two major political parties. Until that great gettin'-up morning, when purists on both sides of the ideological ditch manage to create workable third parties that look like something more substantial than organized unicorn hunts — which won't happen until we have proportional voting, and I wish you as much luck with that as Lani Guinier had — we always will have two major political parties. One of them is inexcusably timid and tied in inexcusably tight with the big corporate money. The other one is demented. This is not "fear" talking. I watched the Republican primaries. I went to the debates. I saw long-settled assumptions about the nature of representative democracy thrown down and danced upon. I heard long-established axioms of the nature of a political commonwealth torn to shreds and thrown into the perfumed air. I saw people seriously arguing for an end to the social safety net, to any and all federal environmental regulations, to the concept of the progressive income tax, and to American participation in the United Nations, the latter on the grounds that a one-world government threatens our "liberty" with its insurance-friendly national health-care reform bill. I saw Rick Santorum base his entire foreign policy on the legend of the 12th Imam, and I saw Herman Cain and Michele Bachmann actually be front-runners for a while. I saw all of this and I knew that each one of them had a substantial constituency behind them within the party for everything they said, no matter how loopy. When you see a lunatic wandering down the sidewalk, howling at the moon and waving a machete, it is not fear that makes you step inside your house and lock the door. It is the simple logic of survival. Fear is what keeps you from trying to tackle the guy and wrestle the machete away from him. And, as much as it may pain some people to admit it, the president is the only one stepping up to do that at the moment. It is vitally important that the Republican party be kept away from as much power as possible until the party regains its senses again. It is not just important to the advance of progressive goals, thought it is. It is not just important to maintain the modicum of social justice that it has taken eighty years to build into the institutions of our government, though it is. It is important, too, that that you vote for one of these men based on whom else, exactly, he owes. Who is it that's going to come with the fiddler to collect when you get what you've bargained for? ........ On the other hand, Willard Romney owes even more to the Wall Street crowd, and he owes even more to the military, but he also owes everything he is politically to the snake-handlers and the Bible-bangers, to the Creationist morons and to the people who stalk doctors and glue their heads to the clinic doors, to the reckless plutocrats and to the vote-suppressors, to the Randian fantasts and libertarian fakers, to the closeted and not-so-closeted racists who have been so empowered by the party that has given them a home, to the enemies of science and to the enemies of reason, to the devil's bargain of obvious tactical deceit and to the devil's honoraria of dark, anonymous money, and, ultimately, to those shadowy places in himself wherein Romney sold out who he might actually be to his overweening ambition. It is a fearsome bill to come due for any man, let alone one as mendaciously malleable as the Republican nominee. Obama owes the disgruntled. Romney owes the crazy. And that makes all the difference. ..... This is not "fear" talking. This is simply the way things are. It is important to stand against the people and the forces to which Willard Romney owes his political career. It is more important to do that than it is to do anything else. It is more important to do that than to salve my conscience, or make a statement, or dream my wistful dreams of a better and more noble politics. And that is why, today, I will vote for Barack Obama, not because of the man he is not, but because of the man his opponent clearly has become. I will do so without enthusiasm, and without a sliver of doubt in my mind. Well said Charlie! And Tara too! Over the last many months we at Brick TeeVee have pointed out the Klown Kar the GOPher primaries were, who could out-krazy who, who was more anti-abortion, a bigger climate-change denier to who wanted even more guns on the street and more deregulation and more war. The fact-checkers have worked overtime to keep up with the prevarications of the Romney/Ryan campaign's tax "plan" among other daily diatribes coming from that kamp amid the down-ticket GOPher War On Women who carelessly toss out that “if it’s a legitimate rape, the female body has ways to try to shut that whole thing down” while the GOPher Platform plank opposes all abortions "seeking a constitutional amendment that would ban abortions with no exceptions for rape, incest, or danger to the life of a pregnant woman". We had to laugh when we saw the U.S. Chamber of Commerce's ad saying Ohio Senator Sherrod Brown voted AGAINST 91% of the Chamber's initiatives! That one ad BACKFIRED and put us solidly in the Sherrod Brown column! What has NOT been mentioned by the Dems in their campaign ads is the GOPher-controlled Do-Nothing Congress openly admitting "The single most important thing we want to achieve is for President Obama to be a one-term president." while who is to blame for Gridlock in Congress? Blame the GOP sez CNN's Julian Zelizer while Bob Cesca explains at HuffPoAOL Republicans Filibuster Everything, Romney Blames Obama for Not Working With Congress Republicans proceeded to rack up the highest number of filibusters in American history. During the president's first two years in office, the 111th Congress, there were 137 cloture motions filed to end Republican filibusters. During the president's second two years, the 112th Congress, there were 109 motions filed to end Republican filibusters and we still have a few more months to go. 246 total cloture motions. Compare this to George W. Bush's first term when there were a total of 133 cloture motions filed. Not even a handful of "sensible" Republicans had the guts to break ranks and vote with the Democrats. Meanwhile, on the House side, the Republican majority has voted in near-lockstep against almost everything. Click over to see just a partial list of what bills the Rethuglicans filibustered! In short we concur with Charlie and Tara: We'd rather be in the slowly-boiling pot than be thrown into the fire. As Charlie succinctly put it "Romney owes the crazy.     Lawmakers concerned about the health effects on humans from mountaintop removal coal mining set forth legislation in the U.S. House of Representatives today. Representatives Dennis Kucinich (OH), Louise Slaughter (NY), Maurice Hinchey (NY), Earl Blumenauer (OR), Lucille Roybal-Allard (CA), John Yarmuth (KY), Lynn Woolsey (CA), Judy Chu (CA), Raúl Grijalva (AZ), James Moran (VA), Michael Honda (CA), John Conyers (MI), and Keith Ellison (MN) introduced the Appalachian Communities Health Emergency (ACHE) Act H.R. 5959 which would place a moratorium on permitting for mountaintop removal coal mining until health studies are conducted by the Department of Health and Human Services. The ACHE coalition presently consists of participants from Coal River Mountain Watch, Mountain Health and Heritage Association, and Christians for the Mountains. “We encourage you, if you’re concerned about mountaintop removal’s effect on your community’s health, to join us in making your voice heard,” said Allen Johnson, executive director of Christians for the Mountains. “Please contact us, learn about the issue, and take action to protect your community.”
