At the ThinkProgress.org Justice blog Ian Millhiser tells us Two Hours After A Court Strikes Down Obamacare Subsidies, Another Appeals Court Upholds Them A little after 10am Tuesday morning, two Republican judges on the United States Court of Appeals for the District of Columbia Circuit ordered much of the Affordable Care Act defunded. Just two hours later, another federal appeals court, the Fourth Circuit, issued a unanimous opinion upholding the same subsidies that were struck down in the DC Circuit’s order. As we explained this morning, both cases hinge upon a glorified typo in the Affordable Care Act. Obamacare gives states the option to run a health insurance exchange selling coverage to their residents, or they may elect to have the federal government run this exchange. If read in isolation, one line of the Affordable Care Act suggests that only “an Exchange established by the State” can offer subsidies to help people pay for health insurance in the exchange. The DC Circuit’s opinion relied on that line to conclude that federally-run exchange subsidies must be defunded.
Yet, as the Supreme Court has made clear — and as the Fourth Circuit reiterates in its opinion — a federal law should not be interpreted by reading a single line out of context. Rather, “a reviewing court should not confine itself to examining a particular statutory provision in isolation” as the “meaning—or ambiguity—of certain words or phrases may only become evident when placed in context.” A full explanation of why the DC Circuit misread the law and ignored other key provisions of the Affordable Care Act can be read here.
Unlike the DC Circuit’s opinion, the Fourth Circuit is a model of judicial restraint and humility. Although all three judges on the Fourth Circuit panel were nominated by Democratic presidents (Judge Roger Gregory, who authored the opinion, has the unusual distinction of being nominated by both President Clinton and the second President Bush), the majority opinion does not claim, as the DC Circuit did, that this case is a slam-dunk for their political party’s preferred outcome. Indeed, it claims that different provisions of the law seem to conflict with one another, and that the meaning of the statute is ambiguous. Though Judge Gregory’s opinion concludes that the Obama Administration “make[s] the better of the two cases” regarding how the law should be read, he also writes that “we are not convinced that either of the purported statutory conflicts render Congress’s intent clear.” Under the longstanding Chevron Doctrine, however, it is not the job of judges who are confronted with an ambiguous statute to read their preferred outcome into the law. Rather, the Supreme Court has ordered federal judges to defer to an agency’s reading of a law — in this case, the Internal Revenue Service (IRS) — so long as “the agency’s answer is based on a permissible construction of the statute.” “We ‘will not usurp an agency’s interpretive authority by supplanting its construction with our own,” Gregory writes, “so long as the interpretation is not ‘arbitrary, capricious, or manifestly contrary to the statute.’” ........... In the end, the battle between the Fourth Circuit and the DC Circuit is a battle over who gets to make law. Normally, that power rests with Congress, but when a law is ambiguous, the Supreme Court has long recognized that courts should defer to the Executive Branch. This rule achieves two ends. It ensures that agencies with expertise on a particular area of law get to interpret that law, rather than leaving matters to inexpert judges. And it also ensures that the people who make important policy decisions are ultimately accountable to the American people. If the electorate does not approve of the Obama Administration’s reading of this law, then the Fourth Circuit’s opinion permits them to vote for a different president who will read the law in a different way. The DC Circuit, however, would steal this decision away from the American people, and place it in the hands of a few unelected officials in black robes.

They Criticize What They Can’t Understand To the extent that there’s an argument against reading the ACA to include subsidies on the federal exchanges, it has to be that while Congress intended the subsidies to be available on both, reading the literal language of an isolated provision it says that the subsidies are only available on state exchanges, so tough luck. This is, to be clear, a terrible argument, but it’s the best one available. To my amazement, as I first saw on Twitter yesterday, some conservatives are arguing that Congress actually intended for the federal exchanges not to include subsidies. .................. This argument is…amazing. It may be true that many members of Congress were too optimistic about states creating their own exchanges. But we also know that Congress anticipated that some states would not create their own exchanges…because the statute gave the federal government the power to create exchanges when states wouldn’t. Ponnuru’s reading of the statute can’t explain why they bothered to do this at all. The actually existing Congress assumed that some states would not participate but wanted the exchanges available in all 50 states. So Ponnuru’s explanation is plainly wrong, and we’re left with an implicit assumption that Congress established the power to have the federal government to create exchanges but wanted them not to work, which is absurd. ......... But there’s a more fundamental problem with the arguments made by the majority of the D.C. Circuit panel and the Republicans cheering them on. The ACA was not written by Republicans — it was written by public officials who wanted to substantially increase access to medical care. The central function of the subsidies wasn’t to create incentives for state governments; it was to ensure that the non-affluent uninsured who didn’t qualify for Medicaid could purchase insurance on the exchanges. To not provide subsidies on the federal exchanges would defeat the very purpose for which they were constructed. If you understand the ACA from the standpoint of those who passed it, this couldn’t be more obvious. Conservatives trying to evaluate the goals of the ACA are like elephants trying to play a toy piano. And, needless to say, this is why as a first approximation zero supporters of the ACA either inside or outside Congress are persuaded by this latest ad hoc attack on the law. In addition to the other ways in which it’s silly it’s premised on not comprehending what the ACA was trying to accomplish. There has been previous use of an LRAD in Detroit on May 1, 2012 when Occupy Detroit gathered on the public sidewalk outside Grand Circus Park after park closing hours of 10pm. The use in 2012 was as a public address. The use in 2014 was to cause distress to those hearing the sound. Reporting for the Pittsburgh Tribune Brian Bowling tells us three years later on Wednesday, Nov. 14, 2012 Pittsburgh to pay researcher who suffered hearing loss during G-20 summit Pittsburgh leaders agreed to pay $72,000 to a professor who experienced permanent hearing loss during the September 2009 Group of 20 economic summit, when police used a highly focused loudspeaker on a neighborhood street, said Vic Walczak, legal director for the American Civil Liberties Union of Pennsylvania. The city also agreed to draft a policy on when and how police will deploy the Long Range Acoustic Device to avoid injuring others, he said on Wednesday. “Our contention all along was that this device should not be used as a weapon against protesters,” he said. “It was developed for wartime.” The settlement leaves the city with one pending lawsuit from the summit, a claim by 13 protesters that police violated their civil rights during arrests. The city and its insurer have paid $560,500 to settle G-20-related lawsuits. City solicitor Dan Regan said the city bought a $10 million police and professional liability insurance policy in advance of the summit, and that policy covered each settlement minus a $25,000 deductible. The city paid a $1.5 million premium for the policy. Although the settlements so far have cost less than the policy premium and deductible, Regan said the city made the right choice. “Settling these claims is also a business decision on the part of the city and its insurer,” he said. The city does not admit wrongdoing in any of the cases, even though it agreed to draft a policy for the LRAD, he said. Karen Piper, an English professor at the University of Missouri, was researching whether protesters have any effect on the International Monetary Fund and the World Bank. She says in the lawsuit that she was about 100 feet away from an LRAD when police used it to disperse protesters. “I am grateful that my case will serve as a deterrent to future users of the LRAD,” Piper said. “The LRAD should have no place on our American streets.” ....... Eleven vehicles passed through the Detroit Windsor Tunnel under the Detroit River. The Canadians rallied outside City Hall before heading for St. Peter's Episcopal Church to deliver the water. The water will be stored behind the church's sanctuary for people needing water after city shutoffs, said the Rev. Bill Wylie-Kellerman. Once the Canadian water is all distributed, "we'll be filling gallon jugs from our tap," he said. Wylie-Kellerman said his church will be a water station and said there will be several more like it in the city. The purpose of Israel's escalating assault on Gaza is to control the Territory's 1.4 trillion cubic feet of gas - and so keep Palestine poor and weak, gain massive export revenues, and avert its own domestic energy crisis. Israel's defence minister is on record confirming that military plans to uproot Hamas' are about securing control of Gaza's gas reserves. ...... Last Tuesday, Israeli defence minister and former Israeli Defence Force (IDF) chief of staff Moshe Ya'alon announced that Operation Protective Edge marks the beginning of a protracted assault on Hamas. The operation "won't end in just a few days", he said, adding that "we are preparing to expand the operation by all means standing at our disposal so as to continue striking Hamas." The price will be very heavy ... yes, $4 billion! But in 2007, a year before Operation Cast Lead, Ya'alon's concerns focused on the 1.4 trillion cubic feet of natural gas discovered in 2000 off the Gaza coast, valued at $4 billion. Ya'alon dismissed the notion that "Gaza gas can be a key driver of an economically more viable Palestinian state" as "misguided". The problem, he said is that "Proceeds of a Palestinian gas sale to Israel would likely not trickle down to help an impoverished Palestinian public. Rather, based on Israel's past experience, the proceeds will likely serve to fund further terror attacks against Israel ... "A gas transaction with the Palestinian Authority will, by definition, involve Hamas. Hamas will either benefit from the royalties or it will sabotage the project and launch attacks against Fatah, the gas installations, Israel - or all three ... "It is clear that without an overall military operation to uproot Hamas control of Gaza, no drilling work can take place without the consent of the radical Islamic movement." ........... Since the discovery of oil and gas in the Occupied Territories, resource competition has increasingly been at the heart of the conflict, motivated largely by Israel's increasing domestic energy woes. Mark Turner, founder of the Research Journalism Initiative, reported that the siege of Gaza and ensuing military pressure was designed to "eliminate" Hamas as "a viable political entity in Gaza" to generate a "political climate" conducive to a gas deal. This involved rehabilitating the defeated Fatah as the dominant political player in the West Bank, and "leveraging political tensions between the two parties, arming forces loyal to Abbas and the selective resumption of financial aid." Ya'alon's comments in 2007 illustrate that the Israeli cabinet is not just concerned about Hamas - but concerned that if Palestinians develop their own gas resources, the resulting economic transformation could in turn fundamentally increase Palestinian clout. ............. As Dr Gary Luft - an advisor to US Energy Security Council - wrote in the Journal of Energy Security, "with the depletion of Israel's domestic gas supplies accelerating, and without an imminent rise in Egyptian gas imports, Israel could face a power crisis in the next few years ..."If Israel is to continue to pursue its natural gas plans it must diversify its supply sources." Israel's new discoveries do not, as yet, offer an immediate solution as electricity prices reach record levels, heightening the imperative to diversify supply. This appears to be behind Prime Minister Netanyahu's announcement in February 2011 that it was now time to seal the Gaza gas deal. But even after a new round of negotiations was kick-started between the Fatah-led Palestinian Authority and Israel in September 2012, Hamas was excluded from these talks, and thus rejected the legitimacy of any deal. ........... For the Israeli government, Hamas continues to be the main obstacle to the finalisation of the gas deal. In the incumbent defence minister's words: "Israel's experience during the Oslo years indicates Palestinian gas profits would likely end up funding terrorism against Israel. The threat is not limited to Hamas ... It is impossible to prevent at least some of the gas proceeds from reaching Palestinian terror groups." The only option, therefore, is yet another "military operation to uproot Hamas". Unfortunately, for the IDF uprooting Hamas means destroying the group's perceived civilian support base - which is why Palestinian civilian casualties massively outweigh those of Israelis. Both are obviously reprehensible, but Israel's capacity to inflict destruction is simply far greater............ You are all right in that this war looks very much like the Syrian War. War Crimes happened in Syria and still do on both sides. The international bodies have and will say the same here. It's essentially a civil war, although Gaza is outside of Israel. How the Palestinians created their government for Gaza is as FUBAR as Maliki's government in Iraq. Israel has a different problem in that the government functions and has a first class military. The government is controlled by right-wing extremists. They should be the ones to pay for the war crimes. They need to be ejected from power. There have to be "cooler heads" in Israel to run that country. It's not Iraq.
