Snowed in Russia We begin with this STASI UPDATE: At TruthDig.com Robert Scheer explains The Good Germans in Government What a disgrace. The U.S. government, cheered on by much of the media, launches an international manhunt to capture a young American whose crime is that he dared challenge the excess of state power. Read the Fourth Amendment to the U.S. Constitution and tell me that Edward Snowden is not a hero in the mold of those who founded this republic. Check out the Nuremberg war crime trials and ponder our current contempt for the importance of individual conscience as a civic obligation. Yes, Snowden has admitted that he violated the terms of his employment at Booz Allen Hamilton, which has the power to grant security clearances as well as profiting mightily from spying on the American taxpayers who pay to be spied on without ever being told that is where their tax dollars are going. Snowden violated the law in the same way that Daniel Ellsberg did when, as a RAND Corporation employee, he leaked the damning Pentagon Papers study of the Vietnam War that the taxpayers had paid for but were not allowed to read. In both instances, violating a government order was mandated by the principle that the United States trumpeted before the world in the Nuremberg war crime trials of German officers and officials. As Principle IV of what came to be known as the Nuremberg Code states: “The fact that a person acted pursuant to order of his government or of a superior does not relieve him from responsibility under international law, provided a moral choice was in fact possible to him.” That is a heavy obligation, and the question we should be asking is not why do folks like Ellsberg, Snowden and Bradley Manning do the right thing, but rather why aren’t we bringing charges against the many others with access to such damning data of government malfeasance who remain silent? ........ John Lewis (D-GA) urged Congress to enact legislation that would protect the freedom to vote on Tuesday, just hours after the Supreme Court struck down a portion of the Voting Rights Act that stopped discriminatory voting laws from going into effect in areas of the country with histories of disenfranchisement. In a 5 to 4 opinion written by Chief Justice John Roberts, the Court ruled that Section 4, which establishes the formula that determines which jurisdictions are subject to federal “preclearance” of changes in election laws, is unconstitutional. Congress will now have to decide which areas of the country still deserve additional federal scrutiny. “These men that voted to strip the Voting Rights Act of its power, they never stood in unmovable lines,” Lewis told MSNBC’s Andrea Mitchell. “They never had to pass a so-called literacy test. It took us almost 100 years to get where we are today. So will it take another 100 years to fix it, to change it?” he asked. Watch it: at the link! Michael Isakoff at NBC News is reporting General in leak probe quit Pentagon post suddenly, citing health reasons The four-star general who is the target of a leak investigation suddenly resigned from his Pentagon advisory job in January for “health reasons” – just as FBI investigators were focusing on him, according to legal sources. As NBC News revealed Thursday, retired Marine Gen. James “Hoss” Cartwright has received a target letter informing him that he’s under investigation for allegedly leaking information about a massive U.S. cyberattack on Iran’s nuclear facilities using the computer worm Stuxnet, according to legal sources. ...... Greg Miller and Sari Horwitz at WaPo follow up with Justice Dept. targets general in leak probe A retired four-star Marine Corps general who served as the nation’s second-ranking military officer is a target of a Justice Department investigation into a leak of information about a covert U.S.-Israeli cyberattack on Iran’s nuclear program, a senior Obama administration official said. Retired Gen. James E. “Hoss” Cartwright served as deputy chairman of the Joint Chiefs of Staff and was part of President Obama’s inner circle on a range of critical national security issues before he retired in 2011. Cartwright, who helped launch that campaign under President Bush and pushed for its escalation under Obama, was recently informed that he was a “target” of a wide-ranging Justice Department probe into the leak, according to the senior official, who spoke on the condition of anonymity because the investigation is ongoing. Justice Department officials declined to comment on the case, as did Marcia Murphy, a spokeswoman for the U.S. attorney’s office in Maryland, which is in charge of the investigation. Neither Cartwright nor his attorney, former White House counsel Greg Craig, responded to requests for comment. The revelation, which was first reported by NBC News, means that an administration that has already launched more leaks prosecutions than all of its predecessors combined is now focused on one of its own. Since Obama took office, the Justice Department has prosecuted or charged eight people for alleged violations of the Espionage Act. ..... The investigation into the Stuxnet leak was launched in June 2012 by Attorney General Eric H. Holder Jr. and gained momentum in recent months amid indications that prosecutors were putting pressure on a range of current and former senior officials suspected of involvement. ..... The narrative may not be as elegant as Graham Greene's, but the plot certainly beats the Bourne trilogy - because it's happening live, in real time, right in front of our eyes. It takes a former CIA asset to beat US "intelligence" - more like intel deprivation. ..... Asia Times Online had also learned from another source close to Snowden's tight circle that a short stint in Hong Kong was always part of Plan A; he never intended to ask for political asylum in either Hong Kong or China. He was already focused on a "third country". What he did was to use Hong Kong as an ideal platform to unveil the inner workings of the Orwellian/Panopticon US surveillance state. First a set of general revelations to The Guardian. Then he went underground to prepare his escape - as he knew Washington would come after him with all guns (drones?) blazing. And then, a final set of revelations to the South China Morning Post closely focused on Asia and China. When Washington woke up to it, he was already out of the building. Jason Bourne, eat your heart out. Snowden was not "allowed to slip away". It all revolved around a meticulously timed operation involving Snowden, the Hong Kong government and WikiLeaks mediation. ......... The predictable fury across Capitol Hill, with plenty of "hostile nations" rhetoric coupled with the inevitable demonizing of Russian President Vladimir Putin, not to mention NSA spy chief General Keith Alexander, among the usual platitudes about "defending this nation from a terrorist attack", depicting Snowden as an " individual who is not acting, in my opinion, with noble intent" - this all reads like lazily written lines in a cheap spy thriller. For the Empire, getting a bloody eye is not taken lightly. Washington is left with wishful thinking that Moscow might detain Snowden. Rubbish. Foreign Minister Sergey Lavrov had even advanced that Russia would consider granting political asylum if Snowden asked for it. And what about this priceless quote from Dmitry Peskov, Putin's spokesman? "I know nothing." Haha! Shades of Sgt. Schultz from Hogan's Heroes! At RT we hear from former KGB Lt. Colonel Vladimir Putin: Snowden still in Moscow airport, won't be extradited, free to go anywhere Former NSA contractor Snowden remains in the transit zone of a Moscow airport. President Putin said that Snowden never crossed the Russian border and doesn’t fall under any extradition treaty. He called accusations against Russia “nonsense and rubbish.” “It is true that Snowden has arrived to Moscow, and it really came as a surprise for us. He arrived as a transit passenger, and didn't need a [Russian] visa, or any other documents. As a transit passenger he is entitled to buy a ticket and fly to wherever he wants,” Vladimir Putin said as he spoke to journalists in Finland. ...... “We can only extradite any foreign citizens to such countries with which we have signed the appropriate international agreements on criminal extradition” ...... "Snowden is a free person. The sooner he chooses his final destination, the better it is for him and Russia" “Just like Snowden, he considers himself a rights advocate and fights for sharing information. Ask yourself: should or should not people like these be extradited to be later put to jail?” “In any case, I would like not to deal with such issues because it is like shearing a pig: there's lots of squealing and little fleece,” he said. ........ Pepe Escobar also points to this op-ed by Valerie Plame Wilson and Joe Wilson at Guardian UK's "Comment is Free" who know a thing or three about "leaks" The NSA's metastasised intelligence-industrial complex is ripe for abuse Let's be absolutely clear about the news that the NSA collects massive amounts of information on US citizens – from emails, to telephone calls, to videos, under the Prism program and other Fisa court orders: this story has nothing to do with Edward Snowden. As interesting as his flight to Hong Kong might be, the pole-dancing girlfriend, and interviews from undisclosed locations, his fate is just a sideshow to the essential issues of national security versus constitutional guarantees of privacy, which his disclosures have surfaced in sharp relief. Snowden will be hunted relentlessly and, when finally found, with glee, brought back to the US in handcuffs and severely punished. (If Private Bradley Manning's obscene conditions while incarcerated are any indication, it won't be pleasant for Snowden either, even while awaiting trial.) Snowden has already been the object of scorn and derision from the Washington establishment and mainstream media, but, once again, the focus is misplaced on the transiently shiny object. The relevant issue should be: what exactly is the US government doing in the people's name to "keep us safe" from terrorists? ...... The shock and surprise that Snowden exposed these secrets is hard to understand when over 1.4 million Americans hold "top secret" security clearances. When that many have access to sensitive information, is it really so difficult to envision a leak? We are now dealing with a vast intelligence-industrial complex that is largely unaccountable to its citizens. This alarming, unchecked growth of the intelligence sector and the increasingly heavy reliance on subcontractors to carry out core intelligence tasks – now estimated to account for approximately 60% of the intelligence budget – have intensified since the 9/11 attacks and what was, arguably, our regrettable over-reaction to them. The roots of this trend go back at least as far as the Reagan era, when the political right became obsessed with limiting government and denigrating those who worked for the public sector. ....... There are no J Edgar Hoover-like "enemy lists" … yet. But it is not so difficult to envision a scenario where any of us has a link, via a friend of a friend, to someone on the terrorist watchlist. What then? You may have no idea who this person is, but a supercomputer in Fort Meade (or, soon, at the Utah Data Center near Salt Lake City) will have made this connection. And then you could have some explaining to do to an over-zealous prosecutor. ........ As it now stands, these programs are ripe for abuse unless we establish ground rules and barriers between authentic national security interests and potential political chicanery. ...... Good item! At the end of Greenwald's Monday interview with Amy Gooodman last Monday he recommends everyone read this report in McClatchy by Marisa Taylor and Jonathan S. Landay Obama’s crackdown views leaks as aiding enemies of U.S. Even before a former U.S. intelligence contractor exposed the secret collection of Americans’ phone records, the Obama administration was pressing a government-wide crackdown on security threats that requires federal employees to keep closer tabs on their co-workers and exhorts managers to punish those who fail to report their suspicions. President Barack Obama’s unprecedented initiative, known as the Insider Threat Program, is sweeping in its reach. It has received scant public attention even though it extends beyond the U.S. national security bureaucracies to most federal departments and agencies nationwide, including the Peace Corps, the Social Security Administration and the Education and Agriculture departments. It emphasizes leaks of classified material, but catchall definitions of “insider threat” give agencies latitude to pursue and penalize a range of other conduct. Government documents reviewed by McClatchy illustrate how some agencies are using that latitude to pursue unauthorized disclosures of any information, not just classified material. They also show how millions of federal employees and contractors must watch for “high-risk persons or behaviors” among co-workers and could face penalties, including criminal charges, for failing to report them. Leaks to the media are equated with espionage. “Hammer this fact home . . . leaking is tantamount to aiding the enemies of the United States,” says a June 1, 2012, Defense Department strategy for the program that was obtained by McClatchy. ........ Michael Calderone at HuffPoAOL explains last week's Glenn Greenwald interview on Meet The David (he of the Karl Rove Dance) Glenn Greenwald: 'Meet The Press' Interview Validates 'Incestuous' Washington Media Critique For years, Guardian columnist Glenn Greenwald has argued that journalists in Washington often seem too cozy with the political figures they’re supposed to hold accountable and too quick to amplify the government’s perspective on national security. "Meet the Press" host David Gregory’s suggestion Sunday that Greenwald “aided and abetted” NSA whistleblower Edward Snowden, his source for a series of bombshell stories, only seemed to validate that viewpoint. “At some level, I feel like it's Christmas and I’ve been given the greatest, best gift that I could wish for,” Greenwald told HuffPost Monday by phone from Rio de Janeiro. “My critique of the D.C. media has long been that instead of being adversaries to government power -- to the government and political power -- they’re servants to it and mouthpieces for it.” Greenwald said that Gregory was doing the work of the Justice Department by putting "together a theory in public about why I, as a journalist, should be prosecuted," along with or "call[ing] into question that I’m a journalist at all." That interview, he said, exemplified the "critique that they’re so in bed with the circles of political power over which they’re supposed to acting as watchdogs -- that they really have become nothing more than just appendages." ....... "To the extent that you have aided and abetted Snowden, even in his current movements, why shouldn't you, Mr. Greenwald, be charged with a crime?" Gregory asked. ..... During Sunday's broadcast, Greenwald expressed surprise that “anybody who would call themselves a journalist would publicly muse about whether or not other journalists should be charged with felonies.” Gregory responded that the "question of who's a journalist may be up to a debate with regard to what you're doing.”..... While Greenwald came to the media world with an activist background, his recent actions concerning the NSA coverage –- reporting, expressing a point of view, maintaining a source relationship –- would fall under journalism. ...... Greenwald said he had no objection to being asked about whether he should be arrested, given that some political and media figures have suggested it. The problem, Greenwald said, is that Gregory seemed to endorse the idea himself, and “embedded into his question this completely baseless, reckless assumption that I had aided and abetted him.” “It’s like saying, to the extent that you molested children, should you be arrested as a pedophile?” he continued. “It assumes that I’ve done something that he has no evidence to suggest I’ve actually done. It’s an accusatory question. It’s not just a question; it’s an accusation.” ...... More! David Sirota at Salon.com picks up on this asking Why shouldn’t David Gregory be charged with a crime? Two weeks into the hullabaloo surrounding whistle-blower Edward Snowden and Guardian reporter Glenn Greenwald, one thing is clear: They did not just reveal potentially serious crimes perpetrated by the government — including possible perjury, unlawful spying and unconstitutional surveillance. They also laid bare in historic fashion the powerful double standards that now define most U.S. media coverage of the American government — the kind that portray those who challenge power as criminals, and those who worship it as heroes deserving legal immunity. Indeed, after “Meet the Press” host David Gregory’s instantly notorious performance yesterday, it is clear Snowden’s revelations so brazenly exposed these double standards that it will be difficult for the Washington press corps to ever successfully hide them again. The best way to see these double standards is to ponder 10 simple questions.

During that “Meet the Press” discussion yesterday of Greenwald publishing stories about Snowden’s disclosures, Gregory asked Greenwald, “Why shouldn’t you, Mr. Greenwald, be charged with a crime?” Beyond the odiousness of a supposed journalist like Gregory seeming to endorse criminal charges against journalists for the alleged crime of committing journalism, there’s an even more poignant question suggested by Mother Jones’ David Corn: Why hasn’t David Gregory asked reporters at the Washington Post, the Associated Press and Bloomberg News the same question, considering their publication of similar leaks? Is it because Greenwald is seen as representing a form of journalism too adversarial toward the government, while those establishment outlets are still held in Good Standing by Washington? ......
  • 3. Later during the “Meet the Press’” discussion of Greenwald’s reporting, NBC’s Chuck Todd demanded to know, “How much was (Greenwald) involved in the plot? … What was his role — did he have a role beyond simply being a receiver of this information? And is he going to have to answer those questions?” Why did Todd not ask that same question of reporters at the Washington Post, the Associated Press and Bloomberg News? Again, is it because Greenwald is seen as representing a form of journalism too adversarial toward the government, while those establishment outlets are still held in Good Standing by Washington? .....

This week's Brick TeeVee LAST WORD comes from our At-Large BTV Editor ms_in_la who explains As for what to "buy" with Snowden and CISPA or any other concepts about the story...the good thing is all we really have to do is wait, watch and see the eventual outcome. Then a bunch of peeps will be nodding..... and the rest will be ...wondering. If CISPA is a slam dunk triggered by all this, then it would be a hard connection to dismiss, given the "helping hand" of the corp press. We can only watch, wait, and see. Proof. Pudding. That part is relatively easy. Like I said earlier....it could go the opposite direction. Not something we often see, but theres slways an outside chance....If the after effect is that we will have more press freedom. Less surveillance, more civil rights and more checks and balances to prevent it from getting this egregious again....then that would be a clear Net Good result. And Snowden's "hero" status would be rightfully earned, and his mission would have accomplished something progressive that would eventually foster vastly improved policies. The Net Bad result would be further clamp down on both press and privacy freedoms (what little is left of them) Increased surveillance (is it even possible?) and of course, draconian CISPA. Time will tell. So hold on you your hats and see what happens next. We'll try to get you the most relevant stories without the "shiny objects" the mass corporomedia try to point us in. SAD WEEK WEEK AT THE BRICK TEEVEE COMPOUND: Two weeks ago we found out our favorite "animal kingdom" correspondent Dee Jay Da Wabbit was diagnosed with a neoplasia in her abdomen. Dee Jay came to us when she was about one year old and has been a constant companion to us ever since. She left us last Wednesday evening on her way to Rainbow Bridge. She was Eight. From taking naps with us and doing the "wabbit dance" around our feet when we answered the phone to greeting us when we came home and waking us in the mornings by jumping on us she was a Fun Bun up until the end. We made sure she got to sit outside in the grass and feel the sunshine and breezes and listen to all the brids singing duing her final days with us. Dee Jay was our deep friend and she affected us in ways too many to number. And all those who have had a non-human friend know exactly what we mean: caring, empathy, understanding, peacefulness, fun and some conflict too. We read our critters and they read us back. And we and they find comfort in each other although we as "parents" ultimately control their number one need - food - which we give every day with love, just part of our budget we don't question, no matter how cash-challenged we may be: Our critter friends get a seat at the dinner table just like the rest of us. Because they ARE Family. And our closest friends. Our critters we keep are fellow travelers on this Pale Blue Dot Our memories of those lost to time keep them alive. The Crew made a lovely box out of rough-hewn mahogany and stained it a deep dark red. We put her to rest next to the pine tree we shared those last days, at dusk Saturday night, about the same time she left us for Rainbow Bridge just days before. As our BTV Wisconsin correspondent donjo offered, "The hurt will go away, but the memories will linger." And BTV correspondent Maddy explained, we soon "will only remember the joy you had with her as the pain slowly fades away." Lastly ms_in_la wrote, "I'm sure Dee Jay will be enormously touched and grateful that you took such care for her not only in her life when you stood to benefit from her company...but in her death when you were filled with heartbreak. That my friend is love." So give all yer critters a Big Hug today from Dee Jay and all of us at Brick TeeVee. The Rainbow Bridge awaits us all.
