It’s beginning to look as if JPMorgan Chase has had a hand in every major banking scandal of the last decade. In fact, it’s the Zelig of Wall Street crime. Take a snapshot of any major bank fraud and chances are you’ll see JPMorgan Chase staring out at you from the frame. Foreclosure fraud, investor fraud, cheating customers, market manipulation, LIBOR … and now, the coup de grâce to JPM’s tattered reputation: a $2 billion fine for closing its eyes and covering up as Bernie Madoff literally bilked widows and orphans, along with a lot of other families and charities. (Here’s a list of investors.) Does Jamie Dimon, the bank’s CEO, still think people don’t say enough nice things about him? Do his friends? More importantly, how does the largest bank in the country (measured in assets) get away with being worse than Enron? That one’s easy: By being the largest bank in the country. .............. There’s no question about it: JPMorgan Chase is worse than Enron. It’s true that Enron’s energy market manipulations were horrible. Enron executives and employees deprived people of their life savings, drove up the price of a vital public utility, and concealed their crimes with all the wiliness of history’s worst master conspirators. But JPMorgan Chase did everything Enron did – and much, much more. Consider: .............. All in all, JPMorgan Chase has paid $20 billion in fines in the last year alone. But none of these fines were personally charged to the executives who committed the crimes. Instead, they were paid by shareholders – some of whom were also bilked by the executives in question. What’s more, most (if not all) of these fines are tax-deductible. That means that taxpayers will take a hit for JPM’s criminality. Even the Enron guys didn’t think of that. Do some good people work at JPMorgan Chase? Of course. I have a couple friends there myself, and they’re honorable people. But they’re living in a nest of fraudsters. Either CEO Dimon thinks that’s just fine, or he’s not competent enough to clean the place out and should be fired forthwith. It’s who you know … How does the JPM Gang get away with all of this fraud? Koch-Backed Political Coalition, Designed to Shield Donors, Raised $400 Million in 2012 The political network spearheaded by conservative billionaires Charles and David Koch has expanded into a far-reaching operation of unrivaled complexity, built around a maze of groups that cloaks its donors, according to an analysis of new tax returns and other documents. The filings show that the network of politically active nonprofit groups backed by the Kochs and fellow donors in the 2012 elections financially outpaced other independent groups on the right and, on its own, matched the long-established national coalition of labor unions that serves as one of the biggest sources of support for Democrats. The resources and the breadth of the organization make it singular in American politics: an operation conducted outside the campaign finance system, employing an array of groups aimed at stopping what its financiers view as government overreach. Members of the coalition target different constituencies but together have mounted attacks on the new health-care law, federal spending and environmental regulations. Key players in the Koch-backed network have already begun engaging in the 2014 midterm elections, hiring new staff members to expand operations and strafing House and Senate Democrats with hard-hitting ads over their support for the Affordable Care Act. Its funders remain largely unknown; the coalition was carefully constructed with extensive legal barriers to shield its donors. But they have substantial firepower. Together, the 17 conservative groups that made up the network raised at least $407 million during the 2012 campaign, according to the analysis of tax returns by The Washington Post and the Center for Responsive Politics, a nonpartisan group that tracks money in politics. ............... The system involved roughly a dozen limited-liability companies with cryptic, alphabet-soup names such as SLAH LLC and ORRA LLC, and entities that dissolved and reappeared under different monikers. Lloyd Hitoshi Mayer, a University of Notre Dame Law School professor who studies the tax issues of politically active nonprofits, said he has never seen a network with a similar design in the tax-exempt world. “It is a very sophisticated and complicated structure,” said Mayer, who examined some of the groups’ tax filings. “It’s designed to make it opaque as to where the money is coming from and where the money is going. No layperson thought this up. It would only be worth it if you were spending the kind of dollars the Koch brothers are, because this was not cheap.” .............It is unclear how much of the network’s funds came directly from the Kochs, who head Koch Industries, one of the largest privately held companies in the country. The brothers, who fund a host of libertarian think tanks and advocacy groups, are heralded on the right and pilloried on the left for their largess. While “the Koch network” has become a shorthand in political circles, the coalition is financed by a large pool of other conservative donors as well, according to people who participate in the organization. ........... At The New Yorker Lawrence Wright explains The Al Qaeda Switchboard .......... Last month, two federal judges came to opposing conclusions about these issues. On December 16th, Judge Richard J. Leon, in Washington, D.C., ruled that the indiscriminate hoarding violates the Fourth Amendment right to privacy and its prohibition of unreasonable searches. Two weeks later, in New York, Judge William H. Pauley III ruled that the metadata-collection program was lawful and effective. Judge Pauley invoked the example of Khalid al-Mihdhar, a Saudi jihadist who worked for Al Qaeda. On 9/11, he was one of the five hijackers of American Airlines Flight 77, which crashed into the Pentagon. In early 2000, Mihdhar made seven calls from San Diego to an Al Qaeda safe house in Yemen. According to Pauley, the N.S.A. intercepted the calls, but couldn’t identify where Mihdhar was calling from. Relying on testimony by Robert Mueller, the former director of the F.B.I., Pauley concluded that metadata collection could have allowed the bureau to discover that the calls were being made from the U.S., in which case the bureau could have stopped 9/11. If he is right, advocates of extensive monitoring by the government have a strong case. But the Mihdhar calls tell a different story about why the bureau failed to prevent the catastrophe. The C.I.A. withheld crucial intelligence from the F.B.I., which has the ultimate authority to investigate terrorism in the U.S. and attacks on Americans abroad. ........ Judge Pauley cites the 9/11 Commission Report for his statement that telephone metadata “might have permitted the N.S.A. to notify the [F.B.I.] of the fact that al-Mihdhar was calling the Yemeni safe house from inside the United States.” What the report actually says is that the C.I.A. and the N.S.A. already knew that Al Qaeda was in America, based on the N.S.A.’s monitoring of the Hada phone. If they had told the F.B.I., the agents would have established a link to the embassy-bombings case, which “would have made them very interested in learning more about Mihdhar.” Instead, “the agents who found the source were being kept from obtaining the fruits of their work.” ........... Yes, the F.B.I. could have stopped 9/11. It had a warrant to establish surveillance of everyone connected to Al Qaeda in America. It could follow them, tap their phones, clone their computers, read their e-mails, and subpoena their medical, bank, and credit-card records. It had the right to demand records from telephone companies of any calls they had made. There was no need for a metadata-collection program. What was needed was coöperation with other federal agencies, but for reasons both petty and obscure those agencies chose to hide vital clues from the investigators most likely to avert the attacks. .......... DEEPWATER HORIZON UPDATE: At BBC News BP loses bid over Gulf oil payouts BP has lost an appeal to cancel the terms of its multi-billion-dollar settlement with businesses over the 2010 Gulf of Mexico oil spill disaster. A US federal appeals court on Saturday upheld the terms of the original 2012 settlement. The UK oil giant has supported compensation for businesses harmed by the disaster. But it argued that the terms of the existing deal meant that some huge sums were being paid for false claims. ......... On Friday, the US Circuit Court of Appeals ruled the original judge, Carl Barbier, did not err by failing to determine whether the class of eligible claimants included individuals who haven't actually suffered any injury. It means that the UK oil giant may have to pay out much more than it originally thought it would have to. BP originally projected that the settlement would cost $7.8bn (£4.8bn) but last year increased its estimate to $9.6bn. BP has faced about $42.4bn in criminal and civil charges since the disaster.

FREEDOM INDUSTRIES WEST VIRGINIA CHEM SPILL: At Reuters Ann Moore reports West Virginia chemical spill triggers tap water ban Up to 300,000 West Virginia residents were told not to drink tap water on Friday after a chemical spill called its safety into question, and health officials said water in the affected area should only be used for flushing toilets and fighting fires. "We don't know that the water's not safe, but I can't say it is safe," Jeff McIntyre, president of West Virginia American Water Co, told a televised news conference. The company runs the state's largest water treatment plant. Governor Earl Ray Tomblin declared a state of emergency for nine counties, and President Barack Obama issued an emergency declaration on Friday. The spill forced the closure of schools and businesses in the state capital. Tests were being done on the water, McIntyre said, but he could not say when it would be declared safe for normal use. The spill of 4-Methylcyclohexane Methanol, or Crude MCHM, a chemical used in the coal industry, occurred on Thursday on the Elk River in Charleston, West Virginia's capital and largest city, upriver from the plant run by West Virginia American Water. Water carrying this chemical has an odor like licorice or anise, McIntyre said. he chemical is not highly lethal, but since the company does not regularly see it as a contaminant, the level that could be considered safe has yet to be quantified, McIntyre said. A company spokeswoman said the chemical could be harmful if swallowed and could cause skin and eye irritation. The spill originated at Freedom Industries, a Charleston company that produces specialty chemicals for the mining, steel and cement industries. .............. The Kanawha-Charleston and the Putnam County Health Departments ordered the closure of all restaurants and schools receiving water from the West Virginia American Water company. Schools also were closed in many counties, including Boone, Cabell, Clay, Jackson, Kanawha, Lincoln, Pocahontas and Putnam. The spill was discovered after the West Virginia Department of Environmental Protection received a report of a strange odor on Thursday morning and visited the Freedom Industries site, where they found a leaking storage unit, a spokeswoman for Governor Tomblin said. The West Virginia chemical spill occurred when a compound called 4-methylcyclohexane methanol leaked from a hole in the bottom of a storage tank, Thomas Aluise, a WVAW spokesman told the New York Times. The liquid then filled a container designed to contain leaks before flowing into the Elk River, about a mile north of a water treatment plant. What is 4-methylcyclohexane methanol? The compound involved in the West Virginia chemical spill is used to rid coal of impurities before it is burned to generate power. "Short version – it is used in removing some sulfur from coal," David Bayless, director of Ohio University's Ohio Coal Research Center, wrote in an e-mail to the Monitor. "That is a separation process ... usually done at the mine before the coal is shipped to the utility to burn." How does that work? Coal straight from the mine brings with it various types of shale, clay, and impurities. To burn it more efficiently and with less pollution, the energy-dense coal must be separated from its associate waste. One method is coal washing, which leverages natural differences in density to separate coal from the sulfur, ash, and rock that we'd rather not burn. The raw material is ground up into tiny chunks, sorted, and initially screened for impurities. Then a fluid (often water) is pulsed upward through a bed of crushed coal and its impurities. Lighter coal particles rise to the top of the slurry, while the heavier impurities fall and are removed from the bottom. The purified coal is then dried in a final preparation process before being shipped off to the power plant. Water alone is not enough to purify coal. Chemicals like 4-methylcyclohexane methanol are added to create a frothy, heavy consistency that enhances the process. Is it dangerous? Officials say the West Virginia chemical is not lethally toxic. It is considered potentially harmful if swallowed or inhaled and can cause eye and skin irritation. There had been no official reports of hospitalizations or fatalities as of midday Friday.

Chemical levels in West Virginia water drop, but still no end in sight to ban The level of odorous chemical in West Virginians' water dropped Friday, but not enough for authorities to lift a warning to avoid drinking, cooking or bathing with it or to give a clear idea as to when things will change. Gov. Earl Ray Tomblin described the situation in nine counties Friday night as "pretty bad," both for residents being told the only thing they should do with their running water is flush their toilets and schools, restaurants, hotels and other businesses forced to close. One bit of good news is tests on the affected water supply, which are being conducted on an hourly basis, show "the chemical level is declining." "But we're just not sure exactly how long it's going to take before it's acceptable to lift the do-not-drink ban," the governor told CNN. ....... West Virginia American Water's president Jeff McIntyre said Friday he didn't believe the substance -- 4-methylcyclohexane methanol -- was still flowing. But that doesn't mean the situation will be resolved soon. "It is not intended to be in the water (or) distribution system," McIntyre said. "... Once it's in there, there's no more treatment for it." ........ Daniel Stewart sued the water utility and Freedom Industries, saying his kidney transplant surgery was canceled because of the ordeal "forcing (him) to undergo dialysis, pain and suffering and continued illness due to his renal failure and other medical damages." West Virginia American Water "failed to maintain an appropriate emergency response plan," Stewart claimed, while Freedom "failed to properly maintain and store its chemicals." A lawsuit was filed Friday by a man whose scheduled kidney transplant was canceled due to the water issue, said attorney Jesse Forbes said. ........

And CNN's Tom Watkins and Ralph Ellis follow up with this report Sunday Official: No quick fix for West Virginia water woes West Virginia's water crisis won't end any time soon, officials said Saturday. Testing must be completed to determine whether chemicals from a leak are still contaminating the water system in nine counties in the southwest section of the state, West Virginia American Water President Jeff McIntyre told reporters Saturday. That means the do-not-use order issued Thursday won't be lifted for days, he said. Some 300,000 West Virginia residents, in the meantime, still won't be able to use tap water to wash hands, brush teeth or take showers. They're being urged to watch for symptoms of exposure to the chemical, such as skin irritation, nausea, vomiting and wheezing. Homeland Security is trucking in 16 tractor-trailer loads of bottled water to help. ......... Officials will know that the water is safe for more than firefighting and toilet flushing -- its only sanctioned uses now -- when tests find less than 1 ppm of 4-methylcyclohexane methanol in treated water, McIntyre said.
Four laboratories have been set up to measure the levels in a uniform manner. "The treatment plant must consistently produce samples at or below this level before the current do-not-use order is lifted," McIntyre said. He said there was an inadequate number of sampling results to report current levels. ......... Mike Dorsey, chief of the Department of Environmental Protection's homeland security and emergency response division, said officials estimate that 7,500 gallons -- the equivalent of about 10 hot tubs that can accommodate eight people each -- leaked through a one-inch hole in the tank's stainless steel wall. "It's an old system," he said about the physical plant, adding that the company had planned to upgrade it. ......... The chemical overflowed a containment area around the tank run by Freedom Industries, then migrated over land and through the soil into the river. The leak happened about a mile upriver from the West Virginia American Water Co. plant. After concluding late Thursday afternoon that the tap water was contaminated, a stop-use warning went out to customers in Boone, Cabell, Clay, Jackson, Kanawha, Lincoln, Logan, Putnam and Roane counties. Since then, the offending material has been hauled from the site, officials said. Some residents have directed their anger at the coal industry company from whose storage tank the chemical leaked. "It's caused us more problems than you could ever imagine," said Danny Jones, the mayor of Charleston, the state's capital and most populated city. "It's a prison from which we would like to be released." .......... An investigative team from the U.S. Chemical Safety Board on Saturday deployed to the scene of the spill. The CSB is an independent federal agency charged with investigating industrial chemical accidents. Freedom Industries President Gary Southern said two Freedom employees noticed material leaking from a storage tank into a dike around 10:30 a.m. Thursday. They contacted authorities and began the cleanup process -- including hauling away the chemical still in the tank and vacuuming up some from the nearby ground, he said. "We have mitigated the risk, we believe, in terms of further material leaving this facility," said the head of Freedom, which supplies products for the coal-mining industry. West Virginia American Water's McIntyre had a different take, as evidenced by the company's unprecedented stop-use warning: "We don't know that the water is not safe, but I can't say it is safe."

The state’s wholesale intrusion into our lives and obliteration of privacy are now facts. And the challenge to us—one of the final ones, I suspect—is to rise up in outrage and halt this seizure of our rights to liberty and free expression. If we do not do so we will see ourselves become a nation of captives. The public debates about the government’s measures to prevent terrorism, the character assassination of Edward Snowden and his supporters, the assurances by the powerful that no one is abusing the massive collection and storage of our electronic communications miss the point. Any state that has the capacity to monitor all its citizenry, any state that has the ability to snuff out factual public debate through control of information, any state that has the tools to instantly shut down all dissent is totalitarian. Our corporate state may not use this power today. But it will use it if it feels threatened by a population made restive by its corruption, ineptitude and mounting repression. The moment a popular movement arises—and one will arise—that truly confronts our corporate masters, our venal system of total surveillance will be thrust into overdrive. ............ The goal of wholesale surveillance, as Arendt wrote in “The Origins of Totalitarianism,” is not, in the end, to discover crimes, “but to be on hand when the government decides to arrest a certain category of the population.” And because Americans’ emails, phone conversations, Web searches and geographical movements are recorded and stored in perpetuity in government databases, there will be more than enough “evidence” to seize us should the state deem it necessary. This information waits like a deadly virus inside government vaults to be turned against us. It does not matter how trivial or innocent that information is. In totalitarian states, justice, like truth, is irrelevant. The object of efficient totalitarian states, as George Orwell understood, is to create a climate in which people do not think of rebelling, a climate in which government killing and torture are used against only a handful of unmanageable renegades. The totalitarian state achieves this control, Arendt wrote, by systematically crushing human spontaneity, and by extension human freedom. It ceaselessly peddles fear to keep a population traumatized and immobilized. It turns the courts, along with legislative bodies, into mechanisms to legalize the crimes of state. ....... The corporate state, in our case, has used the law to quietly abolish the Fourth and Fifth amendments of the Constitution, which were established to protect us from unwarranted intrusion by the government into our private lives. The loss of judicial and political representation and protection, part of the corporate coup d’état, means that we have no voice and no legal protection from the abuses of power. ............. The corporate forces behind inverted totalitarianism do not, as classical totalitarian movements do, replace decaying structures with new structures. They instead purport to honor electoral politics, freedom of expression and the press, the right to privacy and the guarantees of law. But they so corrupt and manipulate electoral politics, the courts, the press and the essential levers of power as to make genuine democratic participation by the masses impossible. The U.S. Constitution has not been rewritten, but steadily emasculated through radical judicial and legislative interpretation. We have been left with a fictitious shell of democracy and a totalitarian core. And the anchor of this corporate totalitarianism is the unchecked power of our systems of internal security. Our corporate totalitarian rulers deceive themselves as often as they deceive the public. Politics, for them, is little more than public relations. Lies are told not to achieve any discernable goal of public policy, but to protect the image of the state and its rulers. Good-bye 2013! Hello 2014! We're sure you've read your share of highlights of The Year 2013 so we won't bore you with our own "list" - just skim through all our past posts from 2013! And besides, our list would only have one entry: Edward Snowden! So let's begin the New Year 2014 with this New York Tiimes op-ed published December 31, 2013 by Michael Moore who explains The Obamacare We Deserve TODAY marks the beginning of health care coverage under the Affordable Care Act’s new insurance exchanges, for which two million Americans have signed up. Now that the individual mandate is officially here, let me begin with an admission: Obamacare is awful. That is the dirty little secret many liberals have avoided saying out loud for fear of aiding the president’s enemies, at a time when the ideal of universal health care needed all the support it could get. Unfortunately, this meant that instead of blaming companies like Novartis, which charges leukemia patients $90,000 annually for the drug Gleevec, or health insurance chief executives like Stephen Hemsley of UnitedHealth Group, who made nearly $102 million in 2009, for the sky-high price of American health care, the president’s Democratic supporters bought into the myth that it was all those people going to get free colonoscopies and chemotherapy for the fun of it. ......... When right-wing critics “expose” the fact that President Obama endorsed a single-payer system before 2004, they’re actually telling the truth. What we now call Obamacare was conceived at the Heritage Foundation, a conservative think tank, and birthed in Massachusetts by Mitt Romney, then the governor. The president took Romneycare, a program designed to keep the private insurance industry intact, and just improved some of its provisions. In effect, the president was simply trying to put lipstick on the dog in the carrier on top of Mitt Romney’s car. And we knew it. By 2017, we will be funneling over $100 billion annually to private insurance companies. You can be sure they’ll use some of that to try to privatize Medicare. ............ For many people, the “affordable” part of the Affordable Care Act risks being a cruel joke. The cheapest plan available to a 60-year-old couple making $65,000 a year in Hartford, Conn., will cost $11,800 in annual premiums. And their deductible will be $12,600. If both become seriously ill, they might have to pay almost $25,000 in a single year. (Pre-Obamacare, they could have bought insurance that was cheaper but much worse, potentially with unlimited out-of-pocket costs.) And yet — I would be remiss if I didn’t say this — Obamacare is a godsend. My friend Donna Smith, who was forced to move into her daughter’s spare room at age 52 because health problems bankrupted her and her husband, Larry, now has cancer again. As she undergoes treatment, at least she won’t be in terror of losing coverage and becoming uninsurable. Under Obamacare, her premium has been cut in half, to $456 per month. Let’s not take a victory lap yet, but build on what there is to get what we deserve: universal quality health care. ........... Planet likely to warm by 4C by 2100, scientists warn Temperature rises resulting from unchecked climate change will be at the severe end of those projected, according to a new scientific study. The scientist leading the research said that unless emissions of greenhouse gases were cut, the planet would heat up by a minimum of 4C by 2100, twice the level the world's governments deem dangerous. The research indicates that fewer clouds form as the planet warms, meaning less sunlight is reflected back into space, driving temperatures up further still. The way clouds affect global warming has been the biggest mystery surrounding future climate change. Professor Steven Sherwood, at the University of New South Wales, in Australia, who led the new work, said: "This study breaks new ground twice: first by identifying what is controlling the cloud changes and second by strongly discounting the lowest estimates of future global warming in favour of the higher and more damaging estimates." "4C would likely be catastrophic rather than simply dangerous," Sherwood told the Guardian. "For example, it would make life difficult, if not impossible, in much of the tropics, and would guarantee the eventual melting of the Greenland ice sheet and some of the Antarctic ice sheet", with sea levels rising by many metres as a result. The research is a "big advance" that halves the uncertainty about how much warming is caused by rises in carbon emissions, according to scientists commenting on the study, published in the journal Nature. .......... "Climate sceptics like to criticise climate models for getting things wrong, and we are the first to admit they are not perfect," said Sherwood. "But what we are finding is that the mistakes are being made by the models which predict less warming, not those that predict more." He added: "Sceptics may also point to the 'hiatus' of temperatures since the end of the 20th century, but there is increasing evidence that this inaptly named hiatus is not seen in other measures of the climate system, and is almost certainly temporary." .......... Sherwood accepts his team's work on the role of clouds cannot definitively rule out that future temperature rises will lie at the lower end of projections. "But," he said, for that to be the case, "one would need to invoke some new dimension to the problem involving a major missing ingredient for which we currently have no evidence. Such a thing is not out of the question but requires a lot of faith." He added: "Rises in global average temperatures of [at least 4C by 2100] will have profound impacts on the world and the economies of many countries if we don't urgently start to curb our emissions." As biotech giant pays huge sums for data analysis about farms, many are terrified about how it might be harnessed. Imagine cows fed and milked entirely by robots. Or tomatoes that send an e-mail when they need more water. Or a farm where all the decisions about where to plant seeds, spray fertilizer and steer tractors are made by software on servers on the other side of the sea. This is what more and more of our agriculture may come to look like in the years ahead, as farming meets Big Data. There’s no shortage of farmers and industry gurus who think this kind of “smart” farming could bring many benefits. Pushing these tools onto fields, the idea goes, will boost our ability to control this fiendishly unpredictable activity and help farmers increase yields even while using fewer resources. The big question is who exactly will end up owning all this data, and who gets to determine how it is used. On one side stand some of the largest corporations in agriculture, who are racing to gather and put their stamp on as much of this information as they can. Opposing them are farmers’ groups and small open-source technology start-ups, which want to ensure a farm’s data stays in the farmer’s control and serves the farmer’s interests. Who wins will determine not just who profits from the information, but who, at the end of the day, directs life and business on the farm. .............. Many farmers are wary that these giants could use these tools to win unprecedented levels of insight into the economics and operational workings of their farms. The issue is not that these companies would shower the farmers with ads, as Facebook does when it knows you’re looking to buy sneakers. For farmers, the risks of big data seem to pierce right to the heart of how they make a living. What would it mean, for instance, for Monsanto to know the intricacies of their business? Farm advocacy groups are now scrambling to understand how — if given free rein — these corporations could misuse the data they collect. “We’re signing up for things without knowing what we’re giving up,” said Mark Nelson, director of commodities at the Kansas Farm Bureau. In May, the American Farm Bureau Federation, a national lobbying group, published a policy brief outlining some potential risks around these data-driven farm tools. For farmers, the most immediate question is who owns the information these technologies capture. ........... How corporations use the information is another central concern. One worry is the giants will harness the data to engage in price discrimination, in which they charge some farmers more than others for the same product. ........... Another issue is how the value of this information will be determined, and the profits divided. The prescription services Monsanto and DuPont are offering will draw on the vast amounts of data they amass from thousands of individual farms. Farmers consider much of this information – such as on soil fertility and crop yields – confidential, and most view details about particular farming techniques as akin to personal “trade secrets.” Even if the corporations agree not to disclose farm-specific information, some farmers worry that the information may end up being used against them in ways that dull their particular competitive edge. “If you inadvertently teach Monsanto what it is that makes you a better farmer than your neighbor, it can sell that information to your neighbor,” said John McGuire, an agriculture technology consultant who runs Simplified Technology Services and developed geospatial tools for Monsanto in the late-1990s. And if the corporation gathers enough information, “it opens the door for Monsanto to say, ‘We know how to farm in your area better than you do,’” he said. There are also no clear guidelines on how this information will be used within commodity markets. ........... HUGE! Read all of this! NEXT Ryan Gorman at the Daily Mail reports on yet another train derailment North Dakota town evacuated after multiple explosions from train carrying soybeans derailed and was struck by train carrying crude oil A train derailed Monday afternoon and burst into flames after being hit by another train just outside the North Dakota town of Casselton - which authorities have now ordered to be fully evacuated. As many as a dozen train cars carrying the highly flammable cargo jumped the tracks at around 2pm before the second train filled with oil barreled into them, causing multiple massive explosions. The toxic plume of flames and smoke has led officials to have the entire town evacuated. Casselton is a suburban town about 25 miles west of Fargo and has a population of about 2,500 people. .......... The first train was traveling westbound away from Casselton, a western suburb of Fargo, when it jumped the tracks, Mr Faust explained. The second eastbound train plowed into it a short time later, resulting in an explosion and fire, but that was only the beginning. There were at least two more explosions, sending a mushroom cloud of bright orange flames hundreds of feet into the air, according to eyewitness accounts. About 21 cars burned Monday night at the height of the blaze, BNSF said in a statement sent to MailOnline. But security expert Jacob Appelbaum notes that the NSA may be digitally violating the 3rd Amendment. By way of background, this week Appelbaum was the main force behind an expose in Spiegel – and gave a must-watch talk – on the NSA’s systemic offensive programs to commandeer computers and computer systems, phone connections and phone systems, and communications networks of all types. Appelbaum shows that the NSA has literally taken over our computer and our phones, physically intercepting laptop shipments and installing bugware before themselves shipping the laptop on to the consumer, installing special hardware that overcomes all privacy attempts, including “air gaps” (i.e. keep a computer unplugged from the Internet). Appelbaum also notes that spyware can suck up a lot of system resources on a computer or smartphone. And he says this is the digital equivalent of soldiers being stationed in our houses against our will: .....

The acquisition of the former chip factory at Sony Place was part of a massive expansion the agency began after the events of Sept. 11, 2001. One of the two main buildings at the former plant has since housed a sophisticated NSA unit, one that has benefited the most from this expansion and has grown the fastest in recent years -- the Office of Tailored Access Operations, or TAO. This is the NSA's top operative unit -- something like a squad of plumbers that can be called in when normal access to a target is blocked. According to internal NSA documents viewed by SPIEGEL, these on-call digital plumbers are involved in many sensitive operations conducted by American intelligence agencies. TAO's area of operations ranges from counterterrorism to cyber attacks to traditional espionage. The documents reveal just how diversified the tools at TAO's disposal have become -- and also how it exploits the technical weaknesses of the IT industry, from Microsoft to Cisco and Huawei, to carry out its discreet and efficient attacks. ............ Having Fun at Microsoft's Expense - One example of the sheer creativity with which the TAO spies approach their work can be seen in a hacking method they use that exploits the error-proneness of Microsoft's Windows. Every user of the operating system is familiar with the annoying window that occasionally pops up on screen when an internal problem is detected, an automatic message that prompts the user to report the bug to the manufacturer and to restart the program. These crash reports offer TAO specialists a welcome opportunity to spy on computers. ............. Nevertheless, TAO has dramatically improved the tools at its disposal. It maintains a sophisticated toolbox known internally by the name "QUANTUMTHEORY." "Certain QUANTUM missions have a success rate of as high as 80%, where spam is less than 1%," one internal NSA presentation states. A comprehensive internal presentation titled "QUANTUM CAPABILITIES," which SPIEGEL has viewed, lists virtually every popular Internet service provider as a target, including Facebook, Yahoo, Twitter and YouTube. "NSA QUANTUM has the greatest success against Yahoo, Facebook and static IP addresses," it states. The presentation also notes that the NSA has been unable to employ this method to target users of Google services. Apparently, that can only be done by Britain's GCHQ intelligence service, which has acquired QUANTUM tools from the NSA. ................ Responding to a query from SPIEGEL, NSA officials issued a statement saying, "Tailored Access Operations is a unique national asset that is on the front lines of enabling NSA to defend the nation and its allies." The statement added that TAO's "work is centered on computer network exploitation in support of foreign intelligence collection." The officials said they would not discuss specific allegations regarding TAO's mission. Sometimes it appears that the world's most modern spies are just as reliant on conventional methods of reconnaissance as their predecessors. Take, for example, when they intercept shipping deliveries. If a target person, agency or company orders a new computer or related accessories, for example, TAO can divert the shipping delivery to its own secret workshops. The NSA calls this method interdiction. At these so-called "load stations," agents carefully open the package in order to load malware onto the electronics, or even install hardware components that can provide backdoor access for the intelligence agencies. All subsequent steps can then be conducted from the comfort of a remote computer. These minor disruptions in the parcel shipping business rank among the "most productive operations" conducted by the NSA hackers, one top secret document relates in enthusiastic terms. This method, the presentation continues, allows TAO to obtain access to networks "around the world." Even in the Internet Age, some traditional spying methods continue to live on. Bernie Sanders (I-Vt.) today asked the National Security Agency director whether the agency has monitored the phone calls, emails and Internet traffic of members of Congress and other elected officials. “Has the NSA spied, or is the NSA currently spying, on members of Congress or other American elected officials?” Sanders asked in a letter to Gen. Keith Alexander, the NSA director. “Spying” would include gathering metadata on calls made from official or personal phones, content from websites visited or emails sent, or collecting any other data from a third party not made available to the general public in the regular course of business?” Sanders said he was “deeply concerned” by revelations that American intelligence agencies harvested records of phone calls, emails and web activity by millions of innocent Americans without any reason to even suspect involvement in illegal activities. He also cited reports that the United States eavesdropped on the leaders of Germany, Mexico, Brazil and other allies. Sanders emphasized that the United States “must be vigilant and aggressive in protecting the American people from the very real danger of terrorist attacks,” but he cited U.S. District Court Judge Richard Leon’s recent ruling that indiscriminate dragnets by the NSA were probably unconstitutional and “almost Orwellian.” Sanders has introduced legislation to put strict limits on sweeping powers used by the National Security Agency and Federal Bureau of Investigation to secretly track telephone calls by millions of innocent Americans who are not suspected of any wrongdoing. ...... Members of Congress have the same privacy protections as all US persons. NSA is fully committed to transparency with Congress. Our interaction with Congress has been extensive both before and since the media disclosures began last June.
In other words: yes, we spy on members of Congress, just like all other Americans. .......... The Washington Post writes:
    The answer is telling. We already know that the NSA collects records on virtually every phone call made in the United States. That program was renewed for the 36th time on Friday. If members of Congress are treated no differently than other Americans, then the NSA likely keeps tabs on every call they make as well. It’s a relief to know that Congress doesn’t get a special carve-out (they’re just like us!). But the egalitarianism of it all will likely be of little comfort to Sanders.”

OUR BTV LAST WORD goes to John Naughton at The Guardian's "Comment is Free" section Here's how data thieves have captured our lives on the internet Whatever else 2013 will be remembered for, it will be known as the year in which a courageous whistleblower brought home to us the extent to which the most liberating communications technology since printing has been captured. Although Edward Snowden's revelations initially seemed only to document the extent to which the state had exploited internet technology to create a surveillance system of unimaginable comprehensiveness, as the leaks flowed it gradually dawned on us that our naive lust for "free" stuff online had also enabled commercial interests effectively to capture the internet for their own purposes. And, as if that realisation wasn't traumatic enough, Snowden's revelations demonstrated the extent to which the corporate sector – the Googles, Facebooks, Yahoos and Microsofts of this world – have been, knowingly or unknowingly, complicit in spying on us. What it boils down to is this: we now know for sure that nothing that you do online is immune to surveillance, and the only people who retain any hope of secure communications are geeks who understand cryptography and use open-source software. This is a big deal by any standards and we are all in Snowden's debt, for he has sacrificed his prospects of freedom and a normal life so that the rest of us would know what has happened to the technologies on we now depend. We can no longer plead ignorance as an excuse for alarm or inaction. ............. And since politicians on both sides of the Atlantic insist that everything the NSA and GCHQ are doing and have done is/was done under legal authority and democratic (that is, political) control it follows that the excesses unveiled by Snowden are the consequences of political judgments and misjudgments. Which means that the only way back to more sensible regimes is also a political one. Ultimately, in other words, this is about politics, not technology. Secrecy impales democracies on the horns of an existential dilemma. On the one hand, democracy abhors secrecy because it makes accountability impossible: citizens cannot consent to what is done in their name if they don't know about it. On the other hand, secrecy is sometimes essential because some things have to be covert – for example activities necessary to ensure the safety of citizens. Societies face a choice between sacrificing accountability; or sacrificing secrecy. In practice, democracies have fudged the issue by lifting the veil of secrecy just enough to provide a semblance of accountability. In the US, this takes the form of a secret court, with secret hearings and judgments, and a congressional committee, which is pathologically deferential to the intelligence services. ..................... Hoovering up metadata amounts to invasive, near-comprehensive surveillance. What's more, it's done without a warrant because of a legal precedent that goes back to the era of analogue telephony – specifically a US supreme court judgment in 1979, which decided that metadata were the property of the telephone company, not of the individual to whose calls the metadata applied. This might have been a reasonable proposition when telephone calls were routed along copper wires, but it's completely inappropriate today. And it is one of the factors that has provided the intelligence agencies with legal immunity. But the biggest misjudgment of all – the one that legitimised most of the excesses that Snowden has unveiled – was also a political one. It was the decision of the George W Bush administration to declare a "war on terror" in the aftermath of the 9/11 attacks – and the eager adoption by the UK and other allies of the same stance. .............. The "war" on terror is not a war in this sense. It is a rhetorical device aimed at engineering consent for a particular political strategy. But it was enough to provide legislative cover for the acquisition by the US intelligence-gathering agencies of warlike powers, which included the means of surveilling every citizen on earth who had an internet connection, and every owner of a mobile phone in most countries of the world. The war on terror may have succeeded in turbocharging the surveillance capabilities of the US and its allies, but it has also inflicted significant collateral damage on the foreign policy of the US, threatened its dominance of cloud computing and other markets, undermined its major technology companies, infuriated some of its most important allies and superimposed a huge question-mark on the future of the internet as a global system. ............... In our rush for "free" services, we failed to notice how we were being conned. The deal, as presented to us in the End User Licence Agreement, was this: you exchange some of your privacy (in the form of personal information) for the wonderful free services that we (Google, Facebook, Yahoo, Skype, etc) provide in return. The implication is that privacy is a transactional good – something that you own and that can be traded. But, in these contexts, privacy is an environmental good, not a transactional one. Why? Because when I use, say, Gmail, then I'm not only surrendering my privacy to Google, but the privacy of everyone who writes to me at my Gmail address. They may not have consented to this deal, but their email is being read by Google nonetheless. ................ All of this we now know – or have belatedly realised – because of Snowden's courage. In less than three decades we have turned a liberating technology into a controlling one. The question now is whether we can extricate ourselves from this mess, or whether we have to resign ourselves to a comprehensively surveilled future? The answer depends partly on whether we treat the Snowden revelations as evidence of a scandal or a crisis. As the political philosopher David Runciman points out, scandals happen all the time in democracies, but they generate little real change. They pass – and business-as-usual resumes. Crises, in contrast, do provoke structural change. Our best hope, therefore, is that the Snowden revelations signal a crisis. If they do, then there are some obvious things to be done........... Keep the pressure on ALL your electeds and mdeia-types: only a groundswell of popular support will move the issue. Lastly the rock-n-roll family lost a great one in Phil Everly who died yesterday.
