HISTORIC INCOME GAP: LA Times' Connie Stewart reports the Income gap between rich and poor is biggest in a century If you feel you're falling behind in the income race, it's not just your imagination. The wealth gap between the top 1% and the bottom 99% in the U.S. is as wide as it's been in nearly 100 years, a new study finds. For starters, between 1993 and 2012, the real incomes of the 1% grew 86.1%, while those of the 99% grew 6.6%, according to the study, based on Internal Revenue Service statistics examined by economists at UC Berkeley, the Paris School of Economics and Oxford University. The top 1% is defined as familes with incomes above $394,000 in 2012. The Great Recession hit the top 1% harder than other income groups, but the wealthy recovered quicker too. From 2009 to 2012, as the U.S. economy improved, incomes of the top 1% grew more than 31%, while the incomes of the 99% grew 0.4% - less than half a percentage point. "This implies that the top 1% incomes captured just over two-thirds of the overall economic growth of real incomes per family over the period 1993-2012," economist Emmanuel Saez of UC Berkeley writes. The 1929 stock market crash that preceded the Great Depression, followed by World War II, reduced an earlier national income gap for decades. But it began to grow again in the 1970s, and has widened since. Saez attributes the trend not just to technology and job outsourcing, but to the reduced power of progressive tax policies and unions, along with "changing social norms regarding pay inequality." Who just might be part of that 1% who saw their incomes grow so large? Here's a hint from Politico.com Exclusive: The Koch brothers' secret bank An Arlington, Va.-based conservative group, whose existence until now was unknown to almost everyone in politics, raised and spent $250 million in 2012 to shape political and policy debate nationwide. The group, Freedom Partners, and its president, Marc Short, serve as an outlet for the ideas and funds of the mysterious Koch brothers, cutting checks as large as $63 million to groups promoting conservative causes, according to an IRS document to be filed shortly. The 38-page IRS filing amounts to the Rosetta Stone of the vast web of conservative groups — some prominent, some obscure — that spend time, money and resources to influence public debate, especially over Obamacare. ......... Short, a soft-spoken but ferociously conservative 43-year-old operative, provided us a draft of a forthcoming IRS filing that will soon be available to the public. Short, like most in the Koch empire, feels wealthy conservative activists such as Charles and David Koch get a bum rap from the media. So, Short wants to ease his groups and their cause out of the shadows. “There’s a mystery around us that makes an interesting story,” Short said in an interview in his conference room. “There’s also a vilification that happens that gets exaggerated when your opposition thinks you’re secretive. Our members are proud to be part of [the organization].” Democrats have their own vast web of secretive funders — and Short is right: Few liberals got as much scrutiny as the Koch brothers over the past few years. But the “proud” donors are not so proud they will publicly identify themselves as donors. Short refused to open up about the men and women behind the quarter-billion-dollar fund, beyond saying that Koch-linked entities provided a “minority” of the funds and that the largest single donor gave about $25 million. Freedom Partners is organized under the same section of the Tax Code as a trade association, a 501(c)6, which allows the group to conceal its donors from public release, although the amounts and recipients of its major grants are public. Natasha Lennard finds The “Monsanto Protection Act” gets extended The biotech rider dubbed the “Monsanto Protection Act” by food and agriculture activists has been extended by the House, advocacy group the Center for Food Safety reported Wednesday. The earmark, which was slipped into a vast budget bill passed six months ago without being read by most Congress members who voted it through, protects biotech giants like Monsanto and their genetically modified seeds from litigation in the face of possible health risks. Despite over 250,000 people signing a petition against the earmark, and a number of rallies taking place in response to its passing, the rider remains in the three-month extension of the appropriations bill voted through the House Tuesday evening. “It is extremely disappointing to see the damaging ‘Monsanto Protection Act’ policy rider extended in the House spending bill,” said Colin O’Neil, director of government affairs for Center for Food Safety. “Hundreds of thousands of Americans called their elected officials to voice their frustration and disappointment over the inclusion of ‘Monsanto Protection Act’ this past spring. Its inclusion is a slap in the face to the American public and our justice system.” ....... U.S. judicial review, which is an essential element of U.S. law and provides a critical check on government decisions that may negatively impact human health, the environment or livelihoods. This also raises potential jurisdictional concerns with the Senate Agriculture and Judiciary Committees that merited hearings by the Committees before its consideration. Kevin Drum at Mother Jones asks 105 Years in Jail for Posting a Link? Brown was indicted for posting the YouTube threats, and there's no question that it was an ill-advised rant regardless of the FBI instigation. But David Carr follows up with more today. It turns out that only three of the charges against Brown are related to the video. Twelve more are related to a link he posted in a chat room:
    In December 2011, approximately five million e-mails from Stratfor Global Intelligence, an intelligence contractor, were hacked by Anonymous and posted on WikiLeaks. The files contained revelations about close and perhaps inappropriate ties between government security agencies and private contractors. In a chat room for Project PM, Mr. Brown posted a link to it. Among the millions of Stratfor files were data containing credit cards and security codes, part of the vast trove of internal company documents....According to one of the indictments, by linking to the files, Mr. Brown “provided access to data stolen from company Stratfor Global Intelligence to include in excess of 5,000 credit card account numbers, the card holders’ identification information, and the authentication features for the credit cards.” ....But keep in mind that no one has accused Mr. Brown of playing a role in the actual stealing of the data, only of posting a link to the trove of documents. ....
This is almost a textbook case of prosecutorial overreach. As Carr points out, the guy who actually stole the Stratfor information is facing a sentence of only ten years. So why is Brown facing 105 years? Certainly not for a video posted while he was in withdrawal from heroin addiction. More likely, it's because the government considers him a thorn in their side and wants to send a message to anyone else planning to follow in Brown's footsteps. That just ain't right. As Carr says, "Punishment needs to fit the crime and in this instance, much of what has Mr. Brown staring at a century behind bars seems on the right side of the law, beginning with the First Amendment of the Constitution."

Douglas Lucas and Christian Stork at WhoWhatWhy follow up with Hacktivist Journo Barrett Brown And Lawyers Gagged In a case about the public’s right to know, where a journalist faces a century in jail, a court agreement silences…everyone. On September 4 in a Dallas courtroom, the prosecution and the defense in the Barrett Brown case agreed to a gag order. It prevents Brown, attorneys for both sides, as well as anyone representing them, from talking to the media about his prosecution. Brown faces over a century in prison for allegedly sharing a hyperlink, concealing laptops, and threatening an FBI agent. The same Special Agent, Robert Smith, testified in court that Brown controlled a share of the publicity surrounding his case. In an ironic twist, the prosecution argued its concern for Brown’s right to a fair trial—and that pro-Brown publicity could rob him of it. ......... The parties bound by the gag order remain free to talk to the media about matters of public record, such as filings and statements made in open court, and Brown’s lawyers can still communicate about finances with Kevin Gallagher of Free Barrett Brown Ltd., who is raising funds for Barrett’s defense. But that’s it. ............ It is logical that defenders of Brown would see his interaction with the media as nothing more than an effort to put his best foot forward. But his critics see it as manipulation.
In pushing for the gag agreement, the US attorney’s office seemed to signal concern that the broader context of Brown’s story could lead jurors to render a “not guilty” verdict—even if they believe he committed the alleged crimes. Such context could include Brown’s celebrated work as a determined researcher of misconduct among intelligence and defense contractors. This work could well resonate both with the public and a jury, particularly in the current moment of heightened interest in NSA spying. It’s not uncommon for a judge to instruct a jury to ignore a defendant’s extended circumstances. The reality, however, is that a favorable portrayal of Brown as a Robin Hood figure nonetheless could potentially help his case. In particular, the prosecution expressed concern that the press was discussing matters for which Brown has not yet been charged, such as drug abuse and receiving data hacked by Anonymous. When the defense objected that those matters were not relevant to the charges at hand, the prosecution, as if arguing on behalf of Brown, said such press was highly prejudicial to Brown’s defense and was taking away his right to a fair trial. Highlighting the Kafkaesque nature of the proceedings, the defense snapped back that the prosecution itself was bringing attention to the matters by discussing them in open court. “There does appear to be some irony in all this,” said District Judge Sam A. Lindsay. ........ WhoWhatWhy will continue to cover Brown’s case—albeit now with limited comment from his newly (and consensually) gagged counsel. Charles Swift, the attorney spearheading Brown’s defense, told WhoWhatWhy the gag order met his objective of protecting Brown’s right to speak and publish from jail– on matters not relating to his case. But when we asked why the defense agreed to the order rather than present evidence and arguments to the court in defense of Brown’s continued ability to express himself, he told us, “Under the terms of the order, I can’t comment.”

Der Speigel reports Privacy Scandal: NSA Can Spy on Smart Phone Data SPIEGEL has learned from internal NSA documents that the US intelligence agency has the capability of tapping user data from the iPhone, devices using Android as well as BlackBerry, a system previously believed to be highly secure. The United States' National Security Agency intelligence-gathering operation is capable of accessing user data from smart phones from all leading manufacturers. Top secret NSA documents that SPIEGEL has seen explicitly note that the NSA can tap into such information on Apple iPhones, BlackBerry devices and Google's Android mobile operating system. The documents state that it is possible for the NSA to tap most sensitive data held on these smart phones, including contact lists, SMS traffic, notes and location information about where a user has been. The documents also indicate that the NSA has set up specific working groups to deal with each operating system, with the goal of gaining secret access to the data held on the phones. In the internal documents, experts boast about successful access to iPhone data in instances where the NSA is able to infiltrate the computer a person uses to sync their iPhone. Mini-programs, so-called "scripts," then enable additional access to at least 38 iPhone features. The documents suggest the intelligence specialists have also had similar success in hacking into BlackBerrys. ....... The documents also state that the NSA has succeeded in accessing the BlackBerry mail system, which is known to be very secure. This could mark a huge setback for the company, which has always claimed that its mail system is uncrackable. In response to questions from SPIEGEL, BlackBerry officials stated, "It is not for us to comment on media reports regarding alleged government surveillance of telecommunications traffic." The company said it had not programmed a "'back door' pipeline to our platform." The material viewed by SPIEGEL suggests that the spying on smart phones has not been a mass phenomenon. It has been targeted, in some cases in an individually tailored manner and without the knowledge of the smart phone companies.

NSA docs show US spied on Brazil oil giant Petrobras Despite earlier US assurances that its Department of Defense does not “engage in economic espionage in any domain,” a new report suggests that the intelligence agency NSA spied on Brazilian state-run oil giant Petrobras. Brazil's biggest television network Globo TV reported that the information about the NSA spying on Petroleo Brasileiro SA came from Glenn Greenwald, the American journalist who first published secrets leaked by whistleblower Edward Snowden. Globo TV aired slides from an NSA presentation from 2012 that revealed the agency’s ability to gain access to private networks of companies such as Petrobras and Google Inc. One slide specified an ‘economic’ motive for spying, along with diplomatic and political reasons. This seems to contradict a statement made by an NSA spokesman to the Washington Post on August 30, which said that the US Department of Defense “does not engage in economic espionage in any domain, including cyber.” An official from the NSA told Globo that the agency gathers economic information not to steal secrets, but to watch for financial instability. ........ The US spy agency then reportedly shared the gathered information with the UK, Canada, Australia and New Zealand. The new report about US spying on Brazil could intensify the already existing tensions between Brazil and US. The relationship between the two countries became tense as Globo reported about allegations that NSA has intercepted private communications of Brazil’s President Dilma Rousseff and her Mexican counterpart Enrique Pena Nieto. Brazil responded by canceling preparations for the presidential visit to the United States and beginning a probe into telecommunications companies to see if they illegally shared data with the NSA. Also, Brazil has asked for a formal apology. .......... In her statement the Brazilian head of state [President Rousseff] said that "it is evident that the reason for the attempted espionage is not security or combating terrorism, but economic and strategic interests" adding that Petrobras represented "no threat to the security of any country. Rather, it represents one of the greatest assets of the world's oil and a heritage of the Brazilian people." Rousseff concluded her remarks on Monday by saying that the Brazilian state would take "all measures to protect the country , the government and its companies ."

The hits keep on comin'! David Kravets at Wired.com's Threat Level notes Senators Authorizing Syria Strike Got More Defense Cash Than Lawmakers Voting No Quel Surprise? Overall, political action committees and employees from defense and intelligence firms such as Lockheed Martin, Boeing, United Technologies, Honeywell International, and others ponied up $1,006,887 to the 17 members of the Senate Foreign Relations Committee who voted yes or no on the authorization Wednesday, according to an analysis by Maplight, the Berkeley-based nonprofit that performed the inquiry at WIRED’s request. Committee members who voted to authorize what the resolution called a “limited” strike averaged $72,850 in defense campaign financing from the pot. Committee members who voted against the resolution averaged $39,770, according to the data. The analysis of contributions from employees and PACs of defense industry interests ranges from 2007 through 2012 — based on data tracked by OpenSecrets.org. ....... The top three defense-campaign earners who voted “yes” were Sen. John McCain (R-Arizona) at $176,000; Sen. Dick Durbin (D-Illinois) at $127,350; and Sen. Timothy Kaine (D-Virginia) at $101,025. The top three defense-campaign earners who voted “no” were Sen. John Barrasso (R-Wyoming) at $86,500; Sen. Marco Rubio (R-Florida) at $62,790; and Sen. Chris Murphy (D-Connecticut) at $59,250.
And at Reuters Syrian forces may have used gas without Assad's permission: paper (Reuters) - Syrian government forces may have carried out a chemical weapons attack close to Damascus without the personal permission of President Bashar al-Assad, Germany's Bild am Sonntag paper reported on Sunday, citing German intelligence. Syrian brigade and division commanders had been asking the Presidential Palace to allow them to use chemical weapons for the last four-and-a-half months, according to radio messages intercepted by German spies, but permission had always been denied, the paper said. This could mean Assad may not have personally approved the attack close to Damascus on August 21 in which more than 1,400 are estimated to have been killed, intelligence officers suggested. Germany's foreign intelligence agency (BND) could not be reached for comment. Bild said the radio traffic was intercepted by a German naval reconnaissance vessel, the Oker, sailing close to the Syrian coast.........

The Rude Pundit observes John Kerry Declares His Penis Is "Unbelievably Small" In an article published this morning in The Guardian, John Kerry is quoted saying that any attack on Syria would be "unbelievably small." Frankly, at that point, Kerry may as well have said to the press, "I want to assure you that should I decide to fuck Syria, in its ass or perhaps in its vagina, should it have one, I will not create any sustained damage to the fucked orifice. Indeed, my penis is unbelievably small, and while I will get all the pleasure I can out of fucking Syria, it will barely feel it. Oh, yes, Syria will know that I have fucked it because of the bit of ejaculate left behind. It will be so little because my balls are also undersized. Yes, it is true, I will be able to brag to everyone that I did fuck Syria, which, in case you haven't figured it out, is really the point. I know that everyone is worried about the unintended consequences of me fucking Syria, like diseases, for example. However, I am assuring the world that I am disease free and nothing of the sort will happen. If everything goes as planned, Syria will learn that it can't get away with that sort of behavior because of the power of my penis, which, let me reiterate, is unbelievably small." Seriously, this shit is getting embarrassing. Between Kerry reassuring our allies that we only wanna bomb a little bit, pretty please, and Vladimir "Behold My Totally Not-Gay Nipples" Putin, for fuck's sake, seeking to play the role of diplomat by saying that Syria needs to place its chemical weapons under "international control," we are really in some kind of bizarro world where nothing makes sense anymore. And, hey, let's throw into the mix Kerry's State Department, channeling Condi and Colin, actually saying about Bashar al Assad, "[T]his brutal dictator with a history of playing fast and loose with the facts cannot be trusted to turn over chemical weapons, otherwise he would have done so long ago. That's why the world faces this moment." ....... It's all fucked up out there. The Obama administration hasn't released any definitive proof of the Syrian government's role in the chemical weapons attack and seems to be playing fast and loose with the number of dead. Republicans and conservative talkbots, who, strangely, last opposed a war when Bill Clinton was in office, are praising Putin. There's a couple of million refugees that really need help, living in camps where the infusion of hundreds of millions of dollars in American aid would probably do more to turn hearts and minds than minimal bombing in Damascus, which crazy-as-a-shithouse-rat Assad told Charlie Rose would cause possible terrorist attacks in response. Fuck everyone involved in this, man. Man, somewhere you know that George W. Bush is laughing his miserable bony ass off, calling Dick Cheney to giggle it up about how they have the world tied in knots, how they've made things that may, in fact, be true sound like lies because their lies sounded like the truth to so many people. How they have made the world a skittish place for even the consideration of action. And how they left behind a tangled pile of live wires and a dare to try to figure it out before you get electrocuted.
Next Washington's Blog proclaims Kerry Couldn’t Sell a Used Car After Secretary of State John Kerry suggested that President Bashar al-Assad avoid a war by handing over any chemical weapons his government possesses, Russia quickly seconded the motion, and Assad agreed to it. Just as quickly, aparently panicked by the possible delay or prevention of missile strikes, Kerry’s staff put out this statement:
    “Secretary Kerry was making a rhetorical argument about the impossibility and unlikelihood of Assad turning over chemical weapons he has denied he used. His point was that this brutal dictator with a history of playing fast and loose with the facts cannot be trusted to turn over chemical weapons, otherwise he would have done so long ago. That’s why the world faces this moment.”
Could Assad be lying? Could he hope to stash away a hidden weapons stockpile? Yes, and then at least a U.S. attack would have been delayed and more time gained to work on preventing it. But that’s not likely. Inspectors are very good. That’s why Prsident George W. Bush wanted them pulled out of Iraq, where they had done a stellar job and the weaponry been eliminated. That could conceivably also be why President Barack Obama wanted them kept away from the site of the August 21st attack and wanted to send missiles into Syria before the inspectors reached any results. So, to all appearances, Assad has immediately done what Kerry just declared impossible. How reliable, then, are other assertions of which Kerry professes to be certain? Is it really an important international norm that one nation should bomb another in support of fanatical terrorists and on the stated basis that people had been killed with the wrong variety of weapon? Is it really true that this war will be both unbelievably small and a significant blow to the Syrian government? Kerry is trying to sell the same used car to people who want an ambulance and other people who want a tank. Nobody’s buying. It’s not entirely Kerry’s fault that he had to come on stage after Colin Powell’s performance, but it is his fault that he’s flubbed all of his lines. ......

Chomsky: Instead of "Illegal" Threat to Syria, U.S. Should Back Chemical Weapons Ban in All Nations The other things that he said were not unusual, but nevertheless kind of shocking to anyone not familiar with U.S. political discourse, at least. So he described the United—he said that for seven decades the United States has been "the anchor of global security." Really? Seven decades? That includes, for example, just 40 years ago today, when the United States played a major role in overthrowing the parliamentary democracy of Chile and imposing a brutal dictatorship, called "the first 9/11" in Latin America. Go back earlier years, overthrowing the parliamentary system in Iran, imposing a dictatorship; same in Guatemala a year later; attacking Indochina, the worst crime in the postwar period, killing millions of people; attacking Central America; killing—involved in killing—in imposing a dictatorship in the Congo; and invading Iraq—on and on. That’s stability? I mean, that a Harvard Law School graduate can pronounce those words is pretty amazing, as is the fact that they’re accepted without comment. So what he said is I’m going to lie like a trooper about history; I’m going to suppress the U.S. role, the actual U.S. role, for the last seven decades; I’m going to maintain the threat of force, which is of course illegal; and I’m going to ensure that the chemical weapons convention is not imposed on the region, because our ally, Israel, would be subjected to it. And I think those are some of the main points of his address.....
AND Chomsky on 9/11, Syria’s "Bloody Partition" and Why U.S. Role Ensures Failure of Mideast Talks after clip of General Wesley Clark descibing the now infamous memo he saw "that describes how we’re going to take out seven countries in five years, starting with Iraq, and then Syria, Lebanon, Libya, Somalia, Sudan and, finishing off, Iran."The Bush administration veered slightly, not far, but slightly, from the general pattern. Actually, the goal of U.S. policy for decades has been to control and dominate those countries. But the Bush administration was more extreme. They thought they could actually just, as they put it, "take ’em out" and forcefully impose our own regimes—not that that would be anything new. There’s a long list of similar cases, going back to Iran in 1953, Guatemala in 1954. There was an assault against—major assault against Indonesia in 1958, an effort to strip away the outer islands where the resources are, and—because they were concerned about too much independence in Indonesia. That failed. Invasion of Cuba failed. The murder of Lumumba, in which the U.S. was involved, in the Congo destroyed Africa’s major hope for development. Congo is now total horror story, for years. The U.S. supported the Mobutu dictatorship. Now it’s maybe the worst place in the world. And on right through, case after case. This is standard U.S. policy. The Bush administration went beyond. They were more extreme in their goals and their actions. And they had to pull back, because that was just beyond U.S. capacity..... Fascinating!
