This just in: Walmart used a tax loophole to get you and me to pay millions to executive fatcats in undeserved bonuses. How do you like that? You probably don't like it at all, because you know that on top of that, you also fork over your tax dollars to maintain the company's system of low wages, which require Medicaid, food stamps, and other public assistance to sustain workers who do not earn enough to live on. Not to mention what you pay to maintain the roads and infrastructure Walmart uses to do business. Or what you pay to educate its workforce through public schools. Etc, etc. etc. Walmart workers can't afford to feed their children, but things are sure different at the top of the Walmart food chain, where executives gobble up stratospheric sums for doing a piss-poor job. According to a new report by the Institute for Policy Studies (IPS) and Americans for Tax Fairness (ATF) Walmart managed to finagle $104 million in taxpayer subsidies over a six-year period due to tax deductions for “performance-based” executive compensation. Eight top executives were able to rake in more than $298 million in “performance pay” that was fully tax deductible. The report release comes just days before Walmart’s annual shareholder meeting on Friday, June 6. Walmart, the study reveals, was able to lower its federal tax payments by $40 million because of obscene pay packages awarded to just one executive — recently retired CEO Michael Duke. Duke took in $116 million in stock options and other performance-based compensation between 2009 and 2014. Of course, his "performance" included presiding over a slump in sales and repeated revelations of worker abuse that have damaged Walmart's reputation. But in the surreal world of corporate America, a corporate CEO can get rich running a company into the ground. (Isn't this the very same model Mitt "Headroom" Romney and Baine Capital and other such 'takeover' con men use every day to get rich while destroying otherwise whole companies? Just sayin' -Ed.) The report, "Walmart’s Executive Bonuses Cost Taxpayers Millions", finds that Walmart’s $104 million in tax savings was made possible by a loophole in U.S. tax law that allows companies to deduct unlimited amounts for performance-based compensation. Ironically, the loophole was created through a 1993 reform meant to discourage excessive executive compensation by capping the amount corporations can deduct from their income taxes for executive pay at no more than $1 million per executive. But the law backfired: It tore open a giant loophole by exempting stock options and other so-called “performance pay” from the cap. ........... If the “CEO bonus pay loophole” were closed, taxpayers would save $50 billion over 10 years, according to the Joint Committee on Taxation. In the U.S. House of Representatives, Rep. Doggett (D-TX) has introduced the Stop Subsidizing Multimillion Dollar Corporate Bonuses Act (H.R. 3970). Sen. Jack Reed (D-RI) and Sen. Richard Blumenthal (D-CT) have introduced identical legislation (S. 1476) in the U.S. Senate. Basically, Walmart is a giant parasite, sucking on the American taxpayer to reward executives and steer the country toward even more dangerous inequality and instability. The spy agency’s reliance on facial recognition technology has grown significantly over the last four years as the agency has turned to new software to exploit the flood of images included in emails, text messages, social media, videoconferences and other communications, the N.S.A. documents reveal. Agency officials believe that technological advances could revolutionize the way that the N.S.A. finds intelligence targets around the world, the documents show. The agency’s ambitions for this highly sensitive ability and the scale of its effort have not previously been disclosed. The agency intercepts “millions of images per day” — including about 55,000 “facial recognition quality images” — which translate into “tremendous untapped potential,” according to 2011 documents obtained from the former agency contractor Edward J. Snowden. While once focused on written and oral communications, the N.S.A. now considers facial images, fingerprints and other identifiers just as important to its mission of tracking suspected terrorists and other intelligence targets, the documents show. “It’s not just the traditional communications we’re after: It’s taking a full-arsenal approach that digitally exploits the clues a target leaves behind in their regular activities on the net to compile biographic and biometric information” that can help “implement precision targeting,” noted a 2010 document. ........... It is not clear how many people around the world, and how many Americans, might have been caught up in the effort. Neither federal privacy laws nor the nation’s surveillance laws provide specific protections for facial images. Given the N.S.A.’s foreign intelligence mission, much of the imagery would involve people overseas whose data was scooped up through cable taps, Internet hubs and satellite transmissions. ......... Civil-liberties advocates and other critics are concerned that the power of the improving technology, used by government and industry, could erode privacy. “Facial recognition can be very invasive,” said Alessandro Acquisti, a researcher on facial recognition technology at Carnegie Mellon University. “There are still technical limitations on it, but the computational power keeps growing, and the databases keep growing, and the algorithms keep improving.” .......... The State Department has what several outside experts say could be the largest facial imagery database in the federal government, storing hundreds of millions of photographs of American passport holders and foreign visa applicants. And the Department of Homeland Security is funding pilot projects at police departments around the country to match suspects against faces in a crowd. ......... “We would not be doing our job if we didn’t seek ways to continuously improve the precision of signals intelligence activities — aiming to counteract the efforts of valid foreign intelligence targets to disguise themselves or conceal plans to harm the United States and its allies,” said Vanee M. Vines, the agency spokeswoman. She added that the N.S.A. did not have access to photographs in state databases of driver’s licenses or to passport photos of Americans, while declining to say whether the agency had access to the State Department database of photos of foreign visa applicants. She also declined to say whether the N.S.A. collected facial imagery of Americans from Facebook and other social media through means other than communications intercepts. “The government and the private sector are both investing billions of dollars into face recognition” research and development, said Jennifer Lynch, a lawyer and expert on facial recognition and privacy at the Electronic Frontier Foundation in San Francisco. “The government leads the way in developing huge face recognition databases, while the private sector leads in accurately identifying people under challenging conditions.” Ms. Lynch said a handful of recent court decisions could lead to new constitutional protections for the privacy of sensitive face recognition data. But she added that the law was still unclear and that Washington was operating largely in a legal vacuum. ........... It is not clear how many images the agency has acquired. The N.S.A. does not collect facial imagery through its bulk metadata collection programs, including that involving Americans’ domestic phone records, authorized under Section 215 of the Patriot Act, according to Ms. Vines. ....... IN A RELATED MATTER CSMonitor's Staff writer Noelle Swan tells us NSA not amassing Americans' photos for face-recognition program, chief says Adm. Michael Rogers, chief of the National Security Agency, acknowledged Tuesday that the NSA uses facial recognition technology to investigate foreign intelligence and counterterrorism targets, but he insisted that photos of Americans are generally off limits unless those individuals are linked to an investigation of a foreign subject. “We have very specific restrictions when it comes to US persons," Rogers told attendees of a Bloomberg Government cyber-security conference, according to Bloomberg. “In broad terms, we have to stop what we’re doing if we come to the realization that somebody we’re monitoring or tracking has a US connection that we were unaware of.” .......... Rogers's comments Tuesday imply that the NSA is not routinely sweeping up and curating images of Americans online or their driver's license photos. His willingness to discuss the issue with Bloomberg marks a step toward greater NSA transparency, something the admiral has advocated since he took the helm of the NSA and US Cyber Command in April. During his Senate confirmation hearing in March, Rogers pledged to “be as transparent as possible about what we’re doing [at the NSA] and why,” Reuters reported. The NSA track record for transparency would not be described as good. Secrecy is so ingrained in the NSA mission that the organization has been jokingly referred to as No Such Agency. The series of documents made public by Mr. Snowden and cooperating news outlets over the past year has helped to cement that reputation. .............. Rogers told conference attendees that the "broad dialogue of what we’re doing and why is a good thing for us as a nation. Mr. Akerman's report notes that “he neglected to mention that the agency and its allies worked behind the scenes last month to weaken privacy and transparency provisions in a major surveillance reform bill.” We go to Marcy Wheeler for details on that "major surveillance bill" in As Snowden Leak Anniversary Approaches, Intelligence Community Prepares to Declare Victory As June 5 approaches — and with it the one year anniversary of the first reporting on Edward Snowden’s leaks — the privacy community is calling supporters to redouble efforts to improve the NSA “reform bill,” which I call the USA Freedumber Act, in the Senate. I explained here why the Senate is unlikely to improve USA Freedumber in any meaningful way. The votes just aren’t there — not even in the Senate Judiciary Committee. ...... Unless the surveillance community finds some way to defeat USA Freedumber, the intelligence community will soon be toasting themselves that they used the cover of Edward Snowden’s disclosures to expand surveillance. The “Edward Snowden Put the NSA in Your Smartphone Act,” they might call it. To prevent that, the privacy community needs to find a way to defeat USA Freedumber. It’s not enough, in my opinion, to point to the judicial review codified by USA Freedumber to accede to letting this pass. Not only doesn’t USA Freedumber end what most normal people call, “bulk collection,” but it expands collection in a number of ways. That’s true, in part, because of the way the bill defines “bulk collection.” USA Freedumber only considers something “bulk collection” if it collects all of some kind of data (so, all phone data in the US). If NSA limits collection at all — selecting to collect all the phone records from Area Code 202, for example — it no longer qualifies as bulk collection under the Intel Community definition used in the bill, no matter how broadly they’re collecting. Here’s a post where I lay that out. To make things worse, the last version of the House bill changed the term “selection term” to make it very broad: including “entities,” “addresses,” and “devices” among the things that count as a single target, all of which invite mass targeting. .......... But it’s not just that the bill doesn’t deliver what its boosters claim it does. There are 4 other ways that the bill makes the status quo worse, as I show in this post: - The move to telecoms codifies changes in the chaining process that will almost certainly expand the universe of data being analyzed — potentially significantly
- In three ways, the bill would permit the use of phone chaining for purposes beyond counterterrorism, which isn’t currently permitted
- The bill weakens the minimization procedures on upstream Section 702 collection imposed by FISC Judge John Bates in 2011, making it easier for the government to collect and keep domestic content domestically
- The bill moves the authority to set minimization procedures for Pen Registers from FISC to the Attorney General (and weakens them significantly), thus eliminating the tool John Bates used to shut down illegal content-as-metadata collection
In my opinion, these changes mean the NSA will be able to do much of what they were doing in 2009, before what were then called abuses – but under this bill would be legalized — were discovered. That, plus they’re likely to expand the dragnet beyond terrorism targets. For a year, privacy advocates have believed we’d get reform in response to Snowden’s leaks. For too long, advocates treated HR 3361 as positive reform. But unless we defeat USA Freedumber, the Intelligence Community will have used the event of Snowden’s leaks as an opportunity to expand the dragnet. NEXT Daniel Elsburg writes at The Guardian Snowden would not get a fair trial – and Kerry is wrong ........ On the Today show and CBS, Kerry complimented me again – and said Snowden "should man up and come back to the United States" to face charges. But John Kerry is wrong, because that's not the measure of patriotism when it comes to whistleblowing, for me or Snowden, who is facing the same criminal charges I did for exposing the Pentagon Papers. As Snowden told Brian Williams on NBC later that night and Snowden's lawyer told me the next morning, he would have no chance whatsoever to come home and make his case – in public or in court. Snowden would come back home to a jail cell – and not just an ordinary cell-block but isolation in solitary confinement, not just for months like Chelsea Manning but for the rest of his sentence, and probably the rest of his life. His legal adviser, Ben Wizner, told me that he estimates Snowden's chance of being allowed out on bail as zero. (I was out on bond, speaking against the Vietnam war, the whole 23 months I was under indictment). More importantly, the current state of whistleblowing prosecutions under the Espionage Act makes a truly fair trial wholly unavailable to an American who has exposed classified wrongdoing. Legal scholars have strongly argued that the US supreme court – which has never yet addressed the constitutionality of applying the Espionage Act to leaks to the American public – should find the use of it overbroad and unconstitutional in the absence of a public interest defense. The Espionage Act, as applied to whistleblowers, violates the First Amendment, is what they're saying. As I know from my own case, even Snowden's own testimony on the stand would be gagged by government objections and the (arguably unconstitutional) nature of his charges. That was my own experience in court, as the first American to be prosecuted under the Espionage Act – or any other statute – for giving information to the American people. ....... And so it has been with every subsequent whistleblower under indictment, and so it would be if Edward Snowden was on trial in an American courtroom now. .......... Without reform to the Espionage Act that lets a court hear a public interest defense – or a challenge to the appropriateness of government secrecy in each particular case – Snowden and future Snowdens can and will only be able to "make their case" from outside the United States. ........... John Kerry's challenge to Snowden to return and face trial is either disingenuous or simply ignorant that current prosecutions under the Espionage Act allow no distinction whatever between a patriotic whistleblower and a spy. Either way, nothing excuses Kerry's slanderous and despicable characterizations of a young man who, in my opinion, has done more than anyone in or out of government in this century to demonstrate his patriotism, moral courage and loyalty to the oath of office the three of us swore: to support and defend the Constitution of the United States. NEXT The Partnership for Civil Justice Fund releases this new report Exposed: The Hidden Role of Fusion Centers in the Nationwide Spying Operation Against Occupy The Department of Homeland Security (DHS)-funded Fusion Centers used their vast anti-terrorism and anti-crime authority and funding to conduct a sprawling, nationwide and hour-by-hour surveillance effort that targeted even the smallest activity of peaceful protestors in the Occupy Movement in the fall and winter of 2011. This spying effort was exposed in a report issued today by the Partnership for Civil Justice Fund (PCJF) based on 4,000 pages of government documents obtained by the PCJF. The newly published documents reveal the actual workings of the Fusion Centers, created ostensibly to coordinate anti-terrorism efforts following the Sept. 11, 2001 attacks, in collecting and providing surveillance information on peaceful protestors. The new documents roll back the curtain on the Fusion Centers and show the communications, interactions and emails of a massive national web of federal agents, officials, police, and private “security” contractors. They accumulated and shared information reporting on all manner of peaceful and lawful political activity that took place during the Occupy movement, from protests and rallies to meetings and educational lectures. This enormous spying and monitoring apparatus included the Pentagon, FBI, DHS, police departments and chiefs, private contractors and commercial business interests. PCJF Executive Director Mara Verheyden-Hilliard stated: "The U.S. Fusion Centers are using their vast counter-terrorism resources to target the domestic social justice movement as a criminal or terrorist enterprise. This is an abuse of power and corruption of democracy." ........ Read the full report! The Partnership for Civil Justice Fund has also initiated a nationwide campaign to flood Congress and the President with letters demanding that the Fusion Centers be de-funded and ended immediately. Elliott Negin from the Union of Concerned Scientists writes at EcoWatch.com Nuclear Front Groups Spread Disinformation to Cover Industry Assets According to the nonpartisan Center for Responsive Politics, Exelon has spent nearly $8 million on political campaigns since 2008, more than any other private electric utility. Over that same time period, Exelon also spent $34.6 million on lobbying, putting it in the top 10 among electric utilities. In addition, Exelon is one of the biggest corporate donors to trade associations, pro-business alliances and other politically active nonprofits, according to a January report by the Center for Public Integrity. In 2012, Exelon gave $13.6 million to approximately two dozen nonprofits, the second-largest amount voluntarily disclosed among the Fortune 300 companies CPI reviewed. Exelon’s lobbyists also have enjoyed unparalleled access to the Obama Administration, according to an Aug. 2012 New York Times exposé. The Times provided several examples of how the company exerted its influence, including delaying and weakening a proposed EPA rule to prevent power plant water intake systems from killing fish and other aquatic life. The Times also reported that Exelon joined with NEI and other plant owners to challenge the NRC’s post-Fukushima safety recommendations. Specifically, they opposed a proposed requirement that they install filters on hardened vents at 31 boiling water reactors to help prevent radiation discharges into the environment in the event of an accident. Those reactors are similar in design to the six at the Fukushima facility. Filtered vents are now required in Japan and much of Europe, and the Nuclear Regulatory Commission technical staff recommended they be installed here. But Exelon and the rest of the U.S. nuclear industry, loathe to spend hundreds of millions of dollars on filters, insist there are other ways to achieve the same result and lobbied hard to avoid the upgrade. ............ The industry prevailed—for the time being. Despite the fact that the NRC technical staff provided ample evidence that filtered vents are a sensible, cost-effective measure that would protect nearby communities, NRC commissioners issued an order requiring owners of the 31 reactors to upgrade their hardened vents that stopped short of requiring filters. Instead, the commissioners gave their staff two years to review all the options for reducing radiation releases. The NRC will then open the proposed rule to public comment and finalize it by the end of 2017. ............ To be sure, nuclear power is the largest source of low-carbon electricity in the country, a major selling point. But Nuclear Matters’ website ominously warns that “the closings of just a handful of nuclear energy plants would have a devastating environmental impact on our country and make it nearly impossible for us to meet our clean energy or carbon reduction goals.” Is that right? Not quite. As it turns out, ramping up renewables—especially wind and solar—and energy efficiency could replace a significant amount of nuclear generation, and do it in a hurry. Let’s look at the numbers. ............... In other words, renewables and efficiency could go a long way to replace nuclear plants—and retiring coal plants—to dramatically reduce U.S. carbon emissions. ................ But you’re not going to hear about the potential of renewables and energy efficiency from Nuclear Matters. Exelon started the front group for the same reason NEI created the CASEnergy Coalition: to prop up the nuclear industry. And not only does Exelon want state and federal authorities to rescue its financially ailing reactors, it also has another goal in mind. A key component of Exelon’s game plan is to hamstring its low-carbon competition, namely the wind and solar industries. The corporate media silence on Fukushima has been deafening even though the melted-down nuclear power plant’s seaborne radiation is now washing up on American beaches. Ever more radioactive water continues to pour into the Pacific. At least three extremely volatile fuel assemblies are stuck high in the air at Unit 4. Three years after the March 11, 2011, disaster, nobody knows exactly where the melted cores from Units 1, 2 and 3 might be. Amid a dicey cleanup infiltrated by organized crime, still more massive radiation releases are a real possibility at any time. Radioactive groundwater washing through the complex is enough of a problem that Fukushima Daiichi owner Tepco has just won approval for a highly controversial ice wall to be constructed around the crippled reactor site. No wall of this scale and type has ever been built, and this one might not be ready for two years. Widespread skepticism has erupted surrounding its potential impact on the stability of the site and on the huge amounts of energy necessary to sustain it. Critics also doubt it would effectively guard the site from flooding and worry it could cause even more damage should power fail. Meanwhile, children nearby are dying. The rate of thyroid cancers among some 250,000 area young people is more than 40 times normal. According to health expert Joe Mangano, more than 46 percent have precancerous nodules and cysts on their thyroids. This is “just the beginning” of a tragic epidemic, he warns. There is, however, some good news—exactly the kind the nuclear power industry does not want broadcast. ......... But last month a Japanese court denied a corporate demand to restart two newer reactors at the Ooi power plant in Fukui prefecture. The judges decided that uncertainty about when, where and how hard the inevitable next earthquake will hit makes it impossible to guarantee the safety of any reactor in Japan. In other words, no reactor can reopen in Japan without endangering the nation, which the court could not condone. Such legal defeats are extremely rare for Japan’s nuclear industry, and this one is likely to be overturned. But it dealt a stunning blow to Abe’s pro-nuke agenda. In Fukushima’s wake, the Japanese public has become far more anti-nuclear. .......... In the meantime, Abe’s infamous, intensely repressive state secrets act has seriously constrained the flow of technical information. At least one nuclear opponent is being prosecuted for sending a critical tweet to an industry supporter. A professor jailed for criticizing the government’s handling of nuclear waste has come to the U.S. to speak. The American corporate media have been dead silent or, alternatively, dismissive about the radiation now washing up on our shores, and about the extremely dangerous job of bringing intensely radioactive fuel rods down from their damaged pools. ........ Fukushima’s General Electric reactors feature spent fuel pools perched roughly 100 feet in the air. When the tsunami hit, thousands of rods were suspended over Units 1, 2, 3 and 4. According to nuclear engineer Arnie Gundersen, the bring-down of the assemblies in Unit 4 may have hit a serious snag. Gundersen says that beginning in November 2013, Tokyo Electric Power removed about half of the suspended rods there. But at least three assemblies may be stuck. The more difficult half of the pile remains. And the pools at three other units remain problematic. An accident at any one of them could result in significant radiation releases, which have already far exceeded those from Chernobyl and from the bombings of Hiroshima and Nagasaki. At least 300 tons of heavily contaminated Fukushima water still pour daily into the Pacific. Hundreds more tons are backed up on site, with Tepco apologists advocating they be dumped directly into the ocean without decontamination. Despite billions of dollars in public aid, Tepco is still the principal owner of Fukushima. The “cleanup” has become a major profit center. Tepco boasted a strong return in 2013. Its fellow utilities are desperate to reopen other reactors that netted them huge annual cash flow. Little of this has made its way into the American corporate media. New studies from the Nuclear Regulatory Commission have underscored significant seismic threats to American commercial nuclear sites. Among those of particular concern are two reactors at Indian Point just north of New York City, which sit near the highly volatile Ramapo Fault, and two at Diablo Canyon, between Los Angeles and San Francisco, directly upwind of California’s Central Valley. ............... While the American reactor industry continues to suck billions of dollars from the public treasury, its allies in the corporate media seem increasingly hesitant to cover the news of post-Fukushima Japan. In reality, those gutted reactors are still extremely dangerous. An angry public, whose children are suffering, has thus far managed to keep all other nukes shut in Japan. If they keep them down permanently, it will be a huge blow to the global nuke industry—one you almost certainly won’t see reported in the American corporate media. The Brick TeeVee Crew must add that the nearby Davis-Besse reactor is based on the same GE design that put "spent fuel pools perched roughly 100 feet in the air" and has had multiple serious problems over the years. Northwest Ohio Nuclear Plant Still Causing Problems With No End in Sight The Davis-Besse nuclear power plant, near Toledo, is in the midst of $600-million infrastructure overhaul (financed by the plant’s operator, Akron’s FirstEnergy Corp.), which will include the replacement of two mammoth steam generators and will employ around 2,300 people in rural Ottawa County. According to one study, the upgrades will generate roughly $150 million for the state. That all sounds like a really non-ironic big whoop, except the anti-nuclear crowd has been raising a collective index finger and clearing a collective throat, urging folks to oppose Davis-Besse and its bid for a 20-year operating license renewal in 2017. Davis-Besse, opponents testify, has had the most high-level structural violations per reactor in the country since 2001. The latest in a series of cracks and corrosions is neither a crack nor a corrosion, but rather an “air bubble,” as described by the plant’s operator. It was uncovered earlier this month when the reactors were shut down for upgrades. According to reports, the air bubble is 6-12 inches wide and runs the length of a 25-foot gap in the reactor’s concrete protective shield. New concrete was poured back in 2011 when the reactor’s lid was replaced. ............ David Lochbaum, an engineer with the Union of Concerned Scientists, says that the issues at Davis-Besse are consistent with issues “industry-wide” related to concrete containment towers. Plants in both Florida and New Hampshire (both similar plants, with Babcock and Wilcox corporate parentage) have shut down since 2009 because of costly expenses related to concrete repair. “It’s been around since the Romans,” says Lochbaum, of concrete, “and I think some complacency may have set in. Just because it’s not rocket science doesn’t mean you can’t mess it up.” Davis-Besse has messed it up repeatedly. In addition to corrosion and cracking which led to a two-year shutdown back in 2002, a “spiderweb” of cracks was discovered in 2011 when a hole was punched in the concrete during the lid replacement. Kevin Kamps is the Director of Radioactive Waste at Beyond Nuclear, the anti-nuclear outfit leading the charge against Davis-Besse’s license renewal. He says the current air bubble was in fact the result of a re-sealing “rush job” in 2011. FirstEnergy knew about the cracks, Kamps says, but didn’t want the public to know and wanted to get the reactors operating again as quickly as possible. Same story when the air bubble was discovered. “[FirstEnergy] rushed in a PR manner to ensure the public that there was no risk of any kind,” Kamps says, “but the concrete containment wall is there to prevent a mother lode of radioactivity from being released, and here nearly 50 percent of it was absent. I don’t think there’s any engineering analysis to back up their claims.” Moreover, Kamps and the coalition against the FirstEnergy Nuclear Operating Commission are dismayed that Davis-Besse’s new generators (constructed by Babcock and Wilcox up in Ontario, with significant changes) have been okayed without an NRC license amendment proceeding. From a press release in May 2013: “The coalition contends that FENOC’s shortcut on safety risks repeating the same sort of dangerous mistakes made at the San Onofre nuclear power plant in southern California. In January 2012 a steam generator tube rupture at San Onofre released radioactivity to the environment, and led to the discovery of widespread tube degradation in replacement steam generators just a year or two old.” “It’s really a big experiment,” Kamps contends, “but it’s turned into a multi-billion dollar fiasco at San Onofre.”
The new generators are necessary from a safety standpoint, but Beyond Nuclear and others are wary of the changes, the additional tubes in particular. ............. Kamps knows how he wants to look at it: “[Davis-Besse is] a poster child for coming very, very close to major disaster,” he says. “And it’s all about the company’s bottom line. They put more tubes in just to generate more heat to generate more electricity to generate more money. For comparison a new traditional roof is about $4000-$6000 for an average roof job. If yer roof already has two layers of shingles BY CODE you have to do a 'tear-off' adding additional cost. So if you have to do a tear-off (and fix parts of the understructure possibly), why not do SOLAR PANELS at that point? Our guesstimates think the cost will be DOUBLE but we have to factor in how long it will take for the solar electricity will PAY OFF this investment. By now you've heard Germany sets new solar power record, institute says (Reuters) - German solar power plants produced a world record 22 gigawatts of electricity per hour - equal to 20 nuclear power stations at full capacity - through the midday hours on Friday and Saturday, the head of a renewable energy think tank said. The German government decided to abandon nuclear power after the Fukushima nuclear disaster last year, closing eight plants immediately and shutting down the remaining nine by 2022. They will be replaced by renewable energy sources such as wind, solar and bio-mass. Norbert Allnoch, director of the Institute of the Renewable Energy Industry (IWR) in Muenster, said the 22 gigawatts of solar power per hour fed into the national grid on Saturday met nearly 50 percent of the nation's midday electricity needs...... Think of the retraining of all those roofers! Think of all the jobs that could be created! And by retraining the roofers to install "solar shingles" it creates demand which "should" lower costs, that is until the Big Industry Players get into the game and get lawmakers to pass counter-productive measures like this ALEC-led measure Oklahoma Will Charge Customers Who Install Their Own Solar Panels Oklahoma residents who produce their own energy through solar panels or small wind turbines on their property will now be charged an additional fee, the result of a new bill passed by the state legislature and expected to be signed into law by Gov. Mary Fallin (R). On Monday, S.B. 1456 passed the state House 83-5 after no debate. The measure creates a new class of customers: those who install distributed power generation systems like solar panels or small wind turbines on their property and sell the excess energy back to the grid. While those with systems already installed won’t be affected, the new class of customers will now be charged a monthly fee — a shift that happened quickly and caught many in the state off guard. “We knew nothing about it and all of a sudden it’s attached to some other bill,” Ctaci Gary, owner of Sun City Oklahoma, told ThinkProgress. “It just appeared out of nowhere.” ......... “It is unfortunate that some utilities that enthusiastically support wind power for their own use are promoting a regressive policy that will make it harder for their customers to use wind power on their own,” said Mike Bergey, president & CEO of Bergey Windpower in Norman, Oklahoma, in a statement. “Oklahoma offers tax credits for large wind turbines which are built elsewhere, but wants to penalize small wind which we manufacture here in the state? That makes no sense to me.” ........... Net metering laws have come under fire from the secretive American Legislative Exchange Council (ALEC), a group backed by fossil fuel corporations, utility companies, and the ultra-conservative Koch brothers. Forty-three states and the District of Columbia currently have net metering policies in place and ALEC has set its sights on repealing them, referring to homeowners with their own solar panels as “freeriders on the system.” ALEC presented Gov. Fallin the Thomas Jefferson Freedom award last year for her “record of advancing the fundamental Jeffersonian principles of free markets, limited government, federalism and individual liberty as a nationally recognized leader.” Oklahoma “could be the first complete defeat for solar advocates in their fight against utility efforts to recover costs lost to DG [distributed generation] use,” writes Utility Dive. ......
