DOJ, AP & Whistleblowers The biggest story last week was Obomber's and Eric Holder's Department of Justice secretly obtaining phone records of the Associated Press. Tyler Durden at ZeroHedge.com first reported DOJ's "Nixonian" Phone Spying Scandal Sets Labor Unions Against Obama and now has Watergate Was For Amateurs: Justice Department Spied For Months On Associated Press Reporters And so the final curtain falls on the myth of what was supposed to be, in its own words, the "most transparent administration" in history. ...... First amendment? Freedom of speech and press? Surely not when it comes to the Nobel-peace prize winning President and those who dare to expose his secret ways. And what's worst, is that the AP breach has all the makings of a spiteful hack driven by personal vengeance against one of America's premier news outlets. We can't wait to see the rest of the not so conservative media stands up in arms and defend one of their peers against an administration whose utter disdain for all checks and balances puts Stalinist Russia to shame. Or perhaps it will be merely a case of "first they came for AP's reporters, and we said nothing..." And while it has long been known that the NSA actively intercepts and records every single form of electronic communication, the unspoken truth is that the government can do anything it wants as long as it doesn't get caught. It just did, and not only in Benghazi, or the IRS fiasco, but in making a complete mockery of the First Amendment. ..... In Today's War News Sidney J. Freedberg at BreakingDefense.com reports on the X-47B: Navy Drone Launches Off Aircraft Carrier; A New Tailhook Era It’s hard enough for a human pilot to take off from the cramped and pitching deck of a US Navy aircraft carrier. Today, for the first time in history, a Remotely Piloted Aircraft did it. You can bet that military leaders in Beijing and Tehran sat up and took note as the batwinged X-47B drone took off from the nuclear-powered aircraft carrier USS George H.W. Bush. The aircraft that took off today, the Northrop Grumman-built X-47B UCAS (Unmanned Combat Air System), is just the trailblazer for an actual combat-ready drone, the UCLASS (Unmanned Carrier-Launched Airborne Surveillance and Strike System), that the Navy plans to start developing in earnest this year. (The draft “request for proposals” is out and industry folks expect the final RFP to come out in the next few weeks). So, if the Navy gets its way — and sufficient funding, which is hardly a foregone conclusion – today’s modest 65-minute flight from the carrier at sea to the Navy’s celebrated “Pax River” test site ashore is just a taste of things to come...... YIKES!

  • David Swanson, Nation of Change: Monsanto Has Taken Over the USDA The U.S. Department of Agriculture has been taken over by an outside organization. RootsAction has launched a campaign demanding a Congressional investigation. The organization is called Monsanto. Monsanto is, of course, the world's largest biotech corporation. These are the people who brought us Roundup weed killer and the resulting superweeds and superbugs, along with growth hormones for cows, genetically engineered and patented seeds, PCBs, and Agent Orange - which Monsanto now wants us to use as herbicide on genetically engineered corn and soybeans. This chemical company - responsible for environmental disasters that have destroyed entire towns, and a driving force behind the international waves of suicides among farmers whose lives it has helped ruin - has monopolized our food system largely by taking over regulatory agencies like the U.S. Department of Agriculture. A recent study links Roundup to autism, Parkinson's, and Alzheimer's.......... The recently passed and signed law nicknamed the Monsanto Protection Act strips federal courts of the power to halt the sale and planting of genetically engineered crops during a legal appeals process. The origin of this act can be found in the USDA's deregulation of Roundup Ready sugar beets in violation of a court order. The USDA argued that any delay would have caused a sugar shortage, since Monsanto holds 95% of the market. The revolving door keeps revolving. Monsanto's board members have worked for the EPA, advised the USDA, and served on President Obama's Advisory Committee for Trade Policy and Negotiations. ...........   • Susan Ohanian, Daily Censored: The Feds Are Making a List; inBloom™ Is Checking It Twice On April 30, 2013 the Obama administration announced they’d cut the much-maligned application form for the health insurance exchanges from a 21-page application to three pages for individuals and seven pages for families.(This isn’t counting the 61-page instruction manual for applying online.) The devil is in the details. They now use three application forms and multiple appendices–to give the appearance of simplifying things. OK, bureaucracy as usual. But take a look at this:

    The Feds are intent on adding to their data bases–so they’ll have all the “proof” they need to document every instant of people’s lives. It starts with the kids......

But The New York Times Editorial Board asks Who Can Take Republicans Seriously? It is time for President Obama to abandon his hopes of reaching a grand budget bargain with Republicans. At every opportunity since they took over the House in 2011, Republicans have made it clear that they have no interest in reaching a compromise with the White House. For two years, they held sham negotiations with Democrats that only dragged down the economy with cuts; this year, they are refusing even to sit down at the table. ...... Senate and House Republicans are refusing to meet with Democrats to negotiate over the budgets passed by each chamber. Four times in the last two weeks, Senate leaders have proposed beginning a conference committee to hash out a federal budget; four times they have been blocked by Republicans. The Senate minority leader, Mitch McConnell, and Senator Ted Cruz of Texas said they were afraid the committee might reach an agreement to raise both taxes on the rich and the debt ceiling, which are, of course, the Democrats’ stated goals. Knowing that their positions would be deeply unpopular among the public if their stubbornness were exposed in an open committee, Republicans would simply prefer not to talk at all. Instead of negotiation, Republicans cling to their strategy of extorting budget demands by threatening not to raise the debt ceiling. ....... Republican lawmakers have become reflexive in rejecting every extended hand from the administration, even if the ideas were ones that they themselves once welcomed. Under the circumstances, Mr. Obama would be best advised to stop making peace offerings. Only when the Republican Party feels public pressure to become a serious partner can the real work of governing begin. Michael Tomasky at The Daily Beast begs to differ and explains The Coming Attempt to Impeach Obama ...... I think the notion of impeachment is industrial-strength insane. There is utterly no proof that the President Obama even knew anything directly about the shifting Benghazi responses, let alone did something about them (yes, folks; under the Constitution, the President must do something). And as for the Internal Revenue Service story, from what we now know, those transgressions were committed by IRS staffers in Cincinnati who have never been closer to Obama than their television sets. I always held a squishy spot in my breast for the Daily Mail because of the “Paperback Writer” mention, but as of this weekend they can go stick it up their punter, or whatever it is they say. Impeachment is crazy, the Daily Mail is crazy, and the idea that Obama has any direct culpability in either of these matters is, given what we know today, utter madness. Okay? But this is my point: utter madness is what today’s Republicans do. You can present to me every logical argument you desire. Benghazi at the end of the day was a terrible tragedy in which mistakes, bad mistakes, were certainly made, and in which confusion and the CYA reflex led to some bad information going out to the public initially, but none of this remotely rises to the level of high crime. The IRS cock-up was just that, a mistake by a regional office. I get all this, and I agree with you. But what we think doesn’t matter. I can assure you that already in the Pavlovian swamps of the nutso right, the glands are swelling. Theirs is a different planet from the one you and I inhabit........They do their base’s bidding, not America’s. How many times do you need to see them do this before you accept that it is the reality? And now there’s an added element. They want to gin up turnout among their base for next year’s elections. And if they gin it up enough, and the Democratic base stays home, they could end up holding the House and taking the Senate. And if they have both houses, meaning that the vote in the House would not be certain to hit a Senate dead-end, well, look out..... Go read all of this! AP PHONE RECORDS SEIZURE: At Wired.com Nicholas Weaver has this suggestion Hear Ye, Future Deep Throats: This Is How to Leak to the Press We now live in a world where public servants informing the public about government behavior or wrongdoing must practice the tradecraft of drug dealers and spies. Otherwise, these informants could get caught in the web of administrations that view George Orwell’s 1984 as an operations manual. With the recent revelation that the Department of Justice under the Obama administration secretly obtained phone records for Associated Press journalists — and previous subpoenas by the Bush administration targeting the Washington Post and New York Times — it is clear that whether Democrat or Republican, we now live in a surveillance dystopia beyond Orwell’s Big Brother vision. Even privately collected data isn’t immune, and some highly sensitive data is particularly vulnerable thanks to the Third Party Doctrine. So how can one safely leak information to the press? Well, it’s hard. Even the head of the CIA can’t email his mistress without being identified by the FBI. With a simple subpoena or warrant, the FBI can obtain historical calling information (and with cellphones, location history); email messages (and records revealing the pattern of where and when the target accessed these accounts); internet activity; and much more. Since even separate, innocuous contacts between a reporter and source may be sufficient for the FBI to establish a relationship in its investigations — and who knows what kind of leak triggers a crackdown — here’s my guide for potential leakers. ...... Then Glenn Greenwald tells us the Justice Department's pursuit of AP's phone records is both extreme and dangerous ....... The legality of the DOJ's actions is impossible to assess because it is not even known what legal authority it claims nor the legal process it invoked to obtain these records. Particularly in the post-9/11 era, the DOJ's power to obtain phone records is, as I've detailed many times, dangerously broad. It often has the power to obtain those records without the person's knowledge (as happened here) and for a wildly broad scope of time (as also happened here). There are numerous instruments that have been vested in the DOJ to obtain phone records, many of which do not require court approval, including administrative subpoenas and "national security letters" (issued without judicial review); indeed, the Obama DOJ has previously claimed it has the power to obtain journalists' phone records without subpoeans using NSLs, and in its relentless pursuit to learn the identity of the source for one of New York Times' James Risen's stories, the Obama DOJ has actually claimed that journalists have no shield protections whatsoever in the national security context. It's also quite possible that they obtained the records through a Grand Jury subpoena, as part of yet another criminal investigation to uncover and punish leakers. None of those processes for obtaining these invasive records requires a demonstration of probable cause or anything close to it. Instead, the DOJ must simply assert that the records "relate to" a pending investigation: a standard so broad that virtually every DOJ desire will fulfill it. Even if a court were involved in the acquisition of these records - and that's unlikely here - it typically does little more than act as rubber-stamping functionary, just as it does when secretly approving the DOJ's requests for FISA warrants. This is what is reaped from continuously vesting the US government with greater and greater surveillance powers in the name of Terrorism and other fears. There has long been concern about the DOJ's snooping into the communications which journalists have with their sources precisely because the DOJ's power to obtain phone data and other sensitive records in secret is now so sweeping. Attempts to enact legislation to protect journalists from this type of concealed investigative intrusion into their source communications have been defeated in part due to the DOJ's insistence that it exercises this power responsibly and only in the most extreme cases. ....... That the Obama administration has prosecuted double the number of whistleblowers under espionage statutes as all previous administrations combined has already severely chilled the news gathering process. Imagine what message this latest behavior sends to journalists and their sources: that at any moment, the phone records of even the nation's most establishment journalists can be secretly obtained by the DOJ, which has no compunction about doing so even in the most extreme and invasive manner. The all-too-familiar axis that has enabled massive civil liberties assaults by the Obama administration - blindly partisan progressive media outlets and particularly obsequious self-styled neutral journalists - instantly sprung into action here and wasted no time jumping to the defense of the US government. ..... But the AP records case, in particular, was the American government’s low-tech answer to an increasingly eyebrow-raising series of hacks and leaks that have been central to recent years’ of news: Wikileaks, overseas leaks, phone hacking in the UK, and Bloomberg spying on its customers. And it was the government version of the new political technologies that have alternately inspired and unsettled members of both parties, big data approaches that replace the old tactic of broadly targeting vast groups toward the new one of approaching voters one at a time based on sophisticate technical analyses and predictions of their political views and plans. The Justice Department’s subpoena of phone records in a leak case probably shouldn’t be a surprise: This Administration has been remarkably, unusually aggressive in targeting leaks — a policy that has surprised and pleased some critics, while alienating traditional alles. But, paired with questions about the IRS and a broader edginess over pervasive surveillance, it’s a sleeper issue that seems poised to break outside its small circle of reporters and advocates. This reaction, and this new fear, is in no small part the Administration’s fault. Obama has always sought to control elements of politics that couldn’t be controlled, and has an obvious affection for the surgical strike. But it also taps perfectly into the fears of the moment, in which futuristic visions of surveillance, hacking, impersonation, and drone war have become everyday powers of corporations, civilians, and the government...... Next Bob Alexander at SuperBeans.com writes Hitchhiking Across the Plain of Megiddo ...... For the last week I’ve tried to jettison some words from my day-to-day vocabulary. Old habits die hard but the mind experiment is interesting. Try it yourself. For one week don’t use these words: Democrat, Republican, Liberal, Conservative, Right Wing, Left Wing, or any other label like Left of Center, Center, or Right of Center. Get rid of all quasi-political descriptors. Because they don’t really work anymore. They’re not very accurate or applicable. If I needed you to take care of my dog you’d need to know if I was talking about a Great Dane or a Chihuahua. “Just saying “dog” isn’t good enough. These days our political labels don’t really tell us anything. And while we’re at it let’s get rid of all the “-ists” and “-isms.” Socialism/Socialist, Communism/Communist, Capitalism/Capitalist, and Fascism/Fascist, are so emotionally charged some of us can’t think straight when they’re plopped into a conversation. Now that we’ve got those words out of the way … let’s perform another mind experiment. Let’s design A New Society. Not an over-reaching Utopia … just a place where you’d like to live. What would make up the basic foundation of such a place? Where to start? ...... So now let’s imagine a government. Not a huge federal bureaucracy … but something more like a town meeting where we’ll discuss what we’re going to do. Nothing complicated. Just a voice vote of Yes or No. For this example if anyone votes “no” the motion is defeated. We begin by voting on keeping our water supply unpolluted. A voice in the back shouts out “NO!” Next we vote on not poisoning the land. The same guy shouts out “NO!” How about cleaning up the air? NO! Eliminating toxins and genetically modified organisms from our food supply. NO! Universal Health Care? NO! Public schools, housing, and transportation? NO, NO and NO! ....... Even the most basic element of the electoral process, a voter-verified paper audit trail, goes down to defeat with a resounding HELL NO! Who is this guy? He is absolutely and completely against everything we would need to build a decent way of life. Not only is he against all social reforms, he wants to destroy our planet. He wants to pump even more carbon into the atmosphere and accelerate global climate change. He wants to pump millions of gallons of toxins into the Earth to get at natural gas. He wants to punch more holes into the ocean floor and suck out the oil. Regardless of the inestimable damage done … he wants to do more. Who is this guy? He’s insane. He’s dangerously insane. We know this because he lusts after all this destruction for the craziest of reasons. He’s doing it for money. Which only would make sense if you could eat, drink, or breathe … money. He wants to bring the Earth to a state where it can no longer support life. And along the way he wants us to be poor, sick, stupid, and soon enough dead. He’s our relative, a co-worker, our boss, our neighbor, our mayor, our congressman, senator, or president. He’s a CEO, a lawyer, a banker, a newspaper publisher, or head of a network. His “NO!” vote nullifies all of our plans while his continue unhindered. It is an oft used tactic to demonize the enemy. It makes it so much easier to shoot at them. But I think it would be best if we “humanized” our enemy. Our enemy is insane. His gargantuan stupidity has elevated him to what I can only call …evil. He possesses a malevolence that is at its core anti-human … anti-life. Are we headed towards a reckoning on the plain of Megiddo where great armies will clash by night in the ancient war between good and evil? Do we need to wait until we’re at the brink? Or could we take an different path? What if we turned to our relative, co-worker, boss, neighbor, or president and said …NO! We are not going to cooperate in our own destruction. And from that moment on … we DO NOT cooperate in our own destruction. What Would Happen Next? For our sake (or if there is to be a future), we have to find out..... Thanks Bob! Prairie2 gets our BTV LAST WORD with A new Strain of Rot New unemployment claims increased sharply last week reversing a multi-week downward trend, but it's still not so high as to cause any real concern, yet. Other economic indicators support the notion that we're not actually losing jobs. Have you noticed that most Republicans aren't talking about the deficit that much anymore? That's because it's disappearing out from under them like Arctic ice under a Polar bear, and they are forced to cling to any ginned up scandal or half-baked conspiracy theory that comes floating by. ....... Let's not start popping the champagne corks though. We've held the austerians at bay, but the underlying rot is still doing its work on the economy. A new twist on the old Con revolves around the housing market. It's been noticed for several years since the Bush Crash that about 25% of home sales have been for 'cash' meaning investors, and not home owners have been buying them. It turns out that it wasn't small local investors or house flippers buying bargains, but large scale private equity firms that have been squeezing out the little guys. They've buying as many as 40% of houses being sold in some market. ....... The problem is this is just one of many crooked schemes Wall Street is running. The Commodity Futures Trading Commission has just backed off from a relatively strict rule on Derivatives that would have required five banks to compete on any derivative being marketed or it couldn't be sold. None of these things should be sold, they used to be illegal for good reason. So we still have 600 trillion dollars (ten times world GDP) of these things in circulation just waiting for the next big screw up to create another banking collapse. And those 'too big to fail' banks from the last crash? They're much bigger and are steadily gobbling up the small banks every day. Something will trigger a complete collapse in the next couple of years unless something is done. Republicans are successfully blocking the implementation of the modest reforms of Dodd-Frank so we are really worse off than we were before. It all hinges on next year's election, the only good news is the Republicans are being seen as less competent by the voters, the bad news is they still have all the money in world to simply buy elections.     Lawmakers concerned about the health effects on humans from mountaintop removal coal mining set forth legislation in the U.S. House of Representatives today.
