Grant Gross writes at ITWorld Lessig, Demand Progress support investigation of Swartz prosecutor Demand Progress, the tech activist group founded by the late Aaron Swartz, and Harvard law professor Lawrence Lessig have called on supporters to press the U.S. Congress to investigate Swartz's prosecuting attorney and to pass a law to decriminalize the type of hacking he was charged with. ........ Lessig, a long-time tech activist and commentator, and Demand Progress, a group founded by Swartz to fight the Stop Online Piracy Act, asked supporters to back an investigation by U.S. Representative Darrell Issa, a California Republican, into U.S. Attorney for Massachusetts Carmen Ortiz's prosecution of Swartz. Lessig and Demand Progress also asked supporters to contact their lawmakers in support of Aaron's Law, proposed legislation from Representative Zoe Lofgren, a California Democrat, that would amend the Computer Fraud and Abuse Act to decriminalize violations of terms of service agreements. "We spent Tuesday burying and mourning our friend Aaron," Lessig and Demand Progress said in a letter released Thursday. "We're sad, we're tired, we're frustrated -- and we're angry at a system that let this happen to Aaron. Now we want to set upon honoring his life's work and helping to make sure that such a travesty is never repeated." .......... Demand Progress is concerned that prosecutors could go after many TOS violations, said David Moon, program director for the group. "If a TOS violation is considered 'felony hacking,' simply breaking a website's rules (such as lying on a social network) could land you in court facing decades in prison," he said in an email. "A growing number of ordinary Americans are becoming less concerned about the effect of criminal hacking on their lives, and more concerned by our government's now persistent attempts to control the Internet and undermine its core principles." CLIMATE CHANGE UPDATE: National Climate Assessment details at The Guardian UK Climate change set to make America hotter, drier and more disaster-prone Future generations of Americans can expect to spend 25 days a year sweltering in temperatures above 100F (38C), with climate change on course to turn the country into a hotter, drier, and more disaster-prone place. The National Climate Assessment, released in draft form on Friday , provided the fullest picture to date of the real-time effects of climate change on US life, and the most likely consequences for the future. The 1,000-page report, the work of the more than 300 government scientists and outside experts, was unequivocal on the human causes of climate change, and on the links between climate change and extreme weather. "Climate change is already affecting the American people," the draft report said. "Certain types of weather events have become more frequent and/or intense including heat waves, heavy downpours and in some regions floods and drought. Sea level is rising, oceans are becoming more acidic, and glaciers and Arctic sea ice are melting." ....... The report states clearly that the steps taken by Obama so far to reduce emissions are "not close to sufficient" to prevent the most severe consequences of climate change. "As climate change and its impacts are becoming more prevalent, Americans face choices," the report said. "Beyond the next few decades, the amount of climate change will still largely be determined by the choices society makes about emissions. Lower emissions mean less future warming and less severe impacts. Higher emissions would mean more warming and more severe impacts." As the report made clear: no place in America had gone untouched by climate change. Nowhere would be entirely immune from the effects of future climate change. ..... The rise will be even steeper in future, with the next few decades projected for temperatures 2 to 4 degrees warmer in most areas. By 2100, if climate change continues on its present course, the country can expect to see 25 days a year with temperatures above 100F. Then in Canada Study provides damning evidence that tar sands development causing carcinogenic pollution in Alberta reporting for the NRDC at Elizabeth Shope’s Blog A study published yesterday in the Proceedings of the National Academy of Sciences (PNAS) provides damning evidence that tar sands development has been causing carcinogenic pollution in Alberta – not just in the immediate development region but even as far as 50 miles away. Today’s print edition of the New York Times features an article on the study entitled Oil Sands Industry in Canada Tied to Higher Carcinogen Level. As lead study author and Queen’s University Professor John Smol said to the New York Times, “Now we have the smoking gun.” The study published yesterday takes it a step farther than previous studies, showing a rise in polycyclic aromatic hydrocarbon (PAH) deposits after the industrial development of the tar sands. Put another way, [from the Tyee]:
    The study conclusively shows that bitumen pollution "is not natural, is increasing over time and the footprint of the industry is much bigger than anyone thought," says John Smol, one of Canada's leading freshwater ecologists, a Queen's University professor and a contributor to the study.

In Andrew Nikiforuk's The Tyee article on the study, Dr. David Schindler – not one of the authors of this study but the lead author of several other major studies about tar sands pollution – says that the findings of this study should “deep six once and for all the bullshit that all pollution from the tar sands is natural.” Dr. Schindler goes on to say about the study:
    It shows that as production rises, so does the pollution fallout from the project. It also implies that we need some means of controlling these stack emissions. It also reinforces the now well-documented fact that past monitoring has been substandard. This sort of contamination should have been easily detected a decade or more ago.
.... With the results of this study out, it’s more important than ever for the governments of Alberta and Canada to get to the root of the cancer issue in Fort Chipewyan. .... Tar sands production is creating a mess in Alberta, but it’s not just Albertans who should be concerned. If President Obama approves the Keystone XL tar sands pipeline, the U.S. will be further aiding this pollution. The draft environmental review for the “northern segment” of the Keystone XL pipeline is expected any day, and should include information about the upstream impacts of tar sands extraction – not just the greenhouse gas emissions but also these carcinogenic and other disease-causing pollutants being caused by the rapid expansion of this extra dirty fuel.
Then Steve Horn of DeSmogBlog reports Breaking: Obama EPA Shut Down Weatherford, TX Shale Gas Water Contamination Study The Associated Press has a breaking investigative story out today revealing that the Obama Administration's Environmental Protection Agency (EPA) censored a smoking gun scientific report in March 2012 that it had contracted out to a scientist who conducted field data on 32 water samples in Weatherford, TX. That report, according to the AP, would have explicitly linked methane migration to hydraulic fracturing ("fracking") in Weatherford, a city with 25,000+ citizens located in the heart of the Barnett Shale geologic formation 30 minutes from Dallas. ........ Despite this smoking gun, everything was soon shut down, with the Obama EPA reversing its emergency order, terminating the court battle and censoring Thyne's report. The AP explained that the Obama EPA has "refused to answer questions about the decision." "I just can't believe that an agency that knows the truth about something like that, or has evidence like this, wouldn't use it," Lipsky, who now pays $1,000 a month to have water hauled to his family's house, told the AP..... Robert Parry at Consortiumnews explains America’s War for Reality The real struggle confronting the United States is not between the Right and the Left in any traditional sense, but between those who believe in reality and those who are entranced by unreality. It is a battle that is testing whether fact-based people have the same determination to fight for their real-world view as those who operate in a fact-free space do in defending their illusions. These battle lines do relate somewhat to the Right/Left divide because today’s right-wing has embraced ideological propaganda as truth more aggressively and completely than those on the Left, though the Left (and the Center, too) are surely not immune from the practice of ignoring facts in pursuit of some useful agit-prop. But key elements of the American Right have set up permanent residence in the world of make-believe, making any commonsense approach to the real-world challenges nearly politically impossible. The Right’s fantasists also have the passions of true-believers, like a cult that gets angrier the more its views are questioned. So, it doesn’t matter that scientific evidence proves global warming is real; the deniers will insist the facts are simply a government ploy to impose “tyranny.” It doesn’t matter how many schoolchildren are slaughtered by semi-automatic assault rifles – or what the real history of the Second Amendment was. To the gun fanatics, the Framers wanted armed rebellion against the non-violent political process they worked so hard to create. ..... The American Right’s collective departure from reality can be traced back decades, but clearly accelerated with the emergence of former actor Ronald Reagan on the national stage. Even his admirers acknowledge that Reagan had a strained relationship with facts, preferring to illustrate his points with distorted or apocryphal anecdotes. ........... This combination of dysfunction contributed to the rise of the Tea Party and the Republican congressional victories in 2010. But Election 2012, with Obama’s reelection and a general rejection of Tea Party fanaticism, has created the chance of a do-over for American rationalists. After all, the United States continues to see the consequences of three decades of right-wing delusions, including high unemployment; massive deficits; self-inflicted financial crises; a degraded middle class; poor health care for millions; a crumbling infrastructure; an overheating planet; costly foreign wars; a bloated Pentagon budget; and children massacred by troubled young men with ridiculously easy access to semi-automatic assault rifles. Yet, if rational and pragmatic solutions are ever going to be applied to these problems, it is not just going to require that President Obama display more spine. The country is going to need its conscious inhabitants of the real world to stand up with at least the same determination as the deluded denizens of the made-up world. Of course, this fight will be nasty and unpleasant. It will require resources, patience and toughness. But there is no other answer. A sensible deficit reduction package must also include significant cuts to unnecessary and wasteful Pentagon spending. IN a related matter Chris Cillizza explains Why Republicans caved on the debt ceiling Days after President Obama held a press conference re-asserting his refusal to negotiate with Republicans on raising the debt ceiling, House GOP leaders announced Friday they would move to extend the country’s credit limit for another three months. ..... It’s an interesting — and smart — gambit by House Republicans who have done very little interesting or smart in terms of political strategy of late. The simple fact is that trying to go toe to toe with President Obama is a loser for the GOP at the moment. In a Washington Post-ABC News national poll released earlier this week, 55 percent of those tested approved of the job Obama was doing while just 24 percent said the same of House Republicans. Add those numbers to the fact that Republicans have no obvious foil for Obama — House Speaker John Boehner, who had been playing that role, was knee-capped by his own conference during the fiscal cliff negotiations — and it’s clear that Republicans are simply in no position at the moment to win a political fight with the president. By postponing a potential debt ceiling showdown and instead making their stand on the sequester (and, to a lesser extent the continuing resolution that must be passed to fund the federal government) the Republican-controlled House pits itself against a less popular political entity: the Senate. “We would like to open a fight against the Senate as opposed to Obama,” said one senior GOPer. “[Senate Majority Leader] Harry Reid has gotten off scot-free in terms of being held responsible for this out-of-control deficit and the breakdown of the budgeting process.” This strategic move by House Republicans is not without short-term and longer-term risks, of course. ..... Over at ProPublica.com Justin Elliot reports Revealed: America’s Arms Sales To Bahrain Amid Bloody Crackdown Despite Bahrain’s bloody crackdown on pro-democracy protesters, the U.S. has continued to provide weapons and maintenance to the small Mideast nation. Defense Department documents released to ProPublica give the fullest picture yet of the arms sales: The list includes ammunition, combat vehicle parts, communications equipment, Blackhawk helicopters, and an unidentified missile system. (Read the documents.) The documents, which were provided in response to a Freedom of Information Act request and cover a yearlong period ending in February 2012, still leave many questions unanswered. It’s not clear whether in each case the arms listed have been delivered. And some entries that only cite the names of weapons may in fact refer to maintenance or spare parts. Defense Department spokesman Paul Ebner declined to offer any more detail. “We won’t get into specifics in any of these because of the security of Bahrain,” said Ebner. While the U.S. has maintained it is selling Bahrain arms only for external defense, human rights advocates say the documents raise questions about items that could be used against civilian protesters. “The U.S. government should not be providing additional military equipment that could make matters worse,” said Sunjeev Bery, Middle East advocacy director for Amnesty International USA. There have been reports that Bahrain used American-made helicopters to fire on protesters in the most intense period of the crackdown. Time magazine reported in mid-March 2011 that Cobra helicopters had conducted "live ammunition air strikes" on protesters....... The Obama administration has stood by Bahrain’s ruling family, who are Sunni, during nearly two years of protests by the country’s majority Shia population. Bahrain is a longtime ally and the home to a large American naval base, which is considered particularly important amid the current tensions with nearby Iran. .... State Department spokesman Noel Clay told ProPublica, “We continue to withhold the export of lethal and crowd-control items intended predominately for internal security purposes, and have resumed on a case-by-case basis items related exclusively to external defense, counter-terrorism, and the protection of U.S. forces.” The U.S. has also sold Bahrain a helicopter fit for the royal family. ...... For updates on the attack on BP's natural gas plant see Chris Irvine's Algeria BP attack: latest at the Telegraph while the Guardian's Glenn Greenwald explains the blowback in The bombing of Mali highlights all the lessons of western intervention As French war planes bomb Mali, there is one simple statistic that provides the key context: this west African nation of 15 million people is the eighth country in which western powers - over the last four years alone - have bombed and killed Muslims - after Iraq, Afghanistan, Pakistan, Yemen, Libya, Somalia and the Philippines (that does not count the numerous lethal tyrannies propped up by the west in that region). For obvious reasons, the rhetoric that the west is not at war with the Islamic world grows increasingly hollow with each new expansion of this militarism. But within this new massive bombing campaign, one finds most of the vital lessons about western intervention that, typically, are steadfastly ignored. ....... As Owen Jones wrote in an excellent column this morning in the Independent:
    "This intervention is itself the consequence of another. The Libyan war is frequently touted as a success story for liberal interventionism. Yet the toppling of Muammar Gaddafi's dictatorship had consequences that Western intelligence services probably never even bothered to imagine. Tuaregs – who traditionally hailed from northern Mali – made up a large portion of his army. When Gaddafi was ejected from power, they returned to their homeland: sometimes forcibly so as black Africans came under attack in post-Gaddafi Libya, an uncomfortable fact largely ignored by the Western media. . . . [T]he Libyan war was seen as a success . . . and here we are now engaging with its catastrophic blowback."
...... As always, western governments are well aware of this consequence and yet proceed anyway. The NYT notes that the French bombing campaign was launched "in the face of longstanding American warnings that a Western assault on the Islamist stronghold could rally jihadists around the world and prompt terrorist attacks as far away as Europe." Indeed, at the same time that the French are now killing civilians in Mali, a joint French-US raid in Somalia caused the deaths of "at least eight civilians, including two women and two children". To believe that the US and its allies can just continue to go around the world, in country after country, and bomb and kill innocent people - Muslims - and not be targeted with "terrorist" attacks is, for obvious reasons, lunacy. As Bradford University professor Paul Rogers told Jones, the bombing of Mali "will be portrayed as 'one more example of an assault on Islam'". Whatever hopes that may exist for an end to the "war on terror" are systematically destroyed by ongoing aggression. .....

Reporting for The Black Agenda Report Radio we go to Glenn Ford The Master as “Guest”: The U.S. Military Swarms Over Africa ...... So, although there is no doubt that the U.S. will be deeply involved in the impending military operation in Mali, the 2nd Brigade’s deployment is a much larger assignment, aimed at making all of Africa a theater of U.S. military operations. The situation in Mali is simply a convenient, after-the-fact rationale for a long-planned expansion of the U.S. military footprint in Africa. The Pentagon’s larger purpose in placing an army brigade on roving duty all across the continent is to acclimate African commanders to hosting a permanent, large scale U.S. presence. This is a very different kind of invasion – more like an infiltration-in-force. The Pentagon’s strategy is designed to reinforce relationships that the U.S. Africa Command has been cultivating with African militaries since the establishment of AFRICOM during George Bush’s last year in office. As an infiltrating force, AFRICOM has been a phenomenal success. Militarily speaking, the African Union has become an annex of the Pentagon. The AU’s biggest operation, in Somalia, is armed, financed and directed by the U.S. military and CIA. The 17,000 African troops on so-called peace-keeping duty in Somalia are, for all practical purposes, mercenaries for the Americans – although poorly paid ones. Ethiopian and Kenyan forces act as extensions of U.S. power in the East Africa. U.S. Special Forces roam the Democratic Republic of Congo, Uganda, South Sudan, and the Central African Republic – ostensibly looking for the fugitive warlord Joseph Kony but, in reality, establishing a web of U.S. military infrastructures throughout center of the continent. Uganda and Rwanda keep the eastern Congo’s mineral riches safe for U.S. and European corporations – at the cost of 6 million Congolese lives. Their militaries are on the Pentagon’s payroll. ......... The creeping, continental U.S. expeditionary force, soon to be spearheaded by the 1st Infantry Division’s 2nd Brigade, will bunk down in African military bases throughout the continent, not as invaders, but as guests. Guests who pay the bills and provide the weapons for African armies whose mission has nothing to do with national independence and self-determination. Three generations after the beginnings of decolonization, the African soldier is once again bowing to the foreign master. And the Beltway Bubalas will surely cover every Shiny Object under the sun about it anyway. We do have a few words about Aaron Swartz. The world lost a great innovator in Aaron. With his successes of the now-common RSS and REDDIT the government sapped nearly all his money he made from these inventions and he was looking at having his parents put up their house to help pay for the costly defense he would have needed had the prosecutors went forward with their crazed obsession to "get him". This is just THE LATEST example of Obama's War on Whistleblowers. From continuing and expanding bu$h's illegal wiretapping of U.S. citizens, the prosecution of Bradley Manning and the ongoing financial blockade of wikileaks and its founder Julian Assange to the government's infiltration of Occupy and the ongoing weaponization of U.S. police forces we are witnessing an unparalleled unbridled power of government over its citizens. Just as the U.S.'s willingness to attack any nation it deems "harboring terrorists" and its "Kill List" sets a precedent for any other nation to attack another (despite international law saying otherwise) we are now seeing how this policy is being turned inward. If it weren't for Aaron's successful fight against SOPA/PIPA we would be living in a very different on-line world, one where copyright holders would have free reign over what content gets posted where. And BE SURE those forces that want to restrict the Free and Open Internet will be back again. Who will be there to alert us stop them next time? At only 26, Aaron did more in his time in this world that many activists haven't even done in a long full lifetime. To say Aaron was a genius is an understatement. In the I.T. world we have the FaceBuuk phenom Mark Zuckerberg with his ominous and scary moving target of "Terms of Service", Larry Page and Sergey Brin of Google who proclaim "Do no harm" but assist the government in their spying and Bill Gates who wholly supports GMOs around the world and even the late much-lauded Steve Jobs whose Apple brand has been exploiting workers for years. Aaron was equally or more brilliant than these men but was motivated by a completely different set of principles that can be boiled down to "Knowledge is Power" and that our collective knowledge must be shared and spread. From the MIT Technology Review Why Aaron Swartz’s Ideas Matter ... Swartz clearly touched the lives of those who knew him well in unique and wonderful ways, and the tributes posted online are testament to a special human being. But those who never knew him were affected as well—through the technologies he developed, his contributions to projects such as Wikipedia and the Internet Archive, and his untiring efforts to create a new understanding of digital rights and ownership, most prominently by helping create the Creative Commons. In February of last year we interviewed him about his philosophy, and about his involvement in the campaign opposing SOPA, a bill that would’ve imposed more stringent rules on the sharing of digital information online (see “Aaron Swartz Hacks the Attention Economy”). You can read more about ideas in his 2008 “Guerilla Open Access Manifesto,” and you’ll find more of his writings in a collection gathered by the Internet Archive. ..... But it was in his role as a digital provocateur that his brilliance shone most brightly. By working on the technical standards for the Creative Commons, he helped extend the legal framework behind the free software movement to other creative endeavors. The impact is felt across the Internet and has helped reshape the public’s understanding of digital property rights more generally...... A brilliant powerful voice for our open internet and open society at-large has been lost, silenced. Who knows how many more groundbreaking inventions and ideas he would have come up with, imagined, engineered then put into practice had he survived? We'll never know. So now we can only hope another brilliant activist will come up through the ranks, barnstorm the internet/copyright barricades and show us the way. Rest in Peace Aaron. We miss you terribly already.

The 1st Amendment is Our Permit Our permit to occupy is The First Amendment. Quickly sign the following statement which will be delivered to mayors, police chiefs and major media across the country:

    Our permit to occupy public squares and parks is in The First Amendment, which affirms "the right of the people peaceably to assemble, and to petition the Government for a redress of grievances." When people across the Middle East occupied public squares, leaders in Washington mostly cheered those protesters and warned Middle Eastern governments not to use force to clear them. Those other societies don’t have a First Amendment. Yet Washington affirmed the universal right to assembly and protest. We do have a First Amendment. The force being used to clear nonviolent protesters from public squares in our country is unacceptable. It must stop.
