The International Telecommunication Union, a UN agency, is meeting in December in Dubai for the World Conference On International Telecommunications to revise the International Telecommunication Regulation treaty. In the lead up, several countries, and even some private companies, have been lobbying for changes that would see nations get more control of how the Internet is used in their countries. ..... Tyler Durden has been following the Troika/Greece "negotiations" at ZeroHedge.com and last week explained The Latest Greek "Bailout" In A Nutshell: AAA-Rated Euro Countries To Fund Massive Hedge Fund Profits .....the money is now supposed to come from the European Financial Stability Fund (EFSF) funded realistically by Europe's AAA governments, all of which have said not one more penny will go to Greece. However, the EFSF already has prefunded and committed capital so it is a convenient loophole. The problem will arise when the parliaments of said AAA countries are asked to explain to their people why they all have to pay billions in order to repay between €20 and €40 billion (assuming a 50 or 25 cent repurchase price) of Greek debt, just so Greece has a theoretical chance of hitting 120% debt/GDP by 2020, a number which has virtually no chance of being hit when one accounts for the the denominator: the collapsing Greek GDP which last quarter tumbled at a 7% rate. But the kicker is when one traces the use of funds. Because what is will happening is a payment not to Greece, obviously, but to its creditors: entities which for the most part are hedge funds, and which have bought up GGB2s in the mid teen levels as recently as 4 months ago (recall Dan Loeb's major position in Greek bonds). So to simplify the flow of funds:
  • Source of Funds: EFSF, using European cash primarily originating at places such as Germany, Finland and Netherlands
  • Use of Funds: Hedge funds holders, with a cost basis in the 10-20 cent range.
  • Summary: European governments, already struggling with day to day cash procurement and finding new and inventive ways of keeping the ponzi going day to day, will pay... Hedge Funds and their billionaire PMs.
And what do they get in return: In part to address the inevitable political concerns, officials are drawing up options to back the new loans with collateral from Greece’s privatisation programme, which aims to raise €50bn. .... The only real loser here? The Greek people, who will have just sold off up to €50 billion in national assets (and this is uncertain - there may very well not be any buyers for Greek "assets"). The same Greek people who will get not one penny from any of the convoluted fund flows explained above. And now you know what the current state of the latest Greek bailout process is.
Then this week we get an update Greece Kicks The Can For The Third Time - SocGen's Take: "More Will Be Needed" and we get this Guest Post Mark Grant On Greece: "There Is No Deal Here" There is no deal here. There is a fantasy of projections and some wishful thinking but no deal. There is not even an agreement on disbursement as codified in the last paragraph of the statement (here). The odds on Greece reaching a primary surplus in the next several years are about 1 degree off of Kelvin's Absolute Zero [the market seems to agree] [chart] The deferral of interest payments and the extension of the loans have some meaning but are nowhere close to bridging the deficit gap. All of this of course has to go back to the nations' Parliaments and it may not be as readily accepted as some hope. There is not even a definitive agreement yet to give Greece more money. The debt buy-back (as we discussed here) is governed under British law and while they are once again going after the private sector bondholders there is no CAC to enforce any action though there is the obvious falsification of prior claims that "it will never happen again." What we have here are more promises, a concocted ruse and an agreement on a concept that is actually no deal at all.... Back in ths States the big to-do is all about the "fiscal cliff" which is more like a "fiscal slope" in reality (there goes the MSM with their death-n-destruction GOP-coined meme again). One of the frustrating aspects of the Great Catfood Debate is that it boils down to not whether, but how much, catfood you get in your future. Even though the folks that created the deficit hysteria are now depicting a budget deal, meaning austerity lite, as a Good Outcome, and triggering the fiscal cliff is a Bad Outcome, austerity is still austerity. We’ve seen again and again that cutting deficits when the economy has lots of slack only makes debt to GDP ratios worse, but despite the overwhelming amount of evidence, Pete Peterson and his Wall Street allies want to run the experiment again in the hope that we get a different outcome. And the cynics contend that the deficits are merely an excuse: the real goal is to keep cutting taxes, period, that the true aim of the plutocrats is to roll the clock back to before 1900 in term of the gap between the rich and everyone else. Marshall Auerback explains why any of the proposed outcomes to the budget negotiations will slow growth and possibly produce a recession.     ...Of course, if there is no compromise, the impact could be calamitous. The IMF projects as much as a 4% decline in GDP if there is a full fiscal cliff. In 1936-37 there was a fiscal cliff of almost 6% of GDP. It was followed by a 36% non annualized decline in industrial production in a mere eight months in late 1937/early 1938. More recently, all of the European countries fiscal restriction has had a more negative impact on GDP than had initially been forecast. So the range of likely outcomes ranges from slowdown to outright recession and the silly thing is that it is all so unnecessary. Social Security, Medicare and Medicaid impose no real burdens, even with a rising proportion of ageing baby boomers. In fact, one could plausibly make the case that an aging society could help to generate favorable conditions for achieving sustained high employment with high productivity growth. .... Here’s what most members of Congress (and, indeed, the media and the public) fail to appreciate: Policy formation must distinguish between financial provisioning and real provisioning for the future; only the latter can prepare society as a whole for coming challenges. While individuals can, and should, save financial assets for their individual retirements, society cannot prepare for waves of future retirees by accumulating financial trust funds. ..... The fiscal austerians are literally strangling the baby in the crib today by denying a sensible fiscal response for the current generation’s plight, while hyperventilating that fiscal deficits will do the strangulation of the next generation tomorrow. All of which exacerbates a problem of economies facing intense global headwinds from private sector deleveraging. Viewed from that perspective, the terms of the debate have been truly twisted around. Granted, it is obviously more difficult to make the case for more government spending when legitimate distrust reasonably exists of dysfunctional financial and governmental systems. That said, what really matters is whether the economy will be able to produce a sufficient quantity of real goods and services to provide for both workers and dependents several generations down the road. The financial aspects of demographics per se should not play a role in policy formulation......
Writing for the NYT Opinion Page Nobel Laureate Paul Krugman is Fighting Fiscal Phantoms ....Given these realities, the deficit-scold movement has lost some of its clout. That movement, by the way, is a hydra-headed beast, comprising many organizations that turn out, on inspection, to be financed and run by more or less the same people; dig down into many of these groups’ back stories and you will, in particular, find Peter Peterson, the private-equity billionaire, playing a key role. But the deficit scolds aren’t giving up. Now yet another organization, Fix the Debt, is campaigning for cuts to Social Security and Medicare, even while making lower tax rates a “core principle.” That last part makes no sense in terms of the group’s ostensible mission, but makes perfect sense if you look at the array of big corporations, from Goldman Sachs to the UnitedHealth Group, that are involved in the effort and would benefit from tax cuts. Hey, sacrifice is for the little people. So should we take this latest push seriously? No — and not just because these people, aside from exhibiting a lot of hypocrisy, have been wrong about everything so far. The truth is that at a fundamental level the crisis story they’re trying to sell doesn’t make sense. ..... Still, haven’t crises like the one envisioned by deficit scolds happened in the past? Actually, no. As far as I can tell, every example supposedly illustrating the dangers of debt involves either a country that, like Greece today, lacked its own currency, or a country that, like Asian economies in the 1990s, had large debts in foreign currencies. Countries with large debts in their own currency, like France after World War I, have sometimes experienced big loss-of-confidence drops in the value of their currency — but nothing like the debt-induced recession we’re being told to fear. So let’s step back for a minute, and consider what’s going on here. For years, deficit scolds have held Washington in thrall with warnings of an imminent debt crisis, even though investors, who continue to buy U.S. bonds, clearly believe that such a crisis won’t happen; economic analysis says that such a crisis can’t happen; and the historical record shows no examples bearing any resemblance to our current situation in which such a crisis actually did happen. If you ask me, it’s time for Washington to stop worrying about this phantom menace — and to stop listening to the people who have been peddling this scare story in an attempt to get their way. One of the senators who seem to be aligning against the Pete Petersen/Fix the Debt meme is the unflappable Bernie Sanders. Or so we're led to believe, says Lambert in I Can Has Shared Sacrifice? ....since nobody else chewed Bernie Sanders’ ankles for drinking the “shared sacrifice” Kool-Aid and proving himself unworthy of the name “Socialist,” I will. It’s hard work, but somebody’s got to do it. Here’s an excerpt from a highly praised speech letter that Sanders recently made wrote; I’ve added some helpful interpretive material in brackets: [.......] So, did you hear Bernie Sanders, Socialist firebrand, the second coming of Eugene V. Debs, calling for “Not one penny of cuts?” No, me neither.In practice, in the world where sausage is made, the position crypto-Democrat Sanders has staked out is indistinguishable from Obama’s: The wealthy are to pay more in taxes and the rest of us will get even worse social insurance. But all the players know this deal is bogus; no matter that the wealthy are supposed to pay “a little more” (Obama) or some “pennies” (Saunders), their only real costs will be the accountants they hire to avoid or evade what isn’t even real money to them; but the costs will be very real to us, and will come out of our hides. ...... Here is what the baseline should be: “Not one penny of cuts to Social Security, Medicare, Medicaid, or any other social insurance program, and any savings to be paid out as benefits.” Hear that from Bernie? Any Democrats? Didn’t think so. We have already sacrificed, whether through the loss of our jobs, our health, our homes, our net worth, or from real wages being flattened for the last forty years, or from paying some well-fed smiling usury-stinking weasel their cut on the deal every time we turn around. The proper amount of additional sacrifice for us is, precisely and exactly, zero. ...... C’mon, Bernie. Socialist? As much a socialist as Obama’s a socialist. Or a Kenyan, for that matter. Go on. Prove me wrong! .... UPDATE 3:25AM Perhaps I need to release my incisors from this portion of Bernie’s website and re-fasten them on his latest speech and, more importantly, on today’s presser (hat tip AH and GC in mail for links). It is true — and it’s good that it’s true — that the “shared sacrifice” verbiage has been removed. That does not mean, however, that a sacrifice will not be performed. .... And Lambert goes on (read the rest for full effect) but concludes Sanders does not challenge the importance of the deficit, and does not point out that the “fiscal cliff” is a wholly political construct. You can’t win a battle of ideas by adopting your enemy’s terms! And that’s before we get to the central misconception in the entire debate: That taxes “fund” spending… True fact! Next Zach Carter at HuffPoAOL explains Fiscal Cliff Talks Bring Influx of Corporate Lobbying For Tax Perks For The Wealthy WASHINGTON -- As negotiations to avert the so-called fiscal cliff intensify, corporate lobbying groups are pushing key tax perks that benefit the wealthy. A coalition of financial institutions, fossil fuel companies, telecommunications firms and even the cigarette company Altria are teaming up to block a tax increase on dividends -- a policy that overwhelmingly aids the rich. ..... The corporate coalition, known as The Alliance for Savings and Investment, is composed exclusively of corporations and lobbying groups. Major companies include AT&T, Verizon, Coca-Cola and Altria, while lobbying groups include two organizations representing Wall Street, another representing the natural gas industry and another that works on behalf of major electricity companies like Duke Energy, PEPCO and Consolidated Edison. The group is currently running a misleading television ad urging Congress to extend the low tax rate on dividends that is currently set to expire at year-end. ...... In fact, the low tax rate on dividends predominantly benefits the wealthy. ..... Most low-tax dividends, moreover, accrue to the wealthy. Over 33 percent of such dividends go to millionaires, who comprise less than 1 percent of the population. More than 52 percent of dividends accrue to households making at least $250,000 a year, and over 72 percent to households that earn more than $100,000 a year. Some of these people are retired but still make six figures or more each year. The Alliance for Savings and Investment's ad does not specify how lawmakers should avert the rate hike, but the group's website suggests they should do so by implementing a second tax boon for the rich. ..... Over 50 percent of all capital gains over the past two decades have accrued to the wealthiest 0.1 percent of taxpayers, according to The Washington Post, while the richest 5 percent of Americans receive 80 percent of all capital gains. The Alliance for Savings and Investment, which declined to comment for this article, is just one of several corporate lobbying groups that are pushing to include tax perks for the wealthy and large corporations in any deal to avert the fiscal cliff. The Campaign to Fix the Debt has organized dozens of corporate CEOs to advocate for $134 billion in tax breaks for Fortune 500 companies as part of any deal to avert the fiscal cliff, according to an analysis by the Institute for Policy Studies, a liberal think tank. One of the biggest con men is Grover "drown the government in a bathtub" Norquist and his front group "Americans for Tax Reform". Seems every network is inviting this guy on for his "expert opinion" on the "Fiscal Cliff"! Writing at The Nation Lee Fang finds Grover Norquist's Budget Is Largely Financed by Just Two Billionaire-Backed Nonprofits Grover Norquist’s iron grip over much of the Republican Party is somewhat puzzling. Why should Senators and other lawmakers listen to a guy caught laundering money for Jack Abramoff? But consider Norquist’s tax pledge and political power another way: that he’s just a proxy for the powerful interest groups that finance him. In the nineties, it was big tobacco that used Norquist’s tax pledge as a cover to lobby lawmakers against cigarette taxes (Norquist still uses an e-mail system donated to him by Altria to send out Tea Party action alerts against tobacco taxes). Now, big PhRMA and other industry groups provide grants to Norquist while his foundation endorses other giveaways, like protectionist support against importing cheaper drugs from Canada and the classification of tax subsidies to refineries as “tax cuts” that must not be cut. I took a look at the last available budget numbers for Americans for Tax Reform, Norquist’s group. Though they do not reveal their donors, we can cobble together much of Norquist’s donors using foundations and other nonprofits that donate money to him.The disclosures show that only two billionaire-backed groups have provided over 66 percent of Norquist’s funding:
  • The Center to Protect Patients Rights donated $4,189,000 to Americans for Tax Reform in 2010, 34 percent of the group’s budget that year.
  • Crossroads GPS donated $4,000,000 to Americans for Tax Reform in 2010, 32.46 percent of the group’s budget that year.
...... When Norquist promises consequences for the few GOP members willing to break with his pledge, what he’s really saying is that his donor network will retaliate with attack ads and money for primary challenges. ...

Their clever method to prove that Politifact is a liberal propaganda outfit: they took all of Politifact’s “Pants on Fire” ratings for a list of politicians, and … added them up! See? They used mathematics here! And they produced this definitive chart to demonstrate their definitive proof. We go to NPR's Scott Horsley on All Things Considered Thursday show for some REAL fact checking on who else but JOHN "Crybaby" BOEHNER after his meet-n-greet at the WH. Of Top Taxpayers, 1 In 5 A Small Business Owner
    REPRESENTATIVE JOHN BOEHNER: Raising taxes on the so-called top 2 percent, half of those taxpayers are small business owners that pay their taxes through their personal income, tax filing every year. BLOCK: That claim by the House speaker has been challenged before, and we're going to take a closer look at it now with NPR's Scott Horsley. And, Scott, this is something that John Boehner has said repeatedly, that half of top earners in the country are small business owners. He's also been repeatedly corrected on this by fact-checkers. What's the truth here? SCOTT HORSLEY, BYLINE: You're right, Melissa. The speaker's office says that John Boehner misspoke yesterday, although it is a misstatement that he's made more than once. It is a variation on another GOP talking point, which is that half of all small business income is taxed at those top two rates. That's according to a study by the Joint Committee on Taxation. But that's using a very broad definition of small business. It also includes a lot of law firm partners and hedge fund managers. Last year, there were some analysts at the Treasury Department who tried to take a closer look at how many top earners really meet the public's idea of a small business. So they threw out all those who were making more than $10 million. At the other end, they threw out people who might have a big salary from a day job and then a little small business on the side. And when they narrowed the definition that way, what they found was about one in five taxpayers in those top two brackets is a small business owner. And of all the income in those brackets that would be taxed at a higher rate, only about 7 percent comes from small businesses. BLOCK: And small businesses, again, defined as those making up to $10 million. HORSLEY: That's right.

We go to a really important issue Glenn Greenwald at Guardian.co.uk has been covering for along time Bradley Manning: a tale of liberty lost in America Over the past two and a half years, all of which he has spent in a military prison, much has been said about Bradley Manning, but nothing has been heard from him. That changed on Thursday, when the 23-year-old US army private accused of leaking classified documents to WikiLeaks testified at his court martial proceeding about the conditions of his detention. The oppressive, borderline-torturous measures to which he was subjected, including prolonged solitary confinement and forced nudity, have been known for some time. A formal UN investigation denounced those conditions as "cruel and inhuman". President Obama's state department spokesman, retired air force colonel PJ Crowley, resigned after publicly condemning Manning's treatment. A prison psychologist testified this week that Manning's conditions were more damaging than those found on death row, or at Guantánamo Bay. Still, hearing the accused whistleblower's description of this abuse in his own words viscerally conveyed its horror. Reporting from the hearing, the Guardian's Ed Pilkington quoted Manning: "If I needed toilet paper I would stand to attention and shout: 'Detainee Manning requests toilet paper!'" And: "I was authorised to have 20 minutes sunshine, in chains, every 24 hours." Early in his detention, Manning recalled, "I had pretty much given up. I thought I was going to die in this eight by eight animal cage." The repressive treatment of Bradley Manning is one of the disgraces of Obama's first term, and highlights many of the dynamics shaping his presidency. The president not only defended Manning's treatment but also, as commander-in-chief of the court martial judges, improperly decreed Manning's guilt when he asserted in an interview that he "broke the law". Worse, Manning is charged not only with disclosing classified information, but also the capital offence of "aiding the enemy", for which the death penalty can be imposed (military prosecutors are requesting "only" life in prison). The government's radical theory is that, although Manning had no intent to do so, the leaked information could have helped al-Qaida, a theory that essentially equates any disclosure of classified information – by any whistleblower, or a newspaper – with treason. Whatever one thinks of Manning's alleged acts, he appears the classic whistleblower. This information could have been sold for substantial sums to a foreign government or a terror group. Instead he apparently knowingly risked his liberty to show them to the world because – he said when he believed he was speaking in private – he wanted to trigger "worldwide discussion, debates, and reforms". ...... As usual, the US establishment journalists have enabled the government every step of the way. Despite holding themselves out as adversarial watchdogs, nothing provokes their animosity more than someone who effectively challenges government actions. Typifying this mentality was a CNN interview on Thursday night with WikiLeaks founder Julian Assange conducted by Erin Burnett. It was to focus on newly released documents revealing secret efforts by US officials to pressure financial institutions to block WikiLeaks' funding after the group published classified documents allegedly leaked by Manning, a form of extra-legal punishment that should concern everyone, particularly journalists. But the CNN host was completely uninterested in the dangerous acts of her own government. Instead she repeatedly tried to get Assange to condemn the press policies of Ecuador, a tiny country that – quite unlike the US – exerts no influence beyond its borders. To the mavens of the US watchdog press, Assange and Manning are enemies to be scorned because they did the job that the US press corps refuses to do: namely, bringing transparency to the bad acts of the US government and its allies around the world. .... The resolution upgrading the Palestinians’ status to a nonmember observer state at the U.N. was approved by a vote of 138-9, with 41 abstentions, in the 193-member world body. A Palestinian flag was quickly unfurled on the floor of the General Assembly, behind the Palestinian delegation. ..... Real independence, however, remains an elusive dream until the Palestinians negotiate a peace deal with the Israelis, who warned that the General Assembly action will only delay a lasting solution. Israel still controls the West Bank, east Jerusalem and access to Gaza, and it accused the Palestinians of bypassing negotiations with the campaign to upgrade their U.N. status. The Palestinians still face enormous limitations. They don’t control their borders, airspace or trade, they have separate and competing governments in Gaza and the West Bank and they have no unified army or police. The United States immediately criticized the historic vote.“Today’s unfortunate and counterproductive resolution places further obstacles in the path peace,” U.N. Ambassador Susan Rice said. U.S. Secretary of State Hillary Rodham Clinton called the vote “unfortunate” and “counterproductive.” The United States and Israel voted against recognition, joined by Canada, the Czech Republic, the Marshall Islands, Micronesia, Nauru, Palau and Panama. ...... After the vote, Netanyahu said the U.N. move violated past agreements between Israel and the Palestinians and that Israel would act accordingly, without elaborating what steps it might take. Thursday’s vote came on the same day, Nov. 29, that the U.N. General Assembly in 1947 voted to recognize a partitioned state in Palestine, with the jubilant revelers then Jews. The Palestinians rejected that partition plan, and decades of tension and violence followed. ..... Just before Thursday’s vote, Israel’s U.N. ambassador, Ron Prosor, warned the General Assembly that “the Palestinians are turning their backs on peace” and that the U.N. can’t break the 4,000-year-old bond between the people of Israel and the land of Israel. (In its purest essence this conflict comes down to 'Who owns this land?' and who is the ultimate arbiter of that question? Their GOD, dontchaknow, a completely human-fabricated construct. -Ed.) The vote had been certain to succeed, with most member states sympathetic to the Palestinians. Several key countries, including France, this week announced they would support the move to elevate the Palestinians from the status of U.N. observer to nonmember observer state. ..... The Palestinians now can gain access to U.N. agencies and international bodies, most significantly the International Criminal Court, which could become a springboard for going after Israel for alleged war crimes or its ongoing settlement building on war-won land. However, in the run-up to the U.N. vote, Abbas signaled that he wants recognition to give him leverage in future talks with Israel, and not as a tool for confronting or delegitimizing Israel, as Israeli leaders have alleged. The vote of 138-9, with 41 abstentions tells us much about how nations around the globe view the U.S. and Israel military/economic aggression toward not just the Palestinians but the Middle East in general (given the ongoing effects of the Arab Spring) and most of the rest of The World at large. Another issue that looms large for The Planet is the global effects of climate change that the U.S. and its corporate allies have denied and tried to debunk through their massive GREENWASHING media efforts.     Lawmakers concerned about the health effects on humans from mountaintop removal coal mining set forth legislation in the U.S. House of Representatives today. Representatives Dennis Kucinich (OH), Louise Slaughter (NY), Maurice Hinchey (NY), Earl Blumenauer (OR), Lucille Roybal-Allard (CA), John Yarmuth (KY), Lynn Woolsey (CA), Judy Chu (CA), Raúl Grijalva (AZ), James Moran (VA), Michael Honda (CA), John Conyers (MI), and Keith Ellison (MN) introduced the Appalachian Communities Health Emergency (ACHE) Act H.R. 5959 which would place a moratorium on permitting for mountaintop removal coal mining until health studies are conducted by the Department of Health and Human Services.     Los Angeles-Long Beach Seaport Strike Quiets Nation’s Largest Container Ports by SilverVigiolante - lerical workers have shut down seven of eight terminals at the Port of Los Angeles (the 13th largest port in the US), along with six at Long Beach (the fourth largest port in the US, responsible for more than $100 billion in annual trade), on Wednesday after 10,000 workers refused to cross picket lines at the nation’s largest combined cargo complex. The strikes mark the biggest work stoppages at the ports in a decade, but comes on the heels of most holiday goods passing through the ports. Los Angeles and Long Beach are the nation’s first and second busiest container ports, respectively. California Sens.
