So this is the third day of the holiday shopping melee that began with Black Friday or more aptly Black Thursday Evening where a number of retailers opened after dinner on Thanksgiving to get wretchedly poor people to stand in line to save a few bucks on stuff they really don't need but have been convinced THEY WILL DIE if they don't get that gadget NOW by a massive blitzkreig of marketing.   • David Kravets at Wired.com's THREAT LEVEL Supreme Court Rejects Case Challenging NSA Phone Spying The Supreme Court today rejected a challenge to the National Security Agency’s once-secret telephone metadata spying program. The justices, without comment, declined to entertain a challenge from the Electronic Privacy Information Center seeking to halt the program that was disclosed in June by NSA leaker Edward Snowden. The court’s inaction means that the there isn’t likely to be any court resolution to constitutional challenges to the metadata program for years. Legislation, however, is pending to gut the program.

Using this scheme, hackers could trick users into giving up personal data as they enter it into the web site, potentially placing Americans at risk of identity theft or allowing fraudsters to file bogus health care claims. And it's not just the federal exchange that has security problems. Some of the 15 states that have established their own online exchanges aren't using standard encryption throughout their Obamacare websites—leaving user information at risk. Here's the problem: When an American signs up for Obamacare online, they must enter a good deal of personal information to verify identity—including name, Social Security number, phone number, email address, income, and employer—and identifying information for their family members. In the majority of states, Americans will enter this information directly into the Healthcare.gov website. Kyle Wilhoit, a threat researcher at Trend Micro, a Japanese security software company, studied the Healthcare.gov portal with his security team and found a "moderate risk" for hacking due to an easy-to-fix coding problem that leaves the site vulnerable to clickjacking. Nidhi Shah, who works on research and development for Hewlett-Packard's Web Security Research Group, found the same problem. This wouldn't be the first time a federal site experienced coding problems: Earlier this year, SAM.gov, a government contracting award management site, automatically revealed companies' private data, without a hacker lifting a finger, because of bad coding. "Common clickjacking would be a popular method to attempt to exploit [the site]" says Wilhoit. "Hackers could use this information in the creation of fake identities, fake credit cards, and fake accounts very easily." He adds that it's relatively easy to fix, although the fixed code would need to rolled out on multiple Healthcare.gov pages and potentially state websites as well. .......... Some state Obamacare sites could be significantly more vulnerable than the federal portal. Healthcare.gov site uses a common form of encryption called Secure Sockets Layer (SSL), which prevents information from being intercepted by a hacker after you click "send" (SSL doesn't defend against most clickjacking). But the 15 states currently running their own independent Obamacare websites do not have explicit instructions from the HHS to use SSL. ..... WHOOPS! GEORGE ZIMMERMAN ALERT: At HuffPoAOL George Zimmerman Arrested After Domestic Dispute With Girlfriend (AP) -- George Zimmerman was charged Monday with assault after deputies were called to the home where he lived with his girlfriend, who claimed he pointed a shotgun at her during an argument, authorities said. ......... Zimmerman and his estranged wife were involved in a domestic dispute in September just days after Shellie Zimmerman filed divorce papers, but police later said no charges were filed against either of them because of a lack of evidence. Zimmerman has also been pulled over three times for traffic stops since his acquittal (in the fatal shooting of unarmed black teenager Trayvon Martin -Ed.). He was ticketed for doing 60 mph in a 45 mph zone in Lake Mary in September and was given a warning by a state trooper along Interstate 95 for having a tag cover and windows that were too darkly tinted. He was also stopped near Dallas in July and was given a warning for speeding. .... UPDATE: George Zimmerman was arrested in Seminole County, Fla., at about 1:30 p.m. Monday and charged with assault, after a dispute at his girlfriend's home, the Associated Press reports. The arrest occurred shortly after a domestic disturbance involving Zimmerman's girlfriend , law enforcement officials told WESH 2. TMZ reports that the girlfriend says she is pregnant. And then Reuters reports Florida judge frees George Zimmerman on bond, denies him weapons WAIT! There's more! From John Couwels, CNN Search in George Zimmerman case turns up weapons, ammunition ....... A search of the home turned up three handguns, a 12-gauge shotgun, a rifle and 106 rounds of ammunition, including two AR-15 magazines, according to a search warrant. Three handgun holsters, a pack of gum, a religious pendant, a flashlight, a pocket knife, sanitizing wipe, a soft-sided gun case and a combination lock were also recovered during the search. At the time of his arrest, Zimmerman had two cell phones. An affidavit, filed Monday, says he told authorities he recorded the altercation with his girlfriend on his cell phone..... At this rate we think this loose cannon will be in The Big House sooner than later. And that's a good thing. Raw Story's David Edwards reports Former Pennsylvania GOP official charged for drugging and raping woman multiple times A former chairman of the Montgomery County Republican Committee in Pennsylvania who resigned last week after being accused of sexual assault was arrested on Tuesday on 19 counts, including rape and drug charges. Sources told several news outlets last week that Robert Kerns had gotten drunk and assaulted a woman following a GOP dinner in October. On Tuesday, Kerns was taken into police custody and charged with rape of an unconscious victim, rape of a substantially impaired person, sexual assault, aggravated assault without consent, aggravated assault of a person unaware penetration was occurring and 8 other forms of assault. He also faces charges of possession of an instrument of crime with intent, possession of a controlled substance and tampering with evidence. ............. According to reporter Carl Hessler, authorities said that Kerns had drugged the woman by putting the insomnia medication Ambien in her drink during a Republican Party dinner. He then allegedly raped her multiple times when she lost consciousness. Ferman added that the Grand Jury described Kerns as “predatory and manipulative” and that there were often other victims in those types of cases. She urged any other women who had been assaulted by Kerns to come forward. “I give great credit to the victim in this case, she was extremely courageous in coming forward and sharing what happened to her,” Ferman said. “I think she should be commended.” Kerns resigned as chairman of Republican Party in Montgomery County last week, but continues to serve as the solicitor for Upper Gwynedd and West Norriton Townships and Trappe Borough, and the Police Chiefs Association of Montgomery County. He was expected to be arraigned Tuesday afternoon. It continues to amaze and baffle The Brick TeeVee Crew why ANY American woman would vote FOR these troglodytes or even associate with them. David Sirota finds Under cover of Thanksgiving, SEC postpones “final” lobbying ethics rule at Pando.com When the federal government quietly releases something in the din of Thanksgiving week, it usually means it’s something bad – something lawmakers are legally required to disclose, but something they really don’t want the public to know about. And when the agency releasing the information is the famously corrupt Securities and Exchange Commission, “bad” is likely too weak a word. In fact, you can almost a guarantee something truly hideous is happening. This week, as much of America heads home for Thanksgiving, the SEC stealthily inserted a couple of paragraphs into the federal register. And while the disclosure is shrouded in esoteric language as a way to say “nothing to see here! move along!” there’s plenty to see here – and we shouldn’t move along. As the Project on Government Oversight reports, the SEC is postponing a new ethics rule. That’s no big deal, right? Wrong. As POGO notes, the move deliberately allows an untold number of senior SEC employees to evade standard employment regulations – more specifically, it allows them to leave the agency and immediately begin lobbying their old government colleagues on behalf of corporate clients. To understand why this week’s SEC move is particularly scandalous and ideological – and not just some accident or some move based on earnest logistical considerations — you have to look at the history of the original ethics rule. ........... What explains the SEC’s transformation from law enforcement agency to enabler of corporate crime? A lot of it, no doubt, has to do with Wall Street bankrolling presidents and senators of both parties. The money goes into those politicians’ campaigns, and predictably presidents appoint corporate cronies to run the SEC and senators loyally confirm those nominees with few questions. But a lot of it also has to do with ethics rules at the center of the SEC’s new announcement in this week’s federal register. Those rules have permitted a revolving door to spin so fast it is now hard to know who is the SEC cop and who is the corporate robber. Fast forward to the last few months. Desperate to respond to all the ugly revelations about this corruption and pretend it wants to do something to address the corruption, the Obama administration recently agreed to tighten restrictions on SEC officials leaving the agency. After a POGO report spotlighting weak ethics rules about post-SEC employment, the administration belatedly agreed to recommendations made three years ago by the SEC’s inspector general. Specifically, the administration finally proposed a rule to ban SEC officials from lobbying their former government colleagues for at least a year. The fact that such a rule was needed only underscored how especially corrupt the SEC is – after all, the rule already applies to all other federal employees, but the SEC had previously carved a waiver out for itself. That said, better late than never – unless the “better” part never comes. And that’s what today’s announcement threatens to ensure. Delaying the loophole closure until at least next year not only lets today’s SEC officials continue going through the revolving door, it potentially indefinitely preserves the ethics loophole – and goes about doing so in an unprecedented way. Yes, the new rule was published as “final” back in October and, as POGO notes, in almost two decades of federal register announcements, “no other Office of Government Ethics notice contain(s) the phrase ‘Withdrawal of Final Rule.’” In other words, this is the first time a “final” rule has been un-finalized. Translated from government-ese: this was no accident – instead, this looks like a calculated decision by SEC officials to preserve their ability to cash in on their public service in a way other federal officials (thankfully!) cannot. Those SEC officials clearly hoped that between Thanksgiving travel, cooking and gorging, nobody would notice. Nice try. Now you know. And Digby asks and answers You say the government is tracking everyone's online sex habits? Of course it is. And why are they doing it? For the usual reasons: defamation and blackmail. One of the things we must understand about all this is the fact that if any part of the US Government dragnet turns up what they think is evidence of a crime, they can pass it on to other agencies. So basically, if they are monitoring all of us, which they are, that means all of our private information can theoretically be used by the government if they can find some connection to a potential crime. All police agencies, whether it's the DEA or the FBI or Homeland Security (or the Commerce department!) can use such evidence to squeeze possible witnesses, set up stings, infiltrate what they believe to be criminal associations, create informants and otherwise use people who they believe might have something to hide in order to make a case. It's done all the time. But until now there was no central database available to go fishing in for blackmail material. (And keep in mind that we now know they routinely go back and dummy up the paper trail so the court and the suspect never knows where the original "tip" came from, a practice that might be understandable if it only pertained to confidential informants, but apparently is also used to cover up government surveillance.) These programs create a huge, global matrix of associations (and associations of associations) and a massive record of information about individuals, all of which could be accessed to provide the government with private and intimate details that people might not want the world to see and which could be used to discredit them or get them to cooperate. ....... CLAWBACK UPDATE: Malloy chatter Anitole78 points out at RT.com Cayman Islands agrees to report US citizens’ offshore assets under controversial law The Cayman Islands has signed an agreement with the United States to combat offshore tax evasion pursuant to a controversial 2010 law that has caused some notable US expatriates to revoke their US citizenship. The US Department of the Treasury announced Friday the US has signed an intergovernmental agreement with the Cayman Islands to enforce the Foreign Account Tax Compliance Act (FATCA) in what it bills as an effort to promote transparency. In the Cayman Islands – one of the world’s largest offshore financial centers - foreign financial institutions (FFIs) will be required to share tax information about US account holders with the IRS via the Cayman Islands Tax Information Authority. Passed by Congress in 2010, FATCA seeks to snuff out Americans avoiding US taxes overseas by requiring FFIs to report yearly to the Internal Revenue Service (IRS) on US citizens holding over $50,000 at a year’s end. Should FFIs refuse to share the information, US financial institutions are ordered to withhold a portion of payments made to the FFIs. The FFIs can make agreements directly with the IRS or follow one of two kinds of agreements their host country signs. The Caymans’ agreement is a Model 1B agreement; a different agreement signed Tuesday with Costa Rica is a Model 1A. "By working together to detect, deter, and discourage offshore tax abuses through increased transparency and enhanced reporting, we can help build a stronger, more stable, and accountable global financial system. We look forward to collaborating with the Government of the Cayman Islands to further these objectives," said Julie Nutter, Minister-Counselor for Economic Affairs at the US Embassy in London, in a statement. Nutter signed the agreement for the US on Friday. .................The amount of citizenship renunciations has gone up from 742 in 2009 to over 1,854 thus far in 2013, according to the State Department. Some estimate the number is much higher based on foreign media reports. In addition, expats say FATCA is causing many overseas banks and financial institutions to “close out longstanding accounts of American clients, refuse to open new ones, and deny loans and mortgages to expats rather than face a US penalty if they don’t comply with the tax law,” McClatchy reported. Wealthier expats may be hiding money overseas, yet most expats like Freeborn are at the mercy of the law. ............ BTV correspondent jen finds this at Tom Dispatch Tomgram: Laura Gottesdiener, Wall Street's Rental Empire “One shitty deal.” “Shitty deal.” “Shitty.” The date was April 27, 2010, and Senator Carl Levin (D-Mich.) was pissed as he launched into a rant with those pungent quotes in it. As part of a Senate subcommittee investigation into the causes of the financial meltdown, Levin was grilling Goldman Sachs CEO Lloyd Blankfein and several other current and former Goldman higher-ups about their roles in that crisis and in particular the exotic, opaque investment deals they had created and peddled. What had Levin steaming mad were internal emails revealing that, on the cusp of the financial crisis, Goldman staffers knew that they were selling crummy investments. Levin’s tirade was inspired by an email in which a Goldman staffer describes a product he’s selling as “one shitty deal.” That, of course, did not stop Goldman from selling such products. Not only that, but the firm's traders later bet against those deals to make even more money! Contempt, thy name is Goldman. At the heart of that April 2010 hearing, and at the heart of the financial crisis itself, were countless “shitty deals” in the form of so-called mortgage-backed securities. Remember those? It’s been a few years, so here’s a quick refresher. Wall Street firms like Goldman cooked up an idea to bundle together thousands of home mortgages -- loans made to people from Fresno to Lubbock to Kalamazoo to Baltimore -- and sell them to investors. Goldman profited off their sale and, as long as those homeowners made their mortgage payments, investors enjoyed a constant income stream. But as we now know, many of those home loans were filled with tricks and trap-doors and, in some cases, were made to people who simply couldn’t afford them. First gradually, and later in cascades, millions of people stopped paying their mortgages, which meant that those mortgage-backed securities went sour. The losses were historic, plunging the U.S. economy into what we now call the Great Recession. Five years later, the fallout from that mortgage-fueled meltdown and the bailing out of many of the financial institutions that profited from them is far from over. However belatedly, the feds continue to investigate the nation’s biggest banks for having sold shoddy mortgage-backed securities. On November 15th, JP Morgan Chase, one of the nation’s largest banks, agreed to a $4.5 billion settlement with 21 institutional investors who claimed they were wrongly sold bad mortgage-backed securities. Days later, the Justice Department announced a $13 billion settlement with JP Morgan -- "the largest settlement with a single entity in American history" -- for wrongdoing related to the packaging, marketing, and selling of those securities. But as Laura Gottesdiener writes today, you can’t keep a bailed-out industry down. Wall Street and its masters of the universe are at it again. They’ve devised a new way to profit off the housing market -- and this time it has nothing to do with risky mortgages. Now, Wall Street is securitizing something else: your rent check. -Andy Kroll

Over the last year and a half, Wall Street hedge funds and private equity firms have quietly amassed an unprecedented rental empire, snapping up Queen Anne Victorians in Atlanta, brick-faced bungalows in Chicago, Spanish revivals in Phoenix. . . .

Our Founding Fathers suppressed the vote by saying only white male property owners could vote. And through the 200 plus years, we've chipped away at the voter suppression … blacks could vote, then women could vote and now the blacks had to -- we had to have Civil Rights laws. There's been voter suppression since the beginning. Here in Ohio the GOPher-controlled ALEX-influenced state legislature have now begun introducing fractured separate bills aimed at voter suppression.     The repeal last year of a complex elections bill by the Republican-controlled legislature has not put to rest controversies over voting procedures. The repeal was just tactical, Republicans avoiding the embarrassment of a referendum. What has followed is a flurry of separate bills, much harder to block. Last week, two House Democrats took aim at one of the worst, an ill-advised measure that would require voters to present a photo ID to cast a ballot. Currently, other forms of identification are acceptable, for example, a utility bill showing the address at which a voter is registered. Kathleen Clyde of Kent, and Michael Curtin of Marble Cliff, near Columbus, marshaled two persuasive arguments against the photo ID bill introduced by state Rep. John Becker, a Union Township Republican. First, the Democrats re-emphasized that voter fraud is practically nonexistent in Ohio. They also used a press conference to cite recent studies pointing to the high cost of implementing a photo ID law. A study initiated by Jon Husted, the Ohio secretary of state, after the presidential election showed just 135 cases of possible voter fraud were referred to law enforcement agencies for further investigation. That’s out of 5.6 million ballots cast. It follows then for Curtin to call Becker’s bill “a solution in search of a nonexistent problem.” In his report, Husted noted that a photo ID requirement would not have stopped most of the instances of suspected voter fraud. More, recent studies by Policy Matters Ohio and the Democratic National Committee put the cost of implementation at between approximately $7 million and $10 million a year over four years. As Curtin noted, that’s money far better spent on implementing electronic voter registration, expanding the use of electronic polls books and replacing voting machines. Kathleen Clyde reminded that some 20 percent of Ohio voters, many women, senior citizens, students and African-Americans, don’t have a state-issued photo ID. That makes it hard not to conclude that the photo ID bill really aims at lowering turnout among Democratic voters.

Morgan Griffith (R-VA) Congressman Proposes Firing EPA Workers Because They Were Furloughed In Government Shutdown The lesson one Republican congressman learned from the government shutdown is that the Environmental Protection Agency should lay off more of its workforce. According to Rep. Morgan Griffith (R-VA), because 94 percent of EPA staff were deemed “non-essential” in the shutdown, they are also unimportant. “If that is the case they should be able to cut 15 percent,” he told a Virginia paper. Griffith will introduce a bill that would force the EPA to cut 15 percent of its staff. Griffith also argued last month that the EPA should devote more time and staff to hearing concerns in coal country......... And that project looks like just the first in a series of big radioactive sludge imports to South Carolina, a local nuclear watchdog warns. The U.S. has taken overland shipments of highly enriched uranium from Canada before, but in solid form, as part of the Department of Energy’s efforts to consolidate and reprocess highly enriched uranium that was previously exported for use in foreign allies’ nuclear research reactors. But the planned delivery of highly enriched uranium in a radioactive liquid solution has American and Canadian environmental activists on high alert. “As far as I know, this is the first time liquid high-level waste has been transported in North America, therefore it deserves much closer analysis and examination than has been given by the Department of Energy, including the most practical and cheapest method: disposal in Canada,” says Tom Clements, Southeastern nuclear campaign coordinator for Friends of the Earth. ........ According to Clements, chances of a cask breach during shipping are slim, but the impact could be huge. “Unlike a solid material, it could be virtually impossible to clean up, particularly if it got into a waterway,” Clements says, “so that’s why they’re doing these shipments in small amounts, which is basically an acknowledgement that there is a threat present.” Of more concern, he adds, is the impact that foreign sludge would have on the Savannah River Site’s waste management system and cleanup efforts. ......
