Owners of websites will install banners to encourage their visitors to fight back against surveillance, and employees of technology companies will demand that their organizations do the same.  Here are a few stories we had ready for last week that we unfortunately did not get to: We also have some comments on the latest SOTU speech: PIPELINE NEWS: Amber Hildebrandt at CBC News reveals a new CBC investigative report Pipeline rupture report raises questions about TransCanada inspections A CBC News investigation has unearthed a critical report that the federal regulator effectively buried for several years about a rupture on a trouble-prone TransCanada natural gas pipeline. On July 20, 2009, the Peace River Mainline in northern Alberta exploded, sending 50-metre-tall flames into the air and razing a two-hectare wooded area. Few people ever learned of the rupture — one of the largest in the past decade — other than the Dene Tha’ First Nation, whose traditional territory it happened on. In an early 2011 draft report about the incident, the National Energy Board criticized TransCanada, the operator of the line owned by its subsidiary NOVA Gas Transmission, for “inadequate” field inspections and “ineffective” management. Final reports are typically published by the investigative bodies, either the NEB or the Transportation Safety Board, but this report wasn’t released until this January when the CBC obtained it through an access-to-information request as part of its ongoing pipelines investigation. ......... Environmental policy expert Nathan Lemphers says he’s “deeply concerned” that the federal regulator kept the “fairly damning” report behind closed doors. “It’s quite likely that there are other incidents like this that the public simply doesn’t know about,” said Lemphers, a former Pembina Institute analyst. “This one stands out simply because of its size and the timing and the company involved.” Lemphers questions whether TransCanada’s contentious Keystone XL proposal, under environmental review in the U.S. at the same time, had a bearing on the regulator not publishing the Peace River Mainline draft report. “It's hard to guess intentions,” said Lemphers. “It certainly seems fishy from the outside that this report was kept quiet due to an apparent administrative error. If the report came out it would have been, risen to immediate public attention.” In January 2011, TransCanada was in the midst of negotiating dozens of U.S. safety requests on pipeline construction, operation and design on the controversial Keystone XL proposal. That was followed by several months of public comments in the States later that year. The Keystone XL project, first proposed in 2008, is still in limbo. A crucial assessment released last week said there are no major environmental objections to the $7-billion mega-project, but a 90-day comment period still remains. ...... According to the report, the pipeline spewed 1.45 million cubic metres of natural gas – equivalent to the volume of 580 Olympic-sized pools – over a period of hours before TransCanada stopped the flow and put out the fire. Fabian Chonkolay, a local hunter who flew over the site, described the aftermath as looking like a “big ball of fire” had consumed the forest. “Just like when they drop a bomb,” he said. ....... The report reveals that the Peace River Mainline has a historically high rate of ruptures — six since the 1970s. The Alberta pipeline’s rupture rate is five times higher than Canada’s national rupture rate, reported in a 2004 study. The section of the pipeline that burst in 2009 was 95 per cent corroded. TransCanada’s own rules required that it physically inspect a pipeline when it reached 75 per cent corrosion, the report says. The report notes the inline inspection tool failed to accurately assess the depth of the “corrosion within corrosion.” Pipeline integrity experts say that given the pipeline’s high rate of ruptures and its known corrosion problems, the company ran along the “ragged edge” of the rules......... Ecowatch.org has now released the First-Ever Footage of Aging Tar Sands Pipelines Beneath Great Lakes By Beth Wallace This past July, National Wildlife Federation (NWF) conducted a diving expedition to obtain footage of aging oil pipelines strung across one of the most sensitive locations in the Great Lakes, and possibly the world: the Straits of Mackinac. Footage of these pipelines has never been released to the public until now. The Straits of Mackinac pipelines, owned by Enbridge Energy, are 60-years-old and considered one of the greatest threats to the Great Lakes because of their age, location and the hazardous products they transport—including tar sands derived oil. For nearly two years, NWF has been pressing pipeline regulators and Enbridge to release information about the integrity of these pipelines, including inspection videos showing how the pipelines cross the Straits of Mackinac. These requests have gone largely unanswered from both Enbridge and the Pipeline Hazards Safety Administration (PHMSA), who regulates pipeline operations. Because Enbridge hastily moved forward with plans to increase pressure on the aging pipelines, and has bypassed critical environmental permitting for changes in operation, NWF decided we needed to obtain our own:... THEN At CommonDreams.org staff writer Sarah Lazare posts Indigenous Groups: 'No Keystone XL Pipeline Will Cross Our Lands' Native American communities along proposed route vow resistance against 'black snake' pipeline: Native American communities are promising fierce resistance to stop TransCanada from building, and President Barack Obama from permitting, the northern leg of the Keystone XL pipeline. "No Keystone XL pipeline will cross Lakota lands," declares a joint statement from Honor the Earth, the Oglala Sioux Nation, Owe Aku, and Protect the Sacred. "We stand with the Lakota Nation, we stand on the side of protecting sacred water, we stand for Indigenous land-based lifeways which will NOT be corrupted by a hazardous, toxic pipeline." Members of seven Lakota nation tribes, as well as indigenous communities in Idaho, Oklahoma, Montana, Nebraska and Oregon, are preparing to take action to stop Keystone XL. “It will band all Lakota to live together and you can’t cross a living area if it’s occupied,” said Greg Grey Cloud, of the Rosebud Sioux Tribe, in an interview with Aboriginal Peoples Television Network. “If it does get approved we aim to stop it.” The indigenous-led 'Moccasins on the Ground' program has been laying the groundwork for this resistance for over two years by giving nonviolent direct action trainings to front-line communities. ...... The promises of joint action follow the U.S. State Department’s public release on Friday of the Final Environmental Impact Statement (FEIS). This report has been widely criticized as tainted by the close ties between Transcanada and the Environmental Resource Management contractor hired to do the report. While the oil industry is largely spinning the report as a green-light for the pipeline, green groups emphasize that it contains stern warnings over the massive carbon pollution that would result if the pipeline is built, including the admission that tar sands oil produces approximately 17 percent more carbon than traditional crude. The release of the FEIS kicked off a 90-day inter-agency review and 30-day public comment period. The pipeline's opponents say now is a critical time to prevent Obama from approving the pipeline, which is proposed to stretch 1,179 miles from Alberta, Canada, across the border to Montana, and down to Cushing, Oklahoma where it would link with other pipelines, as part of a plan to drastically increase Canada's tar sands production......."Let's honor the trail blazers from the Keystone XL south fight," said Idle No More campaigner Clayton Thomas-Muller. "Time for some action, and yes, some of us may get arrested!”. WAIT THERE'S MORE Dan River Coal Ash Spill Pollutes Waterway Near Retired Duke Energy Plant (PHOTOS) EDEN, N.C. (AP) — A pipe under a coal ash pond broke in northern North Carolina, releasing an unknown amount of coal ash into the Dan River, Duke Energy Corp. said Monday. The pipe broke Sunday afternoon at the now-closed Dan River Steam Station in Eden, the utility said. The ash pond covers about 27 acres, and the dam holding the water in was not affected by the leak, officials said. A water quality-monitoring team is checking the river, but Duke Energy said downstream water supplies have not been affected. ........... The N.C. Department of Environment and Natural Resources said in a statement that it is investigating, as well as helping to monitor water quality and work with Duke energy to clean up the spill. Engineers have not figured out exactly how much ash and water made it into the Dan River in Rockingham County, although Duke Energy promised to make that figure public as soon as calculations are complete. Environmental groups, some of which have sued Duke Energy over 14 coal ash dump sites in North Carolina, sharply criticized the utility for waiting for a day before reporting the spill to the public and not immediately releasing information such as results of water quality tests on the river. "State environmental officials failed to immediately notify the public about a major toxic spill in one of our precious waterways. Coal ash is extremely dangerous and the communities near the spill deserve information about their health and safety," Stephanie Schweickert, affiliate organizer with the North Carolina Conservation Network, said in a statement. I am not counting among these 15 major frauds the Bear Stearns and WaMu frauds, but readers need to know that Dimon was eager to acquire WaMu before it collapsed even though it was notorious for the extent of its fraudulent lending and fraudulent sales of fraudulently originated mortgages. JPM was perfectly positioned to recognize how endemically fraudulent WaMu was at the time Dimon sought to acquire it. If WaMu had agreed to the acquisition there would be no issue but that JPM was fully liable for all of WaMu’s contributions to the fraud epidemics that crushed the economy. Dimon has an excuse for WaMu solely because he was lucky enough to be turned down by WaMu’s managers. Second, Raymond should have resigned (if he had any integrity). ...... MORE GOP CANARDS: The recent CBO report on the ACA had all the typical regressives shouting "2 milllion jobs lost!" in concert and the lazy corporate media let them spew their prevarications without any fact-checking. In fact "While Fox News, Fox Business, and MSNBC's favorite GOP mouthpiece Chuck Todd intentionally misstate the report's findings to support repeal, the facts are there in black and white" as karoli at crooksandliars.com lists all the multiple canards the GOPhers and their media allies regurgitate in CBO Report Blows Away GOP ACA Lies THEN At CommonDreams.org DEAN BAKER on the CBO Findings on Obamacare (Minus the GOP Talking Points) © 2014 Center for Economic and Policy Research Apparently a lot of media folks have made such a habit of repeating Republican talking points that they can't see what is right in front of their eyes. The Republicans are touting the fact that the Congressional Budget Office (CBO) expects the Affordable Care Act (ACA) to reduce the number of people working. Guess what? This was one of the motivations for the ACA. It is a feature, not a bug. There are a lot of people who would prefer not to work and would not work if they had some other way to get health care insurance. Imagine a 62 year-old with diabetes and other health conditions. No insurer will touch this person. If they can get insurance at all they are looking at bill that will certainly run well over $10k a year. If this person has a job that provides insurance they will keep it until they qualify for Medicare no matter how much of a struggle it is to go to work each day. Now with the ACA this person will be able to buy insurance at the same price as anyone else in the age 55-64 age group. If they can get by on their Social Security and prior savings then they may well decide to retire early. They may also qualify for a subsidy in the exchanges. Is this an awful story? You be the judge. The other likely scenario is the case of a mother with a newly born child. She may want to spend some time at home with her kid, but may have no other way to pay for her health insurance if she leaves her job. The ACA will give her an opportunity to get lower cost insurance (possibly with a subsidy). Again, is a mother taking some off to be with a new born kid a horror story? Finally, we should be very clear about what CBO said on wages since there really is no ambiguity here. It said: "According to CBO’s more detailed analysis, the 1 percent reduction in aggregate compensation that will occur as a result of the ACA corresponds to a reduction of about 1.5 percent to 2.0 percent in hours worked. (p 127)" If hours fall by 1.5 to 2.0 percent, but compensation falls by 1.0 percent, then compensation per hour rises by 0.5-1.0 percent due to the ACA. If this is bad news for workers then someone must have been enjoying the new found freedoms in Colorado or Washington State too much. Obama On Private And Public Sector Job Creation ..... Private sector job creation returned in February of 2010, the 13th month of President Obama’s term. Since then, the economy has added 4.3 million private sector jobs, a 4 percent increase. Under President Bush, the economy stopped shedding private sector jobs in July of 2003, fully 30 months into his administration. From that point until May of 2004, the economy added just 1.5 million private sector jobs, an increase of only 1.4 percent. ..... Microsoft, Facebook, Google and Yahoo release US surveillance requests reports SPENCER ACKERMAN at TheGuardian.com • Tech giants turn over data from tens of thousands of accounts • Limited disclosure part of transparency deal made last month: Tens of thousands of accounts associated with customers of Microsoft, Google, Facebook and Yahoo have their data turned over to US government authorities every six months as the result of secret court orders, the tech giants disclosed for the first time on Monday. As part of a transparency deal reached last week with the Justice Department, four of the tech firms that participate in the National Security Agency’s Prism effort, which collects largely overseas internet communications, released more information about the volume of data the US demands they provide than they have ever previously been permitted to disclose. But the terms of the deal prevent the companies from itemising the collection, beyond bands of thousands of data requests served on them by a secret surveillance court. The companies must also delay by six months disclosing information on the most recent requests – terms the Justice Department negotiated to end a transparency lawsuit before the so-called Fisa court that was brought by the companies. In announcing the updated data figures, the companies appeared concerned by the lack of precision over the depth of their compelled participation in government surveillance.“We still believe more transparency is needed so everyone can better understand how surveillance laws work and decide whether or not they serve the public interest,” said Google’s legal director for law enforcement and information security, Richard Salgado, in a post on the company’s official blog. “Specifically, we want to disclose the precise numbers and types of requests we receive, as well as the number of users they affect in a timely way.” (Haha 'more transparency" haha! You basturds have been scooping up our user data (to benignly "sell us" products and services) while their deep DATA MINING has been going on since EVER! Google gave the government the internet metadata of up to 999 customer accounts, and the content of communications from between 9,000 and 9,999 customers. ........... Microsoft received fewer than 1,000 orders from the Fisa court for communications content during the same period, related to between 15,000 and 15,999 “accounts or individual identifiers”. ............ Yahoo disclosed that it gave the government communications content from between 30,000 and 30,999 accounts over the first six months of 2013, and fewer than 1,000 customer accounts that were subject to Fisa court orders for metadata. ........ Facebook disclosed that during the first half of 2013, it turned over content data from between 5000 and 5999 accounts – a rise of about 1000 from the previous six month period – and customer metadata associated with up to 999 accounts ..... Editor of the Techdirt blog Mike Masnick explains New Net Neutrality Bill Introduced, Has No Chance Of Passing Well, this was inevitable, but a group of Representatives have introduced a new net neutrality bill, called the Open Internet Preservation Act of 2014, which attempts to bring back the FCC's rules that an appeals court struck down. The bill is more PR than anything else. For whatever reason (actually no good reason at all), net neutrality has become a purely partisan issue in Congress (Democrats for, Republicans against) and based on the fact that this bill only has Democrat sponsors, it means, first off, that it's only going to rekindle the same old fight without solving anything and go nowhere. But, more importantly, it's still the same old situation trying to kludge together a temporary solution for the real problem, which is the lack of a competitive market. It's one thing to insist that the US government mustn't apply any pressure on the Israeli government to comply with US policy. It would be quite another thing to demand that the Congress require the administration to apply more pressure on other governments and institutions to stop them from applying pressure on the Israeli government to comply with US policy. The BTV LAST WORD goes to JUAN COLE who pens this open letter at his Informed Comment blog Dear President Obama: Tar Sands & Keystone XL are more Dangerous than an Iranian Atomic Bomb ....... But while you seem to put a great deal of emphasis on Iran’s nuclear enrichment program and the danger it might be weaponized, and while you say you want nuclear disarmament in general, you seem to take a longer view on a much, much more extreme threat to the earth than a few thousand atomic bombs. While you have been the best president on the issue of climate change, and EPA regulations on coal plants in your administration are going a long way toward closing them down, you keep talking about an “all of the above” energy policy that lauds hydraulic fracking and increased hydrocarbon production. If you produce more of the stuff, it will be burned into the atmosphere. And, even just extracting it out is very bad for the earth. The greater threat than atomic bombs is carbon emissions and the likelihood that tar sands extraction of petroleum will greatly increase them. This coming on line of massive new amounts of extremely dirty tar sands petroleum would be much abetted by the Keystone XL pipeline. Extraction of petroleum from tar sands should be illegal for all kinds of reasons. Most importantly, it is a very, very dirty fuel. We are already putting 278 atomic bombs worth of energy into the atmosphere in the form of carbon dioxide emissions every minute. Let us stop and think about that. If one country detonated even one atomic bomb against another country, that would practically be the apocalypse nowadays. Or, if the countries of the world just did 278 tests of nuclear weapons a year there would be an enormous outcry. But we let Big Oil, Big Gas and Big Coal carry out the equivalent of that many explosions every 60 seconds. We only have 15 years to very substantially reduce the 32 billion metric tons of CO2 we put into the atmosphere every year. My guess is that you think we have more like 45 years, to about 2050. Climate scientists like Jim Hansen have revised that timeline. We have until 2030 to limit global warming to less than 4 degrees Fahrenheit. Getting hotter than than may well destabilize the climate, making it chaotic. We are in crisis and need a Manhattan project. The magnitude of the threat became even clearer in 2013, as The Smithsonian Magazine, which you publish recently pointed out. If you’d be willing to spend a likely $3 trillion and a great deal of American blood on a war with Iran to stop it from having one nuke, why not spend at least that much money to make sure that the equivalent of hundreds of thousands of nuclear weapons are not set off every single day? ............ Tar sands extraction, it turns out, puts 2 to 3 times as many polycyclic aromatic hydrocarbon (PAH) emissions into the atmosphere, water and soil as had earlier been estimated by industry studies. That chemical will affect both Canadian and American citizens. Your Center for Disease Control warns that PAHs are dangerous to human beings. They have caused tumors from being inhaled or from skin contact in laboratory animals and have caused cancer in human beings. Mice ingesting large amounts of PAHs had difficulty conceiving, so they damage reproductive health. They also have caused birth defects in animals. Animal studies also show that PAHs compromise immune response. So they make you sick and then make you less able to fight off sickness. But a chemical that causes cancer or birth defects is actually benign compared to the carbon emissions themselves, which will kill many more people through drought, flood, and other calamities, even over just the next century (it gets way worse after that). In the next 80 years we will lose New orleans and Miami to rising seas, and see substantial loss of coasts. Forest fires and crop failures threaten the southwest, which won’t have enough water. We can’t afford “all of the above” as an approach to our energy security, Mr. President. ......... You have really only one area left in which to enter the history books for your second term achievements. And that is the environment and climate change. If you approve Keystone XL and become an enabler of tar sands, you will not only lose that opportunity, you will be remembered as a second Nero, who fiddled while Rome burned. BEATLEMANIA!   • "Kids for Cash" Kids For Cash: Inside One of the Nation’s Most Shocking Juvenile Justice Scandals Today a special on "kids for cash," the shocking story of how thousands of children in Pennsylvania were jailed by two corrupt judges who received $2.6 million in kickbacks from the builders and owners of private prison facilities. We hear from two of the youth: Charlie Balasavage was sent to juvenile detention after his parents unknowingly bought him a stolen scooter; Hillary Transue was detained for creating a MySpace page mocking her assistant high school principal. They were both 14 years old and were sentenced by the same judge, Judge Mark Ciavarella, who is now in jail himself — serving a 28-year sentence. Balasavage and Transue are featured in the new documentary, "Kids for Cash," by filmmaker Robert May, who also joins us. In addition, we speak to two mothers: Sandy Fonzo, whose son Ed Kenzakoski committed suicide after being imprisoned for years by Judge Ciavarella, and Hillary’s mother, Laurene Transue. Putting their stories into context of the larger scandal is attorney Robert Schwartz, executive director of the Juvenile Law Center. The story is still developing: In October, the private juvenile-detention companies in the scandal settled a civil lawsuit for $2.5 million.
