We go to Jane hamsher at FDL for an explanation Obama Schedules Meeting With Democrats, Grayson Forced to Cancel NSA Hearing President Obama has historically considered the Hill some lower bardo of hell. One of the major complaints of congressional Democrats has always been that the President does not consult them or include them in shaping his legislative agenda, let alone stop by for a chin wag. So imagine everyone’s surprise when the President suddenly announced he was coming to the Hill today to meet with all the Democrats – right before the August recess begins. Coincidentally, this forced Alan Grayson to cancel the hearing on NSA activity scheduled for today, at which the Guardian’s Glenn Greenwald was to testify. Grayson’s bipartisan hearing was organized to give critics of the NSA’s sweeping surveillance programs a chance to air their concerns, and stem the tide of “constant misleading information” coming from the intelligence community, per Grayson. Those who saw Glenn Greenwald on ABC’s This Week last Sunday heard him hint at reporting he would publish this week which would directly contradict claims made by General Keith Alexander, James Clapper and President Obama himself about the limited nature of the NSA’s programs (video above). DSWright has more on XKeyscore, the NSA program Greenwald reports on today. Suffice to say the Guardian publishes copies of training manuals that teach analysts how to search nearly “everything a user does on the internet.” Of all the revelations made by Edward Snowden so far, these are by far the most explosive — and they directly contradict statements by the President that the NSA’s surveillance activities are limited to metadata. Sadly, Grayson’s hearing has to be pushed into September because of the President’s sudden desire to drop by for a cuppa. Coincidence? Only those in the White House would know for sure. Regardless, we’ll keep you posted on when the hearing is rescheduled. At The Nation David Zirin questions On Vultures and Red Wings: Billionaire Gets New Sports Arena in Bankrupt Detroit The headline juxtaposition boggles the mind. You have, on one day, “Detroit Files Largest Municipal Bankruptcy in History.” Then on the next, you have “Detroit Plans to Pay For New Red Wings Hockey Arena Despite Bankruptcy.” Yes, the very week Michigan Governor Rick Snyder granted a state-appointed emergency manager’s request to declare the Motor City bankrupt, the Tea Party governor gave a big thumbs-up to a plan for a new $650 million Detroit Red Wings hockey arena. Almost half of that $650 million will be paid with public funds. This is actually happening. City services are being cut to the bone. Fighting fires, emergency medical care and trash collection are now precarious operations. Retired municipal workers will have their $19,000 in annual pensions dramatically slashed. Even the artwork in the city art museum will be sold off piece by piece. This will include a mural by the great radical artist Diego Rivera that’s a celebration of what the auto industry would look like in a socialist future. As Stephen Colbert said, the leading bidder will be “the museum of irony.” They don’t have money to keep the art on the walls. They do have $283 million to subsidize a new arena for Red Wings owner and founder of America’s worst pizza-pizza chain, Little Caesar’s, Mike Ilitch, whose family is worth $2.7 billion dollars. (“Friends! Romans! Countrymen! Lend me your pensions!”) How did Governor Snyder possibly summon the shamelessness to justify this? Here's how. ........... As Neal DeMause, who runs the indispensable website Field of Schemes, said to me: “There’s absolutely no reason on earth that the state of Michigan couldn’t say to Mike Ilitch, ‘Sorry, Detroit has more important things to do with its money.’ Instead, though, the governor seems content to let Ilitch cut to the front of the line for public funds, on the grounds that ‘who doesn’t get fired up’ about hockey. Even if you limited it to economic development projects, putting money into fixing city schools or restoring streetlights would do far more for Detroit’s business prospects than a hockey arena. This just goes to show the problem with carving out shares of tax revenue to go to development authorities—they end up basically serving as slush funds for developers, even when the city treasury is otherwise empty.” There is a right-wing narrative about Detroit that the city is in peril because of some combination of the 1967 “race riots” and greedy unions. The reality is that black and brown residents of Detroit made Motown and those “greedy unions” built a stable working class that could realistically dream of a better life for their own children. The breaking of Detroit should be seen, in the words of David Sirota, as an indictment of right wing economic orthodoxy. Instead, the bankruptcy has been used as a warning to other cities that unions, pensions and a culture of resistance are roads to ruin. With this Red Wings arena, Snyder, Ilitch, and their ilk may have gone too far. WOW! The Rightards simply have no shame! Neither does Obomber it seems.

We go to this Black Agenda Radio commentary by BAR executive editor Glen Ford Obama and GOP Speak Same Language: Corp Tax Cuts = Jobs President Obama, like his Republican colleagues, says the word “jobs” when he really means “corporate tax cuts.” He lectured in the same Corp-Speak in Chattanooga, where he told low-wage workers how wonderful their bosses are, and what economic miracles could be accomplished by lavishing corporations with “incentives” to do the right thing. President Obama went to a low wage warehouse in Chattanooga in the right-to-work state of Tennessee to renew his offer to massively lower corporate tax rates – from 35 to 28 percent – and had the nerve to call it a Grand Bargain for the middle class. Surrounding the president were employees who do backbreaking work for $11 or $12 an hour – and can by no stretch of imagination be considered middle class. Obama praised their cutthroat Amazon corporation bosses as the sort of benign masters that he’s depending on to bring the country back to economic health – once they’ve been properly incentivized with lower tax rates, on the one hand, and outright public subsidies, on the other. Amazon is only invested in Tennessee because the state has given the corporation huge tax breaks that will allow it to undercut other book sellers, forcing them out of business and their workers into unemployment. Amazon’s 7,000 new, low wage jobs come at the cost of lay-offs and bankruptcies among its competitors. It’s the Wal-Mart business model, which is quite popular at the White House. The Obamas have a special place in their hearts for corporations of all kinds, as long as they’re big. ....... Obama used the Chattanooga visit to re-pitch much of his last State of the Union Address, in which he pledged to work for a public private partnership to upgrade the privately-owned U.S. infrastructure, such as energy grids and ports. That’s a euphemism for spending billions in public monies to subsidize private, profit making corporations. Obama calls that a jobs program. He also thinks workers should be appreciative of the Free Trade deals whose proliferation has coincided with the destruction of the U.S. manufacturing base and the loss of millions of jobs that really were “good.” Obama promised to call a meeting of the CEOs of the same corporations that sent the jobs overseas, to ask them to do more for the country – as if they haven’t done enough, already. He’s got another program, called Select USA, that offers tax breaks and other incentives to foreign corporations that locate facilities in the U.S. Since so many U.S. headquartered high-tech corporations, like Apple, are actually Chinese companies for purposes of employment, Obama might as well combine his various tax break programs and hand out the goodies to CEOs regardless of nationality. In fact, that’s close to the actual practice. There is no jobs creation plan, only a series of corporate tax giveaway programs. For workers, there’s the minimum wage, now set at $7.25 an hour. Obama promised, once again, in Chattanooga, to try to raise that to $9.00. But, back in 2008, candidate Obama vowed to fight for $9.50. I guess, somewhere along the way, he lost his incentive. OUCH!

Essentially, this is one step forward, two steps back for media freedom in the United States” said Reporters Without Borders. ........ “Leaks are the lifeblood of investigative journalism,” stated Reporters Without Borders, “given that nearly all information related to national security is considered ‘secret’ and that the DOJ has argued in the past that reporter’s privilege does not exist at all for national security reporters, it is safe to say that this crackdown against whistleblowers is designed to restrict all but officially approved versions of events and information. These developments highlight the need for a comprehensive, federal shield law in the U.S.” added the organization. ....... “It is important that any shield law passed actually addresses the issues that are currently plaguing journalists.” said Reporters Without Borders. “The Senate version would not have protected the Associated Press from the government’s investigation of their phone records, nor would it have protected Fox News’ James Rosen,” continued the Paris-based NGO. “Confidential sources have been integral in informing the public of the government’s actions, such as the abuse of prisoners in Abu Ghraib and the Watergate scandal. These events highlight the fact that public debate on American military and intelligence methods is crucial for establishing government oversight. CASE IN POINT: Seems the NSA has its worms all over including New Zealand reports Nicky Hagar US spy agencies eavesdrop on Kiwi The New Zealand military received help from US spy agencies to monitor the phone calls of Kiwi journalist Jon Stephenson and his associates while he was in Afghanistan reporting on the war. Stephenson has described the revelation as a serious violation of his privacy, and the intrusion into New Zealand media freedom has been slammed as an abuse of human rights. The spying came at a time when the New Zealand Defence Force was unhappy at Stephenson's reporting of its handling of Afghan prisoners and was trying to find out who was giving him confidential information. The monitoring occurred in the second half of last year when Stephenson was working as Kabul correspondent for the US McClatchy news service and for various New Zealand news organisations. The Sunday Star-Times has learned that New Zealand Defence Force personnel had copies of intercepted phone "metadata" for Stephenson, the type of intelligence publicised by US intelligence whistleblower Edward Snowden. The intelligence reports showed who Stephenson had phoned and then who those people had phoned, creating what the sources called a "tree" of the journalist's associates. New Zealand SAS troops in Kabul had access to the reports and were using them in active investigations into Stephenson. The sources believed the phone monitoring was being done to try to identify Stephenson's journalistic contacts and sources. They drew a picture of a metadata tree the Defence Force had obtained, which included Stephenson and named contacts in the Afghan government and military. ......... The Human Rights Foundation says Defence Force involvement in monitoring a journalist is an abuse of fundamental human rights. "Don't they understand the vital importance of freedom of the press?" spokesman Tim McBride said. "Independent journalism is especially important in a controversial war zone where the public has a right to know what really happens and not just get military public relations," he said. The news has emerged as the Government prepares to pass legislation which will allow the Defence Force to use the GCSB to spy on New Zealanders. The Stephenson surveillance suggests the Defence Force may be seeking the GCSB assistance, in part, for investigating leaks and whistleblowers. Stephenson said monitoring a journalist's communications could also threaten the safety of their sources "by enabling security authorities to track down and intimidate people disclosing information to that journalist". He said there was "a world of difference between investigating a genuine security threat and monitoring a journalist because his reporting is inconvenient or embarrassing to politicians and defence officials". ....... A leaked New Zealand Defence Force security manual reveals it sees three main "subversion" threats it needs to protect itself against: foreign intelligence services, organisations with extreme ideologies and "certain investigative journalists". The New Zealand government said Monday there is no evidence to support a report in the Sunday Star-Times newspaper that the military was assisted by the United States in monitoring the phone data of journalist Jon Stephenson, a New Zealander working for the U.S.-based McClatchy news organization. The report is the first indication that the NSA's techniques may have been used to spy on a journalist. It challenges U.S. claims that the NSA programs were not used to target specific individuals, but rather to compile large pools of usage data. Surprised? Next here's Glenn Greenwald's latest blockbuster scoop XKeyscore: NSA tool collects 'nearly everything a user does on the internet' A top secret National Security Agency program allows analysts to search with no prior authorization through vast databases containing emails, online chats and the browsing histories of millions of individuals, according to documents provided by whistleblower Edward Snowden. The NSA boasts in training materials that the program, called XKeyscore, is its "widest-reaching" system for developing intelligence from the internet. The latest revelations will add to the intense public and congressional debate around the extent of NSA surveillance programs. They come as senior intelligence officials testify to the Senate judiciary committee on Wednesday, releasing classified documents in response to the Guardian's earlier stories on bulk collection of phone records and Fisa surveillance court oversight. ......... Mike Rogers, the Republican chairman of the House intelligence committee, said of Snowden's assertion: "He's lying. It's impossible for him to do what he was saying he could do." But training materials for XKeyscore detail how analysts can use it and other systems to mine enormous agency databases by filling in a simple on-screen form giving only a broad justification for the search. The request is not reviewed by a court or any NSA personnel before it is processed. XKeyscore, the documents boast, is the NSA's "widest reaching" system developing intelligence from computer networks – what the agency calls Digital Network Intelligence (DNI). One presentation claims the program covers "nearly everything a typical user does on the internet", including the content of emails, websites visited and searches, as well as their metadata. Analysts can also use XKeyscore and other NSA systems to obtain ongoing "real-time" interception of an individual's internet activity. Under US law, the NSA is required to obtain an individualized Fisa warrant only if the target of their surveillance is a 'US person', though no such warrant is required for intercepting the communications of Americans with foreign targets. But XKeyscore provides the technological capability, if not the legal authority, to target even US persons for extensive electronic surveillance without a warrant provided that some identifying information, such as their email or IP address, is known to the analyst. .......... In a second Guardian interview in June, Snowden elaborated on his statement about being able to read any individual's email if he had their email address. He said the claim was based in part on the email search capabilities of XKeyscore, which Snowden says he was authorized to use while working as a Booz Allen contractor for the NSA. One top-secret document describes how the program "searches within bodies of emails, webpages and documents", including the "To, From, CC, BCC lines" and the 'Contact Us' pages on websites". To search for emails, an analyst using XKS enters the individual's email address into a simple online search form, along with the "justification" for the search and the time period for which the emails are sought. The analyst then selects which of those returned emails they want to read by opening them in NSA reading software. The system is similar to the way in which NSA analysts generally can intercept the communications of anyone they select, including, as one NSA document put it, "communications that transit the United States and communications that terminate in the United States". One document, a top secret 2010 guide describing the training received by NSA analysts for general surveillance under the Fisa Amendments Act of 2008, explains that analysts can begin surveillance on anyone by clicking a few simple pull-down menus designed to provide both legal and targeting justifications. Once options on the pull-down menus are selected, their target is marked for electronic surveillance and the analyst is able to review the content of their communications ......... The XKeyscore system is continuously collecting so much internet data that it can be stored only for short periods of time. Content remains on the system for only three to five days, while metadata is stored for 30 days. One document explains: "At some sites, the amount of data we receive per day (20+ terabytes) can only be stored for as little as 24 hours." To solve this problem, the NSA has created a multi-tiered system that allows analysts to store "interesting" content in other databases, such as one named Pinwale which can store material for up to five years. It is the databases of XKeyscore, one document shows, that now contain the greatest amount of communications data collected by the NSA. ........ In recent years, the NSA has attempted to segregate exclusively domestic US communications in separate databases. But even NSA documents acknowledge that such efforts are imperfect, as even purely domestic communications can travel on foreign systems, and NSA tools are sometimes unable to identify the national origins of communications. Moreover, all communications between Americans and someone on foreign soil are included in the same databases as foreign-to-foreign communications, making them readily searchable without warrants. Some searches conducted by NSA analysts are periodically reviewed by their supervisors within the NSA. "It's very rare to be questioned on our searches," Snowden told the Guardian in June, "and even when we are, it's usually along the lines of: 'let's bulk up the justification'." ....... At Emptywheel On Same Day Alexander Tells BlackHat, “Their Intent Is to Find the Terrorist That Walks Among Us,” We See NSA Considers Encryption Evidence of Terrorism Thirty minutes into his speech at BlackHat yesterday, [current head of the United States National Security Agency] Keith Alexander said, "Remember: their intent is not to go after our communications. Their intent is to find the terrorist walks among us." He said that to a room full of computer security experts, the group of Americans probably most likely to encrypt their communications, even hiding their location data. ...... Meanwhile, note something else about Alexander’s speech. 13:42 into his speech, Alexander admits the Section 702 collection (this is true of XKeyscore too — but not the Section 215 dragnet, except in its use on Iran) also supports counter-proliferation and cybersecurity. That is the sole mention in the entire speech of anything besides terrorism. The rest of it focused exclusively on terror terror terror. Except, of course, yesterday it became clear that the NSA considers encryption evidence of terrorism. Increasingly, this infrastructure is focused intensively on cybersecurity, not terrorism. That’s logical; after all, that’s where the US is under increasing attack (in part in retaliation for attacks we’ve launched on others). But it’s high time the government stopped screaming terrorism to justify programs that increasing serve a cybersecurity purpose. Especially when addressing a convention full of computer security experts. But maybe Alexander implicitly admits that. At 47:12, Alexander explains that the government needs to keep all this classified because (as he points into his audience), "Sitting among you are people who mean us harm." (Note after 52:00 a heckler notes the government might consider BlackHat organizer Trey Ford a terrorist, which Alexander brushes off with a joke.) It’s at that level, where the government considers legal hacker behavior evidence of terrorism, that all reassurances start to break down. Update: NSA has now posted its transcript of Alexander’s speech. It is 12 pages long; in that he mentioned “terror” 27 times. He mentions “cyber” just once. And also Wyden: We Proved that “Unique” and “Vital” Information Wasn’t in 2011 .....So while the government thought these documents would prove how controlled these programs are (aspects of them don’t), Wyden demonstrates that they show the IC lies about the usefulness of programs when they talk to Congress about them. Which is, Patrick Leahy suggested in yesterday’s hearing, what the IC appears to be doing when invoking 54 plots to justify the 215 phone dragnet, which has only been tied to 12 plots. ..... YOIKS! While the front splash page for Change.gov has linked to the main White House website for years, until recently, you could still continue on to see the materials and agenda laid out by the administration. This was a particularly helpful resource for those looking to compare Obama’s performance in office against his vision for reform, laid out in detail on Change.gov. According to the Internet Archive, the last time that content (beyond the splash page) was available was June 8th — last month. Why the change? Here’s one possibility, from the administration’s ethics agenda: Protect Whistleblowers: Often the best source of information about waste, fraud, and abuse in government is an existing government employee committed to public integrity and willing to speak out. Such acts of courage and patriotism, which can sometimes save lives and often save taxpayer dollars, should be encouraged rather than stifled. We need to empower federal employees as watchdogs of wrongdoing and partners in performance. Barack Obama will strengthen whistleblower laws to protect federal workers who expose waste, fraud, and abuse of authority in government. Obama will ensure that federal agencies expedite the process for reviewing whistleblower claims and whistleblowers have full access to courts and due process. It may be that Obama’s description of the importance of whistleblowers went from being an artifact of his campaign to a political liability. It wouldn’t be the first time administration positions disappear from the internet when they become inconvenient descriptions of their assurances. Obama’s vision for lobbying transparency has similarly been discarded along the way, but the timing here suggests that the heat on Obama’s whistleblower prosecutions has led the administration to unceremoniously remove their previous positions.

Kevin Gosztola at FireDogLake has been following the Manning trial forever and reports What the Verdict in Bradley Manning’s Trial Means for Whistleblowers .....Manning was not found guilty of the most serious offense that he faced, the “aiding the enemy” offense, which charged that he had knowingly given intelligence indirectly to the enemy through WikiLeaks. However, he was found guilty of five Espionage Act offenses, which is quite significant in the war on leaks and whistleblowers that has been waged by the administration of President Barack Obama. He was found guilty of multiple stealing offenses and of exceeding authorized access on a government computer. Altogether, as the trial enters the sentencing phase, Manning faces a maximum punishment of 136 years in prison. The director of the American Civil Liberties Union’s Privacy and Technology Project, Ben Wizner, declared in reaction to the verdict, “While we’re relieved that Mr. Manning was acquitted of the most dangerous charge, the ACLU has long held the view that leaks to the press in the public interest should not be prosecuted under the Espionage Act. “Since he already pleaded guilty to charges of leaking information – which carry significant punishment – it seems clear that the government was seeking to intimidate anyone who might consider revealing valuable information in the future,” Wizner added. Reflecting upon the “aiding the enemy” charge that was brought, Widney Brown, the senior director of international law and policy at Amnesty International, stated, “The government’s pursuit of the ‘aiding the enemy’ charge was a serious overreach of the law, not least because there was no credible evidence of Manning’s intent to harm the USA by releasing classified information to Wikileaks.” “It was wrong for the government to charge Mr. Manning with the offense of ‘aiding the enemy.’ Mr. Manning pleaded guilty to lesser offenses related to his disclosure of classified information. That should have ended the case,” the National Whistleblowers Center said in a statement. The Center for Constitutional Rights, which had pushed for greater transparency in the court martial, condemned the verdict, “While the “aiding the enemy” charges (on which Manning was rightly acquitted) received the most attention from the mainstream media, the Espionage Act itself is a discredited relic of the WWI era, created as a tool to suppress political dissent and antiwar activism, and it is outrageous that the government chose to invoke it in the first place against Manning. Government employees who blow the whistle on war crimes, other abuses and government incompetence should be protected under the First Amendment.” The group added, “Manning’s treatment, prosecution, and sentencing have one purpose: to silence potential whistleblowers and the media as well. One of the main targets has been our clients, WikiLeaks and Julian Assange, for publishing the leaks. Given the US government’s treatment of Manning, Assange should be granted asylum in his home country of Australia and given the protections all journalists and publishers deserve.” Assange himself reacted, “The Obama administration has been chipping away [at] democratic freedoms in the United States. With today’s verdict, Obama has hacked off much more. The administration is intent on deterring and silencing whistleblowers, intent on weakening freedom of the press.” He also said, “Bradley Manning’s alleged disclosures have exposed war crimes, sparked revolutions, and induced democratic reform.
