MORE 114th CONGRESS: Dylan Scott at TPM finds New GOP Congress Fires Shot At Social Security On Day One With a little-noticed proposal, Republicans took aim at Social Security on the very first day of the 114th Congress. The incoming GOP majority approved late Tuesday a new rule that experts say could provoke an unprecedented crisis that conservatives could use as leverage in upcoming debates over entitlement reform. The largely overlooked change puts a new restriction on the routine transfer of tax revenues between the traditional Social Security retirement trust fund and the Social Security disability program. The transfers, known as reallocation, had historically been routine; the liberal Center for Budget and Policy Priorities said Tuesday that they had been made 11 times. The CBPP added that the disability insurance program "isn't broken," but the program has been strained by demographic trends that the reallocations are intended to address. The House GOP's rule change would still allow for a reallocation from the retirement fund to shore up the disability fund -- but only if an accompanying proposal "improves the overall financial health of the combined Social Security Trust Funds," per the rule, expected to be passed on Tuesday. While that language is vague, experts say it would likely mean any reallocation would have to be balanced by new revenues or benefit cuts. House Democrats are sounding the alarm........... MORE! Reporting for Rueters Timothy Gardner U.S. House passes Keystone XL bill, Senate to debate next week The U.S. House of Representatives passed a bill on Friday to approve the Keystone XL oil pipeline, despite a threat by the White House to veto legislation on the project. The bill passed, 266-153, with 28 of the House Democrats voting for the pipeline, down three from a similar vote in November. The Senate will debate a similar bill early next week. President Barack Obama has said the State Department should finish its assessment of the project before he decides whether to approve it. TransCanada Corp's pipeline would help transport more than 800,000 barrels per day of mostly Canadian tar sands oil to refineries along the Gulf Coast. Since we can't get past the WSJ's paywall we go to Tech Dirt Editor MIKE MASNICK and the because-surveillance-is-fun,-yo dept Feds Put Fake Cell Towers On Planes, Spied On Tons Of Innocent Americans The Wall Street Journal broke the news that the DOJ has been spying on tons of innocent Americans by putting fake mobile phone towers on airplanes and scooping up all sorts of data from people who thought they were connecting to regular mobile phone towers.
    The U.S. Marshals Service program, which became fully functional around 2007, operates Cessna aircraft from at least five metropolitan-area airports, with a flying range covering most of the U.S. population, according to people familiar with the program. Planes are equipped with devices—some known as “dirtboxes” to law-enforcement officials because of the initials of the Boeing Co. unit that produces them—which mimic cell towers of large telecommunications firms and trick cellphones into reporting their unique registration information. The technology in the two-foot-square device enables investigators to scoop data from tens of thousands of cellphones in a single flight, collecting their identifying information and general location, these people said.
We have, of course, reported for a while now on so-called Stingray devices, which mimic mobile phone towers on the ground (and have noted that Stingray is just one brand of a few such devices, known as IMSI catchers), but putting them on special planes and flying them around would allow law enforcement agencies to get a lot more information on a lot more people. Given that law enforcement efforts like this are supposed to be narrowly targeted towards those actually suspected of breaking the law, this seems like a massive 4th Amendment abuse, creating mass surveillance programs for law enforcement with little real oversight or control. While it may not be entirely surprising that this is happening, it is yet another surveillance program being done with zero public transparency, zero public debate and zero public input. That's a huge concern as we've seen time and time again how such programs get abused. And, while the WSJ doesn't come out and say it, it certainly sounds like it got this info from a concerned whistleblower inside the US Marshals Service:
    Within the Marshals Service, some have questioned the legality of such operations and the internal safeguards, these people said. They say scooping up of large volumes of information, even for a short period, may not be properly understood by judges who approve requests for the government to locate a suspect’s phone. Some within the agency also question whether people scanning cellphone signals are doing enough to minimize intrusions into the phone system of other citizens, and if there are effective procedures in place to safeguard the handling of that data.
As such programs keep getting disclosed, think of how many such other programs there are that we just don't know about? We know! Let's ask Ed Snowden! The Nation The CIA Didn’t Just Torture, It Experimented on Human Beings Reframing the CIA’s interrogation techniques as a violation of scientific and medical ethics may be the best way to achieve accountability. ..................... As Americans from the Beltway to the heartland debate—again—the legality and efficacy of “enhanced interrogation,” we are reminded that “torture” has lost its stigma as morally reprehensible and criminal behavior. That was evident in the 2012 GOP presidential primary, when more than half of the candidates vowed to bring back waterboarding, and it is on full display now. On Meet the Press, for example, former Vice President Dick Cheney, who functionally topped the national security decision-making hierarchy during the Bush years, announced that he “would do it again in a minute.” No one has been held accountable for torture, beyond a handful of prosecutions of low-level troops and contractors. Indeed, impunity has been virtually guaranteed as a result of various Faustian bargains, which include “golden shield” legal memos written by government lawyers for the CIA; ex post facto immunity for war crimes that Congress inserted in the 2006 Military Commissions Act; classification and secrecy that still shrouds the torture program, as is apparent in the Senate report’s redactions; and the “look forward, not backward” position that President Obama has maintained through every wave of public revelations since 2009. An American majority, it seems, has come to accept the legacy of torture. Human experimentation, in contrast, has not been politically refashioned into a legitimate or justifiable enterprise. Therefore, it would behoove us to appreciate the fact that the architects and implementers of black-site torments were authorized at the highest levels of the White House and CIA to experiment on human beings. Reading the report through this lens casts a different light on questions of accountability and impunity. .............. In the mid-1980s, CIA practices became the subject of congressional investigations into US-supported atrocities in Central America. Both manuals became public in 1997 as a result of Freedom of Information Act litigation by The Baltimore Sun. That would have seemed like a “never again” moment. But here we are again. This brings us back to Mitchell and Jessen. Because of their experience as trainers in the military’s Survival, Evasion, Resistance, Escape (SERE) program, after 9/11 they were contacted by high-ranking Pentagon officials and, later, by lawyers who wanted to know whether some of those SERE techniques could be reverse-engineered to get terrorism suspects to talk. .................... My point is not to minimize the illegality of torture or the legal imperatives to pursue accountability for perpetrators. Rather, because the concept of torture has been so muddled and disputed, I suggest that accountability would be more publicly palatable if we reframed the CIA’s program as one of human experimentation. If we did so, it would be more difficult to laud or excuse perpetrators as “patriots” who “acted in good faith.” Although torture has become a Rorschach test among political elites playing to public opinion on the Sunday morning talk shows, human experimentation has no such community of advocates and apologists. From Wired's UK affiliate Nasa wants to make water and oxygen on the Moon We heard a blurb about this last week and even though this article is from last February we thought you might be interested! By 2018, Nasa is hoping to put a rover on the lunar surface that will be able to extract hydrogen, water and oxygen from the soil. The RESOLVE (Regolith and Environment Science and Oxygen & Lunar Volatile Extraction) mission will grab handfuls of lunar dirt and heat them up to a temperature where hydrogen, oxygen and water vapour can escape. The two ingredients can then be combined to make water. A similar experiment will be mounted on the next Mars rover, due to launch in 2020. However this version will involve extracting carbon dioxide from the Martian atmosphere, filtering out dust, and then processing the CO2 into oxygen. Both missions are early experiments in the science of terraforming - turning other planets into environments that humans could live in without specialised equipment. Without oxygen and water we're unlikely to survive for too long -- but bringing it from home is difficult, so it's far preferable to be able to conjure it up in-situ. If the experiments are successful, future missions may involve industrialising the process, eventually allowing us to drink Martian water and breathe lunar air. ....... What could possibly go wrong? HOODIES BANNED IN OKLAHOMA? $500 FINE? Emily Atkin at ThinkProgress tells us New Bill Would Make Wearing Hoodies A Crime FOR REAL! Oklahoma lawmakers are planning to introduce a bill this February that would make it illegal to wear hooded sweatshirts, or “hoodies,” in public, according to a report from Oklahoma’s Channel 6 News. Republican Senator Don Barrington will introduce the bill, which would make it a misdemeanor to “wear a mask, hood, or covering” either while committing a crime or in order to intentionally conceal one’s identity. If the bill is passed, offenders would be subject to a fine of $50 to $500, and up to one year in jail. The ban would not affect mask-wearers on Halloween or at masquerade parties, nor would it apply to people who wear head coverings for religious purposes. The bill’s purpose is seemingly to deter crime. As Channel 6’s report notes, robberies caught on surveillance camera often show the perpetrator wearing a mask or hoodie to cover his or her face. With the bill’s language only prohibiting wearing hoodies while committing a crime or to intentionally hide, supporters say the ban wouldn’t negatively affect people just trying to wear a sweatshirt in day-to-day life. Others, however, have argued that bans on hoodies — no matter the intention — only serve to exacerbate problems with racial profiling. CNN legal analyst Sunny Hostin took on the issue when an Indiana mall banned the garment in March: “This is about the pretext of being able to stop young African-American males,” she said. “Hoodie is code for ‘thug’ in many places and I think businesses shouldn’t be in the business of telling people what to wear. They were seeking "several explosive devices, including a thermite-mix charge and a dozen pipe bombs constructed for 'maximum fragmentation,'" NorthwestGeorgianews.com recently reported. Unfortunately for them, instead of an arms dealer, they met up "an undercover FBI source." Before their trip, Peace, Cannon and Williamson — all members of a militia in Georgia — "participated in online chat discussions between Jan. 23 and Feb. 15, 2014, that were monitored by the FBI," NorthwestGeorgianews.com pointed out. "During the conversations online, they discussed using guerilla war tactics and planned to launch attacks against a metro Atlanta police station and several government agencies in February 2014. The three men attempted to 'recruit other individuals to join them and to carry out similar operations in those individuals' home states.' Peace allegedly told other militia members to choose targets including 'road blocks, TSA checkpoints, sheriffs/police conducting operations outside the Constitution' as well as to participate in the 'removal of government people who support extra-Constitutional activities.'" "The men were arrested in Cartersville, [Georgia] on Feb. 15, 2014, when they took possession of inert explosives and other material given to the source by the FBI." They were "originally arraigned in March 2014 on a charge of conspiracy to receive and possess a destructive device." They were recently indicted "on a much more serious domestic terrorism charge — conspiracy to use weapons of mass destruction," an "indictment and charge supersedes the previous indictment," NorthwestGeorigianews.com reported. On Fox's "Outnumbered" Wednesday, the cast got into a discussion about how Paris police didn't have enough weapons, which enabled – they claimed – the Islamic extremist terrorists to massacre 12 people. Enter Fox News anchor Shannon Bream, a former corporate attorney and graduate of Jerry Falwell's Liberty University. Bream, speaking unscripted, wondered how police would be able to identify "bad guys" if they had ski masks and couldn't "even know what color," what "the tone of their skin was?" Her commentary – totally unquestioned by the four other Fox News hosts – was in response to co-host Kennedy Montgomery, aka "Kennedy," who had said, "sometimes bad guys don't look like bad guys." "That's my question about these guys because if we know they were speaking unaccented French and they had, you know, ski masks on, do we even know what color they were?," Bream asked. "What the tone of their skin was," she tried to clarify – as if that were less racist. "I mean what if they didn't look like typical bad guys?" Media Matters noted that Bream "apparently," was "implying that certain skin tones should raise red flags for law enforcement." And calling it "naked racism," Blue Nation Review noted that "Fox News tends to cloak its racism in code words and dog whistles," but "sometimes it’s disturbingly on display," as it was Wednesday. Just as it has been said "One person's terrorist is another's Freedom Fighter" from outside the U.S. where LSM reports are carefully crafted and screened (a.k.a. propaganda) the rest of the world sees U.S. foreign policy something along the lines of "Shoot first, ask questions later" or "Kill 'em all and let God sort 'em out" which could be boiled down to "Shoot anything that moves" as U.S. Foreign Policy Objective #1. This simplistic view of the outside world according to the Washington Consensus these past decades has led us to this place in time. When we were protesting the invasion of Iraq in 2003, its country and society was as secular and modern as possible in the Mid-East (not like Saudi Arabia or Egypt). Remember Iraq was an ally of Donald Rumsfeld and the Reagan regime. Aside from the on-going tensions in the region between Sunni & Shia and Jews & Palestinians the region was fairly stable. But the blind ambition of "war prezident" Dim Son and his cronies in the carbon extraction industries decided (on false pretenses) to kick the hornet's nest. To this day we see the effects of that military action in what the LSM terms "radicalized Moose-lims". Our Brick TeeVee LAST WORD goes to Professor Juan Cole Sharpening Contradictions: Why al-Qaeda attacked Satirists in Paris The horrific murder of the editor, cartoonists and other staff of the irreverent satirical weekly Charlie Hebdo, along with two policemen, by terrorists in Paris was in my view a strategic strike, aiming at polarizing the French and European public. The problem for a terrorist group like al-Qaeda is that its recruitment pool is Muslims, but most Muslims are not interested in terrorism. Most Muslims are not even interested in politics, much less political Islam. France is a country of 66 million, of which about 5 million is of Muslim heritage. But in polling, only a third, less than 2 million, say that they are interested in religion. French Muslims may be the most secular Muslim-heritage population in the world (ex-Soviet ethnic Muslims often also have low rates of belief and observance). Many Muslim immigrants in the post-war period to France came as laborers and were not literate people, and their grandchildren are rather distant from Middle Eastern fundamentalism, pursuing urban cosmopolitan culture such as rap and rai. In Paris, where Muslims tend to be better educated and more religious, the vast majority reject violence and say they are loyal to France. Al-Qaeda wants to mentally colonize French Muslims, but faces a wall of disinterest. But if it can get non-Muslim French to be beastly to ethnic Muslims on the grounds that they are Muslims, it can start creating a common political identity around grievance against discrimination. This tactic is similar to the one used by Stalinists in the early 20th century. ......... The operatives who carried out this attack exhibit signs of professional training. They spoke unaccented French, and so certainly know that they are playing into the hands of Marine LePen and the Islamophobic French Right wing. They may have been French, but they appear to have been battle hardened. This horrific murder was not a pious protest against the defamation of a religious icon. It was an attempt to provoke European society into pogroms against French Muslims, at which point al-Qaeda recruitment would suddenly exhibit some successes instead of faltering in the face of lively Beur youth culture (French Arabs playfully call themselves by this anagram term deriving from wordplay involving scrambling of letters). Ironically, there are reports that one of the two policemen they killed was a Muslim. Al-Qaeda in Mesopotamia, then led by Abu Musab al-Zarqawi, deployed this sort of polarization strategy successfully in Iraq, constantly attacking Shiites and their holy symbols, and provoking the ethnic cleansing of a million Sunnis from Baghdad. The polarization proceeded, with the help of various incarnations of Daesh (Arabic for ISIL or ISIS, which descends from al-Qaeda in Mesopotamia). And in the end, the brutal and genocidal strategy worked, such that Daesh was able to encompass all of Sunni Arab Iraq, which had suffered so many Shiite reprisals that they sought the umbrella of the very group that had deliberately and systematically provoked the Shiites. “Sharpening the contradictions” is the strategy of sociopaths and totalitarians, aimed at unmooring people from their ordinary insouciance and preying on them, mobilizing their energies and wealth for the perverted purposes of a self-styled great leader. (We'll add the American hard-right Evangelical Christians in this group who claim "victim" status. -Ed.) The only effective response to this manipulative strategy (as Grand Ayatollah Ali Sistani tried to tell the Iraqi Shiites a decade ago) is to resist the impulse to blame an entire group for the actions of a few and to refuse to carry out identity-politics reprisals. For those who require unrelated people to take responsibility for those who claim to be their co-religionists (not a demand ever made of Christians), the al-Azhar Seminary, seat of Sunni Muslim learning and fatwas, condemned the attack, as did the Arab League that comprises 22 Muslim-majority states. We have a model for response to terrorist provocation and attempts at sharpening the contradictions. It is Norway after Anders Behring Breivik committed mass murder of Norwegian leftists for being soft on Islam. The Norwegian government launched no war on terror. They tried Breivik in court as a common criminal. They remained committed to their admirable modern Norwegian values. Most of France will also remain committed to French values of the Rights of Man, which they invented. But an insular and hateful minority will take advantage of this deliberately polarizing atrocity to push their own agenda. Europe’s future depends on whether the Marine LePens are allowed to become mainstream. Extremism thrives on other people’s extremism, and is inexorably defeated by tolerance. Let me conclude by offering my profound condolences to the families, friends and fans of our murdered colleagues at Charlie Hebdo, including Stephane Charbonnier, Bernard Maris, and cartoonists Georges Wolinski Jean Cabut, aka Cabu, and Berbard Verlhac (Tignous)– and all the others. As Charbonnier, known as Charb, said, “I prefer to die standing than to live on my knees.”.
