DNC ROUNDUP Here's one we missed from last week by Greg Palast for TruthOut RNC to Open With Politician Who "Should Be in Jail" "Tim Griffin should be in jail." That's the conclusion of civil rights attorney Robert F. Kennedy Jr. after going through the evidence I asked him to review. But Griffin's not in jail: he's in Congress. And Tuesday, he'll be the first Congressman the Republicans have chosen to bring to their convention podium. Predictably, I haven't seen one US press report noting that in 2007, Griffin resigned from the Justice Department in disgrace, ahead of what could have been (should have been), his indictment. Kennedy thought a couple of other characters should join Griffin in the lockup: first, Griffin's boss, the man whom George W. Bush gave the nickname, "Turdblossom": Karl Rove. And there's yet another odiferous blossom, Griffin's assistant at the time of the crime: Matt Rhoades. Rhoades isn't in jail either. He's the campaign director of presidential candidate Mitt Romney. ... "What they did was absolutely illegal - and they knew it and they did it anyway," Kennedy told me. What they did was called voter "caging." The RNC sent letters by the thousands to soldiers, first class, marked, "DO NOT FORWARD." When the letters were returned undelivered, the Republicans planned to use these "caged" envelopes as evidence the voters were "fraudulent" - then challenge their ballot. A soldier mailing in his or her vote from Iraq would have that ballot disqualified - and the soldier wouldn't even know it. That's not just sick, it's a crime, a violation of the Voting Rights Act drafted by Kennedy's late father. And it was a crime because of whom the RNC caging crew attacked: not just any soldiers, but soldiers of color. Read on! Luke Johnson at HuffPoAOL explains Ohio Voting: Secretary Of State Refuses To Expand Weekend Voting Until Appeals Court Rules Ohio Secretary of State Jon Husted announced Tuesday that the state would not comply with a court ruling and restore early voting in the final weekend before the election until an appellate court rules on the matter.
One solution would be for the judge to issue an arrest warrant for Husted and lock him up until he apologizes and complies with the ruling! Wait! There's more! Aviva Shen reports at ThinkProgress After Bucking Federal Judge On Early Voting, Ohio Secretary Of State Ordered To Appear In Court Judge Peter Economus has set a hearing for September 13 to address Ohio Secretary of State Jon Husted’s refusal to comply with the court’s ruling that the state must allow early voting on the three days leading up to the general election. Economus released a terse order Wednesday afternoon: “The Court ORDERS that Defendant Secretary of State Jon Husted personally attend the hearing.” The Obama campaign filed a motion earlier Wednesday asking the court to make Husted give way. .... Husted fired two Montgomery County election board members after they defied his directive and voted to hold weekend voting hours. Two other Ohio counties have asked Husted to reevaluate the voting restrictions. ..... There are several pending lawsuits against Husted’s office, including a recent suit by his Democratic predecessor, Jennifer Brunner, over his directive to limit voting hours. On Tuesday, the two fired board of elections members called for Husted’s resignation over a redistricting ballot issue. We'll have an update next week on Husted's tangle with Judge Economus. The apology came in a motion today, after Husted was ordered by the judge to personally appear for a hearing next week. ...... This afternoon, after being summoned to court in response to that Directive, Husted rescinded it and the state filed a motion [PDF] apologizing for what was interpreted as him having attempted to place his own personal stay on Economus' order. "The Secretary apologizes to the federal district court for creating that misimpression and has rescinded [the] Directive," the state writes in the motion, which seeks an official stay on the ruling, pending the Sixth Circuit's expedited appeal... ... In response, rather than issuing a directive with uniform hours for voting in those three days before the November Presidential election, Husted issued a Directive on Tuesday notifying the state's 88 county Boards of Election that they should not establish hours for voting in those days, as the state was filing an appeal in the case. Our own ljm finds this reprint at The Nation by Ari Berman from May Mitt Romney's Neocon War Cabinet It’s safe to say that foreign policy was not the strong suit of this year’s contenders for the GOP presidential nomination. Rick Perry labeled the Turkish government “Islamic terrorists.” Newt Gingrich referred to Palestinians as “invented” people. Herman Cain called Uzbekistan “Ubeki-beki-beki-beki-stan-stan” and memorably blanked when asked what he thought of NATO’s incursion into Libya. Michele Bachmann pledged to close the US embassy in Iran, which hasn’t existed since 1980. Rick Santorum gave a major foreign policy speech at a Jelly Belly factory in California. Yet though the candidates and their views were often hard to take seriously, their statements on foreign policy reflected a more disturbing trend in the GOP. Despite facing a war-weary public, the candidates—with the exception of Ron Paul, an antiwar libertarian, and Jon Huntsman, a moderate internationalist—positioned themselves as unapologetic war hawks. That included Mitt Romney, marginally more polished than his rivals but hardly an expert. Given Romney’s well-established penchant for flip-flopping and opportunism, it’s difficult to know what he really believes on any issue, including foreign affairs (the campaign did not respond to a request for comment). But a comprehensive review of his statements during the primary and his choice of advisers suggests a return to the hawkish, unilateral interventionism of the George W. Bush administration should he win the White House in November. ..... Of Romney’s forty identified foreign policy advisers, more than 70 percent worked for Bush. Many hail from the neoconservative wing of the party, were enthusiastic backers of the Iraq War and are proponents of a US or Israeli attack on Iran. ..... The Romney campaign released the white paper and its initial roster of foreign policy advisers in October, to coincide with a major address at The Citadel. The cornerstone of Romney’s speech was a gauzy defense of American exceptionalism, a theme the candidate adopted from another PNAC founder and Romney adviser, Robert Kagan. The speech and white paper were long on distortions—claiming that Obama believed “there is nothing unique about the United States” and “issued apologies for America” abroad—and short on policy proposals. The few substantive ideas were costly and bellicose: increasing the number of warships the Navy builds per year from nine to fifteen (five more than the service requested in its 2012 budget), boosting the size of the military by 100,000 troops, placing a missile defense system in Europe and stationing two aircraft carriers near Iran. “What he articulated in the Citadel speech was one of the most inchoate, disorganized, cliché-filled foreign policy speeches that any serious candidate has ever given,” says Steve Clemons, a senior fellow at the New America Foundation. .... This reminds us of "The Crazies" and Day One - The War With Iran from 2005 "By 9:30 AM, gas stations on the US east coast began to raise their prices. Slowly at first and then altogether in a panic, the prices rose. $4 a gallon, and then $5 and then $6, the prices skyrocketed. Worried motorists, rushing from work, roared into the nearest gas station, radios blaring the latest reports of the pre-emptive attack on Iran. While fistfights broke out in gas stations everywhere, the third Middle Eastern war had begun." And we cannot forget Sy Hersh in November 2011's New Yorker blog Iran and the I.A.E.A. But how definitive, or transformative, were the findings? The I.A.E.A. said it had continued in recent years “to receive, collect and evaluate information relevant to possible military dimensions of Iran’s nuclear program” and, as a result, it has been able “to refine its analysis.” The net effect has been to create “more concern.” But Robert Kelley, a retired I.A.E.A. director and nuclear engineer who previously spent more than thirty years with the Department of Energy’s nuclear-weapons program, told me that he could find very little new information in the I.A.E.A. report. John Burton apologizes for comparing Republicans to Nazi Goebbels ....“If Mitt Romney, Paul Ryan, or the Republicans are insulted by my describing their campaign tactic as the big lie -- I most humbly apologize to them or anyone who might have been offended by that comment,” John Burton said in a statement. .... Burton, who let loose against Republicans in an interview with KCBS and the San Francisco Chronicle, expressed his contempt for the party’s recent rhetoric Monday morning. “They lie and they don’t care if people think they lie. As long as you lie, Joseph Goebbels, the big lie, you keep repeating it, you know,” he said. Burton made a point of noting that he never used the word “Nazi”; however, he did invoke the Nazi minister of propaganda twice. “That was Goebbels, a big lie, they said they don’t care about facts,” he said. “They’re going to lie so, I mean, that’s not pejorative to them. They probably wear it as a compliment.” Burton also brought Republican vice presidential nominee Paul D. Ryan into his condemnations. “What Paul Ryan said was a bold-faced lie to all the American people and he doesn’t care that it was a lie because it doesn’t matter because it sounds good,” he said. ..... This is how it works now in Amerika: tell the truth about somebody and get flamed for it. And the GOPhers completely played the victim and denied all charges, even though they are true. Face it, Lyin' Ryan lied through his TEETH throughout his entire speech to the GOPher convention, even after his claims were alll ALREADY DEBUNKED! And there's no sign of them letting up REPEATING THE BIG LIES over and over to their troglodyte knuckle-dragging minions, who BELIEVE THEM nonetheless. If Lyin' Ryan can casually lie about his marathon running time what else is he lying about? Lee Fang at The Nation has one answer in an Exclusive: Paul Ryan Quietly Requested Obamacare Cash Republican vice-presidential candidate Paul Ryan is barnstorming the country, promising to repeal every provision of the Affordable Care Act if the Romney-Ryan ticket is elected. But a letter he wrote to the Obama administration may undermine this message. On December 10, 2010, Ryan penned a letter to the Department of Health and Human Services to recommend a grant application for the Kenosha Community Health Center, Inc to develop a new facility in Racine, Wisconsin, an area within Ryan’s district. The grant Ryan requested was funded directly by the Affordable Care Act, better known simply as healthcare reform or Obamacare. The letter, among several obtained by The Nation and The Investigative Fund through a Freedom of Information Act request, is a stark reminder that even the most ardent opponents of Obamacare privately acknowledge many of the law’s benefits. .... Ryan first denied responsibility for the stimulus grant requests, but later confessed that his office had sent the letters. Republicans have praised Ryan for his willingness to embrace unpopular cuts to government programs and for being a “consistent conservative.” The fact that Ryan has privately pleaded with the Obama administration for government grants from the president’s signature policy accomplishments, however, could unravel that conceit. UPDATE: Brendan Buck, a spokesperson for the Mitt Romney campaign, responded to this story by claiming that this "grant program was created by President Bush, not Obamacare. This... type of misinformation is what you get from gotcha reporting on liberal blogs." Ryan's letter directly requests money from the HRSA-11-017 New Access Points program announced in August of 2010. This New Access Points grant program that Ryan requested money from is funded fully by the Affordable Care Act, a fact made clear on multiple government websites. The claim that Bush "created" this program is also unfounded. Federally-funded health centers were created through the Public Health Services Act, legislation signed into law by President Franklin Roosevelt in 1944. New Access Point grants have existed well before the Bush administration came to office. These guys have some serious brass balls when it comes to lying, prevaricating, spewing half-truths and general hypocrasy: OBJECTIVE REALITY IS IMMATERIAL to them. And the weak corporomedia go along for the Lie Ride every day never calling them out on anything ever! Next we go to Vanity Fair contributing editor Kurt Eichenwald opines at his blog The Five Reasons Why Romney/Ryan Must be Defeated in 2012 – And Why Conservatives Should Hope They Are The GOP must be stopped in 2012. The future of America’s ideals of democracy – and of the Republican Party itself – could well be at stake. Contrary to how it might seem, I am not a partisan bomb thrower. Throughout most of my adulthood, I have been just as likely to vote for a Republican as for a Democrat – in local, state and national contests. I have cast my ballot in presidential races for both Republicans and Democrats. But in the last four years, the GOP has transmogrified into something ugly and vicious and, more important, something wedded to the politics of fantasy and ignorance. It has rushed so far from its moorings that I cannot conceive of voting for members of this party until, hopefully, they pull themselves back from the precipice of self-destruction, paranoia and delusion. Today, for Republicans, up is down and front is back. Lying has become so ingrained into the conservatives’ national dialogue that they are now dangerously demagogic or, worse, severely unhinged. Blind rage at the election of Barack Obama has wrecked a once great political party. Its leaders have made so many deals with the devil in their almost pathological obsession with unseating Obama that they have pushed the GOP into its own version of political hell – unable to speak truths to their now-rabid and conspiracy-addled base and unable to right the party back onto a path of responsibility. Only through the disinfectant of defeat can the Republicans, and the two party system, be preserved. And so, the campaign of Mitt Romney and Paul Ryan must be consigned to the ash heap of history. They are utilizing the obscene Citizens United case to undermine the very nature of democracy by allowing anonymous millionaires to broadcast as many lies as they can in order to fool the electorate for whom they have so much disdain. Lying, impeding voting, buying elections – all of this is un-American and reflects a party that no longer has anything to offer other than fear. If it works, god help us…our country will become a nation of liars whose only concern will be how much air time they could purchase to insure the lies penetrate the American consciousness. Stunning and spot-on! Do read all of this and pass it on to those you know who haven't drunk the lie-infested GOPher cool-aid (those 30% or so who will vote GOPher no matter what are unreachable - do NOT waste your time with them). But let us remember that the other side of the Political Korporate Koin isn't all bunnies and rainbows and sunshine. Margorie Cohn writes at her blog No Accountability for Torturers The Obama administration has closed the books on prosecutions of those who violated our laws by authorizing and conducting the torture and abuse of prisoners in U.S. custody. Last year, Attorney General Eric Holder decided that his office would investigate only two incidents, in which CIA interrogations ended in deaths. He said the Justice Department “has determined that an expanded criminal investigation of the remaining matters is not warranted.” With that decision, Holder conferred amnesty on countless Bush officials, lawyers and interrogators who set and carried out a policy of cruel treatment. Now the attorney general has given a free pass to those responsible for the deaths of Gul Rahman and Manadel al-Jamadi. Rahman froze to death in 2002 after being stripped and shackled to a cold cement floor in the secret Afghan prison known as the Salt Pit. Al-Jamadi died after he was suspended from the ceiling by his wrists which were bound behind his back. MP Tony Diaz, who witnessed al-Jamadi’s torture, said that blood gushed from his mouth like “a faucet had turned on” when he was lowered to the ground. A military autopsy concluded that al-Jamadi’s death was a homicide. Nevertheless, Holder announced that “based on the fully developed factual record concerning the two deaths, the department has declined prosecution because the admissible evidence would not be sufficient to obtain and sustain a conviction beyond a reasonable doubt.” Amnesty for torturers is unacceptable. General Barry McCaffrey declared, “We tortured people unmercifully. We probably murdered dozens of them during the course of that, both the armed forces and the CIA.” Major General Anthony Taguba, who directed the Abu Ghraib investigation, wrote that “there is no longer any doubt as to whether the [Bush] administration has committed war crimes. The only question that remains to be answered is whether those who ordered the use of torture will be held to account.” Holder has answered Taguba’s question with a resounding “no.” Some have suggested that Holder’s decisions have been motivated by political considerations. ..... But the Obama administration’s decision to allow the lawbreakers to go free is itself a violation of the law. The Constitution says that the president “shall take Care that the Laws be faithfully executed.” When the United States ratified the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, we promised to extradite or prosecute those who commit, or are complicit in the commission, of torture. The Geneva Conventions also mandate that we prosecute or extradite those who commit, or are complicit in the commission of, torture. There are two federal criminal statutes for torture prosecutions—the U.S. Torture Statute and the War Crimes Act; the latter punishes torture as a war crime. The Torture Convention is unequivocal: nothing, including a state of war, can be invoked as a justification for torture. By letting American officials, lawyers and interrogators get away with torture – and indeed, murder – the United States sacrifices any right to scold or punish other countries for their human rights violations. Meanwhile across the pond George Monbiot writes in "Comment is Free" at the Guardian UK a rejoinder We're one crucial step closer to seeing Tony Blair at The Hague For years it seems impregnable, then suddenly the citadel collapses. An ideology, a fact, a regime appears fixed, unshakeable, almost geological. Then an inch of mortar falls, and the stonework begins to slide. Something of this kind happened over the weekend. When Desmond Tutu wrote that Tony Blair should be treading the path to The Hague, he de-normalised what Blair has done. Tutu broke the protocol of power – the implicit accord between those who flit from one grand meeting to another – and named his crime. I expect that Blair will never recover from it. The offence is known by two names in international law: the crime of aggression and a crime against peace. It is defined by the Nuremberg principles as the "planning, preparation, initiation or waging of a war of aggression". This means a war fought for a purpose other than self-defence: in other words outwith articles 33 and 51 of the UN Charter. That the invasion of Iraq falls into this category looks indisputable. Blair's cabinet ministers knew it, and told him so. His attorney general warned that there were just three ways in which it could be legally justified: "self-defence, humanitarian intervention, or UN security council authorisation. The first and second could not be the base in this case." Blair tried and failed to obtain the third. ....... But while the case against Blair is strong, the means are weak. Twenty-nine people have been indicted in the international criminal court, and all of them are African. (Suspects in the Balkans have been indicted by a different tribunal). There's a reason for this. Until 2018 at the earliest, the court can prosecute crimes committed during the course of an illegal war, but not the crime of launching that war. Should we be surprised? ...... That the prospect of prosecution currently looks remote makes it all the more important that the crime is not forgotten. To this end, in 2010 I set up a bounty fund – www.arrestblair.org – to promote peaceful citizens' arrests of the former prime minister. People contribute to the fund, a quarter of which is paid out to anyone who makes an attempt which meets the rules. With our fourth payment last week, we've now disbursed more than £10,000. Our aim is the same as Tutu's: to de-normalise an act of mass murder, to keep it in the public mind and to maintain the pressure for a prosecution. That looked, until this weekend, like an almost impossible prospect. But when the masonry begins to crack, impossible hopes can become first plausible, then inexorable. Blair will now find himself shut out of places where he was once welcome. One day he may find himself shut in. Obama campaign brags about its whistleblower persecutions: For several decades, protection of whistleblowers has been a core political value for Democrats, at least for progressives. Daniel Ellsberg has long been viewed by liberals as an American hero for his disclosure of the top secret Pentagon Papers. In 2008, candidate Obama hailed whistleblowing as "acts of courage and patriotism", which "should be encouraged rather than stifled as they have been during the Bush administration". President Obama, however, has waged the most aggressive and vindictive assault on whistleblowers of any president in American history, as even political magazines generally supportive of him have recognized and condemned. One might think that, as the party's faithful gather to celebrate the greatness of this leader, this fact would be a minor problem, a source of some tension between Obama and his hardest-core supporters, perhaps even some embarrassment. One would be wrong. Far from shying away from this record of persecuting whistleblowers, the Obama campaign is proudly boasting of it. A so-called "Truth Team" of the Obama/Biden 2012 campaign issued a document responding to allegations that the Obama White House has leaked classified information in order to glorify the president: [....] ...More remarkable is that a Democratic presidential candidate is sticking his chest out and proudly touting that he has tried to imprison more whistleblowers on espionage charges than all previous presidents in history combined: more than the secrecy-loving Bush/Cheney White House, more than the paranoid, leak-hating Nixon administration, more than anyone in American history. Just contrast the script Democrats now read from to the one they pretended to believe in, in 2008; from the Obama/Biden campaign's official Document for Change: [....] ..... This isn't just what Democrats do. It's what they now boast about, what they campaign on, what they celebrate. That, as much as anything, is the Obama legacy. See the UPDATE at the link for video evidence and THIS ....the minute he is confronted with real questions, he retreats -- just like he does when his conduct is challenged in court -- to claiming that it is all just too secret to permit any discussion of it whatsoever. In other words, The Most Transparent Administration Ever argues that which citizens the President chooses to kill and why is too secret to permit you to know anything about it (unless having you know about it can benefit him politically, in which case dozens of his aides will leak it).
MoJo's Adam Serwer weighs in with Democrats Retreat on Civil Liberties in 2012 Platform In 2008, Democrats were eager to draw a contrast with what they then portrayed as Republican excesses in the fight against Al Qaeda. Since then, the Obama administration has in many cases continued the national security policies of its predecessor—and the Democratic Party's 2012 platform highlights this reversal, abandoning much of the substance and all of the bombast of the 2008 platform. Here are a few places where the differences are most glaring: Indefinite Detention..... ; Warrantless Surveillance/PATRIOT Act.....; Gitmo.....; Racial Profiling in Fighting Terrorism.....; Torture: 2008: "We reject torture."2012: "Advancing our interests may involve new actions and policies to confront threats like terrorism, but the President and the Democratic Party believe these practices must always be in line with our Constitution, preserve our people's privacy and civil liberties, and withstand the checks and balances that have served us so well. That is why the President banned torture without exception in his first week in office." Despite Obama's executive order banning torture, Americans who allege they have been detained abroad by foreign governments at the United States' request say they have been abused while in custody. It does not appear as though anyone will face charges over the Bush administration's torture program, including those who went beyond its legal guidelines. The section of the 2012 Democratic platform titled "Staying True to our Values at Home" states, "We must always seek to uphold these values at home, not just when it is easy, but, more importantly, when it is hard." The distance between the 2008 and 2012 platform shows just how hard it has been, and starkly illustrates the extent to which the Democratic Party has given up on its 2008 promises to roll back the national security state that emerged and expanded in the wake of the 9/11 attacks. - From Safety4Sea.com U.S. Department Of Justice Accuses BP Of Gross Negligence And Willful Misconduct The U.S. Justice Department is ramping up its rhetoric against BP PLC for the massive 2010 oil spill in the Gulf of Mexico, describing in new court papers examples of what it calls "gross negligence and willful misconduct." The court filing is the sharpest position yet taken by the U.S. government as it seeks to hold the British oil giant largely responsible for the largest oil spill in U.S. history. Gross negligence is a central issue to the case, slated to go to trial in New Orleans in January 2013. A gross negligence finding could nearly quadruple the civil damages owed by BP under the Clean Water Act to $21 billion. The U.S. government and BP are engaged in talks to settle civil and potential criminal liability, though neither side will comment on the status of negotiations. "The behavior, words, and actions of these BP executives would not be tolerated in a middling size company manufacturing dry goods for sale in a suburban mall," government lawyers wrote in the filing on August 31 in federal court in New Orleans. The filing comes more than two years after the disaster that struck on April 20, 2010 when a surge of methane gas known to rig hands as a "kick" sparked an explosion aboard the Deepwater Horizon rig as it was drilling the mile-deep Macondo 252 well off Louisiana's coast. The rig sank two days later.....

The hand-over deal, signed on March 9 at President Hamid Karzai’s demand, set a six-month transfer schedule and was a reflection of rising Afghan assertions of sovereignty at a time of extreme tensions over U.S. troops’ burning of Qurans. - From the Common Dreams Staff Green Groups: Keystone XL Reroute No Fix; We Need Clean Energy Canadian energy giant TransCanada announced on Wednesday that it has submitted an alternative route for the tar sands-pumping Keystone XL Pipeline in Nebraska that would "support the safe construction and operation of the pipeline." But environmental groups said the new route still threatens water resources and habitat, and that the only safe way forward is to "ditch Keystone XL entirely and embrace clean energy solutions." But Jane Kleeb, Executive Director of Bold Nebraska, a group that's been fighting the Keystone XL, says that the new route still fails to protect the water and people of Nebraska. "The new route still risks our land, water and property rights. The new route still crosses high water tables, sandy soil which leads to higher vulnerability of contamination and still crosses the Ogallala Aquifer, the lifeblood of Nebraska's economy," stated Kleeb. "We will not allow middle American to be the middle man for a foreign tarsands pipeline wanting to export their extreme form of energy to the highest bidder."

- Lawmakers concerned about the health effects on humans from mountaintop removal coal mining set forth legislation in the U.S. House of Representatives today. Representatives Dennis Kucinich (OH), Louise Slaughter (NY), Maurice Hinchey (NY), Earl Blumenauer (OR), Lucille Roybal-Allard (CA), John Yarmuth (KY), Lynn Woolsey (CA), Judy Chu (CA), Raúl Grijalva (AZ), James Moran (VA), Michael Honda (CA), John Conyers (MI), and Keith Ellison (MN) introduced the Appalachian Communities Health Emergency (ACHE) Act [H.R. 5959] which would place a moratorium on permitting for mountaintop removal coal mining until health studies are conducted by the Department of Health and Human Services. The ACHE coalition presently consists of participants from Coal River Mountain Watch, Mountain Health and Heritage Association, and Christians for the Mountains. “We encourage you, if you’re concerned about mountaintop removal’s effect on your community’s health, to join us in making your voice heard,” said Allen Johnson, executive director of Christians for the Mountains. “Please contact us, learn about the issue, and take action to protect your community.”
