Dog Days of Summer! Sure signs of the Dog Days are the opening of NFL training camps and MLB heading into the final month of the season with all but a handful of teams officially eliminated from the post-season, many hovering around the .500 mark with an eye at their September schedule (even though they all proclaim it's "one game at a time" haha!) The Tribe is in the mix 6½ games out at 58-59 but will somehow have to catch fire soon with AL Central Division foes laden in their September schedule. NEOH never really had hugely hot-n-humid stretches this summer like normal (and the garden shows it). We'll be back later with more reports and STUFF so check back Sunday evening! Human Rights Watch has released this new report US: Surveillance Harming Journalism, Law, Democracy - Government Spying Undermines Media Freedom and Right to Counsel (Washington, DC) – Large-scale US surveillance is seriously hampering US-based journalists and lawyers in their work, Human Rights Watch and the American Civil Liberties Union said in a joint report released today. Surveillance is undermining media freedom and the right to counsel, and ultimately obstructing the American people’s ability to hold their government to account, the groups said. The 120-page report, “With Liberty to Monitor All: How Large-Scale US Surveillance is Harming Journalism, Law, and American Democracy,” is based on extensive interviews with dozens of journalists, lawyers, and senior US government officials. It documents how national security journalists and lawyers are adopting elaborate steps or otherwise modifying their practices to keep communications, sources, and other confidential information secure in light of revelations of unprecedented US government surveillance of electronic communications and transactions. The report finds that government surveillance and secrecy are undermining press freedom, the public’s right to information, and the right to counsel, all human rights essential to a healthy democracy. “The work of journalists and lawyers is central to our democracy,” said report author Alex Sinha, Aryeh Neier Fellow at Human Rights Watch and the American Civil Liberties Union. “When their work suffers, so do we."............... Many journalists described adopting elaborate techniques in an environment of tremendous uncertainty in an effort to protect evidence of their interaction with sources. The techniques ranged from using encryption and air-gapped computers (which stay completely isolated from unsecured networks, including the Internet), to communicating with sources through disposable “burner” phones, to abandoning electronic communications altogether. Those cumbersome new techniques are slowing down reporters in their pursuit of increasingly skittish sources, resulting in less information reaching the public. This situation has a direct effect on the public’s ability to obtain important information about government activities, and on the ability of the media to serve as a check on government, Human Rights Watch and the ACLU found. .................... For lawyers, large-scale surveillance has created concerns about their ability to meet their professional responsibilities to maintain confidentiality of information related to their clients. Failure to meet those responsibilities can result in discipline through professional organizations, or even lawsuits. ............. As with the journalists, lawyers increasingly feel pressure to adopt strategies to avoid leaving a digital trail that could be monitored. Some use burner phones, others seek out technologies designed to provide security, and still others reported traveling more for in-person meetings. Like journalists, some feel frustrated, and even offended, that they are in this situation. “I’ll be damned if I have to start acting like a drug dealer in order to protect my client’s confidentiality,” said one. The result of the anxieties over confidentiality is the erosion of the right to counsel, a pillar of procedural justice under human rights law and the US Constitution, Human Rights Watch and the ACLU found. ........... THEN David Sirota posts this Study: Government Blocks Specific Journalists From Accessing Information at OpEdNews.com As states move to hide details of government deals with Wall Street and as politicians come up with new arguments to defend secrecy, it was revealed this week that many government information officers block specific journalists they don't like from accessing information. The news comes as 47 federal inspectors general sent a letter to lawmakers criticizing "serious limitations on access to records" that they say have "impeded" their oversight work. The data about public information officers was compiled over the past few years by Kennesaw State University professor Carolyn Carlson. Her surveys found that 4 in 10 public information officers say "there are specific reporters they will not allow their staff to talk to due to problems with their stories in the past." "That horrified us that so many would do that," Carlson told the Columbia Journalism Review, which reported on her presentation at this week's conference of the Association for Education in Journalism and Mass Communication.
Carlson has conducted surveys of journalists and public information officers since 2012. In her most recent survey of 445 working journalists, four out of five reported that "their interviews must be approved" by government information officers, and "more than half of the reporters said they had actually been prohibited from interviewing [government] employees at least some of the time by public information officers." In recent years, there have been signs that the federal government is reducing the flow of public information. Reason Magazine has reported a 114 percent increase in Freedom of Information Act (FOIA) rejections by the Drug Enforcement Agency since President Obama took office. The National Security Agency has also issued blanket rejections of FOIA requests about its metadata program. And the Associated Press reported earlier this year that in 2013 "the government cited national security to withhold information a record 8,496 times -- a 57 percent increase over a year earlier and more than double Obama's first year." Those revelations foreshadowed this week's letter from more than half of the federal government's inspectors general saying that government agencies' move to hide information from them represents a "potentially serious challenge to the authority of every Inspector General and our ability to conduct our work thoroughly, independently, and in a timely manner." .............. Carlson's data from 2014 shows that three-quarters of journalists surveyed now agree with the statement that "the public is not getting the information it needs because of barriers agencies are imposing on journalists' reporting practices." Yet, despite that lament, the government's efforts to keep information secret may be having its intended effect on the psychology of journalists.......


Yves Smith at NakedCapitalism.com explains Access Journalism, Agnotology, and Breeding for Elite Incompetence refers to Sirota's article and adds There’s nothing quite like watching systems deliberately made worse, all in the name of better propaganda. One rapidly escalating trend among officials and government agencies is making more and more information, including decades-old material, either impossible to obtain or accessible only to journalists who are “trusted,” meaning they are deferential to authority and will put the best possible spin on what they are fed. This is deeply disturbing in a society that tries to maintain the veneer of being a democracy, since it keeps important information from the public and is clearly intended to preserve the image of particular organizations and shield them from what is likely to be well-deserved criticism. Anti-transparency policies are tantamount to anti-accountability. But at least as bad is the destructive effects on the sponsors of this dissimulation by omission. Yes, they may do better in the short term, but over time, they fall prey to the pathology of believing their own PR. They become convinced that their airbrushed photos and the adoring crowds that are carefully screened for their public appearances accurately reflect their performance and popularity. In more extreme versions, you wind up with Versailles behavior, for instance, when wealthy financiers lash out when anyone dares criticize them, because they’ve come to believe deeply in their own myth-making, that their success is the result of merit, as opposed to luck and conniving. ..................... In a disheartening bit of synchronicity, Lambert flagged a new article from the American Historical Association, Black Holes in the Predecisional Universe: Agencies Gain a New Justification for Secrecy, which describes how the CIA has scored a major legal win that allows it to withhold information, even decades-old information that Presidential libraries want to make public:
    .............The claim that the entire universe of “predecisional” documents–including any claimed “draft”–should be withheld from the public is in line with the agency’s information withholding strategy. The agency has found that it is much easier to withhold entire universes of documents than argue the merits of classification to protect US national security on a case-by-case, document-by-document basis. The CIA got its first taste of “universal withholding” when Congress passed the 1984 CIA Operational Files Exemption. Unlike other Freedom of Information Act exemptions, which can be applied after agencies search and locate requested documents, the Operational Files Exemption creates a universe of documents that the CIA does not even have to search for. This means that if a historian requests records for, say, Operation Phoenix, the CIA-led assassination program conducted during the Vietnam War, the CIA will reply–less than completely forthcomingly–that its search has returned no results. Admiral William McRaven, the Joint Special Operations Commander who oversaw the Osama bin Laden raid, knew about this transparency black hole: he ordered the FOIA-complying Department of Defense to purge its computers of all files on the Navy SEALs raid on bin Laden and send them to the CIA, where the Operational Files Exemption would keep them “safe” from search and review for release. Troublingly, the CIA’s withholding of its Bay of Pigs history is an attempt to keep another universe of documents from disclosure: those it claims are “predecisional.” The CIA is seeking this expansion because key figures within the US government have begun reviewing the CIA’s classification decisions and overruling the agency’s claims for the need of secrecy. The Interagency Security Classification Appeals Panel (ISCAP), housed at the US National Archives, overrules government classification claims in more than 70 percent of the documents it reviews (including those of the CIA). To avoid being overruled by ISCAP, the CIA has employed two tactics. First, it uses the Operational Files Exemption so that requesters cannot officially identify classified documents for ISCAP to review and overturn. Second, it has begun to stop withholding some documents because they are classified (which ISCAP could overturn) and instead withholds them because they are “predecisional” (which ISCAP has no authority to overturn). The CIA’s shell game is an affront to those who strive to compile an accurate history of US intelligence, foreign policy, and national security history. The CIA also strives to obstruct the declassification efforts of holders of releasable universes of documents, including the presidential libraries. At the presidential libraries, the CIA has installed a Remote Archives Capture (RAC) system where it claims authority to digitize all documents at the libraries and first crack at keeping them secret–often using the Operational Files or “predecisional” exemptions–before letting the library, and other agencies, review the documents for release. The RAC system was installed, at least partially, in reaction to the presidential libraries acting with too much autonomy in their declassification decisions and in releasing to the public documents the CIA wished to keep secret.

NOW Argentina files lawsuit against US over debt dispute at PressTV.com Argentina has attempted to sue the United States at the International Court of Justice (ICJ) in The Hague, the UN’s highest court, over a debt dispute. The lawsuit was filed on Thursday after a US judge blocked Argentina from servicing its restructured debt, with Buenos Aires accusing Washington of violating Argentinean sovereignty. New York District Judge Thomas Griesa has ruled to freeze Argentina’s June debt payment of $539 million in a US bank because two American hedge funds are demanding a full repayment of their money. The two hedge funds, NML Capital and Aurelius Capital Management, have been described by Argentina as "vulture funds" that are seeking profit out of the country’s financial misery. “Given that a state is responsible for the conduct of all the branches of its government, these violations have generated a controversy between the Republic of Argentina and the United States, which our country submits to the ICJ for resolution,” President Cristina Kirchner’s office said in a statement. However, the ICJ declined to take any action, claiming that it is powerless to act “unless and until the United States of America consents to the court’s jurisdiction.” Argentina’s 2001 economic collapse caused the country to default on more than $100 billion in debt. Argentina is still fighting to deal with the crisis. Last week, Argentinean Economy Minister Axel Kicillof went to New York to try to resolve the impasse on the eve of his country’s default. There, he slammed the US judge for his ruling. “A judge in one jurisdiction can’t be allowed to block the debt payments of an entire country,” he said. “There’s something called sovereignty.”
THE EDITORIAL BOARD at the New York Times now calls out The C.I.A.’s Reckless Breach of Trust .................. In March, John Brennan, the C.I.A. director, was indignant when Senator Dianne Feinstein charged that the agency had broken into computers used by staff investigators from the Senate Intelligence Committee, which she leads. “As far as the allegations of C.I.A. hacking into Senate computers,” he said, “nothing could be further from the truth. I mean, we wouldn’t do that. I mean, that’s just beyond the scope of reason.” But reason seems to have little to do with the C.I.A.’s operations, as Mr. Brennan apparently discovered far too late. On Thursday, the Central Intelligence Agency admitted that it did, indeed, use a fake online identity to break into the Senate’s computers, where documents connected to a secret report on the agency’s detention and torture program were being stored. Mr. Brennan apologized privately to Ms. Feinstein and to Senator Saxby Chambliss, the vice chairman of the intelligence committee, and promised to set up an accountability board to determine who did the hacking and whether and how they should be punished. The accountability and the apologies, however, will have to go much further. It’s not just two senators that the C.I.A. has offended by this shocking action. It is all of Congress and, by extension, the American public, which is paying for an intelligence agency that does not seem to understand the most fundamental concept of separation of powers. That concept means that Congress is supposed to oversee the intelligence community and rein in its excesses. It cannot possibly do so effectively if it is being spied on by the spy agency, which is supposed to be directing its efforts against foreign terrorists and other threats to national security. ................. Late last year, the agency suspected that Senate investigators had obtained an internal C.I.A. review of the torture program. Senate officials said the review was in a database they were allowed to see, but realized that the C.I.A. had broken into a private Senate computer server and found the review. A summary of an agency inspector general’s report, released Thursday, said C.I.A. hackers even read the emails of Senate staffers. Then they exhibited a “lack of candor” to agency investigators. In an extraordinary speech on the Senate floor in March, Ms. Feinstein accused the agency of having “undermined the constitutional framework essential to effective congressional oversight of intelligence activities or any other government function.” The institutional affront even drew Republican criticism. If the charge was true, said Senator Lindsey Graham, Republican of South Carolina, “heads should roll, and people should go to jail.” One of those heads may need to be Mr. Brennan’s. If he knew about the break-in, then he blatantly lied. If he did not, then apparently he was unaware of the lawless culture that has festered within the C.I.A. since the moment it was encouraged by George W. Bush and Dick Cheney to torture suspects and then lie about it. That recklessness extended to the point where agency officials thought nothing of burglarizing their own overseer. Senator Mark Udall of Colorado said the action was illegal and required the resignation of Mr. Brennan. The C.I.A. needs far more than a few quiet personnel changes, however. Obama's admission that the United States engaged in torture is an "admission" and would be admissible as credible evidence in a court of law. Obama is the head of the executive branch, and the OLC, where John Yoo worked, is also part of the executive branch. Thus, Obama's admission reflects back to the Office of Legal Counsel and directly to John Yoo, as the principal author of the Torture Memos. Yet, Yoo continues to teach law at UC Berkeley School of Law. Christopher Edley, while dean of Berkeley Law School, stated that investigation of Yoo would be appropriate if there was "clear professional misconduct." Meaning, was there "some breach of the professional ethics applicable to a government attorney - material to Professor Yoo's academic position? Did the writing of the memoranda and his related conduct violate a criminal or comparable statute?" Based on Obama's admission that the United States engaged in torture, there is credible evidence that Yoo's memoranda, in addition to being just plain bad, and legally inadequate, violated the law. Sujit Choudry, the new dean of Berkeley Law, understands that torture is morally, ethically and legally wrong. While working for the British Columbia Civil Liberties Association, Choudry represented a Guantanamo detainee against the Canadian government, in a case based on human rights abuses that occurred at Guantanamo. Obama's admission is yet one more reason Berkeley Law should open an investigation into John Yoo. On the outside of UC Berkeley Law School there is a quote from Justice Cardozo, stating students "will study the wisdom of the past [and] the precepts of justice." It's time for UC Berkeley Law to either investigate John Yoo, or remove Cardozo's words, and replace them with "Silence is Complicity."

(This will become important later on, as we shall see.) She also spent a year teaching English in Czechoslovakia, which I guess qualifies her for her current job, being a public spokesperson for the latest attempt to privatize American public education, Michelle (Big Grift) Rhee having apparently run her course as the rake in this long con, what with the cheating scandal and the big salary and all that sweet corporate sugar. The make-education-a-business scamsters needed a new face for the operation. Enter Campbell Brown, B.A. in political science, and professional communicator. (It's important now to mention that Senor Senor, the spousal unit in this lash-up, has been closely allied with Paul Singer, the vulture capitalist who has thrown a big piece of his ill-gotten booty into the school "reform" movement. Brown comes by her current job fairly directly.) So Brown is now out there shilling for the latest "reform" scheme -- using the courts to bust the teacher's unions and to deny public school teachers the freely-bargained rights to due process that ensure that they will not be altogether subject to the whims of local school board fanatics. She had a bit of a time of it with Stephen Colbert the other night, declining to name the people funding the crusade for which she is the mouthpiece. (It's nice to see she's transcended that nasty transparency tic so common to the members of her former profession. Senor Senor must be very thrilled.) The answer about her donors was rendered in fluent weaselspeak.
    When Colbert asked Brown who is funding her new Partnership for Educational Justice, she said she wouldn't reveal her donors. Why? Because, she said, she thought it was important to give anonymity to donors so that they wouldn't become "a target" of people who were protesting her appearance outside the studios before the show. "They are going to go after people who are funding us," she said.
Oh, my stars. Its it possible that many people who will lose their jobs cannot see the wisdom of Campbell Brown's position and may take steps to argue their own? Won't somebody please think of the children? ............... And, as Diane Ravitch points out, Brown has been working the system on behalf of this con for a long time. Ravitch sends us to this investigation by Mother Jones, which reveals that, in 2013, Brown went after public schools because, she said, there were "sexual predators" lurking in the halls and protected by, yes, teacher tenure. ............This is about political power, and that is all it's about, and Campbell Brown is the spokesperson for grifters and mountebanks, and that's all she is. Not that it matters, because Campbell Brown is Good On TV, and that's what's most important. The only thing her Partners For Educational Justice care less about than education, is justice.

NEXT at THE//INTERCEPT Cora Currier and Morgan Marquis-Boire discover more Leaked Files: German Spy Company Helped Bahrain Hack Arab Spring Protesters A notorious surveillance technology company that helps governments around the world spy on their citizens sold software to Bahrain during that country’s brutal response to the Arab Spring movement, according to leaked internal documents posted this week on the internet. The documents show that FinFisher, a German surveillance company, helped Bahrain install spyware on 77 computers, including those belonging to human rights lawyers and a now-jailed opposition leader, between 2010 and 2012—a period that includes Bahrain’s crackdown on pro-democracy protesters. FinFisher’s software gives remote spies total access to compromised computers. Some of the computers that were spied on appear to have been located in the United States and United Kingdom, according to a report from Bahrain Watch. Earlier this week, an anonymous hacker released 40 gigabytes of what appears to be internal data from FinFisher on Twitter and Reddit, including messages between people who appear to be Bahraini government officials and FinFisher customer service representatives. In those messages, Bahraini software administrators complained to FinFisher that they were “losing targets daily” due to faults in its software. In one message employing the language of a frustrated consumer, a spy appeared to complain that he or she had to keep re-infecting a targeted computer, risking detection: “[W]e cant stay bugging and infecting the target every time since it is very sensitive. and we don’t want the target to reach to know that someone is infecting his PC or spying on him” one message reads. On its website, FinFisher says it sells surveillance technology “exclusively to government law enforcement and intelligence agencies.” The company has previously denied reports that it sold spyware to Bahrain, claiming that examples researchers identified could have come from stolen or demonstration copies. The new documents, showing sustained correspondence between individuals in Bahrain and customer service, undercut that claim. FinFisher did not respond to requests for comment. ...................... Another targeted computer belonged to Mohamed Altajer, a prominent human rights lawyer who was blackmailed in 2011 with a video of him and his wife having sex. The video arrived via CD at his office on January 24, 2011, bearing instructions that he stop defending activists or the tape would be made public. On that same day, the leaked logs show, spyware was installed on his computer, suggesting that government officials used the blackmail gambit to install FinSpy. The video eventually became public in 2012, after Altajer participated in a UN human rights conference. “The 24th of January, 2011, was the most devastating day of my life,” said Altajer, reached in Bahrain. “I’m happy that this is exposed,” he said. “The regime should understand that it is not so wise and clever to keep penetrating into people’s lives. This is such an interesting and major development that it requires a much more subtle analysis than just the crude calculation of how much this might cost the EU or US. The greenback’s share of global reserves has already shrunk to under 61 percent from more than 72 percent in 2001. The drumbeat has only gotten louder since the financial crisis in 2008, an event that began in the U.S. when subprime-mortgage loans soured, and the largest emerging-market nations including Russia have vowed to conduct more business in their currencies. “The crisis created a rethink of the dollar-denominated world that we live in,” said Joseph Quinlan, chief market strategist at Bank of America Corp.’s U.S. Trust, which oversees about $380 billion. “This nasty turn between Russia and the West related to sanctions, that can be an accelerator toward a more multicurrency world.” It seems everything started going wrong for the American empire from 2001. I think future historians will mark that as the beginning of the rapid part of the end.

A statement issued by the ICJ, the United Nation’s highest court for disputes between nations, said Argentina’s request had been sent to the US government. It added that no action will be taken in the proceedings “unless and until” Washington accepts the court’s jurisdiction......
    Obama Celebrates the 50th Anniversary of the Gulf of Tonkin Resolution by Bombing Iraq by Michael Krieger — Fifty years ago yesterday, on August 7, 1964, Congress passed the now infamous Gulf of Tonkin resolution, which led to a massive escalation of America’s involvement in the Vietnam War. Without a formal declaration of war, the resolution permitted President Johnson to take “all necessary measures” to support South Vietnam, including armed forces.
