For large numbers of fishermen and coastal residents living in the four-state impact zone of BP's oil spill, the disaster has never ended. Four years on, they, along with marine life and the broader ecosystem, continue to show clear signs of the chronic impact of the largest marine oil disaster in US history.
Dead Dolphins, Ailing Tuna, Sea Turtle Near Extinction: Oil from BP's disaster is now linked to heart defects in both tuna and amberjack, according to a recent National Oceanic and Atmospheric Administration (NOAA) study.
"We can now say with certainty that oil causes cardiotoxicity in fish," Stanford University fisheries biologist Barbara Block said during a news conference on the study, which was also published in the esteemed Proceedings of the National Academy of Sciences.
A recent University of South Florida study shows oil from BP's disaster has floated underwater all the way down to Florida's Sanibel Island (nearly all the way to the southern tip of Florida), sickening fish along the way. Meanwhile, a large mat of submerged oil, also confirmed as being from BP's disaster, was found on a Florida beach before over 1,300 pounds of it were removed. Insects living in wetland grasses along Louisiana's coast that was oiled in the aftermath of BP's disaster are still dying, according to a recent study by a Louisiana State University entomologist. The recent deaths, she says, are a result of exposure to oil that has remained in the marsh almost four years after the disaster began. BP's oil continues to take its toll on other areas of the Louisiana marsh, where people living in low-lying coastal communities are having to contemplate moving, hence abandoning their culture and way of life, due to the erosion of oiled marsh coupled with rising seas from climate change. Despite all of this ongoing evidence of BP's deleterious impact on the Gulf of Mexico region, President Obama's Environmental Protection Agency has decided to allow the oil giant back into Gulf waters to search for more oil leases. The impact of the BP disaster is not going away: Crude oil persists in the environment for, in some cases, decades. A full 25 years after the Exxon Valdez disaster in Alaska, the ongoing presence of relatively fresh oil in Prince William Sound continues to surprise scientists. .........

The event will culminate in a march past the the Capitol on Saturday. The jury returned its 5-1 verdict confirming that Aruba Petroleum “intentionally created a private nuisance” though its drilling, fracking and production activities at 21 gas wells near the Parrs' Wise County home over a three-year period between 2008-2011. Plaintiffs attorneys claimed the case is “the first fracking verdict in U.S. history.” The trial lasted two and a half weeks. Aruba Petroleum plans to appeal the verdict. The pollution from natural gas production near the Parrs' Wise County home was so bad that they were forced to flee their 40-acre property for months at a time. The Parrs were represented by attorneys David Matthews, Brad Gilde and Rich Capshaw. “They’re vindicated,” said Mr. Matthews. “I’m really proud of the family that went through what they went through and said, ‘I’m not going to take it anymore. It takes guts to say, ‘I’m going to stand here and protect my family from an invasion of our right to enjoy our property.’ It’s not easy to go through a lawsuit and have your personal life uncovered and exposed to the extent this family went through.” According to Mr. Matthews' blog post, the verdict included $275,000 for the Parr’s property loss of market value and $2 million for past physical pain and suffering by Bob and Lisa Parr and their daughter, $250,000 for future physical pain and suffering, $400,000 for past mental anguish. "Making fracking safe is simply not possible, not with the current technology, or with the inadequate regulations being proposed," Louis Allstadt, former executive vice president of Mobil Oil, said during a news conference in Albany called by the anti-fracking group Elected Officials to Protect New York. Up until his retirement in 2000, Allstadt spent 31 years at Mobil, running its marketing and refining division in Japan and managing Mobil's worldwide supply, trading and transportation operations. After retiring to Cooperstown, NY, Allstadt said he began studying fracking after friends asked him if he thought it would be safe to have gas wells drilled by nearby Lake Otsego, where Allstadt has a home. Since that time, he's become a vocal opponent of the shale oil and gas drilling technique. "Now the industry will tell you that fracking has been around a long time. While that is true, the magnitude of the modern technique is very new," Allstadt said, adding that a fracked well can require 50 to 100 times the water and chemicals compared to non-fracked wells. Then there's this Strongest sandstorm in decades sweeps China A strong sandstorm swept Gansu Province in northwest China on Wednesday, reducing visibility to less than 65ft, according to the provincial meteorological center. The sandstorm, the strongest since 1996 according to reports, started in the early afternoon in Dunhuang County. "Suddenly it became dark and I can't tell whether it's day or night," said one resident. "My nose hurts and I can't open my eyes," another resident said.
The Jiuquan City Meteorological Center, which includes Dunhuang, issued a sandstorm red alert, the highest level alert, forecasting that visibility would be reduced to less than 164ft throughout Jiuquan on Wednesday evening.

Capital in the 21st Century TruthDig.com has this book review by Steven Pearlstein Capital in the 21st Century Just when you thought Karl Marx had finally lost all political and economic relevance, a brilliant French economist has come along to pick up where the German philosopher left off—correcting for many of Marx’s mistakes, updating his analysis in light of subsequent experience and unearthing a bounty of modern economic data to support a theory about capitalism’s inherent and self-destructive contradictions. The economist is Thomas Piketty, a professor at the Paris School of Economics, who with Emmanuel Saez of the University of California at Berkeley has recently turbocharged the debate about income inequality. Piketty and Saez gathered data from tax returns that confirm the story of stagnant middle-class incomes over the last 30 years while revealing how much the super-rich have pulled away from everyone else. In its magisterial sweep and ambition, Piketty’s latest work, “Capital in the Twenty-First Century,” is clearly modeled after Marx’s “Das Kapital.” But where Marx’s research was spotty, Piketty’s is prodigious. And where Marx foresaw capitalism’s collapse leading to a utopian proletariat paradise, Piketty sees a future of slow growth and Gilded Age disparities in which the wealthy—owners of capital—capture a steadily larger share of global wealth and income. “The clash of communism and capitalism sterilized rather than stimulated research on capital and inequality by historians, economists, and even philosophers,” writes Piketty, who sets out to reignite a richer and more satisfying debate. .......... Piketty’s prediction of a 21st century of slow growth and extreme inequality is based on historic data and a simple equation. The data, which he assembled with various collaborators in several countries, shows that over long periods of time, output per person—productivity—tends to grow at an average of 1 to 1.5 percent. The data also shows that average return on investment over long periods of time ranges between 4 and 5 percent. The problem with these two historic trends, explains Piketty, is that whenever the return on financial capital (investment) is higher than the return on human capital (productivity) for an extended period, it is a matter of simple arithmetic that growing inequality will result. The reason: Those with highest incomes will save and invest, generating capital income that will allow them to pull away from those relying solely on wages and salaries. It only takes a few generations before this accumulating and accumulated wealth becomes a dominant factor in the economy and the social and political structure. Indeed, says Piketty, the data show it has already happened in the United States, where the inequality in the distribution of both wealth and income surpasses that of class-bound Europe of 1900. ........ His 700-page book Capital in the 21st Century is certainly not some kind of screed filled with calls for class warfare. In fact, the wonky and mild-mannered French economist opens his tome with a description of his typical Gen X abhorrence of what he calls the “lazy rhetoric of anticapitalism." He is in no way, shape, or form a Marxist. As fellow-economist James K. Galbraith has underscored in his review of the book, Piketty "explicitly (and rather caustically) rejects the Marxist view" of economics. But he does do something that gives right-wingers in America the willies. He writes calmly and reasonably about economic inequality, and concludes, to the alarm of conservatives, that there is no magical force that drives capitalist societies toward shared prosperity. Quite the opposite. He warns that if we don't do something about it, we may end up with a society that is more top-heavy than anything that has come before — something even worse than the Gilded Age. For this, in America, you get branded a crazed Communist by the right. ............... For Douthat and his tribe, the proposition that unfettered capitalism marches toward gross inequality is not a conclusion based on carefully collected data, strenuous research and a sweeping view of history. It has to be a Communist plot. The very heft of Piketty's book is terrifying to the Douthats, and no wonder they don't dare to read it, because if they did, they would find chart after chart, data set after data set, and hundreds of years worth of economic history scrutinized. ........... Piketty is scaring the right because he is a serious researcher and a calm, disciplined observer who writes in measured tones. But for conservatives who have based the last several decades of economic discussion on mythology, this dose of reality has come at them like a chillling blast of Arctic air. Let them have their hysteria. It's a testimony to the utter bankruptcy of their ideas. Memo to liberals and progressives: making Piketty into a rock star isn't helping, either. Brown-nosing the new aristocrats for THIS ............As in the old days of feudalism, if one wants to do something for the people one must petition the King or whomever the local noble might be to seek the funds to make it happen. It's an interesting American twist that we have the government facilitating the nobility's philanthropic hobbies, but it all adds up to the same thing. Whenever I read something like this I like to reprise this piece from a decade ago by Phil Agre. It seemed a little bit extreme to some people at the time. I'd guess fewer people think that today:
    From the pharaohs of ancient Egypt to the self-regarding thugs of ancient Rome to the glorified warlords of medieval and absolutist Europe, in nearly every urbanized society throughout human history, there have been people who have tried to constitute themselves as an aristocracy. These people and their allies are the conservatives. The tactics of conservatism vary widely by place and time. But the most central feature of conservatism is deference: a psychologically internalized attitude on the part of the common people that the aristocracy are better people than they are. Modern-day liberals often theorize that conservatives use "social issues" as a way to mask economic objectives, but this is almost backward: the true goal of conservatism is to establish an aristocracy, which is a social and psychological condition of inequality. Economic inequality and regressive taxation, while certainly welcomed by the aristocracy, are best understood as a means to their actual goal, which is simply to be aristocrats. More generally, it is crucial to conservatism that the people must literally love the order that dominates them. Of course this notion sounds bizarre to modern ears, but it is perfectly overt in the writings of leading conservative theorists such as Burke. Democracy, for them, is not about the mechanisms of voting and office-holding. In fact conservatives hold a wide variety of opinions about such secondary formal matters. For conservatives, rather, democracy is a psychological condition. People who believe that the aristocracy rightfully dominates society because of its intrinsic superiority are conservatives; democrats, by contrast, believe that they are of equal social worth. Conservatism is the antithesis of democracy. This has been true for thousands of years. The defenders of aristocracy represent aristocracy as a natural phenomenon, but in reality it is the most artificial thing on earth. Although one of the goals of every aristocracy is to make its preferred social order seem permanent and timeless, in reality conservatism must be reinvented in every generation. This is true for many reasons, including internal conflicts among the aristocrats; institutional shifts due to climate, markets, or warfare; and ideological gains and losses in the perpetual struggle against democracy. In some societies the aristocracy is rigid, closed, and stratified, while in others it is more of an aspiration among various fluid and factionalized groups. The situation in the United States right now is toward the latter end of the spectrum. A main goal in life of all aristocrats, however, is to pass on their positions of privilege to their children...
It's very nice that many of these young idealistic aristocrats want to do good deeds. But this is really nothing more than good old fashioned noblesse oblige which basically leaves the betterment of man to the whims of rich people. One of the big improvements democracy was supposed to bring was that the people themselves decided how to organize society rather than depending on the kindness of aristocrats. Even great philanthropists of the gilded age like Andrew Carnegie believed in a huge confiscatory tax of great estates in order that the government of the people might make the decisions rather than the heirs of great fortunes. But we're going the wrong way again...........

(AP) — Prosecutors must turn over never-revealed details about the time a Guantanamo Bay detainee spent in secret CIA prisons after his arrest in connection with the deadly attack on the USS Cole in Yemen, according to a military judge's order released Tuesday. The five-page order was a victory for defense lawyers representing Abd al Rahim al-Nashiri, accused of orchestrating the Oct. 12, 2000, bombing of the USS Cole in the Yemeni port of Aden. ........ A CIA inspector general's report said al-Nashiri, considered to have once been one of the most senior leaders in al-Qaida, was waterboarded under rules approved by the George W. Bush administration, although many of them have been repudiated as torture. He also was threatened with a gun and a power drill to solicit information about possible attacks against the United States, but those methods were beyond approved interrogation procedures. Prosecutors, who can appeal the judge's ruling, had argued that information about his time spent in CIA custody was irrelevant to the case. The defense believes the case against al-Nashiri is tainted by CIA actions in the secret prisons and could be used to spare him from the death penalty. Little information about what happened in the CIA black sites has been confirmed by the government. ............. The judge said the government must provide details of al-Nashiri's capture, detention, rendition and interrogation. The information the judge ordered the government to reveal includes a chronology of how al-Nashiri was shuttled among secret CIA black sites, and how he was transported, clothed and restrained. The government also must provide reports, summaries of interrogations and any photos or videos documenting the conditions of his confinement. Prosecutors are barred under the rules for military commissions from using any evidence or testimony obtained by coercion. The defense, however, has argued that all information from al-Nashiri is tainted by the harsh treatment he endured at the hands of the CIA. ............. ZeroHedge's Tyler Durdan tells us US Judge Rules DoJ Must Release Drone Killing Rationale Documents In yet another surprising 'loss' for the current administration, RT reports a three-judge 2nd Circuit Court of Appeals overturned a previous ruling that would have allowed the federal government to keep the rationale behind drone killings classified. The US Department of Justice must turn over important details from a key "White Paper" which the government has used to justify targeted killings across the Middle East. While the document was no secret (with parts leaked before Brennan's swearing in as CIA chief last year), the judges ruled that "whatever protection the legal analysis might once have had has been lost be virtue of public statements of public officials and official disclosure of the DOJ White Paper." As the ACLU stated, "This is a resounding rejection of the government’s effort to use secrecy, and selective disclosure, as a means of manipulating public opinion about the targeted killing program." As RT reports, The New York Times – two reporters in particular, Charlie Savage and Scott Shane – fought for the release of a Justice Department “White Paper” that contains a detailed explanation of why the controversial killings were legal.

The appeals court ruled in their favor, declaring that the Obama administration had undermined its claim that the document could not be made public because of national security concerns, because a number of public officials had spoken publicly about US drone activity. “Whatever protection the legal analysis might once have had has been lost be virtue of public statements of public officials and official disclosure of the DOJ White Paper,” Circuit Judge Jon Newman wrote, as quoted by Reuters. The decision went on to say that any claim that military plans, intelligence activity, or essential foreign relationships would be damaged is no longer valid.
The decision did not include any timeline about when the White Paper will actually be released. The Justice Department can still appeal for a ruling either from the full appeals court or the US Supreme Court. Steven Aftergood, a government secrecy analyst at the Federation of American Scientists, told the Times that the decision is a clear “rebuff to the administration’s secrecy policy.” ... Yet the 2nd Circuit was careful to note that the plaintiffs were not challenging the legality of the drone program with their FOIA request, only the secrecy surrounding it. Jameel Jaffer, an attorney with the American Civil Liberties Union, was jubilant when speaking to the Times. “This is a resounding rejection of the government’s effort to use secrecy, and selective disclosure, as a means of manipulating public opinion about the targeted killing program,” he said. “The government can’t pretend that everything about its targeted killing program is a classified secret while senior officials selectively disclose information meant to paint the program in the most favorable light.”

    Internet For The Wealthy On The Way Unless We Stop It ........ Under the plan wealthy corporations will be able to purchase faster service, while those that cannot do so will have slower service. Rather than an open Internet for all the US will be moving to a class-based Internet. Of course, this will mean that when Netflix and other corporations purchase faster Internet, the consumers who use their service will be paying more to watch movies and download information. As a result, more money will be funneled from working Americans to wealthy telecom giants. We recently wrote that the United States has lost its democratic legitimacy and now was a plutocratic oligarchy. This is what plutocracy looks like – policies designed for the wealthy, so they can make more money from the rest of us. .............. In the future, if a new start-up – the future Twitter or Facebook – begins it will have a very hard time competing with those who are established Interne companies because the slower service of the start-ups will make them less consumer friendly. As a result we can expect less creativity on the Internet. And like more and more of us who are fighting for climate justice, I am engaged in a struggle—a struggle—for the fate of humanity and of life on Earth. Not a polite debate around the dinner table, or in a classroom, or an editorial meeting—or an Earth Day picnic. I’m talking about a struggle. A struggle for justice on a global scale. A struggle for human dignity and human rights for my fellow human beings, beginning with the poorest and most vulnerable, far and near. A struggle for my own children’s future—but not only my children, all of our children, everywhere. A life-and-death struggle for the survival of all that I love. We know that if the governments of the world actually wanted to address this situation in a serious way, they could. Indeed, a select few, such as Germany, have begun to do so. It can be done—and at relatively low cost. And yet the fossil-fuel industry, and those who do its bidding, have been engaged in a successful decades-long effort to sow confusion, doubt and opposition—and to obstruct any serious policies that might slow the warming, or their profits, and buy us time. As I’ve said elsewhere, let’s be clear about what this means: at this late date, given what we know and have known for decades, to willfully obstruct any serious response to global warming is to knowingly allow entire countries and cultures to disappear. It is to rob the poorest and most vulnerable people on the planet of their land, their homes, their livelihoods, even their lives and their children’s lives—and their children’s children’s lives. For money. For political power. These are crimes. They are crimes against the Earth, and they are crimes against humanity. What, are you shocked? The same industry, the same people committing these crimes—while we subsidize them for their trouble—have been getting away with murder along the fence lines and front lines for generations. What is the proper response to this? How should I respond? Remain calm, we’re told. No “scare tactics” or “hysterics,” please. Cooler heads will prevail. Enjoy the Earth Day festivities. Fuck that. The cooler heads have not prevailed. It’s been a quarter-century since the alarm was sounded. The cooler heads have failed. You want sweet, cool-headed reason? How about this? ........................... What I’m talking about is not a fight to “solve the climate crisis.” That’s not possible anymore. But neither is it simply a fight for human survival—because there are oppressive and dystopian forms of survival, not to mention narcissistic ones, that aren’t worth fighting for. ........... What I’m talking about is both a fight for survival and a fight for justice—for even the possibility of justice. It’s a fight that transcends environmentalism. It requires something of us beyond the usual politics and proposals, the usual pieties. It requires the kind of commitment you find in radical movements—the kind of struggles, from abolition to women’s, labor and civil rights, that have made possible what was previously unimaginable...........
