Trans-Pacific Partnership Thursday November 22 was the anniversary of the shooting/killing/murder/assassination of the 36th President of the United States, John Fitzgerald Kennedy. From the outset, the Pentagon, the CIA and many of JFK's advisers urged airstrikes and a U.S. invasion of the island that, as a Soviet military commander later revealed, would have triggered a nuclear war with the Soviets. JFK opted for a blockade, which Soviet ships respected. By October 26th, the standoff was de-escalating. Then, on October 27th, the crisis reignited when Soviet forces shot down a U.S. reconnaissance plane, killing its pilot, Maj. Rudolf Anderson. Almost immediately, the brass demanded overwhelming retaliation to destroy the Soviet missile sites. Meanwhile, Castro pushed the Kremlin military machine toward a devastating first strike. In a secret meeting with Ambassador Anatoly Dobrynin, my father told him, "If the situation continues much longer, the president is not sure that the military will not overthrow him and seize power." U.S. marshals appeared at our house to take us to government bunkers in western Virginia. My brother Joe and I were anxious to go, if only to see the setup. But my father, who'd spent the previous six nights at the White House, called to say that we needed to be "good soldiers" and show up for school in Washington. To disappear, he told us, would cause public panic. That night, many people in our government went to sleep wondering if they would wake up dead. Despite the fact that Republican Congressional can didates received nearly 1.4 million fewer votes than Democratic candidates last November, the Republicans lost only eight seats from their historic 2010 romp, allowing them to preserve a fat 33-seat edge in the House. Unscrupulous Republican gerrymandering following the 2010 census made the difference, according to a statistical analysis conducted by the Princeton Election Consortium. Under historically typical redistricting, House Republicans would now likely be clinging to a reedy five-seat majority. "There's the normal tug of war of American politics," says Sam Wang, founder of the consortium. "Trying to protect one congressman here, or unseat another one there." The Princeton model was built, he says, to detect "whether something got pulled off-kilter on top of that." Did it ever. In Pennsylvania, Democratic candidates took 51 percent of the vote across the state's 18 districts, but only five of the seats. In Wang's model, the odds against Democrats emerging at an eight-seat disadvantage are 1,000-to-1. And Pennsylvania was not alone. According to the Election Consortium analysis, gerrymandering helped Republicans secure 13 seats in just six states – including Ohio, Michigan, Indiana, Virginia and North Carolina – that, under normal rules of engagement, Democrats would have won. This tilting of the electoral playing field was the result of a sophisticated campaign coordinated at the highest levels of Republican politics through a group called the Republican State Leadership Committee (RSLC) – a Super-PAC-like entity chaired by Bush-era RNC chairman Ed Gillespie and backed by Karl Rove. Shortly after President Obama's first election, the RSLC launched the Redistricting Majority Project (REDMAP) with an explicit strategy to "keep or win Republican control of state legislatures with the largest impact on congressional redistricting." The logic was simple. Every decade following the census, the task of redrawing federal congressional-district boundaries falls (with some exceptions) to the state legislatures. If Republicans could seize control of statehouses – and, where necessary, have GOP governors in place to rubber-stamp their redistricting maps – the party could lock in new districts that would favor Republican candidates for a decade. As Rove wrote in a Wall Street Journal column in early 2010: "He who controls redistricting can control Congress." In short order, the RSLC raised more than $30 million to fund Rove's vision while its hapless counterpart, the Democratic Legislative Campaign Committee, raised barely one-third of that amount. .............. Republican redistricting has made a mockery of the ideal of "one man, one vote." To take back the House next year, 100 Democratic voters would have to turn out for every 94 Republicans. "Given the GOP-tilted nature of the congressional map," writes David Wasserman of the Cook Political Report, "Democrats would need to win the national popular vote by between six and seven points in order to win the barest possible House majority." ............. The filibuster adds an undemocratic overlay to a chamber that is already rankly undemocratic. In today's Senate, 41 small-state Republicans can mount a filibuster on behalf of 28 percent of the country. And the departure from historical practice is shocking: LBJ faced one filibuster as Senate majority leader. Harry Reid, the current majority leader, has faced more than 430. Nearly half the filibusters of executive-branch nominations in the nation's history – 16 of 36 – have occurred under Obama. ........ MUCH MORE! Harry Reid did Thursday wasn’t a win for Democrats as much as it was a triumph for democracy. That the Washington conventional wisdom likely won’t characterize it that way, though, shouldn’t be surprising. For far too long, the Beltway media has, by turns, overlooked, enabled, and normalized what has been a relentless, unprecedented siege campaign by Senate Republicans against Constitutional privilege and White House authority. Once a rare, last-ditch bureaucratic maneuver on the part of the minority, filibusters are no longer about extending actual debate on legislation or questioning the fitness of a political appointee. Instead, having been deployed a record 446 times since 2006, they’ve effectively been weaponized by the GOP as an extra-Constitutional end run around settled law. So, to say Reid “went nuclear” on the Senate rules Thursday is to ignore seven years of overwhelming evidence that the Republicans blew them up first. Nevertheless, this week’s press coverage of Republican filibusters leading up to the nuclear option was more of the same old objective ambiguity. ........ Over time, the media’s steady use of euphemisms and false equivalence has buried the larger narrative of Republican filibuster abuse. Likewise, it compartmentalizes each round of executive or judicial nominations into discrete events, which only allows the GOP to escape real accountability for their egregious abuse. For instance, when NBC News’s political tip sheet First Read previewed Reid’s “nuclear option” move Thursday, note that it only did so with respect to the three most recent judicial nominees blocked by the GOP.
    “And so after Senate Republican filibustered President Obama’s nominees to sit on the D.C. Circuit Court of Appeals—not on concerns about ideology or qualifications, but over the president’s ability to appoint ANYONE to these vacancies—Senate Democrats are poised to change the rules via the so-called ‘nuclear option’”
No. No. NO. While credit is due for highlighting the intellectual dishonesty of Republicans, this kind of short-sighted analysis of Democratic motives would be laughable if the stakes weren’t so high. This incredibly simplistic explanation leaves the reader with the mistaken impression that, though Republicans are being stubborn, Harry Reid just up and changed the rules in something resembling a fit of pique after a rough couple of weeks. This is not a new phenomenon, unfortunately. Over and over, the Beltway media has examined these filibuster events through a blinkered, ahistorical prism. ........... Breaking the logjam this way, some media naysayers worry, will forever change the Senate, making it operate more like the House. And that’s probably true, but the operative word in that sentence is, well, operate. For, right now, the Senate is a broken legislative body, hijacked by a spiteful few extremists who are wholly uninterested in performing even the most routine aspects of government business. While that obvious point isn’t lost on even the most process-obsessed members of the Washington press corps, time and again news organizations have failed to draw a bright line between Senate Republicans’ filibuster abuse and the dangerously anti-democratic precedent set by their behavior. Lacking any kind of pushback from the press, is it any wonder Republicans kept pushing further and further? As a result, they felt free to intentionally hamstring regulatory agencies for years by leaving them short-staffed and without leadership, effectively undermining the executive branch’s Article I authority. And why not consistently flout the president’s judicial appointees—to, say, maintain Republican dominance on the D.C. Appeals Court? It only negates the electoral mandate provided by the public. Hey, it’s not like the press is really going to notice. But make no mistake, even though it may fly underneath the radar of almost every big-name pundit, tilting the balance on the D.C. Appeals Court matters. ............... But it’s not just judicial appointees that can have a far-reaching impact. This past week, we saw what it can mean for workers and people in low-income areas when the Senate nominations process functions as intended. After scuffling along for years with only a minimum quorom, a now fully-staffed and fully-engaged NLRB handed down a major ruling against Walmart Monday one that penalized the company for illegally disciplining and firing employees who had participated in labor strikes. Likewise, on Wednesday, the newly created CFPB—whose inaugural director was only just approved by the Senate this past summer after a long filibuster fight—announced its first major settlement against predatory lenders. With a rabidly conservative Republican majority in the House making legislative progress all but impossible, legal rulings and enforcement actions represent the best shot at policy success for Democrats until 2015, at the earliest. Not coincidentally, it's precisely the kind of duly-earned progress the Senate GOP’s filibuster abuse would have kept on unfairly delaying had Reid not acted. In the end, the story of Thursday's “nuclear option” is mostly a tale of winners, though—our democracy first and foremost, but both Democrats and Republicans too, since the move ultimately makes government more responsive and actually enhances the value of winning elections. (The next GOP Senate Majority Leader will no doubt come to appreciate Reid’s decision when there’s a Republican in the White House). Perhaps the only real loser in all this is the Beltway media, which showed once again that it can miss a big story up to and even after the moment it blows up.

Read this REPORT: The Right Wing Domination Of Talk Radio And How To End It The Center for American Progress and Free Press today released the first-of-its-kind statistical analysis of the political make-up of talk radio in the United States. It confirms that talk radio, one of the most widely used media formats in America, is dominated almost exclusively by conservatives. The new report — entitled “The Structural Imbalance of Political Talk Radio” — raises serious questions about whether the companies licensed to broadcast over the public radio airwaves are serving the listening needs of all Americans. While progressive talk is making inroads on commercial stations, right-wing talk reigns supreme on America’s airwaves. Some key findings:
  • – In the spring of 2007, of the 257 news/talk stations owned by the top five commercial station owners, 91 percent of the total weekday talk radio programming was conservative, and only 9 percent was progressive.
  • – Each weekday, 2,570 hours and 15 minutes of conservative talk are broadcast on these stations compared to 254 hours of progressive talk — 10 times as much conservative talk as progressive talk.
  • – 76 percent of the news/talk programming in the top 10 radio markets is conservative, while 24 percent is progressive.
Two common myths are frequently offered to explain the imbalance of talk radio: 1) the 1987 repeal of the Fairness Doctrine (which required broadcasters to devote airtime to contrasting views), and 2) simple consumer demand. Each of these fails to adequately explain the root cause of the problem. The report explains:
    Our conclusion is that the gap between conservative and progressive talk radio is the result of multiple structural problems in the U.S. regulatory system, particularly the complete breakdown of the public trustee concept of broadcast, the elimination of clear public interest requirements for broadcasting, and the relaxation of ownership rules including the requirement of local participation in management. [...]
Ultimately, these results suggest that increasing ownership diversity, both in terms of the race/ethnicity and gender of owners, as well as the number of independent local owners, will lead to more diverse programming, more choices for listeners, and more owners who are responsive to their local communities and serve the public interest.

GOPher WAR ON WOMEN UPDATE: Speaking of the anti-abortion crowd Jodie Gummow at Alternet finds the Koch Brothers Secretly Funding Anti-Choice Movement Tax documents reveal the billionaire conservatives’ real agenda: a full-fledged “war on women.” Inquiries into the tax records of two major so-called “free market” organizations linked to the Koch brothers have revealed that the right-wing billionaires have poured millions of dollars into the movement to ban abortions and deny contraceptive access to women, Raw Story reported. While the Koch brothers have always claimed to be more interested in business policies rather than social issues, RH Reality Check and Politico unveiled their true political agenda: fueling the anti-choice movement. After some digging into records, correspondent Adele Stan, found that tax documents show the Koch Brothers directed anti-abortion groups to back legislative proposals aimed at exclusively shutting down women’s health clinics and restricting women’s’ access to contraception and abortions. “There is little doubt that the rash of anti-choice measures that flooded the legislative dockets in state capitols in 2013 was a coordinated effort by anti-choice groups and major right-wing donors lurking anonymously behind the facades of the non-profit “social welfare” organizations unleashed to tear up the political landscape, thanks to the high court’s decision in Citizens United. Helping to drive the right-wing offensive in the states and in Congress is a network of deep-pocketed business titans convened by the billionaire brothers Charles and David Koch, principals in Koch Industries, the second-largest privately held corporation in the United States,” Stan wrote. Politico further describes how the Koch network used shell company Freedom Partners, dubbed “Koch Brothers secret bank”, as an outlet for its ideas by awarding more than $236 million in funds to anti-abortion groups and far-right causes since November 2011. Such groups include the Centre to Protect Patients Rights (CPPR), a group vigorously opposed to both abortion and Obamacare as well as social pressure groups and a think-thank policy group that works closely with the GOP. This week, at a press conference, Jodi Jacobson, President and Editor-in-Chief of RH Reality Check explained how anti-abortion groups and legislators have orchestrated a concerted effort over time to deny women their reproductive rights, Raw Story reported: “Over the past ten years, so-called pro-life groups and legislators such as Congressman Paul Ryan have increasingly been involved in efforts to deny women their rights while simultaneously shredding the social safety net on which the most vulnerable in this society depend. It is a marriage of ‘church and commerce’ not previously seen in the United States. Now it is clear that the Koch brothers are pouring money into a policy agenda that recognizes both corporations and fertilized eggs as people, but not the personhood of women,” she said. And now with the so-called ‘nuclear option’ derailing the GOPher's obstruction agenda we see a Fully staffed NLRB investigates complaints against Wal-Mart by ALANA SEMUELS at the LA TIMES It may be some companies’ worst nightmare: the National Labor Relations Board, which is fully functioning with all its members for the first time since August 2003, is beginning to investigate labor practices and big companies, and so far, has sided with labor. The NLRB’s general counsel said Monday that it had investigated charges against Wal-Mart regarding employee protests last year in 13 states including California. It found that the retailer unlawfully threatened employees with reprisal if they engaged in strikes on Black Friday, unlawfully disciplined workers who did in engage in those strikes and unlawfully treated employees in other stores in anticipation of them participating in strikes or other labor activities. The Black Friday protests last year spread to 100 cities, with 600 people turning out to a Wal-Mart in Paramount, Calif., to support workers. The NLRB found in favor of Wal-Mart in two instances, saying that Wal-Mart did lawfully tell non-employees to move from Wal-Mart property, and that it did not unlawfully change work schedules. But the findings, which will become complaints if Wal-Mart does not settle with workers, were considered a victory for labor across the board. Wal-Mart could be forced to award workers back pay and reinstate certain workers.................. In a deal in July, the Senate confirmed all five members of the NLRB. In exchange, Obama had to withdraw the nomination of his two recess appointees. One of those appointees, Richard Griffin, was appointed the next month to the position of NLRB general counsel. Griffin’s office investigated the complaints against Wal-Mart. The investigation was announced in a news release by the United Food and Commercial Workers before it appeared on the NLRB’s website. This enraged union watchdogs.
    “It should not be lost upon anyone, that this is one of the first official actions by the new general counsel Richard Griffin, who was previously an official within a union that had serial management problems, including connections to organized crime,” said Fred Wszolek, spokesman for the Workforce Fairness Institute, in a statement. “Next, the fact this issue came to light in an announcement made by the United Food and Commercial Workers, even before the new general counsel made public any information related to the matter, certainly confirms the worst fears of American workers and businesses, which are union bosses are completely unchecked, pulling the strings in government and have declared war on our nation’s job creators.”

There has long been a debate about how slaves were treated in colonial America. Records kept by slave holders suggested that they were grossly underfed. Archaeological digs however suggest that the 'masters' provisions were only a supplement to what slaves could grow for themselves, or harvest from the wild. But those were different times, land was plentiful, extensive gardens presented no problem, game and wilderness plantlife were plentiful. Today we live in a much more dystopian landscape. While today's slave might be called a 'sales associate' or 'your server', he or she must still try to find enough to eat. This sage advice comes from the McDonald's 'employee only access' website: "...to keep from feeling hungry, break up your available food into small portions and spread them out." Ronald McDonald doesn't even bother to have a canned food drive for his employees like the pne that starving workers at Walmart get. Mickey D's does have a number of tips for how its employees can get government assistance,with no mention of the fact that a business that profits billions should at least be able to feed its slaves. In fact, McDonald's could double its wages and only add 17 cents to a Dollar Menu item. At this pay scale McDonald's employees could afford to eat and have disposable income to stimulate the rest of the economy. This "workers should have enough to eat" concept isn't in the billionaire's game plan. The whole point of high unemployment is to drive down wages to the point where people will not just work for food, but in order to have enough to eat they would be willing to kill those who oppose the billionaires. Jay Gould, a 19th century Railroad Baron, is quoted with articulating this concept. H said, "I can hire half of the 'working class' to kill the other half." It really wasn't a new concept with him, - this has always been the Conservative way. Liberals fought the British East India Company in the 18th century and the Confederates in the 19th over this very idea. Conservatives constantly conflate 'free markets' with a 'free people', citing Communism and other nonsense. In an actual 'free market' you can buy slaves.The Revolutionary and Civil Wars were fought and won by Liberals over this concept of 'freedom'. It has always been an imperfect implementation, but now we're in danger of going back to a truly 'free market'. You could wake up in a factory complex with the slogan, "Work will set you free" above the gate, ("Arbeit macht frei" in German). The sign above the drive-though might not actually say, 'Arbeit macht frei, and would you like fries with that? '. But that is exactly what they mean. »»» FEATURED SHOW Harvey Wasserman: Risky Operation at Fukushima Demands World Action On Monday the process to remove over 400 tons of spent fuel began at the Fukushima Daiichi nuclear plant in Japan. The delicate rod removal is an unprecedented procedure that Tokyo Electric Power (TEPCO), the company that operates the plant, has continually reassured the world that it can handle. But after years of obfuscation by TEPCO, ever since the tsunami and earthquake that laid waste to parts of Fukushima in March 2011, nuclear researcher and activist Harvey Wasserman of nukefree.org, doesn’t want to give the company another chance. The fuel rods at Reactor Number Four, can’t heat up, be exposed to air or break without releasing deadly gas, says Wasserman, but the cooling pool they’ve been resting in is leaky and potentially corroded by seawater and it’s feared it could not withstand another tremor or quake. The cooling pool is also 100 feet up: “These rods have to be brought to the ground.
